Rates Rates are generally an amount of money paid per unit, or per day/hour/month. Black's Law Dictionary defines rates as "proportional or relative value, the proportion by which quantity or value is adjusted; or an amount paid or charged for a good or service." Webster's Dictionary defines rates as "degree of value; price; also, the unit cost of a commodity or service: the rate for electricity, gas, water, and the like." For example, in addition to rates for utilities, the airport rental terminal rates are $27.26 per square foot of space on the first floor of the terminal and the Beyond the Bell program charges a rate of$5.00 per child, per day. Fees Fees are generally costs for services. Black's Dictionary defines fee as "A charge for labor or services, especially professional services." Webster's Dictionary defines fee, in part, as "A payment, as for professional services; A charge for a special privilege, as admission to entertainment." Fees can be charged for attorneys' time and efforts, to file a claim with the court, for engineers' work, or for painting lines on a softball field. 200 South Third Street,2nd Fl. I Yakima,WA 98901 P:509.575.6030 I F:509.575.6160 3 Honorable Mayor and City Councilmembers City Manager Bob Harrison November 13, 2023 Page 2 The Washington courts have collectively referred to all nontax charges as fees, which is a broad category that encompasses connection fees, collection fees, facility fees, user fees, permit fees, parking fees, and registration fees. See Tukwila School Dist. No. 406 v. City of Tukwila, 140 Wn.Ap. 735, 746, 167 P.3d 1137 (2007), citing Okeson v. City of Seattle, 150 Wn.2d 540, 551- 52, 78 P.3d 1279 (2003). Charges Charges are amounts billed. Black's Law Dictionary defines charges as "Price, cost, or expense." Webster's Dictionary defines charge, in part, as "a price." Charges is the general term for costs and expenses. In summary, rates and fees are both charges, and oftentimes the terms are used interchangeably. The fee resolution encompasses all rates, fees and charges for city services, including licenses, connection charges, use of city facilities, and other charges to regulate activities or entities. Additionally, rates, fees and charges do not include taxes, which are addressed through an ordinance and vote as required by the City Charter. City Council adopted Resolution R- 2023-041 to approve these amendments, including an annual adjustment in accordance with the nationally recognized International Code Council's Building Valuation Data Table (BVDT). The BVDT is updated twice a year by the International Code Council(publishers of codes and standards)and the latest table from the previous year is adopted by the City of Yakima to be effective January 1st of each year. R-2023-041 A RESOLUTION amending the City of Yakima Master Fee Schedule —Code Administration Fees and all Permit Related Fees WHEREAS, on February 15, 2022 the city entered into a contract with FCS group (hereinafter"Consultant") to conduct a Community Development Services Fee Study to determine the current level of cost recovery for fees as presented under existing fee levels, inclusive of internal service delivery (overhead) costs for Code Administration (R-2022-025); and WHEREAS, fire code permit fees have not been reviewed or adjusted since their original adoption in 2002 and all other Code Administration fees, including but not limited to building, mechanical, and plumbing permit fees, have not been increased since 2014; and WHEREAS, at the October 11, 2022 council study session, the fee study results were discussed further by staff and council with council directing staff to prepare legislation for 100% cost recovery for fees; and WHEREAS, the Code Administration fees that were included in the Master Fee Schedule adopted by council resolution on December 6, 2022 (Resolution R-2022-169) shall be herein modified; and WHEREAS, the fees herein include the replacement of the Plan Review and Construction Inspection section within the Fire Code table (Exhibit "C") as outlined in the Master Fee Schedule; and WHEREAS, the fees herein include the replacement of the Control of Moved Buildings section within the License and Permits table (Exhibit "D") outlined in the Master Fee Schedule; and WHEREAS, the International Code Council publishes a new Building Valuation Data Table twice a year to reflect average construction costs per square foot; and WHEREAS, the Yakima City Council finds that it is in the best interest of the City of Yakima to amend Code Administration fees by way of utilizing the Building Valuation Data issued by the International Code Council including local modifications, adjusting the first day of each year utilizing the latest Building Valuation Data issued the previous year, as proposed in Exhibit A to capture 100% fee recovery; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: Section 1. The Code Administration valuation table and permit related fees set forth in the attached Exhibit "B," shall be amended as presented in Exhibit "A" which is incorporated herein, are hereby adopted by reference. Section 2. For Meeting of: March 21, 2023 ITEM TITLE: Resolution amending the Master Fee Schedule for Plumbing, Mechanical, Building and Construction Related Permits to be effective May 1 , 2023 SUBMITTED BY: Joan Davenport,AICP, Community Development Director *Glenn Denman, Code Administration Manager SUMMARY EXPLANATION: Prior to 2014, City of Yakima building permit fees automatically adjusted annually in accordance with data from the Seattle Consumer Price Index (CPI). Other fees such as plumbing, mechanical and fire permit fees have not been adjusted since 2002. In February 2022, the City entered into a contract with FCS Group under Resolution R-2022-025 to accurately determine the cost of services and conduct a fee study. Fee study results were presented at the October 4, 2022 Council business meeting. Further discussion occurred at the October 11, 2022 Council study session where Council directed staff to prepare legislation that would adjust fees so that the City's cost of delivering services directly related to permitting would be 100% recovered. Building permit fees are based on valuation of projects determined by valuation fee tables that are adopted by Council. The proposed ordinance adopts the current valuation table that is published by the International Code Council, and fees will automatically adjust annually as the new tables are published. Plumbing, mechanical and fire permit fees are currently based on a "per item" basis or a flat rate. Those fees will be based on the same valuation table as building permits. Permit related fees as codified in YMC 11.04.030 were included in the Master Fee Schedule adopted by council Resolution R-2022-169 on December 6, 2022. The attached Resolution and Exhibits "A", "B", "C" and "D" reflect the Council's direction to capture 100% cost recovery consistent with the FCS Group's fee study. POLICE Memorandum 1234 November 22, 2023 To: Matthew Murray, Chief of Police From: Maritza Davis, Corrections and Police Services Commander Subject: Crime Free Rental Housing Program Proposal At the direction of City Manager Bob Harrison, all city departments were to identify significant expenditure reductions in order to balance the budget. As part of the City's seven budget review meetings, on May 9, 2023, the Yakima Police Department delivered several budget reductions in a presentation to City Council. The proposed preliminary budget reduction included the elimination of two (2) Police Services Specialist positions that are responsible for two programs: A)The Crime Free Rental Housing Program and B)Fingerprinting services which were provided at an annual cost of$163,315.52. The purpose of this memorandum is to present a proposal to retain the Crime Free Rental Housing Program (CFRHP)by funding the one(1)Police Services Specialist position through fees imposed on participants of the CFRHP. Police Services Specialist Shelly Owens is currently assigned to CFRHP. Please see her memorandum providing the program's history, utilization, research, and fees imposed by other cities (attached). Crime Free Rental Housing Program: The Crime Free Rental Housing Program is a partnership between the Yakima Police Department, local landlords, and tenants working together to foster a safer and healthier community in rental housing. The CFRHP is a crime prevention program designed to reduce crime, drugs, and gangs on rental housing premises under the supervision of the Yakima Police Department. Through education and support, the CFRHP addresses rental based illegal activities and special needs with the goal of reducing calls for police service and creating a safer and more stable living environment for residents. Per RCW 35.106.020, a local government can charge a fee for participation in the CFRHP. Participation in the CFRHP is voluntary. Police Services Division: The Yakima Police Services Division cannot continue to operate the CFRHP due to reduced staffing levels and a significant backlog of work that currently exists. Personnel must dedicate their time and resources to complete duties and tasks that are essential and required by law. Without additional staffing, the Crime Free Rental Housing Program would need to be terminated on or before December 31, 2023, or as determined by the City Manager; unless the City imposes a fee to generate revenue that will staff one(1)Police Services Specialist position. 73 Proposed Fee: There are two viable options that could fund the Police Services Specialist position that would be tasked with managing the Crime Free Rental Housing Program (approx. $96,355): • Option One: Impose a fee for each participant, based on a tiered system • Option Two: Reach out to the Yakima Valley Landlords Association (YVLA) to determine its interest in funding the program as a member benefit. As of October 20, 2023, the Yakima Police Department (YPD) had 4,588 properties participating in the program(9,023 individual units). I propose that the City of Yakima impose an annual fee in order to maintain the CFRHP in operation. The fee would not exceed $50 annually ($4.16 monthly) per unit. Larger properties would pay a lower cost to encourage participation and the max amount would be capped. Below is the proposed tier rates for consideration by City Council. • 1-10 Units = $50 max (annually) • 11-50 Units = $250 max (annually) • 51 + Units = $500 max (annually) Based on the current number of properties (4,588), the City would need approximately 40% enrollment in the CFRHP in order to generate sufficient revenue to maintain the program. Any extra fees collected over the anticipated cost would be reinvested into the crime free program. If there is a shortage in the amount of revenue collected, the program services would be reduced. Only those landlords that pay the fee would be permitted to engage and use the information in the program. Conclusion: The City of Yakima is not legally required to provide a Crime Free Rental Housing Program to the community. The Yakima Police Department has been offering community members a Crime Free Rental Housing Program since 2008. This program works hand in hand with the City of Yakima's Chronic Nuisance Ordinance and builds a partnership between community members and police officers in crime prevention. Between January 1, 2023 to September 30, 2023, there were 241 incidents reported involving CFRHP and 169 arrests. Between the two options, the most efficient would be a partnership with the Yakima Valley Landlords Association to fund this program in order to provide this valuable benefit to its members and YVLA can build the annual program fee into its annual membership dues. This would result in only one billing transaction per year, versus multiple transactions for each participant. The City would need to explore this option with the YVLA, which has been an advocate to maintain the program. Alternatively, the City could build the fee into the annual fee schedule. If the program does not have revenue attached to it, we recommend eliminating the program.
