The hearing will be held Tuesday, May 18, 2010 at 7:00 p.m. in the Council Chambers at City Hall located at 129 North 2"d Street, Yakima, Washington. Residents in the vicinity of the pathway have requested relief from crime and graffiti that they believe is encouraged by the current pathway. In addition to the Robertson Elementary level students, there are also middle school and high school students that use the walkway for the same purpose. Robertson is a bus pick up and drop off site for all three school levels. The sidewalks and shoulder space available on parallel roads to the walkway are limited and the loss of the pathway would create a less safe option for student walkers. Closing this area off will diminish our neighborhoods appeal and availability for the residents that live in the area. Additionally, I believe that sectioning off this area will curb crime on 23rd Ave., but will only route more of this activity to the next nearest thoroughfare 24th Ave. Due to 24th Avenue being the nearest road thoroughfare to Summitview from 16th Ave, the residents on 24th Ave have also experienced a Targe amount of this same criminal activity. Constant car window breaking, egging, and thefts of personal property have occurred numerous times to me and my neighbors. Closing off this thoroughfare only puts a Band-Aid on the problem and does solve the crime problem for the rest of the community. I. noticed that there are graffiti cameras posted at this entrance to this pathway. I also noticed the second when this camera was taken down for service, the graffiti artists knew this and took advantage of the lack of observation. These cameras need to be moved and hidden to be effective in catching criminals. We need to think of other ideas on catching wrong doers instead of routing them somewhere else to do their crimes. Installing a hidden police camera on this thoroughfare and areas up and down Lincoln may help local police find criminals who are conducting these activities that ruin our community. We should not have to block off our neighborhoods to avoid this activity. Lets find ways to solve this criminal activity with solutions and not avoidance. Me and my wife have always voted to increase our taxes to pay for increased police services and believe this is one of the answers to this problem. Other solutions are starting a community crime watch or increased police surveillance in this area. 1 • • Council Public Safety Committee CED Conference Room City Hall April 21, 2010 MINUTES Council Committee Members Present: Maureen Adkison, Kathy Coffey and Bill Lover Staff present: Dick Zais, Dave Zabell, Sam Granato, Kelly Rosenow, Greg Copeland, Mike Merryman, Charlie Hines, Judge Kelly Olwell, Linda Hagert, Cynthia Martinez, Cesar Abreu, Terri Croft, Bronson Faul, Randy Beehler. Others: Yakima County Commissioner Kevin Bouchey, Yakima County Court Administrator Harold Delia, Yakima County Senior Probation Officer Ron Krebs. Coffey called the meeting to order at 3:00. The agenda order was revised to accommodate the reports of attendees that had to leave the meeting early. Status report on the Comprehensive Mental Health Diversion Program Ron Krebs from Yakima County Probation provided a statistical report of the impact the CWCMH diversion program has had in decreasing repeat arrests of participants in the program. Krebsrealizes that law enforcement has greater restrictions that do not always allow for referral'to the program that do not apply to probation, so the benefit may not be immediately noticeable. Krebs stated that arrests are reduced by approximately 6% by participation in the program and he requested that the City of Yakima continue to fund the diversion program. Zais advised that the City had provided funding for a six month pilot program that had been paid for out of reserve, and Granato advised prior to that it had been funded"by a grant that has expired. Given the current economic condition of the City, the committee cannot recommend to the full council to continue to fund the program, despite the program's benefits. The committee will forward the report to the full council with a recommendation to not continue funding. II. Status of federal earmark grant funds for county -wide gang suppression efforts Harold Delia and Commissioner Bouchey provided an updated report of the budget for the federal grant application and reviewedthe programs the grant would support. Delia advised they had also applied for a $200,000 state grant, which would also give them a basis and support to apply for an additional $500,000 federal earmark. The County would like to conduct a community assessment to address gang problems to use in future grant/funding applications. During her recent visit; Senator Murray commented that the county -wide approach would be important in obtaining future funding. " III. Update report on Block Watch program and contract with OIC We are currently 8 months into the 2 year contract with OIC to provide a block watch coordinator. The block watch program is being updated to fit in with current needs, and unnecessary practices are being eliminated, such as requiring 50% block participation for form a block watch and running a records check on all members of participating households. This report will be forwarded to the full council as information item. IV. Red Light Camera Judge Olwell advised that she had contacted municipal courts in cities in Washington that are currently using the red light camera technology, and estimates there would be an increase of over 21,000 filings with the court if red light cameras are implemented in Yakima. This would double the workload of court staff. There would be an increase in phone calls, court time, and longer lines at the payment window. Additionally, there would be increased prosecutor time as the prosecutor needs to be involved in contested hearings. Although there would be revenue generated from the program, it is not know if it would be enough to cover the necessary human resource expense to manage the program. Although the committee supports the traffic safety aspect of the program, it is not the desire of the committee to have this as a revenue source, nor should it be a financial liability. Coffey is unsure if enough of the council members would support it to even justify having vendor demonstrations. The. committee will forward the report to the full council for discussion and public comment before scheduling vendor demonstrations. V. Updated report on jail costs reductions The department is working to expand the electronic home monitoring program (EHM) to utilize GPS equipment for those that do not have land line telephones. After this project is initiated, they will look into expanding to EHM with alcohol monitoring capabilities. The department expects to continue reducing jail costs by utilization of these programs. There are emphasis patrols scheduled, and the jail cost figures are expected to increase once the patrols are started. VI. Status report on proposed study for PAL Center Staff provided a bid from Wardell Architects to conduct a study for expansion and updating of the PAL Center. The major drawback of the current facility (formerly the senior citizen center) is that it does not have a gymnasium. The cost for the study is $9000 and would be funded out of the Law and Justice Capital budget. Staff would like to have the plan ready for when future funding may become available. Lover asked if this needed to go out for bid. Zais advised that it did not as Wardell is on a list professional service providers that could be selected for such projects. Zais also reiterated that this was to be paid out of the capital fund and not the general fund. This request will be forwarded to the full council with a recommendation from the committee for approval. VII. Updated report on Part II Crimes in vicinity of N. 23rd Ave. and Lincoln Ave. (pathway area) Abreu presented an updated analysis with the requested parameter changes. Part 11 crimes are relatively low in this area. The key issue is the request to close the pathway from 23rd Ave to Lincoln Ave. The pathway could be gated off with lockboxes installed for emergency personnel access. The committee requested this be forwarded to the full • • council to set a date for public hearing regarding closure of the pathway. The committee additionally requested that the Fire Department and Code Divisions provide input prior to the public hearing. VIII. Status of gang database Granato recommended the committee forego discussion of the gang database since. briefings have been held/scheduled with the council members. The committee agreed to skip discussion of the gang database report. IX. Update on gang free initiative The committee reviewed the information provided by Yakima County regarding their Comprehensive Gang Initiative. As the updated report indicated there would not be any significant "hard dollar" funding for the City of Yakima's Gang Free Initiative, the City will need to go out to obtain its own funding. The committee envisions eventually applying for a joint grant of which the City of Yakima would receive the largest share, however assistance is still needed in the area of grant writing. Once selected, the project director should be able to assist with grant applications. The committee would also like to see if cost sharing and cost matching with non profit partners would be a possibility. Merryman updated the committee on the Gang Free Initiative draft plan and advised the committee needed to provide direction on their vision for the project director/coordinator position. Currently the initiative is focused on suppression. The City has not focused any efforts on prevention or intervention at this point. The long term strategies need to be on prevention and intervention. The goal for the draft plan is for the City to initially be the driving entity in the initiative, but eventually be able to step back and let the community partners handle the implementation of the plan. Zais advised that for the short term, the general fund contingency could cover a professional services contract to hire the director/coordinator position. The committee would like to see all the of the gang initiatives and their elements brought together and to add to what is already being done. Coffey would like to start marketing the initiative and do a promotional piece and does not think this should wait until the steering committee is selected. There is a marketing tool kit for Weed and Seed sites that could be formulated to the Gang Free Initiative. The promo piece cannot be done before the official announcement of the Gang Free Initiative. Coffey recommended to adopt the Gang Free Initiative as presented, hire the coordinator, to be financed by the general fund contingency, move ahead with the campaign and promotion, and develop the steering committee. This will all be presented at a study session on May 11. The Police Department has analyzed... crime statistics in the area at the request of the Public Safety Committee. The 'price of chain link fencing the pathway area is estimated at $5,000. Gates could be installed with locks and Knox boxes to allow public safety access in event of the need to enter the pathway. Staff recommends that Council hold a Public Hearing on the possible closure of this pathway and deliberate on the public comment prior to any decision. A buffer of 500 meters surrounding this address was created for this research. Using Crime View and ArcGIS 9.3, a review of all Part II crimes during 2008 and 2009 was conducted; the comparative criminal statistics figures were collected, collated and evaluated by count or frequency for each of the identified buffers for the cited address. It was noted that in 2009 there was an increase in Part II Crimes for the selected area as indicated below. As requested by the Public Safety Committee only Part II crimes have been included in this report. In order to provide clarity, the following information is provided: Part II crimes are comprised of non -serious felonies and misdemeanors. Examples of Part II crimes include quality of life offenses such as graffiti, car prowls, malicious mischief's, vandalism, bomb threats, disorderly conduct, possession of stolen property (PSP), narcotics and drug related crimes, forgery, domestic violence, misdemeanor assaults, etc. There are two categories of misdemeanors in Washington State: Gross Misdemeanors (punishable by up to one year in jail and/or a $5,000 fine) and Misdemeanors (punishable by up to 90 days in jail and/or a $1,000 fine). Index crimes are the eight crimes the FBI combines to produce its annual crime index. These offenses include willful homicide, forcible rape (attempts to commit), robbery, burglary, aggravated assault, larceny over $50, motor vehicle theft, and arson, which are all Part I crimes. Part I crimes are comprised of serious felonies, which were not included in this report. Part I crimes are further broken down into two separate categories Violent Crime and Property Crime: VIOLENT CRIME - Violent crime offenses are murder, forcible rape, robbery, and aggravated assault. While simple assault can be violent, it is not generally serious in nature therefore is excluded from the categorization of violent crime for this publication. PROPERTY CRIME - Property crime offenses are burglary, larceny, motor vehicle theft, and arson. I will point out both the positive and negative view points in regards to criminal activity and gang activity that occurs frequently year around. In addition, I approve to have the pathway closed. First, I like to point out that North 23`1 Avenue and Summitview is a dead end street which provides a pathway at the North end of the street to West Lincoln Avenue. Second, although the City of Yakima has assisted the neighbors on 23rd Avenue by removing all of the heavy dense area at the pathway, criminal activity appears to continue at the same rate. Third, I have been a victim of crime (attempted Burglary) in 2009 at my residence. In addition, I have found burglary tools on my back porch several times in 2008/2009. Also, my neighbor had observed 2 male juveniles casing my house by entering my property from North 23`d Avenue to the south end of my house. Finally, there has been a vast amount of homes on North 23`d Avenue that has been victims of burglary and the pathway had been used for the escape route by the criminal(s). The following are positive indictors for the closure of the pathway: 1) Criminal activity may decrease (Criminals will not have the access to the pathway for a quicker get away which allows more get away routes. 2) Neighbors can better observe suspicious activity by seeing limited people entering down North 23"' Avenue (people living in this neighborhood and others for outdoor activity -walking, jogging) 3) The physically impaired that use wheel chairs do not have the ability to use the pathway. The handicapped uses the next street over which is 24th Avenue. The public can use 24th Avenue to get to West Lincoln at almost the same rate as if using the pathway on 231-d Avenue. 4) Gang graffiti has been observed both in the North 23`d Avenue neighborhood and pathway area. By closing the pathway, gang graffiti may decrease in the neighborhood. 5) I am willing to help pay the cost of the pathway closure. The following are negative indicators for not closing the pathway: 1) Criminal activity may stay or increase as there are more access for criminals for their criminal get away routes. 2) Neighbors on 23rd Avenue may have more difficulty in observing whom uses the pathway for legitimate reasons. 3) Gang graffiti may stay or increase in the neighborhood. As I have stated above, I have mentioned both the positive and negative view points for the pathway closure. I believe that the positives out weight the negatives. Also, neighbors on North 23`d Avenue would benefit more likely if the closure to the pathway. Please consider closing the pathway access from North 23'd Avenue to West Lincoln Avenue. Thank you.
