HomeMy WebLinkAbout1976-1956 CONSTRUCTING MAINS, FIRE HYDRANTS, VALVES & OTHER APPURTENANCES FOR SUPPLYING WATER FOR DOMESTIC USE & FIRE PR n ORDINANCE NO. /95 AN ORDINANCE providing for the improvement of certain property by constructing the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection; establish- ing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. The following described property situate in Yakima County, Washington, shall be improved by constructing the necessary mains, fire hydrants, valves and other appurtenances for the purpose of supplying water for domestic use and fire protection: Beginning at the southeast corner of Section 18, Township 13 North, Range 19, E.W.M.; thence north 0 ° 44'08" east along the east line of said subdivision 650.66 feet; thence north 88 ° 03'37" West 269.20 feet to the true point of beginning; thence north 88 west 683.41 feet; thence north 17 ° . 19' west 5.30 feet; thence north 88 ° 03'37" west 313.81 feet; thence south 40 ° 39' west 10.87 feet; thence south 72 ° 41' west 63.0 feet; thence north 17 ° 19' west 200 feet; thence south 72 ° 41' west 140.0 feet; thence north 17 ° 19' west 251.65 feet; thence south 88 ° 43'52" east 204.54 feet; thence north 1 ° 59'12" east 190 feet; thence north 88 ° 43'52" west 346.0 feet; thence south 83 ° 38'27" west 100.15 feet; thence south 17 ° 17'east 27.0 feet; thence south 72 ° 42'08" west 10.0 feet; thence north 17 ° 17' west 163.13 feet; thence south 87 east 75.55 feet; thence north 17 ° 54'19" west 65.0 feet; thence south 87 ° 55'19" east 460 feet; thence north 80 ° 57'41" east 500 feet; thence south 72 ° 28'19" east 253.40 feet; thence south 58 ° 18'49" east 143.20 feet to the west right -of -way line of State High- way No. 3 (S.R.82); thence southeasterly along said right -of- way line to the true point of beginning. Section 2. There is hereby created a Local Improvement District, to be called "Local Improvement District No. 1009," which said dis- trict shall include all of the above described property. Section 3. The assessments shall be made according to special benefits derived from the improvements without regard to the zone and termini method. Section 4. All costs and expenses in connection with the con- struction of said improvement, including the engineering, inspection 1 advertising, publication of notices, and all other expenses incident thereto shall be levied and assessed against all, of the property legally and properly assessable therefor as provided by law and as above described. IP- Section 5. All of the aforesaid construction work shall be in accordance with the plans and specifications, profiles, maps and detailed drawings which have been prepared by the City Engineer, filed with the. City Clerk, and which are hereby approved and adopted. Section 6. The work necessary to be done in connection with the making of said improvement shall be done by contract upon com- petitive bids according to specifications and plans as prepared by the Engineering Division of the Department of Public Works, and the City shall have the power to reject any and all bids. Section 7 There is hereby created a special fund, to be called "Local Improvement Fund, District No. 1009 ", into which shall be placed all sums paid on account of the aforesaid special assessments, including all interest and penalties thereon, and in the event of the sale of local improvement bonds by the City, all premium and interest on said bonds issued for said improvement. Section 8. Bonds bearing interest at a rate not to exceed 8% per annum, payable on or before 12 years from the date of issuance, shall be issued in payment of the costs and expense of said improve- ment, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said district, payable in ten equal annual installments with interest at a rate not to exceed 82% per annum, interest payable annually ilk under the mode of payment "payment by bonds ", as defined by the statutes of the State of Washington and the ordinances of the City of Yakima, provided that, this improvement may be financed by the issuance of promisorry notes, under the authority of R.C.W. 35.45.150 -2- and Section 8.12.100 of the City of Yakima Municipal Code. Section 9. This ordinance is one relating to local improve- ments or assessments therefor, and shall become effective immediately upon its passage, approval and publication as provided by law and by the City Charter.
