Roll Call Present: Mayor Janice Deccio, presiding;Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera, Eliana Macias (present at 5:31 p.m. and attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins, and City Clerk Rosalinda Ibarra 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Public Comment Joey Wallberg and Dustin Miley, City employees, spoke regarding interdependence between City divisions and departments, the inability to hire employees due to wages and its effect on the ability to provide service. 5. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title (Items on the Consent Agenda are handled under one motion without further discussion - see motion directly below.) MOTION: Cousens moved and Byers seconded to approve the consent agenda. The motion carried by a 7-0 roll call vote. A. Resolution authorizing Task Order 2023-04 Supplemental Engineering Agreement for Professional Services with JUB Engineering, Inc. for the Terminal Building Modernization Project Phase 1A at the Yakima Air Terminal-McAllister Field RESOLUTION NO. R-2023-145,A RESOLUTION authorizing a Task Order 2023-04 Supplemental Engineering Agreement for Professional Services with JUB Engineering, Inc. for the Terminal Building Modernization Project Phase 1A at the Yakima Air Terminal-McAllister Field. G. Resolution authorizing City Manager to execute the funding agreements with Housing and Urban Development (HUD)for the 2023 HOME and CDBG grant 40 contracts RESOLUTION NO. R-2023-146,A RESOLUTION authorizing the City Manager to accept the 2023 Community Development Block Grant (CDBG) and HOME Funds and execute the funding contracts as mandated by the Department of Housing and Urban Development (HUD). H. Ordinance amending the 2023 Budget for the City of Yakima and making appropriations from unappropriated fund balances within various funds for expenditure during 2023 for various purposes (Second Reading) ORDINANCE NO. 2023-039,AN ORDINANCE amending the 2023 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2023 for various purposes. PUBLIC HEARINGS 8. Public Hearing and Resolution declaring certain property originally part of Drainage Improvement District#39, later abandoned by Yakima County and ceded to the City, to be Page 2 of 5 4 surplus to the City needs Wastewater and Stormwater Manager Mike Price briefed the Council on the resolution. Mayor Deccio opened the public hearing, and with no one coming forward or calling in to speak, closed the hearing. The City Clerk read the resolution by title only. MOTION: Lund moved and Cousens seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2023-147,A RESOLUTION declaring certain property originally part of Drainage Improvement District#39 later abandoned by Yakima County to be surplus to City needs and abandoning all interest to the property owners over which the pipeline extends. 9. Public hearing and Ordinances pertaining to Ad Valorem Taxes to be levied for collection in Fiscal Year 2024 Interim Director of Finance& Budget/Assistant City Manager Rosylen Oglesby reviewed the proposed ordinances pertaining to ad valorem taxes which authorizes the County Assessor to levy real and personal property taxes necessary to fund the City of Yakima's 2024 Mid-Biennial Budget. Ms. Oglesby introduced Deanna Gregory of Pacifica Law Group, the City's Bond Counsel, who presented information about bond issuances and the City's obligations. Mayor Deccio opened the public hearing. With no one coming forward or calling in to speak, Mayor Deccio closed the public hearing. The City Clerk read Ordinance A by title only. MOTION: Lund moved and Cousens seconded to pass Ordinance A. The motion carried by a 7-0 roll call vote. A. ORDINANCE NO. 2023-040,AN ORDINANCE relating to the annual property tax levy; declaring the City Council's intent to increase the City's 2024 regular levy up to 101% along with new construction, annexation, refunds and growth in state-assessed property values from the amount levied the previous year. The City Clerk read Ordinance B by title only. MOTION: Lund moved and Cousens seconded to pass Ordinance B. The motion carried by a 7-0 roll call vote. B. ORDINANCE NO. 2023-041,AN ORDINANCE fixing and levying the amount of ad valorem taxes necessary to discharge the expected expenses and obligations for the 2024 Budget for the City of Yakima. 10. Public Hearing regarding proposed Utility Tax increase Interim Director of Finance& Budget/Assistant City Manager Rosylen Oglesby presented information regarding proposed increases to utility taxes for 2024. Ms. Oglesby described the increase for residential and commercial users. The potential increase in revenue is estimated at $2,713,271 with approximately$589,217 going towards the Aquatic Fund for Capital and Operating costs. Councilmember Byers provided a statement indicating her position on the issue. Mayor Deccio opened the public hearing. The following members spoke in favor: Ester Huey, Eric Silvers, Laliyah Bravo, Jenenzy Che, Imani Larze, Sonya Lott, Reverend Willie Pride, Corey Radcliff, James Parks, Dori Peralta Baker,Anthony Peterson. With no one else coming forward or calling in to speak, Mayor Deccio closed the public hearing. 11. First public hearing on the 2024 Mid-Biennial Budget for the City of Yakima Interim Director of Finance& Budget/Assistant City Manager Rosylen Oglesby reported on the 2024 Preliminary Mid-Biennial Budget and highlighted the General Fund forecast with and without the proposed in lieu tax increases. Mayor Deccio opened the public hearing. With no one coming forward or calling in to speak, Mayor Deccio closed the public hearing. DEPARTMENT ITEMS 440,N 12. Draft 2024 State and Federal Legislative Priorities Communications and Public Affairs Director Randy Beehler briefed Council on the 2024 State and Federal Legislative Priorities.After brief Council discussion, MOTION: Cousens moved and Herrera seconded to adopt the 2024 State and Federal Legislative Priorities. The motion carried by unanimous vote. 13. Resolution to establish a Debt Financial Policy for the City of Yakima Interim Director of Finance& Budget/Assistant City Manager Rosylen Oglesby briefed Council on the proposed resolution to establish a Debt Policy for the City of Yakima. The City Clerk read the resolution by title only. MOTION: Lund moved and Cousens seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2023-148,A RESOLUTION establishing a debt policy for the City of Yakima. 14. Resolution ratifying the declaration of an emergency and authorizing the City Manager to execute all applicable contracts for the 2023 police vehicle order Yakima Police Lieutenant Ira Cavin briefed Council on the resolution ratifying the declaration of an emergency for the police vehicle order with Bud Clary Ford. The City Clerk read the resolution by title only. MOTION: Byers moved and Cousens seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2023-149,A RESOLUTION ratifying the declaration of an emergency and authorizing the City Manager to execute all applicable contracts for the 2023 police vehicle order. 15. Ordinance amending Yakima Municipal Code 6.27.060, setting time limit for an owner to retrieve impounded shopping carts, and adding a new section, YMC 6.27.075, for appeals Page 4 of 5 6 Assistant City Attorney Brian Aaron briefed Council on the proposed ordinance amending Yakima Municipal Code 6.27 related to shopping cart regulations. ORDINANCE NO. 2023-042,AN ORDINANCE amending the City of Yakima Municipal Code Section 6.27.060 Retrieval and impoundment procedures; and adding Section 6.27.075 as a new section, titled Appeals. 16. Resolution placing the shopping cart appeal fee in the Master Fee Schedule City Attorney Sara Watkins briefed Council on the resolution amending the Master Fee Schedule to add the shopping cart appeal fee. The City Clerk read the resolution by title only. MOTION: Cousens moved and Herrera seconded to adopt the resolution. The motion carried by a 7-0 roll call vote. RESOLUTION NO. R-2023-150,A RESOLUTION updating the Master Fee Schedule relating to Yakima Municipal Code 6.27 Shopping Cart Regulations. 17. Other Business City Manager Harrison thanked Assistant City Manager Rosylen Oglesby for taking on multiple roles during recent staff shortages. 18. Introduction of Mark Roberts as the City's new Director of Finance and Budget City Manager Bob Harrison introduced Mark Roberts as the new Director of Finance and Budget for the City of Yakima. 4. Resolution authorizing a temporary agreement between the State of Washington Department of Revenue and the City of Yakima Tourism Promotion Area for the administration and collection of the tourism promotion lodging charges City Attorney Sara Watkins briefed the Council on the proposed resolution. The City Clerk read the resolution by title only. MOTION: Cousens moved and Byers seconded to adopt the resolution. The motion carried by a 6-0 vote; Macias absent. RESOLUTION NO. R-2023-151,A RESOLUTION authorizing the Temporary Agreement for the State Administration of the City of Yakima and Yakima County Tourism Promotion Area Fees. 5. Opioid Use Disorder Discussion City Attorney Sara Watkins introduced the discussion regarding opioid use disorders. The participants in the discussion included: Erika Ochoa and Melissa Sixberry(Yakima Health Page 1 of 2 8 District), Megan Tweedy(Community Activist), Dr. Gillian Zuckerman (Community Health of Central Washington), Cassidy Leslie (Triumph Treatment), Dr. Jocelyn Pedrosa (Yakima Neighborhood Health Services),Alicia Stromme Tobin (SAFE Yakima), Cynthia Martinez (City of Yakima Prosecuting Attorney), and Dr. Frank Garner(Chief Medical Officer, Comprehensive Healthcare). Erika Ochoa presented information about the history and benefits of the Yakima Health District's Syringe Services Program (SSP)which is part of their Harm Reduction Program. The SSP provides sterile injection supplies, safe disposal, critical services, linkage to care, and referral resource to individuals. Dr. Jocelyn Pedrosa presented data and information regarding strategies to address the opioid crisis. AMID Each participant talked about the successes and challenges in their respective programs and services offered in the community. Some of the successes noted include decrease in mortality rates for people with opioid use disorder who receive medication assisted treatment; increase in funding opportunities to provide awareness and prevention efforts; collaboration with community providers. Some of the challenges noted include the ability to serve individuals at their time of need; accessibility and availability of medical detox and in-patient facilities; navigating the barriers with insurance companies; and lack of housing for individuals. 6.
