For Meeting of: January 16, 2024 ITEM TITLE: Resolution accepting Change Order No. 1 to City Contract 2023- 161 with Industrial Construction of Washington LLC for Project SW2661 DID #29 Stormwater Improvements and Spot Repairs SUBMITTED BY: Scott Schafer, Director of Public Works * Mike Price Wastewater/Stormwater Manager 509-249-6815 SUMMARY EXPLANATION: The City of Yakima (City) entered into Contract 2023-161 with Industrial Construction of Washington LLC for the replacement and realignment of a segment of deteriorated stormwater drainage pipe in the vicinity of West Lincoln and North 35th Avenues. Prior to bidding the construction project, the engineering consultant's review of groundwater levels in nearby monitoring wells indicated that groundwater elevations should not interfere with the construction as designed. However, the construction contractor encountered shallow groundwater depth during the excavation that required an increase in the trench footprint, traffic control, fill material, paving area, and an additional ten (10)working days for safe project completion. The attached Change Order No. 1 provides for the addition of 10 working days and the required materials, equipment, and labor at a total cost of $116,715.30. R-2024- A RESOLUTION accepting Change Order No. 1 to City Contract 2023-161 with Industrial Construction of Washington LLC for Project SW2661 DID #29 Stormwater Improvements and Spot Repairs WHEREAS, Industrial Construction of Washington LLC was selected as the contractor and the City of Yakima (City) entered into an Agreement for the realignment and spot repairs of stormwater conveyance pipe in the amount of$243,955.22; and WHEREAS, shallow groundwater depth during construction required additional labor, equipment, materials and the addition of ten (10) contract working days to protect existing utility infrastructure and worker and traffic safety; and WHEREAS, the total cost is $116,715.30 for the labor, equipment, materials, and the addition of 10 working days associated with Change Order No. 1; and WHEREAS, the City Council finds that it is the best interest of the City of Yakima and its residents to proceed with approval of Change Order No. 1; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to execute Change Order No. 1 between the City of Yakima and Industrial Construction of Washington LLC in the amount of One Hundred Sixteen Thousand Seven Hundred-Fifteen Dollars ($116,715) for additional working days and labor and materials required for Project No. SW2661 DID #29 Stormwater Improvements and Spot Repairs. Yakima River Drive West Richland, WA 9353 L J You are directed to make the following changes in this Contract: This Change Order consists of adding 1050 CY of Unclassified Excavation Incl. Haul, 2000 TN of Select Backfill, 135 LF of Cement Conc. Traffic Curb and Gutter, drain rock and fabric for Infiltration round Manhole#6, and 10 additional days of Project Temporary Traffic Control. The Contractor encountered differing site conditions during the construction of the DID#29 improvement project at the Lincoln Avenue and 35th Avenue intersection. The discovery of shallow ground water depth during excavation for the new pipe was not anticipated based on the initial design that relied on information from surrounding ground water monitoring wells. The presence of shallow ground water led to unsuitable soil conditions during construction, causing significant trench collapsing throughout the project site. To mitigate this issue, the unsuitable material was removed from the trench,and select backfill (crushed rock)was used as backfill. Given these unforeseen circumstances and the additional work required to address them, the City has requested the preparation of a change order. Factors such as increased labor, materials, and equipment needed to address the trench collapsing was included in this change order. This also included temporarily cutting and capping of a water main to avoid any disasters if it had collapsed into the trench; this was in everyone's interest and was directed by the City. The contractor has managed to continue with all the additional work necessitated by the change order within the timeframe required for paving before the asphalt plants close down for the winter. Adding ten working days to the contract for the extra work is necessary given the scope of what needed to be addressed. The breakdown of the change order items-such as ten days of traffic control, unclassified excavation, select backfill, curb and gutter replacement, and the installation of infiltration material around manhole#6-demonstrates the various aspects affected by the unforeseen site conditions and the measures taken to address them. This change order is all encompassing of the change in conditions and includes full compensation for work completed and the additional work anticipated to install the storm sewer pipe from STA.20+18 to STA 21+05. Any new change of conditions that may arise in order to complete the project will be reviewed on a separate change request submitted by the contractor.
