For Meeting of: January 16, 2024 ITEM TITLE: Resolution authorizing Supplemental Agreement 1 to the Professional Services Agreement with HLA Engineering and Land Surveying, Inc. for Project SW2661 DID #29 Stormwater Improvements and Spot Repairs SUBMITTED BY: Scott Schafer, Director of Public Works * Mike Price, Wastewater/Stormwater Manager 509-249-6815 SUMMARY EXPLANATION: The City of Yakima (City) entered into Contract 2020-124/Task Order 2022-03 with HLA for engineering services including fifteen (15) days of construction inspection for City Project SW2661 DID #29 Stormwater Improvements and Spot Repairs. The construction contractor encountered shallow groundwater during the construction that required an extension of construction working days to protect worker safety and existing underground infrastructure. The attached Supplemental Agreement 1 with HLA provides for the addition of twenty-four(24) days of construction inspection services performed by HLA as a result groundwater site conditions in an amount not to exceed $67,200. R-2024- A RESOLUTION authorizing Supplemental Agreement 1 to the Professional Services Agreement with HLA Engineering and Land Surveying Inc. for Project SW2661 DID#29 Stormwater Improvements and Spot Repairs WHEREAS, the City entered into Contract No. 2020-124/Task Order 2022-03 with HLA Engineering and Land Surveying, Inc. for engineering services including fifteen (15) days of construction inspection for City Project SW2661 DID #29 Stormwater Improvements and Spot Repairs; and WHEREAS, changed site conditions during construction required that HLA provide inspection services for up to an additional twenty-four (24) days: and WHEREAS, Supplemental Agreement 1 is for an amount not to exceed $67,200 in compensation for up to an additional 24 days of inspection services; and WHEREAS, the City Council finds that it is the best interest of the City of Yakima and its residents to proceed with approval of Supplemental Agreement 1; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute Supplemental Agreement 1 between the City of Yakima and HLA Engineering and Land Surveying, Inc. for additional construction inspection services for Project No. SW2661 DID #29 Stormwater Improvements and Spot Repairs. All provisions of the Agreement for Professional Services executed July 22, 2020, by Resolution No. R-2020-079 remain in effect except as expressly modified by this supplement. REASON FOR SUPPLEMENTAL AGREEMENT The Construction Contractor exceeded their Contract with the City by twenty-four (24) working days. Supplement No. 1 provides $67,200 compensation for engineering services during construction requested by the City to observe and administer the Construction Contractor's additional working days. The changes to Task Order No. 2022-03 are described as follows: TIME OF PERFORMANCE 2.0 Construction Engineering—DID#29 Realignment A maximum of thirty-nine (39) working days has been provided to the Contractor for the construction of improvements. Should the Contractor be granted time extensions for construction completion, engineering services beyond the thirty-nine (39) working days shall be considered additional services (fifteen (15) working days for Task Order No. 2022-03 plus twenty-four (24) working days for Supplemental Agreement No. 1). FEE FOR SERVICE EXHIBIT 2 shall be amended to include HLA 2024 Schedule of Rates, attached. 2.0 Construction Engineering — DID#29 Realignment The estimated maximum fee for this work is $102,700 ($35,500 Task Order No. 2022-03 plus $67,200 for Supplemental Agreement No. 1).
