For Meeting of: June 4, 2024 ITEM TITLE: Resolution authorizing the Sole Source purchase of an Ion Chromatograph from Metrohm USA, Inc. for the City of Yakima Wastewater Treatment Plant Laboratory SUBMITTED BY: Susan Knotts, Buyer II, Purchasing *Mike Price, Wastewater Manager SUMMARY EXPLANATION: The WWTP Lab conducted a web search for equipment capable of providing full resolution of fluoride, chloride, nitrite, nitrate, ortho-phosphate in EPA Method 300.0 for required nutrient analysis. A search on Lab Compare for"Ion Chromatography Instrument" yielded 12 possible products, from three companies, 1) Metrohm USA, 2) Thermo Fisher Scientific, and 3) Shimadzu Instruments. Upon reviewing the specifications for each of the instruments, it was determined that the Metrohm Ion Chromatograph is the only instrument that provides the unique combination of in-line ultra-filtration and an anion chemical suppressor, which uses four times less eluent and requires no replacement of costly consumable cartridges. The competitors require hand-filtration of samples through 0.45 um syringe filters and replacement of consumable column traps. The Metrohm intrument's chemical anion suppressor is significantly more cost effective to use because it lasts 3-5 years with free replacement under the 10- warranty, whereas the competitors' electrolytic anion suppressor only last 6 months to a year. In addition, the Metrohm instrument also comes with a sequential suppression which further lowers detection limits and provides a 30°/o increase in sensitivity. The Metrohm instrument also comes with intuitive software that is familiar, which eliminates further training cost, and as it replaces an instrument from the same manufacturer, some parts from the previous ion chromatograph's autosampler would be available as a back-up, if necessary. R-2024- A RESOLUTION authorizing the sole source purchase of an Ion Chromatograph from Metrohm USA, Inc. for the City of Yakima Wastewater Treatment Plant Laboratory. WHEREAS, Article VI, Section 6 of the City of Yakima Charter and the Yakima Municipal Code Chapter 1.80 generally requires that purchases over $50,000 be accomplished by competitive bidding, subject to certain exceptions; and WHEREAS, the law recognized a "sole source" exception for these competitive bid requirements when, due to unique specifications and requirements, it would be futile to utilize competitive bidding; and WHEREAS, the treatment plant is required under NPDES Permit WA0024023 with the Department of Ecology to monitor nutrients in wastewater samples; and WHEREAS, the laboratory's existing ion chromatograph that is used to monitor wastewater nutrients has reached the end of its service life and requires replacement; and WHEREAS, the Purchasing Division advertised a "Notice of Intent to Sole Source" in the Yakima Herald-Republic on 4/23/24 and 4/25/24 and no vendor came forth to compete for this equipment; and WHEREAS, a web search was conducted for other vendors that could provide the unique combination of hardware and software features of high data quality, usability, and cost-efficiency of the Metrohm instrument, in which there were none; and WHEREAS, pursuant to RCW 39.04.280 (1)(a), any requirements for competitive bidding for the acquisition of the above-described instrument is hereby waived by adoption of this Resolution, due to the fact that: (a) Although there are other manufactures of nutrient analysis instruments on the market, it is documented that Metrohm is the only manufacturer that provides in-line ultra- filtration and an anion chemical suppressor, which is required by the wastewater laboratory because: 1) the in-line ultra-filtration unit uses filter paper at a lower cost versus hand-filtration through 0.45 um filters and column traps that require replacement at a higher frequency; and 2) the design of the chemical suppressor utilizes as much as 4 times less volume of eluent and requires no replacement of costly consumable cartridges; and (b) The Metrohm instrument comes with easy-to-use software that is familiar and requires no further training costs; and (c) The Metrohm instrument uses a chemical anion suppressor that lasts 3-5 years with free replacement under the 10-year warranty, instead of competitors' electrolytic anion suppressor that lasts 6 months to a year; and (d) The Metrohm instrument comes with sequential suppression, which further lowers detection limits and provides a 30% increase in sensitivity; and 37 (e) The instrument is clearly and legitimately limited to a sole source of supply; and WHEREAS, Metrohm USA, Inc. has agreed to provide the instrument, autosampler, and a 2-year total service contract for$57,450 as included in the attached quotation; and WHEREAS, the City Council finds that it is in the best interests of the City to approve the purchase of the replacement Ion Chromatograph instrument described above, and that such approval will enable the City to continue to meet regulatory permit requirements for wastewater monitoring; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The City Council finds and determines that the purchase of a replacement Ion Chromatograph instrument is clearly and legitimately limited to a sole source of supply, justifying the waiver of competitive bidding in this acquisition, which bidding requirements are hereby waived. Section 2. The purchase and installation of the Ion Chromatograph instrument, as described above, for an amount not to exceed of$57,450. is approved. Section 3. The City Manager, or his designee, is hereby authorized to accomplish the purchase of such instrumentation, and to execute any and all documentation to accomplish such purchase. Metrohm offers unique leading technology advances which include, but are not limited to, an anion chemical suppressor and in-line ultra-filtration. Though competitors offer chemical suppression, as much as 4 times the volume of eluent is required, adding to the costs of daily operation. Metrohm's anion chemical suppressor consists of 3-identical chambers that rotate, a unique design feature that requires much smaller amounts of eluent to be used. Metrohm is the only vendor that offers in-line ultra-filtration with a paper filter that can last anywhere from 100-300 samples before requiring replacement. The competitor uses column traps that require replacement. The chemical suppressor has a 10 year warranty, a specification unique to Metrohm. The Metrohm system's versatile design is more than capable of meeting our current needs while offering the option of expanding analyses in the future. Other: The competitors' electrolytic anion suppressorl'2 does not last as long (6 months-1 year) as Metrohm's chemical anion suppressor(3-5 years, free under 10 year warranty). In our experience, the 881 chemical anion suppressor lasted over 10 years, without needing replacement. The competitors require costly cartridges for the eluent and suppressor that need to be changed for maintenance. The cost of consumables within the first year from Thermo Fisher Dionex (Thermo) is—$2,000-$3,000 for replacement of the suppressor, column, and column traps. Column traps are not necessary for Metrohm because of their highly rated ultra-filtration technology (—$0.06 to $0.07 per sample). The 919 Autosampler used with the old 881 system, can be used as a spare with the new 930 system or provide spare parts, if necessary. Also, any of the repair equipment and consumables (i.e., filters, sample line tubing, etc.) can be utilized with the new system, providing further savings in parts. Metrohm's consumables (i.e., standards, sample tubes, filters, etc.) are available through other vendors and do not require purchase through their company. Most of the consumables the competitors require are "locked-out" and only available for purchase through their company. The Metrohm Magic Net software has been user friendly compared to references using Thermo software. In our experience, Metrohm's customer service has excellent and prompt. References have reported poor customer service and long wait times from Thermo. 3. Is this product/service available only through one vendor? Yes. A web search on Lab Compare for `Ion Chromatography Instrument' yields 12 products from 3 vendors: Metrohm USA, Thermo Fisher Scientific, and Shimadzu3. Metrohm USA Inc. (Metrohm) offers the latest technology advances which include, but are not limited to, an anion chemical suppressor with a 10-year warranty, in-line ultra-filtration, and the ability to switch quickly between anion and other types of ion analyses, if desired. 46 Though competitors offer chemical suppression, Metrohm's anion chemical suppressor consists of 3-identical chambers that rotate, a unique design feature that requires much smaller amounts of eluent(i.e., about 4 times less)to be used. The competitors require hand-filtration through 0.45um filters4 and column traps that need to be replaced at a much higher cost and frequency than Metrohm's ultra-filtration filter paper that can last from 100-300 samples before replacing. 5. Why is this a sole source vendor? The 881 Metrohm Ion Chromatograph (IC) that was used daily for routine required nutrient analysis in the Wastewater Lab stopped working beyond repair in February 2024. Required testing is being sent to contract labs until the system is able to be replaced. The repair estimate for the 881 service call & parts is a blanket dollar amount of$8,000. Even if repair costs are less, the end of the service agreement support, where Metrohm is no longer obligated to provide parts for the 881, has been reached. Thus, it is more cost effective to upgrade. The 881 Metrohm IC was purchased in 2013 via Sole Source. The unique design features and the fact that Metrohm has provided excellent technical support for over 10 years has lead us to upgrade via Sole Source again to the 930 Compact IC Flex. It is important to note that we would have the 881 components, specifically the 919 Autosampler, available as a back-up and for spare parts. 6. What efforts were made to assure the City if receiving the lowest or best price possible? Several efforts were made during negotiation of the quote to assure that the City is receiving the lowest price possible. Because we are returning customers, Metrohm has offered a 10%total discount and an additional 5% savings in comps for standards and consumables. Additionally, free shipping and handling has been applied to the quote, if the purchase order is received before 8/30/2024. In addition, since we are familiar with Metrohm's 881 IC system and the Magic Net Software, we are able to forgo the 930 IC Flex training at a cost of$2,700. We are also able to save another $2,000 by utilizing the same ultra-filtration apparatus and additional costs by using the existing Windows 10 computer system. The reason it is called that is because the pore size of the membranes are very small (0.2 urn). For this reason,filter caps and syringes aren't required. It doesn't get clogged because of the flow mechanism. 25-40% percent of the sample is pulled up through the filtration membrane and to the IC. The other 60-75%is pulled to waste. The constant flow between the two channels is what prevents a filter cake from forming. The ultrafiltration cell is not a consumable and doesn't need to be changed. The membranes generally need to be changed every 100-200 injections, depending on the sample type. The cost to filter one sample is about$0.06 to$0.07. Thus, in order to measure the ions of interest, the eluent needs to be suppressed—exchanged with ions of a lower conductivity(chemical suppression) or converted to neutral or non-charged compounds (electrolytic suppression). There are two types of suppression: Chemical and Electrolytic.
