Roll Call Present: Mayor Janice Deccio, presiding;Assistant Mayor Soneya Lund (attending remotely via Zoom) and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Rosalinda Ibarra 2. Pledge of Allegiance Mayor Deccio introduced Girls Scouts Troop 2226 and 2314 who led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Public Comment Michael Kay, resident of Yakima, CEO of Camp Hope, addressed information provided to City Council regarding recent events and the status of Camp Hope. Joe Daniels, City resident, read a religious passage for City Council. Mr. Daniels asked Council who to address concerns regarding community issues involving residents of color. Tony Courcy, City resident, commented on several matters. 5. Open Discussion for the Good of the Order A. Proclamations Harvest Marching Band Festival Proclamation Mayor Deccio proclaimed October 21, 2023 as "Harvest Marching Band Festival Day" and Steven Kessler accepted the proclamation. 6. Council Reports None. 7. Consent Agenda Page 1 of 5 3 Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. Item C and Item N were removed from the consent agenda. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Cousens moved and Byers seconded to approve the consent agenda as amended. The motion carried by a 7-0 roll call vote. A. Ordinance adopting the City Council's decision on the Comprehensive Plan Amendment (CPA#001-23) and concurrent Rezone (RZ#001-23) ORDINANCE NO. 2023-037,AN ORDINANCE amending the Future Land Use Map and Zoning Map of the City of Yakima for parcel 181315-14472 as follows: Future Land Use Map from Mixed Residential to Commercial Mixed-Use and Zoning Map from Multi-Family Residential (R-3)to General Commercial (GC). Items Removed from the Consent Agenda A. Financial Policy- Debt Policy (New) City Manager Harrison provided a description of the Financial Policy- Debt Policy. Item C was removed from the consent agenda.After discussion, MOTION: Byers moved and Cousens seconded to place Item C on the next scheduled business meeting for discussion. The motion passed by unanimous vote. B. 4114 Resolution authorizing an agreement with ImageTrend for Emergency Medical Services (EMS) statewide reporting software for the Fire Department Item N was removed from the agenda by staff prior to the Council meeting. This item was removed from the agenda in its entirety; there was no discussion or action on the item. DEPARTMENT ITEMS 8. Draft 2024 State and Federal Legislative Priorities Communications & Public Affairs Director Randy Beehler briefed Council on the Draft 2024 State and Federal Legislative Priorities for the City of Yakima. 9. 2023 Vacant Building Safety Project 3rd Quarter Report Page 3 of 5 5 Code Administration Manager Glenn Denman reported on the 2023 3rd Quarter Vacant Building Safety Project implementation efforts. 10. Resolution authorizing a Joint Use Agreement with the Yakima School District No. 7 The Joint Use Agreement with the Yakima School District requires additional review and will be added to a future meeting. 11. Ordinance amending the 2023 Budget for the City of Yakima and making appropriations from unappropriated fund balances within various funds for expenditure during 2023 for various purposes (First Reading) Interim Director of Finance and Budget Rosylen Oglesby briefed Council on the first reading proposed amendments to the 2023 budget. The City Clerk read the ordinance by title only. First reading of AN ORDINANCE amending the 2023 budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2023 for various purposes. 12. Ordinance amending the City of Yakima Municipal Code 5.96-Ambulance Services Fire Chief Aaron Markham briefed the Council on the proposed amendments to Yakima Municipal Code Section 5.96-Ambulance Services. The City Clerk read the ordinance of the title only.After discussion, MOTION: Brown moved and Cousens seconded to pass the ordinance. The motion carried by a 7-0 vote. ORDINANCE NO. 2023-038,AN ORDINANCE amending the City of Yakima Municipal Code Section 5.96.080 entitled Conditions of ambulance service. 13. Other Business MOTION: Byers moved and Cousens seconded to adjourn to an executive session for 10 minutes regarding pending litigation pursuant to RCW 42.30.110(1)(a)(i). The motion carried by unanimous vote. Present for Executive Session: Mayor Deccio,Assistant Mayor Lund (present via phone), and Councilmembers Brown, Byers, Cousens, Herrera, and Macias (present via phone). Executive session was held at 6:25 p.m. and adjourned at 6:35 p.m., at which time the meeting reconvened. 14. Adjournment MOTION: Byers moved and Cousens seconded to adjourn to a study session on October 24, 2023 beginning at 5:00 p.m. in the Council Chambers at Yakima City Hall. The motion carried by unanimous vote. Meeting conducted in person and virtually via Zoom. 1. Roll Call Present: Mayor Janice Deccio, presiding;Assistant Mayor Soneya Lund (attending remotely via Zoom) and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera, and Eliana Macias Staff: City Manager Robert Harrison, City Attorney Sara Watkins, and City Clerk Rosalinda I barra 2. Public comment (allow 15 minutes) Jay Hirst, President of Kittitas Interactive Management, spoke about the lack of parking enforcement downtown and impact that has on agencies who purchase monthly parking permits. Ken Johnsen, Trolley Association, expressed interest in working with the City to seek funding opportunities to ease the burden of the infrastructure costs for the Trolley repairs. Raymond Paolella, William O. Douglas Trail Association, spoke regarding Trolley infrastructure and his desire to work with the City to identify and seek grant funding to aid the project. 3. Mid-biennial Budget-Session 2 of 2 Assistant City Manager Rosylen Oglesby presented the continuation of the mid-biennial review. She explained the modifications of proposed revenue and expenditure forecast for the 2024 fiscal budget and its impact to the General Fund and the City's financial reserves, noting the comparison of property and sales tax revenues and disbursements. Police Chief Murray, Corrections Commander Davis, and Human Resources Director Mendoza moderated the discussion regarding projected expenditures including increases to jail housing, aquatic operating & capital, stop loss insurance, annual technology maintenance, salaries and benefits, salary survey findings, indigent defense, labor and industries, and collective bargaining negotiations. Staff highlighted several challenges the City is experiencing with hiring new employees and retaining employees. Parks and Recreation Manager Ken Wilkinson provided information regarding expenses and Page 1 of 3 8 revenues for programs and services offered at Lions Pool, Franklin Pool, Fisher Park Golf Course, and Tahoma Cemetery. He also updated Council on the financial status of the Aquatic Center at MLK Jr. Park and upcoming expenses for the Yakima Rotary Aquatic Center. 4. Set the date of November 7, 2023, for a public hearing on potential Utility Tax increase. MOTION: Cousens moved and Byers seconded to set November 7, 2023 as a public hearing date for potential utility tax increase. The motion carried by unanimous vote. MOTION: Cousens moved and Byers seconded to take a 5-minute break (recess). The motion carried by unanimous vote. The meeting reconvened at 7:01 p.m. 5. Discussion on the Yakima Trolley Infrastructure City Engineer Bill Preston provided an update on the Yakima Trolley infrastructure. He noted the two areas of concern reported by Sargent Engineers Inc. are the status of the bridge spanning over the Naches River and the trolley tracks within 6th Avenue. The 6th Avenue/Trolley Track Repair project is listed on the Transportation Benefit District (TBD) list. Mr. Preston provided Council several options to consider moving forward with the 6th Avenue reconstruction: • Reconstruct 6th Avenue and replace the trolley tracks -$6.9 million • Remove and replace just the trolley tracks -$3.9 million • Reconstruct 6th Avenue and remove the trolley tracks -$3 million After Council discussion, no action was taken. The original plan to reconstruct 6th Avenue and replace the trolley tracks will remain in place. 6. Update on 40th Ave & Chestnut Traffic Analysis Project 2602 City Engineer Bill Preston provided an update to the findings of the traffic analysis conducted by Transportation Engineering Northwest LLC (TENW) at the intersection of 40th Avenue and West Chestnut Avenue. The report includes evaluation of the existing conditions, previous improvements, and recommendations for potential improvement alternatives. The recommended alternatives for improvements at that intersection include: traffic signal, Hawk signal, bike reroute, road diet, and RRFB enhancement. Council discussed at length the alternatives and provided further direction to staff. MOTION: Cousens moved and Byers seconded to direct staff to move ahead with exploring the Hawk System for 40th Ave. and Chestnut Ave. and present back to Council with funding piece included. The motion carried by unanimous vote. 7. Discussion on State Auditor's Exit Conference Report Councilmember Holly Cousens introduced the discussion regarding the State Auditor's Exit Conference Report. The report noted a finding with respect to inadequate internal controls for ensuring compliance with federal requirements for suspension and debarment. MOTION: Byers moved and Macias seconded to add to a future study session a Page 2 of 3 9 presentation on the process of hiring contractors and how we can include local preference. The motion carried by unanimous vote. Cousens reminded Council about an upcoming AWC event in Cle Elum. 8. Adjournment MOTION: Byers moved and Cousens seconded to adjourn to the next Council regular meeting on November 7, 2023, at 5:30 p.m. in the Council Chambers at City Hall.
