HomeMy WebLinkAbout01/02/2024 Business Meeting/Adj to Executive SessionJanuary 2, 2024 City Hall -- Council Chambers -129 N 2nd Street, Yakima, WA 5:30 p.m. Regular meeting conducted in person and virtually via Zoom.- 1 Roll Call Present: Councilmembers Reedy Berg, Matt Brown, Patricia Byers, Janice Deccio, Rick Glenn, Danny Herrera and Leo Roy Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Rosalinda Ibarra Councilmember Deccio led the Pledge of Allegiance. 3. Interpreter Services Councilmember Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Newly Elected Process A. Oath of Office for Newly Elected Council Members City Clerk Ibarra administered the Oaths of Office to newly elected and re-elected Councilmembers Reedy Berg, Patricia Byers, Rick Glenn, and Leo Roy. B. Election of Mayor Councilmember Berg nominated Councilmember Byers for Mayor. Councilmember Byers accepted the nomination and was voted in as the new Mayor with a 7-0 roll call vote C. Election of Assistant Mayor (Mayor Pro-tem) Councilmember Roy nominated Councilmember Brown for Assistant Mayor. Councilmember Brown accepted the nomination and was voted in as the new Assistant Mayor with a 7-0 roll call vote. 5. Public Comment - Gregory Koshkin, resident, requested more consistent sidewalks throughout Yakima in order to have a more walkable and healthier city. - Brian Islas Martinez, downtown employee, spoke in support of petition to modify parking in the downtown and advocated for a dynamic model for parking fees. Joe Daniels, resident, read a religious passage. Page 1 of 5 - Tony Courcy, resident, spoke on several matters. - Ladon Linde, County Commissioner, congratulated newly elected Councilmembers and offered interest in continued joint support and cooperation on matters affecting Yakima residents. - Bill Dolsen, resident, congratulated newly elected Councilmembers and spoke in support of the east side pool. - Jeanna Hernandez, resident, congratulated newly elected Councilmembers and spoke in support of the local crime lab. 6. Open Discussion for the Good of the Order A. Proclamations Martin Luther King Jr. Day of Service proclamation Mayor Byers proclaimed the Martin Luther King Jr. Holiday as a Day of Service. Reverend Trimble and Anthony Peterson thanked Council and accepted the proclamation. Draft Black History Month proclamation MOTION: Deccio moved and Herrera seconded to approve the proclamation. The motion carried by unanimous vote. 7. Council Reports None. 8. Consent Agenda Mayor Byers referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion —see motion directly below.) MOTION: Brown moved and Deccio seconded to approve the consent agenda as read. R-2024-001, A RESOLUTION revoking Resolution R-2023-173 to fix the time for a public hearing before the Hearing Examiner on January 11, 2024, on a petition (Petition No. 23-04) to vacate right-of-way at N. 4th St. between E. Lincoln Ave. and E. Martin Luther King Jr. Blvd. G. Resolution declaring certain rolling stock surplus and authorizing the City Manager to dispose of said property in a manner most beneficial to the City of Yakima RESOLUTION NO. Resolution authorizing award of RFP 12324P and execution of agreement with Connexionz Limited for procurement of Onboard Integrated Technology System for Yakima Transit RESOLUTION NO. Resolution authorizing professional service contracts with Gary Cuillier as the City of Yakima Hearing Examiner and Patrick Spurgin as the Examiner Pro-Tem RESOLUTION NO. R-2024-011, A RESOLUTION authorizing the City Manager of the City of Yakima to execute contract agreements with Gary Cuillier for Hearing Examiner's Services and Patrick Spurgin for Hearing Examiner Pro-Tem Services DEPARTMENT ITEMS 9. Ordinance to create a fund to account for the Aquatic Center at MLK Jr. Park (First Reading) Director of Finance and Budget Mark Roberts briefed Council on the first reading of the proposed ordinance to establish a new fund. The City Clerk read the ordinance by title only. First Reading of AN ORDINANCE establishing a Special Revenue Fund 132 "Aquatic Center at MLK Jr. Park Fund"; specifying sources of revenue for such fund; and designating the purposes of and the manner of authorizing expenditures from such fund. 10. Yakima Public Safety Year End Review Yakima Police Chief Matt Murray presented a year-end review of public safety information regarding crime in Yakima discussing focused deterrence for gang and domestic violence, collaboration, proactive efforts, and data driven policing. Some of the challenges highlighted include lack of cohesion, unevolved use of data, need for new technology, staff recruitments and budget limitations. EXECUTIVE SESSION 11. Executive session to consider the selection of a site or acquisition of real estate by lease or purchase pursuant to RCW 42.30.110(1)(b) MOTION: Brown moved and Deccio seconded to adjourn to Executive Session for 15 minutes to consider the selection of a site or acquisition of real estate by lease or purchase pursuant to RCW 42.30.110(1)(b). The motion carried by unanimous vote. Present for Executive Session: Mayor Byers, Assistant Mayor Brown, and Councilmembers Berg, Deccio, Glenn, Herrera, and Roy. Executive Session was held at 7:13 p.m. and adjourned at 7:27 p.m. The meeting was called back to order at 7:31 p.m. 12. Other Business Page 4 of 5 A. Chamber building property acquisition update MOTION: Brown moved and Deccio seconded to direct staff to continue negotiations with the Chamber for the purchase of the Chamber building. The motion carried by unanimous vote. OTHER BUSINESS: MOTION: Brown moved and Glenn seconded to suspend the rules [Council Rules of Procedure]. The motion carried by unanimous vote. After Council discussion regarding a proposed resolution, MOTION: Brown moved and Glenn seconded to adopt the resolution removing the City Manager, terminating the City Manager's employment agreement without cause, and providing for severance pay pursuant to the employment agreement. The motion carried by a 5-2 roll call vote; with Deccio and Herrera voting no. The City Clerk read the resolution by title only. RESOLUTION NO. R-2024-012, A RESOLUTION removing the City Manager, terminating the City Manager's employment agreement without cause, and providing for severance pay pursuant to the employment agreement. MOTION: Brown moved and Berg seconded to put on the next council meeting agenda the following items: A.) A without cause separation agreement consistent with Section 13(B) of the City Manager's Employment Agreement between the City of Yakima and City Manager Bob Harrison; B.) A contract with GMP Consultants for an interim city manager; and, C.) A discussion regarding the recruitment for a new city manager. The motion carried by unanimous vote. MOTION: Brown moved and Deccio seconded to schedule a study session on downtown parking at the Bank of America building at 101 North 2nd Street on Tuesday, January 23, 2024, at 5:30 p.m. The motion carried by unanimous vote. 13. Adjournment MOTION: Brown moved and Deccio seconded to adjourn to the next Council regular meeting on January 16, 2024, at 5:30 p.m. in the Council Chambers at City Hall.
