Roll Call Present: Mayor Janice Deccio, presiding; Assistant Mayor Soneya Lund (attending remotely via Zoom) and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Rosalinda Ibarra 2. Pledge of Allegiance Mayor Deccio introduced Girls Scouts Troop 2226 and 2314 who led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Viillasenor who announced interpreter services are available in Spanish. 4. Public Comment Michael Kay, resident of Yakima, CEO of Camp Hope, addressed information provided to City Council regarding recent events and the status of Camp Hope. Joe Daniels, City resident, read a religious passage for City Council. Mr. Daniels asked Council who to address concerns regarding community issues involving residents of color. Tony Courcy, City resident, commented on several matters. 5. Open Discussion for the Good of the Order A. Proclamations i. Harvest Marching Band Festival Proclamation Mayor Deccio proclaimed October 21, 2023 as "Harvest Marching Band Festival Day" and Steven Kessler accepted the proclamation. 6. Council Reports None. 7. Consent Agenda Page 1 of 5 Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Item C and Item N were removed from the consent agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion —see motion directly below.) MOTION: Cousens moved and Byers seconded to approve the consent agenda as amended. The motion carried by a 7-0 roll call vote. A. Approval of minutes from the October 2, 2023 City Council special meeting, October 3, 2023 City Council regular meeting and October 10, 2023 City Council study session B. 2023 3rd Quarter Treasury Report C. Item C was removed from the Consent Agenda Item C was removed from the Consent Agenda. D. Approve payment of disbursements for the period September 1-30, 2023 E. Project Completion and Contract Acceptance with Knobels Electric Inc for the City Hall Sidewalk Replacement Project 2750 F. Set date of November 7, 2023 for public hearing regarding the Ad Valorem Tax (properly tax) for collection in 2024 G. Set date of November 7, 2023 for a Public Hearing to declare property surplus to the City needs and abandon a section of former Drainage Improvement District (DID)#39 H. Set dates of November 7 and 21, 2023, for public hearings on the 2024 Mid Biennial Budget for the City of Yakima I Resolution authorizing a multiple award to Newco Inc dba Cascade Columbia and Two Rivers Terminal, for Bid 12337 Miscellaneous Chemicals for the Wastewater Treatment Plant. RESOLUTION NO. R-2023-137, A RESOLUTION authorizing a multiple award for Bid 12337 Miscellaneous Chemicals for the Wastewater Treatment Plant. Resolution awarding Bid 12338 and authorizing an agreement with Northstar Chemical, Inc., for Liquid Aluminum Chlorohydrate (ACH) RESOLUTION NO. R-2023-138, A RESOLUTION awarding Bid 12338 and authorizing an agreement with Northstar Chemical, Inc., for Liquid Aluminum Chlorohydrate (ACH). K. Resolution authorizing an agreement with the Washington Traffic Safety Commission for high visibility traffic safety emphasis patrols RESOLUTION NO. R-2023-139, A RESOLUTION authorizing an Interlocal Agreement with the Washington Traffic Safety Commission for funding to provide traffic safety emphasis patrols. Page 2 of 5 L. Resolution authorizing an agreement with Washington Traffic Safety Commission to provide pass -through funding from the US Department of Transportation to fund an impaired driving emphasis officer and equipped patrol vehicle RESOLUTION NO. R-2023-140, A RESOLUTION authorizing an agreement with Washington Traffic Safety Commission to provide pass -through funding from the US Department of Transportation to fund an impaired driving emphasis officer and equipped patrol vehicle. M. Resolution authorizing Supplemental Agreement 1 to the Professional Services Agreement with Haley & Aldrich Inc to perform the design and remediation for the environmental cleanup of the former Tiger Oil site at 2312 W Nob Hill Blvd EV2999 RESOLUTION NO. R-2023-141, A RESOLUTION authorizing Supplemental Agreement 1 to the Professional Services Agreement with Haley & Aldrich Inc to perform the design and remediation for the environmental cleanup of the former Tiger Oil site at 2312 W Nob Hill Boulevard. N. Item N was removed from the Consent Agenda prior to the Council meeting Item N was removed from the Consent Agenda prior to the Council meeting. O. Ordinance adopting the City Council's decision on the Comprehensive Plan Amendment (CPA#001-23) and concurrent Rezone (RZ#001-23) ORDINANCE NO.2023-037, AN ORDINANCE amending the Future Land Use Map and Zoning Map of the City of Yakima for parcel 181315-14472 as follows: Future Land Use Map from Mixed Residential to Commercial Mixed -Use and Zoning Map from Multi -Family Residential (R-3) to General Commercial (GC). Items Removed from the Consent Agenda A. Financial Policy - Debt Policy (New) City Manager Harrison provided a description of the Financial Policy - Debt Policy. Item C was removed from the consent agenda. After discussion, MOTION: Byers moved and Cousens seconded to place Item C on the next scheduled business meeting for discussion. The motion passed by unanimous vote. B. Resolution authorizing an agreement with ImageTrend for Emergency Medical Services (EMS) statewide reporting software for the Fire Department Item N was removed from the agenda by staff prior to the Council meeting. This item was removed from the agenda in its entirety; there was no discussion or action on the item. DEPARTMENT ITEMS 8. Draft 2024 State and Federal Legislative Priorities Communications & Public Affairs Director Randy Beehler briefed Council on the Draft 2024 State and Federal Legislative Priorities for the City of Yakima. 9. 2023 Vacant Building Safety Project 3rd Quarter Report Page 3 of 5 we Code Administration Manager Glenn Denman reported on the 2023 3rd Quarter Vacant Building Safety Project implementation efforts. 10.. Resolution authorizing a Joint Use Agreement with the Yakima School District No. 7 The Joint Use Agreement with the Yakima School District requires additional review and will be added to a future meeting. 11. Ordinance amending the 2023 Budget for the City of Yakima and making appropriations from unappropriated fund balances within various funds for expenditure during 2023 for various purposes (First Reading) Interim Director of Finance and Budget Rosylen Oglesby briefed Council on the first reading proposed amendments to the 2023 budget. The City Clerk read the ordinance by title only. First reading of AN ORDINANCE amending the 2023 budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2023 for various purposes. 12. Ordinance amending the City of Yakima Municipal Code 5.96 - Ambulance Services Fire Chief Aaron Markham briefed the Council on the proposed amendments to Yakima Municipal Code Section 5.96 - Ambulance Services. The City Clerk read the ordinance of the title only. After discussion, MOTION: Brown moved and Cousens seconded to pass the ordinance. The motion carried by a 7-0 vote. ORDINANCE NO.2023-038, AN ORDINANCE amending the City of Yakima Municipal Code Section 5.96.080 entitled Conditions of ambulance service. 13. Other Business MOTION: Byers moved and Cousens seconded to adjourn to an executive session for 10 minutes regarding pending litigation pursuant to RCW 42.30.110(1)(a)(i). The motion carried by unanimous vote. Present for Executive Session: Mayor Deccio, Assistant Mayor Lund (present via phone), and Councilmembers Brown, Byers, Cousens, Herrera, and Macias (present via phone). Executive session was held at 6:25 p.m. and adjourned at 6:35 p.m., at which time the meeting reconvened. 14. Adjournment MOTION: Byers moved and Cousens seconded to adjourn to a study session on October 24, 2023 beginning at 5:00 p.m. in the Council Chambers at Yakima City Hall.
