For Meeting of: October 17, 2023 ITEM TITLE: Ordinance amending the City of Yakima Municipal Code 5.96 - Ambulance Services SUBMITTED BY: Aaron Markham, Fire Chief SUMMARY EXPLANATION: The attached ordinance contains a revision to section 5.96.080(f) of the Yakima Municipal Code. The revision replaces the current specific response time requirement with language requiring response time standards to be maintained by the ambulance service provider per WAC 246-976- 390, or as amended. BE IT ORDAINED BY THE CITY OF YAKIMA: Section 1. City of Yakima Municipal Code Section 5.96.080 Conditions of ambulance service, is hereby amended to read as follows: 5.96.080 Conditions of ambulance service. Each ambulance service operating within the city must comply with the following minimum conditions: (a) Provide ALS and BLS ambulance services throughout the city on a twenty-four hours per day, seven days per week basis. (b) Each ambulance of the ambulance service that is operating in the city must be licensed by the state of Washington and must meet all standards and requirements set forth in WAC Chapter 246-976 as now or hereafter amended. Proof of a current state license must be maintained and available in the ambulance at all times. (c) Each ambulance of the ambulance service that is on duty and operating in the city shall be staffed with a minimum of two ambulance attendants, and staffed in accordance with the applicable ALS and BLS personnel requirements in WAC 246-976-390 as now or hereafter amended. (d) Emergency incidents shall require that the closest appropriate level of ambulance, BLS or ALS, be dispatched as determined by the EMD criteria outlined and approved by the Yakima County MPD. (e) The city may provide first response EMS. An ambulance service receiving a direct request for EMS shall notify the city's 9-1-1 communication center immediately so that the department's first response can be initiated. The only exception to this requirement shall be for the transport of nonemergent interfacility transfer of patients, routine medical transports, and BLS standbys. (f) For emergency responses, ambulances shall maintain a response time of eight minutes or less on ninety percent as required by WAC 246-976-390, or as amended, of those calls occurring within the corporate city limits. (g) Within ten calendar days following the end of each month, the ambulance service shall provide the fire chief with a written report from the previous month that demonstrates whether the ambulance service has complied with the city's response criteria. The report will include the date of each incident, location, the time the call was received, the time of arrival of the ambulance at the incident scene, and the calculated response time. The report shall include a separate section that identifies all ambulance service responses that did not comply with the city's response criteria and description of the reasons for the delay of each such response. (h) Each ambulance service shall comply with all applicable state and local laws, rules, regulations, procedures, and protocols, including but not limited to those that are specific to 1 3 ambulances, ambulance service, ambulance equipment, ambulance personnel, EMS, ALS, and EMT and paramedic personnel. (i) Each ambulance service shall equip each of its in-service ambulances with a fully functioning AVL unit of a type and model that is acceptable to the city. City personnel shall monitor the location of each AVL unit and respective ambulance on a twenty-four-hour basis in order to ensure that the closest available appropriate ambulance is dispatched to any incident requiring an ambulance. The ambulance service shall be responsible for all costs associated with the purchase and maintenance of the AVL unit for each ambulance and are required to pay the city a monthly monitoring fee within ten calendar days following the end of each month of monitoring service. The monthly monitoring fee will be set forth in the city of Yakima master fee schedule adopted via resolution by city council. Any ambulance service contracting for dispatch services with the city shall be excluded from monthly AVL monitoring fees. Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval, and publication as provided by law and by the City Charter. (1) The secretary verifies prehospital EMS services . Verification is a higher form of licensure that requires twenty-four-hour, seven day a week compliance with the standards outlined in chapter 70 . 168 RCW and this chapter. Verification will expire with the prehospital EMS serv- ice ' s period of licensure . (2) To qualify for trauma verification, an agency must be a li- censed ambulance or aid service as specified in WAC 246-976-260 . (3) The following EMS services may be verified: (a) Aid service : Basic, intermediate (AEMT) , and advanced (paramedic) life support; (b) Ground ambulance service : Basic, intermediate (AEMT) , and ad- vanced (paramedic) life support; (c) Air ambulance service . (4) Personnel requirements : (a) Verified aid services must provide personnel on each trauma response including: (i) Basic life support : At least one individual who is an EMR or above; (ii) Intermediate life support : At least one AEMT; (iii) Advanced life support - Pramedic: At least one paramedic; (b) Verified ambulance services must provide personnel on each trauma response including: (i) Basic life support : At least two certified individuals - one EMT plus one EMR; (ii) Intermediate life support : One AEMT, plus one EMT; (iii) Advanced life support - Paramedic: At least two certified individuals - One paramedic and one EMT; (c) Verified air ambulance services must provide personnel as identified in WAC 246-976-320 . (5) Equipment requirements : (a) Verified BLS vehicles must carry equipment identified in WAC 246-976-300, Table A; (b) Verified ILS and paramedic vehicles must provide equipment identified in Table A of this section, in addition to meeting the re- quirements of WAC 246-976-300; (c) Verified air ambulance services must meet patient care equip- ment requirements described in WAC 246-976-320 . (7) Ground ambulance service response time requirements : Verified ground ambulance services must meet the following minimum agency re- sponse times for all EMS and trauma responses to response areas as de- fined by the department and identified in the regional plan: (a) To urban response areas : Ten minutes or less, eighty percent of the time; (b) To suburban response areas : Twenty minutes or less, eighty percent of the time; (c) To rural response areas : Forty-five minutes or less, eighty percent of the time; (d) To wilderness response areas : As soon as possible . (8) Verified air ambulance services must meet minimum agency re- sponse times as identified in the state plan. (9) Verified ambulance and aid services must comply with the ap- proved prehospital trauma triage procedures defined in WAC 246-976-010 . (10) The department will : (a) Identify minimum and maximum numbers of prehospital services, based on: (i) The approved regional EMS and trauma plans, including: Dis- tribution and level of service identified for each response area; and (ii) The Washington state EMS and trauma plan; (b) With the advice of the steering committee, consider all available data in reviewing response time standards for verified pre- hospital trauma services at least biennially; Certified on 2/20/2023 WAC 246-976-390 Page 2 8 (c) Administer the BLS/ILS/ALS verification application and eval- uation process; (d) Approve an applicant to provide verified prehospital trauma care, based on satisfactory evaluations as described in this section; (e) Obtain comments from the regional council as to whether the application (s) appears to be consistent with the approved regional plan; (f) Provide written notification to the applicant (s) of the final decision in the verification award; (g) Notify the regional council and the MPD in writing of the name, location, and level of verified services; (h) Approve renewal of a verified service upon reapplication, if the service continues to meet standards established in this chapter and verification remains consistent with the regional plan. (11) The department may: (a) Conduct a preverification site visit; and (b) Grant a provisional verification not to exceed one hundred twenty days . The secretary may withdraw the provisional verification status if provisions of the service ' s proposal are not implemented within the one hundred twenty-day period, or as otherwise provided in chapter 70 . 168 RCW and this chapter.
