EXECUTIVE SESSION �.
1. Executive session to consider the selection of a site or acquisition of real estate by lease or
purchase (RCW 42.30.110(1)(b); and to discuss with agency council agency litigation (RCW
42.30.110(1)(i)(i)
MOTION: Byers moved and Macias seconded to adjourn to Executive Session for up
to 30 minutes to consider the selection of a site or acquisition of real estate by lease
or purchase pursuant to RCW 42.30.110(1)(b); and to discuss agency litigation
pursuant to RCW 42.30.110(1)(i)(i). The motion carried by unanimous vote.

No interpreter in attendance.
4. Public Comment
Russell Mumford, Executive Director of Veteran's Rights Council, spoke regarding lack of
events at Chuck Austin Place and Yakima Housing Authority's management of the housing
facility.
Rodney Beason, Yakima resident, expressed concern related to housing density as proposed

in the Naches Avenue Historic Overlay Zone and he encouraged Council not to take action.
Genovieve Ramirez, Selah resident and general manager of downtown Yakima restaurant,
spoke about parking permit matters and public parking in the downtown area.

7. Consent Agenda
Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there
were any additions or deletions from Council members present. There were no changes. The
City Clerk read the Consent Agenda items, including resolutions and ordinances, by title.
(Items on the Consent Agenda are handled under one motion without further discussion—see
motion directly below.)
MOTION: Macias moved and Byers seconded to approve the consent agenda. The
motion carried by a 6-0 roll call vote; Lund absent.

8. First public meeting to receive comments on the Draft 2024 Annual Action Plan for HOME and
CDBG funded programs
Community Development Director Joan Davenport briefed Council on the 2024 Annual Action
Plan for program support funded with 2024 Community Development Block Grant (CDBG) and
HOME Investment funds.

Mayor Deccio opened the public hearing and, with no one coming forward or calling in to
speak, closed the hearing.
9. Public hearing and Resolution authorizing an Interlocal Agreement with Yakima County
regarding the 2023 JAG Grant
Yakima Police Lieutenant Tory Adams briefed Council on the resolution regarding the Justice
Assistance Grant.
Mayor Deccio opened the public hearing and, with no one coming forward or calling in to
speak, closed the hearing.
The City Clerk read the resolution by title only.
MOTION: Byers moved and Brown seconded to adopt the resolution as read. The
motion carried by a 6-0 roll call vote; Lund absent.
RESOLUTION NO. R-2023-162,A RESOLUTION ratifying an application for a grant in the
total amount of$73,844 from the United States Department of Justice, Bureau of Justice
Administration, Edward Byrne Memorial Justice Assistance Grant Program.
10. Second public hearing on the 2024 Mid-Biennial Budget for the City of Yakima
Director of Finance and Budget Mark Roberts introduced the second public hearing on the
2024 Mid-Biennial budget for the City of Yakima.
Mayor Deccio opened the public hearing. Patty Hoendermis spoke in opposition to the use of
the utility tax to fund the pools and requested that Council delay vote until the new Council is
seated. Following public comment, Mayor Deccio closed the hearing.
DEPARTMENT ITEMS
11. Consideration of Naches Avenue Historic Overlay Zone Standards
Planning Manager Joseph Calhoun briefed Council on the Naches Avenue Historic Overlay
Zone (HOZ) standards. The purpose of the standards is to ensure that changes along Naches
Avenue within the HOZ area will preserve existing structures with its historic and visual
character. Clayton Bussey, Historic Preservation Commission member, encouraged Council to
review the standards and implement them. Council asked about density standards, parking,
and alley access.After discussion, it was consensus to further discuss this topic at a study
session in January.
12. Resolution authorizing the purchase of Flock Falcon LPR cameras with vehicle fingerprint from
Insight Public Sector utilizing grant funds awarded in City Contract 2023-163, Resolution R-
2023-128
Yakima Police Lieutenant Tory Adams briefed Council on the proposed resolution authorizing
the purchase of Flock Falcon cameras.
The City Clerk read the resolution by title only.
MOTION: Macias moved and Brown seconded to adopt the resolution. The motion
carried by a 6-0 roll call vote; Lund absent.

RESOLUTION NO. R-2023-163,A RESOLUTION authorizing the purchase of Flock Falcon
LPR cameras with vehicle fingerprint from Insight Public Sector utilizing grant funds award in
City Contract 2023-163, and Resolution R-2023-128.
13. Resolution authorizing grant acceptance from the Washington State Department of Commerce
Office of Crime Victims Advocacy Community Services Divisions SFY24 Violence Against
Women DVHRT Program
Yakima Police Lieutenant Chad Janis briefed Council on the proposed resolution authorizing
the acceptance of the SFY24 Violence Against Women Program grant.

MOTION: Brown moved and Herrera seconded to adopt the resolution. The motion
carried by a 6-0 roll call vote; Lund absent.
RESOLUTION NO. R-2023-164,A RESOLUTION accepting the Washington State
Department of Commerce Office of Crime Victims Advocacy Community Services Divisions
SFY24 Violence Against Women DVHRT Program Grant.
14. Other Business
MOTION: Byers moved and Macias seconded to opt out of the 3M PFAS settlement.
The motion carried by unanimous vote; Lund absent.

settlement. The motion carried by unanimous vote; Lund absent.
15. Adjournment
MOTION: Brown moved and Byers seconded to adjourn to the next Council study
session on November 28, 2023, at 5:00 p.m. in the Council Chambers at City Hall. The
motion carried by unanimous vote. The meeting adjourned at 6:32 p.m.

2. Public comment (allow 15 minutes)
Jeanna Hernandez, resident, spoke against proposed utility tax increase.
Genovieve Ramirez, General Manager of Cowiche Canyon Kitchen, commented on
downtown parking and enforcement issues.
3. Presentation on Rates and Fees
Director of Finance and Budget Mark Roberts introduced the presentation on rates and fees
and noted the City's ability to charge reasonable fees to recover costs to provide services.
Director of Yakima Air Terminal Robert Hodgman briefed Council regarding the evaluation of
airport rates and charges and explained the proposed gradual increase to their fees.
Planning Manager Joseph Calhoun briefed Council on the updated land use fees as
proposed by the FCS Group Fee Study recommendations.
Code Administration Manager Glenn Denman briefed Council on the International Code
Council's Building Valuation Data Table (BVDT) and noted a slight reduction to the plumbing,
mechanical, building and construction-related permit fees.
Parks and Recreation Manager Ken Wilkinson presented information on the 2024 proposed
fee schedule for recreation facilities, programs, and services, including Tahoma Cemetery,
Fisher Park Golf Course, aquatics, Harman Center, and Washington Fruit Community
Center.
Yakima Police Chief Matthew Murray and Corrections and Police Services Commander
Maritza Davis provided information about a proposal to retain the Crime Free Rental Housing
Program.
4. Final Discussion on 2024 Mid-Biennial Budget
MOTION: Byers moved and Cousens seconded to recess for 5 minutes. The motion

carried by unanimous vote. The meeting recessed for a break at 6:05 p.m. and reconvened
at 6:12 p.m.
Director of Finance and Budget Mark Roberts introduced the final discussion on the
proposed 2024 Mid-Biennial budget for the City of Yakima. Roberts highlighted the
breakdown of the 2024 estimated property tax calculation, reported on projected revenues
and expenditures, provided an update on the ARPA funds, and the proposed utility tax
increase.
5. Proposed Ordinance(s)to Increase "in lieu" Utility Tax-Amending YMC Chapter 7.64 Water,
Wastewater, Stormwater and Refuse Revenue Tax
City Manager Robert Harrison briefed Council on the proposed ordinances to increase "in-
lieu" utility taxes. The City Clerk read the ordinances by title only.
AN ORDINANCE amending the City of Yakima Municipal Code Section 7.64.020 Water and
wastewater tax.
AN ORDINANCE amending the City of Yakima Municipal Code Section 7.64.030 Refuse
tax.
AN ORDINANCE amending the City of Yakima Municipal Code Section 7.64.040
Stormwater tax.
MOTION: Herrera moved and Macias seconded to pass all three ordinances. The
motion failed by a 4-3 roll call vote due to the lack of a minimum affirmative vote of five
members as required by the Yakima City Charter; Brown, Byers and Cousens voting no.
6. Discussion regarding consistency in board, committee and commission processes and
procedures
City Attorney Sara Watkins provided information regarding consistency in board, committee
and commission processes and procedures.After discussion, no changes were suggested.
7. Adjournment
MOTION: Lund moved and Cousens seconded to adjourn to the next Council
regular meeting on December 5, 2023 at 5:30 p.m. in the City Hall Council
Chambers. The motion carried by unanimous vote. The meeting adjourned at 6:37 p.m.
