Executive session to consider the selection of a site or acquisition of real estate by lease or purchase (RCW 42.30.110(1)(b); and to discuss with agency council agency litigation (RCW 42.30.110(1)(i)(i) MOTION: Byers moved and Macias seconded to adjourn to Executive Session for up to 30 minutes to consider the selection of a site or acquisition of real estate by lease or purchase pursuant to RCW 42.30.110(1)(b); and to discuss agency litigation pursuant to RCW 42.30.110(1)(i)(i). The motion carried by unanimous vote. Present for Executive Session: Mayor Deccio and Councilmembers Brown, Byers, Herrera, and Macias Executive session was held at 5:00 p.m. and adjourned at 5:18 p.m. 1. Roll Call Present: Mayor Janice Deccio, presiding; and Councilmembers Matt Brown, Patricia Byers, Holly Cousens (attending remotely via Zoom), Danny Herrera and Eliana Macias Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Rosalinda Ibarra Absent and Excused:Assistant Mayor Soneya Lund 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services No interpreter in attendance. 4. Public Comment Russell Mumford, Executive Director of Veteran's Rights Council, spoke regarding lack of events at Chuck Austin Place and Yakima Housing Authority's management of the housing facility. Rodney Beason, Yakima resident, expressed concern related to housing density as proposed Page 1 of 5 239 in the Naches Avenue Historic Overlay Zone and he encouraged Council not to take action. Genovieve Ramirez, Selah resident and general manager of downtown Yakima restaurant, spoke about parking permit matters and public parking in the downtown area. 5. Open Discussion for the Good of the Order None. 6. Council Reports None. 7. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Macias moved and Byers seconded to approve the consent agenda. The motion carried by a 6-0 roll call vote; Lund absent. A. R-2023-152,A RESOLUTION accepting and approving the 3rd Quarter 2023 Claim Report for the City of Yakima. G. Resolution amending the City Treasurers Petty Cash and Change Funds RESOLUTION NO. R-2023-153,A RESOLUTION amending Resolution No. R-2021-147, adopted November 16, 2021 and authorizing the existence of Change Funds, and other Petty Cash Funds, within the various Funds of the City of Yakima. H. Resolution authorizing an agreement with Microsoft for volume licensing and enterprise enrollment RESOLUTION NO. Resolution authorizing a contract agreement with Queensgate Interpreting to provide Court Interpreter Services RESOLUTION NO. R-2023-157,A RESOLUTION authorizing City of Yakima Court Presiding Judge, on behalf of the city, to execute an agreement with Queensgate Interpreting Service, LLC to provide interpreting services for Yakima Municipal Court. L. Resolution ratifying and approving a grant agreement with the Washington State Office of Public Defense for 2024-2025 to assist with indigent defense expenses RESOLUTION NO. R-2023-158,A RESOLUTION ratifying and approving the City Manager's execution of a grant agreement with the Washington State Office of Public Defense accepting the terms and conditions for a grant for 2024-2025. M. Resolution authorizing acceptance of the Supporting Investments in Economic Development grant and loan funding for the Yakima Chief Hops Traffic Signal Project RESOLUTION NO. R-2023-159,A RESOLUTION accepting and authorizing the execution of the Supporting Investments in Economic Development(SIED) grant and loan funding from Yakima County for Contract YC-YCH-23—Yakima Chief Hops Traffic Signal. N. Resolution to amend an Interlocal Agreement between the Washington State Department of Transportation, Yakima County, and the City of Yakima for the Naches-Cowiche Flood Risk Reduction and Floodplain Restoration Project RESOLUTION NO. R-2023-160,A RESOLUTION amending the Interlocal Agreement between the Washington State Department of Transportation, Yakima County, and the City of Yakima for the Naches-Cowiche Flood Risk Reduction and Floodplain Restoration Project. O. Resolution amending FAA Grant 3-53-0089-047-2021 for Capital Improvement Project at the Yakima Air Terminal-McAllister Field RESOLUTION NO. R-2023-161,A RESOLUTION amending FAA Grant 3-53-0089-047- 2021 for Capital Improvement Project at the Yakima Air Terminal-McAllister Field. PUBLIC HEARINGS 8. First public meeting to receive comments on the Draft 2024 Annual Action Plan for HOME and CDBG funded programs Community Development Director Joan Davenport briefed Council on the 2024 Annual Action Plan for program support funded with 2024 Community Development Block Grant (CDBG)and HOME Investment funds. Page 3 of 5 241 Mayor Deccio opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. 9. Public hearing and Resolution authorizing an Interlocal Agreement with Yakima County regarding the 2023 JAG Grant Yakima Police Lieutenant Tory Adams briefed Council on the resolution regarding the Justice Assistance Grant. Mayor Deccio opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. The City Clerk read the resolution by title only. MOTION: Byers moved and Brown seconded to adopt the resolution as read. The motion carried by a 6-0 roll call vote; Lund absent. RESOLUTION NO. R-2023-162,A RESOLUTION ratifying an application for a grant in the total amount of$73,844 from the United States Department of Justice, Bureau of Justice Administration, Edward Byrne Memorial Justice Assistance Grant Program. 10. Second public hearing on the 2024 Mid-Biennial Budget for the City of Yakima Director of Finance and Budget Mark Roberts introduced the second public hearing on the 2024 Mid-Biennial budget for the City of Yakima. Mayor Deccio opened the public hearing. Patty Hoendermis spoke in opposition to the use of the utility tax to fund the pools and requested that Council delay vote until the new Council is seated. Following public comment, Mayor Deccio closed the hearing. DEPARTMENT ITEMS 11. Consideration of Naches Avenue Historic Overlay Zone Standards Planning Manager Joseph Calhoun briefed Council on the Naches Avenue Historic Overlay Zone (HOZ)standards. The purpose of the standards is to ensure that changes along Naches Avenue within the HOZ area will preserve existing structures with its historic and visual character. Clayton Bussey, Historic Preservation Commission member, encouraged Council to review the standards and implement them. Council asked about density standards, parking, and alley access.After discussion, it was consensus to further discuss this topic at a study session in January. 12. Resolution authorizing the purchase of Flock Falcon LPR cameras with vehicle fingerprint from Insight Public Sector utilizing grant funds awarded in City Contract 2023-163, Resolution R- 2023-128 Yakima Police Lieutenant Tory Adams briefed Council on the proposed resolution authorizing the purchase of Flock Falcon cameras. The City Clerk read the resolution by title only. MOTION: Macias moved and Brown seconded to adopt the resolution. The motion carried by a 6-0 roll call vote; Lund absent. R-2023-163,A RESOLUTION authorizing the purchase of Flock Falcon LPR cameras with vehicle fingerprint from Insight Public Sector utilizing grant funds award in City Contract 2023-163, and Resolution R-2023-128. 13. Resolution authorizing grant acceptance from the Washington State Department of Commerce Office of Crime Victims Advocacy Community Services Divisions SFY24 Violence Against Women DVHRT Program Yakima Police Lieutenant Chad Janis briefed Council on the proposed resolution authorizing the acceptance of the SFY24 Violence Against Women Program grant. The City Clerk read the resolution by title only. MOTION: Brown moved and Herrera seconded to adopt the resolution. The motion carried by a 6-0 roll call vote; Lund absent. RESOLUTION NO. R-2023-164,A RESOLUTION accepting the Washington State Department of Commerce Office of Crime Victims Advocacy Community Services Divisions SFY24 Violence Against Women DVHRT Program Grant. 14. Other Business MOTION: Byers moved and Macias seconded to opt out of the 3M PFAS settlement. The motion carried by unanimous vote; Lund absent. MOTION: Byers moved and Macias seconded to opt out of the DuPont PFAS settlement. The motion carried by unanimous vote; Lund absent. 15. Adjournment MOTION: Brown moved and Byers seconded to adjourn to the next Council study session on November 28, 2023, at 5:00 p.m. in the Council Chambers at City Hall. The motion carried by unanimous vote.
