HomeMy WebLinkAbout12/12/2023 Business Meeting/Executive Session249 MINUTES YAKIMA CITY COUNCIL December 12, 2023 City Hall -- Council Chambers -129 N 2nd Street, Yakima, WA 5:15 p.m. Executive Session 15:30 p.m. Regular meeting conducted in person and virtually via Zoom EXECUTIVE SESSION Executive session to consider the selection of a site or acquisition of real estate by lease or purchase (RCW 42.30.110(1)(b) MOTION: Lund moved and Cousens seconded to adjourn to Executive Session for 15 minutes to consider the selection of a site or acquisition of real estate by lease or purchase pursuant to RCW 42.30.110(1)(b). The motion carried by unanimous vote. Present for Executive Session: Mayor Deccio, Assistant Mayor Lund, and Councilmembers Brown, Byers, Cousens, Herrera, and Macias Executive Session was held at 5:16 p.m. and adjourned at 5:21 p.m. Roll Call Present: Mayor Janice Deccio, presiding; Assistant Mayor Soneya Lund, and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera, and Eliana Macias Staff: City Manager Robert Harrison, City Attorney Sara Watkins, and City Clerk Rosalinda lbarra 2 Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Public Comment Warren Hurley, City resident, expressed support for the City's cooperation with Cowiche Canyon Conservancy for maintenance and operation of the Rocky Top area for public trail use. Charles Mulvey, City resident, expressed gratitude for the City's work on the Climate Change Plan. Coleen Anderson, City resident, thanked the Sustainable Yakima Committee for their hard work on the Climate Change Plan, especially urban forests. Page 1 of 5 250 5. Open Discussion for the Good of the Order A. Proclamations Homeless Persons' Memorial Day Proclamation Mayor Deccio proclaimed December 21, 2023 as "Homeless Persons' Memorial Day". Rhonda Hauff, Yakima Neighborhood Health Services, accepted the proclamation. ii. Draft Martin Luther King Jr. Day of Service Proclamation MOTION: Byers moved and Herrera seconded to approve the proclamation. The motion carried by unanimous vote. B. Presentations / Recognitions / Introductions Recognition of outgoing Assistant Mayor Lund and Council members Macias and Cousens Mayor Deccio recognized Assistant Mayor Lund and Council members Cousens and Macias for their service to the residents of Yakima over the years. Assistant Mayor Lund and Council members Cousens and Macias expressed their gratitude to the community for the time they served. Council Reports A. Yakima Sustainable Committee One -Year Action Plan Solid Waste and Recycling Manager Trace Bradburn and Jeff Scott, Chair of the Yakima Sustainable Committee, presented the committee's Climate Action Plan. The plan incorporates goals, strategies and actions to reduce the City's energy consumption and greenhouse gas emissions. It serves as a road map to a sustainable future for the community and identifies major climate issues affecting Yakima. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Item D was removed from the consent agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion —see motion directly below.) MOTION: Lund moved and Cousens seconded to approve the consent agenda as presented. The motion carried by a 7-0 roll call vote. A. Approval of minutes from the December 5, 2023 City Council regular meeting B. Approve payment of disbursements for the period November 1 — 30, 2023 C. R-2023-174, A RESOLUTION authorizing the City to accept a Municipal Stormwater Capacity grant from the Department of Ecology. F. Resolution authorizing the assignment of an Agriculture Lease Agreement to Doug Hartshorn RESOLUTION NO. R-2023-175, A RESOLUTION authorizing the assignment of an Agriculture Lease Agreement. G. Resolution authorizing an interlocal agreement between SunComm 911 and Yakima County Technology Services for network equipment maintenance and repair on the Spillman Computer Aided Dispatch (CAD) workstations RESOLUTION NO. R-2023-176, A RESOLUTION authorizing an interlocal agreement (ILA) with Yakima County Technology Services (YCTS) for network equipment maintenance and repair on the Spillman Computer Aided Dispatch (CAD) workstations H. Resolution authorizing an agreement with City of Yakima Public Works to improve the HVAC systems at Henry Beauchamp Jr. Community Center and Washington Fruit Community Center RESOLUTION NO. R-2023-177, A RESOLUTION authorizing an agreement with City of Yakima Public Works for $260,000 in Community Development Block Grant Funds to improve the HVAC systems at Henry Beauchamp Jr Community Center and Washington Fruit Community Center. Resolution designating $719,091 of ARPA Funds as Revenue Replacement RESOLUTION NO. R-2023-178, A RESOLUTION designating $719,091 ofARPAfunds as Revenue Replacement. J. Ordinance updating Classification and Compensation Plan for City Employees Section 2.20.100 ORDINANCE NO.2023-044, AN ORDINANCE relating to City personnel; adopting a classification and compensation plan for City employees to be effective January 14, 2024; and repealing all preceding pay ordinances in the City of Yakima Municipal Code. Items Removed from the Consent Agenda A. Resolution setting January 11, 2024, as the date for an open record public hearing before the City of Yakima Hearing Examiner to vacate a portion of N 4th St between MLK Jr Blvd and Lincoln Ave Item D was removed from the Consent Agenda. Community Development Director Joan Davenport provided additional information regarding the public hearing notification process. The City Clerk read the resolution by title only. MOTION: Byers moved and Cousens seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2023-173, A RESOLUTION fixing time for a public hearing before the Hearing Examiner on January 11, 2024, on a petition (Petition No. 23-04) to vacate right -of - Page 3 of 5 252 way at N. 4th St. between E. Lincoln Ave. and E. Martin Luther King Jr. Blvd. DEPARTMENT ITEMS 8. Resolution authorizing an Agreement with the Cowiche Canyon Conservancy for the trail use, maintenance and operation of the area known as Rocky Top Parks and Recreation Manager Ken Wilkinson briefed Council on the agreement with Cowiche Canyon Conservancy for the maintenance and operation of the trail for public use. Celisa Hopkins, Cowiche Canyon Conservancy member, supports the partnership with the City of Yakima. The City Clerk read the resolution by title only. MOTION: Byers moved and Cousens seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2023-179, A RESOLUTION authorizing an agreement with Cowiche Canyon Conservancy for the maintenance and operation of the Rocky Top property. Resolution authorizing the retum of Clean Green Resources and Electrification Project Grant to the Department of Commerce for $1,000,000 Solid Waste and Recycling Manager Trace Bradburn briefed Council on the challenges of fulfilling the requirements of the grant and the need to return the grant funds to the Department of Commerce. The City Clerk read the resolution by title only. MOTION: Cousens moved and Byers seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2023-180, A RESOLUTION authorizing the City to return the Clean Green Resource and Electrification Project grant from the Department of Commerce for an Anerobic Digester. 10. Resolution authorizing an agreement with People for People to provide assessment and case management services for the City of Yakima Community Diversion Program through December, 2024 Senior Assistant City Attorney Cynthia Martinez briefed Council on the proposed agreement with People for People to provide assessment and case management services for the Community Diversion Program. The City Clerk read the resolution by title only. MOTION: Cousens moved and Byers seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2023-181, A RESOLUTION authorizing an agreement with People for People to provide assessment and case management services for the City of Yakima Community Diversion Program through December, 2024 11. Resolution authorizing the City Manager to sign a Commercial Purchase and Sale Agreement between the Greater Yakima Chamber of Commerce and the City of Yakima City Attorney Sara Watkins informed Council on the proposed resolution to purchase the Chamber of Commerce building and property. The City Clerk read the resolution by title only. Page4of5 253 MOTION: Cousens moved and Byers seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2023-182, A RESOLUTION authorizing the City Manager to sign a Commercial Purchase and Sale Agreement between the Greater Yakima Chamber of Commerce and the City of Yakima. 12. Other Business MOTION: Lund moved and Cousens seconded to direct staff to work with the Bike & Pedestrian Committee to develop traffic calming standards at a future meeting. The motion carried by unanimous vote. City Manager Harrison requested interest from councilmembers to participate in a trip to Washington, D.C. in January to request support for FAAfederally directed spending to upgrade the Yakima Air Terminal. MOTION: Cousens moved and Herrera seconded that Byers and Brown be approved for the D.C. trip. The motion carried by unanimous vote. MOTION: Brown moved and Cousens seconded to suspend the Council rules. The motion carried by unanimous vote. MOTION: Brown moved and Cousens seconded to place a moratorium on parking enforcement for the next 60 days in the downtown. The motion carried by unanimous vote. 13. Adjournment MOTION: Lund moved and Cousens seconded to adjourn to the next Council regular meeting on January 2, 2024, at 5:30 p.m. in the Council Chambers at City Hall.
