Executive session to evaluate the qualifications of applicants for public employment pursuant to RCW 42.30.110(1)(g) MOTION: Brown moved and Herrera seconded to adjourn to Executive Session up to 5:30 p.m. to evaluate the qualifications for public employment pursuant to RCW 42.30.110(1)(g). The motion carried by unanimous vote; Berg and Deccio absent. Present for Executive Session: Mayor Byers,Assistant Mayor Brown, and Councilmembers Berg (present at 4:40 p.m.), Deccio (present at 4:25 p.m.), Glenn, Herrera, and Roy Executive Session was held at 4:03 p.m. and adjourned at 4:58 p.m. The meeting was called back to order at 5:30 p.m. 1. Roll Call Present: Mayor Patricia Byers, presiding;Assistant Mayor Matt Brown and Councilmembers Reedy Berg, Janice Deccio, Rick Glenn, Danny Herrera and Leo Roy Staff: Interim City Manager Dave Zabel!, City Attorney Sara Watkins and City Clerk Rosalinda Ibarra 2. Pledge of Allegiance Mayor Byers led the Pledge of Allegiance. 3. Interpreter Services Mayor Byers introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Public Comment Andrew Reyes inquired about administrative jurisdiction over judicial records regarding his personal affairs. Tony Courcy, City resident, spoke regarding several matters. Jerrod Sessler introduced himself as a candidate running for Congress. Mayor Byers informed him that electioneering is not allowed at public facilities. Page 1 of 5 5 5. Open Discussion for the Good of the Order A. Proclamations i. Missing and Unidentified Persons Awareness Month proclamation Mayor Byers proclaimed May 2024 as "Missing and Unidentified Persons Awareness Month" and Michelle Joe accepted the proclamation. ii. Draft Mental Health Awareness Month proclamation MOTION: Deccio moved and Berg seconded to approve the proclamation. The motion carried by unanimous vote. iii. Draft Pride Month proclamation Ar MOTION: Deccio moved and Herrera seconded to approve the proclamation. The motion failed by a 5-2 vote; Berg, Brown, Byers, Glenn and Roy voting no. iv. Draft ALS Awareness Month proclamation MOTION: Deccio moved and Herrera seconded to approve the proclamation. The motion carried by unanimous vote. 6. Council Reports None. 7. Consent Agenda �� Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Item 7L was removed from the Consent Agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion --see motion directly below.) MOTION: Brown moved and Deccio seconded to approved the consent agenda as read. Ordinance updating Classification and Compensation Plan for City Employees Section 2.20.100 ORDINANCE NO. 2024-015,AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective June 24, 2024; and repealing all preceding pay ordinances in the City of Yakima Municipal Code. N. Ordinance granting a non-exclusive Franchise to Spectrum Pacific West, LLC, I/k/a Charter Communications to operate and maintain a Cable Communications System throughout the City of Yakima Page 3 of 5 7 ORDINANCE NO. 2024-016, AN ORDINANCE granting a non-exclusive Franchise to Spectrum Pacific West, LLC, I/k/a Charter Communications to operate and maintain a Cable Communications System throughout the City of Yakima; setting forth provisions, terms and conditions of the grant of Franchise; providing for City regulation and use of the Cable Communications System; prescribing penalties for violation of Franchise provisions; and terminating Ordinance No. 93-115. Items Removed from the Consent Agenda A. Resolution authorizing an Agreement with GN Northern for construction materials testing at the Aquatic Center at MLK Jr. Park 41IFItem 7L of the Consent Agenda was removed for recognition. Parks and Recreation Manager Ken Wilkinson briefed Council on the donation from GN Northern, Inc. The City Clerk read the resolution by title only. Ale MOTION: Brown moved and Herrera seconded to adopt the resolution for Item 7L. The motion carried by a 7-0 roll call vote. N. RESOLUTION NO. R-2024-100,A RESOLUTION approving an agreement with GN Northern, Inc for geotechnical and special inspection services on the MLK Jr. Park Eastside Pool Project 2745. PUBLIC HEARINGS 8. First public meeting to receive comments on the 2023 Consolidated Annual Performance Evaluation Report (CAPER) regarding HUD funded housing and supportive services Assistant City Manager Rosylen Oglesby briefed Council on the public meeting regarding the 2023 Consolidated Annual Performance and Evaluation Report (CAPER). The CAPER summarizes the programs and projects supported through Community Development Block Grants (CDBG), HOME funds and other related funding which were expended in 2023. Councilmember Glenn expressed concern related to subsidized housing for certain population and not others. Mayor Byers opened the public meeting and, with no one coming forward or calling in to speak, closed the meeting. DEPARTMENT ITEMS 9. Resolution authorizing an agreement with Cascade Fire Equipment Inc for the purchase of one (1) KME Custom Pumper Apparatus for the Yakima Fire Department Deputy Fire Chief DJ Goldsmith briefed Council on the proposed resolution for the purchase of a new fire apparatus from Cascade Fire Equipment, Inc. The City Clerk read the resolution by title only. MOTION: Deccio moved and Brown seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. Page 4 of 5 8 RESOLUTION NO. R-2024-101,A RESOLUTION authorizing an agreement with Cascade Fire Equipment, Inc., for the purchase of One (1) KME Custom Pumper Apparatus for the Yakima Fire Department. 10. Other Business Interim City Manager Dave Zabell provided an update on the N. First Street construction project. Staff evaluated several options to address concerns brought forth by businesses in the area and determined that expediting the construction project is the most viable. Staff is working with the contractor and believes that the base layer can be in place near Thanksgiving 2024, which moves the timeline up by more than 6 months to limit the extended impact on business access. Alf Assistant Mayor Brown requested an update regarding a recent City of Pasco project involving grant funds for micro-businesses. Mr. Zabel) provided a description of the process necessary to implement a similar plan in the City of Yakima. 11. Public comment (allow 15 minutes) Angie Girard, City resident; and Phil Dindia, City resident; spoke against Council's recent decision regarding the Pride Month proclamation. Mike Warren, City resident; Sue Fenich, City resident; Patricia Hoerdermis, City resident; Page 1 of 3 10 Frieda Stephens (via Zoom), City resident; Scot Stephens (via Zoom), City resident; expressed support for City Council's recent decision relating to the Pride Month proclamation. Joe Daniels, City resident, read a religious passage. Mayor Byers announced that the allotted time for public comment ended. 4. Draft Juneteenth Freedom Week proclamation MOTION: Deccio moved and Herrera seconded to approve the proclamation. The motion carried by unanimous vote; Roy absent. 5. ALS Awareness Month proclamation Councilmember Deccio proclaimed the month of May as "ALS Awareness Month". 6. Mental Health Awareness Month proclamation Air Mayor Byers proclaimed the month of May 2024 as "Mental Health Awareness Month" and Angela Bazan accepted the proclamation. 7. Second public meeting to receive comments on the 2023 Consolidated Annual Performance Evaluation Report (CAPER) regarding HUD funded housing and supportive services Interim Director of Community Development Bill Preston briefed Council on the public meeting regarding the 2023 Consolidated Annual Performance and Evaluation Report (CAPER). Mayor Byers opened the public hearing. Jeanna Hernandez, City resident, requested further details regarding what has been accomplished and how the City met the requirements of the CAPER. With no one else coming forward to speak, Mayor Byers closed the public hearing. Assistant City Manager Rosylen Oglesby, via Zoom, provided additional details as requested by Ms. Hernandez and City Council. 8. Growth Plan and Annexation Study Update Senior Planner Eric Crowell provided an update regarding the draft Yakima Growth Plan and Annexation Study. The City contracted with FCS Group to evaluate potential areas for future annexations and how resulting changes in population, housing, employment and assessed valuation levels impact the City's budget. The areas include portions of Terrace Heights, South Airport(south and west of the Yakima airport), Bachelor Creek(southwest of city limits), West Valley, and Northwest (northwest of current city boundaries). The key findings are as follows: • Area 1 (Terrace Heights): 2,373 potential new jobs and 2,713 potential new dwellings • Area 2 (South Airport): 414 potential new jobs and 181 potential new dwellings • Area 3 (Bachelor Creek): no new potential jobs and 722 potential new dwellings • Area 4 (West Valley): 739 potential new jobs and 2,375 potential new dwellings Page 2 of 3 11 • Area 5 (Northwest): no new potential jobs and 888 potential new dwellings Mr. Crowell also described the annexation petition processes and options for the election method, sixty percent method, and alternative petition method. 9. Adjournment MOTION: Brown moved and Deccio to adjourn to the next City Council regular meeting on June 4, 2024 at 5:30 p.m. in the City Hall Council Chambers.
