Roll Call Present: Mayor Janice Deccio, presiding; Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Holly Cousens and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Rosalinda Ibarra Absent and Excused: Councilmember Danny Herrera 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Open Discussion for the Good of the Order A. Proclamations Draft Surgical Technologists Week proclamation MOTION: Byers moved and Cousens seconded to approve the proclamation. The motion carried by unanimous vote; Herrera absent. B. Appointments to Boards, Commissions and Council Committees Appointments to the Yakima Arts Commission Assistant Mayor Lund, Chair of the Council Nominating Committee, reported on the August 21, 2023 committee meeting. The Council Nominating Committee recommended the appointment of Susie Temple, Larissa Knopp, Vance Jennings, and Aaron Cohen to the Yakima Arts Commission. MOTION: Cousens moved and Byers seconded to approve the Council Nominating Committee's recommendation. The motion carried by unanimous vote; Herrera absent. 5. Council Reports Page 1 of 5 None. 6. Consent Agenda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion —see motion directly below.) MOTION: Lund moved and Byers seconded to approve the consent agenda. The motion carried by unanimous vote; Herrera absent. A. Approval of minutes from the August 15, 2023 City Council regular meeting, August 22, 2023 City Council study session, and August 28, 2023 City Council special joint meeting with the Yakima School District B, Set October 3, 2023 as the public hearing date to consider the Yakima Planning Commission's recommendation on one Comprehensive Plan Map amendment application C. Resolution awarding RFP 12306P and authorizing an agreement with Paymentus Corporation for merchant services RESOLUTION NO. R-2023-113, A RESOLUTION awarding and authorizing an agreement with Paymentus Corporation for RFP 12306P Merchant Services for the Utility Services Division D. Resolution ratifying an amendment to Grant Agreement R 22 56104 035 awarded by the US Department of Treasury for residential utility customer accounts affected by the COVID pandemic RESOLUTION NO. R-2023-114, A RESOLUTION ratifying the City Manager's execution of an amendment to Grant Agreement R 22 56104 035 for residential utility customer accounts affected by the COVID pandemic. E. Resolution adopting Yakima Transit's Transit Development Plan for 2023-2028 and Annual Report for 2022 RESOLUTION NO. R-2023-115, A RESOLUTION adopting Yakima Transit's Development Plan for 2023-2028 and annual report for 2022. F. Resolution authorizing an agreement with AT&T Corp for FirstNet cellphone services RESOLUTION NO. R-2023-116, A RESOLUTION authorizing an agreement with AT&T Corp (AT&T) for FirstNet cellphone services. G. Resolution authorizing an agreement with Ascent Foundations & More, LLC. for Project SW2646 DID #24 Improvements RESOLUTION NO. R-2023-118, A RESOLUTION authorizing an agreement with Gray & Osborne, Inc. to provide engineering services for City of Yakima Project WF2715 Primary Digesters and UASB Improvements at the Wastewater Treatment Plant. Resolution authorizing application for funding assistance for a Local Parks Maintenance project to the Recreation and Conservation Office (RCO) for resurfacing the tennis courts at Kissel Park RESOLUTION NO. R-2023-119, A RESOLUTION authorizing application for funding assistance for a Local Park Maintenance (LPM) project to the Recreation and Conservation Office (RCO). J. Resolution authorizing an amendment to Airport Lease Agreement with the Hertz Corporation dba Hertz Car Rental RESOLUTION NO. R-2023-120, A RESOLUTION authorizing an Amendment to Airport Lease Agreement with The Hertz Corporation dba Hertz Car Rental. K. Resolution authorizing an amendment to Airport Lease Agreement with BBold Advertising and Marketing RESOLUTION NO. R-2023-121, A RESOLUTION authorizing an amendment to Airport Lease Agreement with BBold Advertising and Marketing. 7. Public Comment Joe Daniels, City resident, expressed concerns regarding relations between public officials and members of the community and whether anything has been done to improve those issues. PUBLIC HEARINGS 8. Public hearing and Ordinance relating to the Transportation Benefit District (TBD); modifying the transportation improvements project list to be funded by the district City Engineer Bill Preston briefed the Council on the Transportation Benefit District project list. Mayor Deccio opened the public hearing. With no one coming forward to speak, Mayor Deccio closed the public hearing. After Council discussion, the City Clerk read the ordinance by title only. MOTION: Cousens moved and Lund seconded to pass the ordinance. The motion carried by unanimous vote; Herrera absent. ORDINANCE NO.2023-035, AN ORDINANCE relating to a Transportation Benefit District; modifying the transportation improvements to be funded by the district. DEPARTMENT ITEMS 9. Resolution authorizing an application to the Yakima County "Supporting Investments in Economic Development" (SIED) Program on behalf of Yakima Chief Hops for a project at South 3rd Avenue and Division Street Page 3 of 5 206 Economic Development Services Assistant Sy Ruiz briefed the Council on the SIED application for a project at South 3rd Avenue and Division Street. The City Clerk read the resolution by title only. MOTION: Cousens moved and Byers seconded to adopt the resolution. The motion carried by unanimous vote; Herrera absent. RESOLUTION NO. R-2023-122, A RESOLUTION authorizing the City of Yakima to support the grant and loan application of up to $750,000 from the Yakima County Supporting Investments in Economic Development (SIED) fund to install a traffic signal in the intersection of S. 3rd Avenue and Division Street for Yakima Chief Hops, in the City of Yakima. 10. Ordinance amending the City of Yakima Municipal Code 9.50 — Parking and Rules of the Road Utility Customer Services Manager James Dean briefed the Council on the proposed ordinance. The City Clerk read the ordinance by title only. MOTION: Cousens moved and Byers seconded to pass the ordinance with the additional change provided to Council. The motion carried by unanimous vote; Herrera absent. ORDINANCE NO.2023-036, AN ORDINANCE amending the City of Yakima Municipal Code 9.50 — Parking and Rules of the Road. 11 Resolution updating long-term downtown parking lot and resident permit parking fees in the Master Fee Schedule Utility Customer Services Manager James Dean briefed the Council on the proposed resolution. The City Clerk read the resolution by title only, MOTION: Byers moved and Cousens seconded to adopt the resolution. The motion carried by unanimous vote; Herrera absent. RESOLUTION NO. R-2023-123, A RESOLUTION updating long-term downtown parking lot and residential permit parking fees in the Master Fee Schedule. 12. Invitation for Regional Fire Authority Meeting Yakima Fire Chief Aaron Markham invited surrounding fire districts to an upcoming special meeting regarding the Regional Fire Authority. The meeting will take place at Fire Station 95 on East Nob Hill Blvd. on September 19, 2023 at 3:00 p.m. 13. Other Business MOTION: Brown moved and Byers seconded to add to a future meeting a discussion regarding fire district assumption of City fire services be considered along with a Regional Fire Authority in the anticipated study of this issue. The motion carried by unanimous vote; Herrera absent. Chief Markham provided an update on the status of the Request for Proposals (RFP) from consultants regarding the Regional Fire Authority study. Page 4 of 5 207 14. The meeting recessed for a break at 5:51 p.m. and reconvened at 6:00 p.m. A. Executive Session to review the performance of a public employee per RCW 42.30.110 (1)(g) MOTION: Lund moved and Byers seconded to adjourn to an executive session for 45 minutes to review the performance of a public employee per RCW 42.30.110(1)(g). The motion carried by unanimous vote; Herrera absent. At 6:50 p.m. Mayor Deccio announced additional time is necessary in executive session. MOTION: Lund moved and Byers seconded to stay in executive session until 7:00 p.m. The motion carried by unanimous vote; Herrera absent. Executive session was held at 6:05 p.m. and adjourned at 7:00 p.m. The Council business meeting reconvened at 7:01 p.m. MOTION: Lund moved and Byers seconded to request staff to prepare Mr. Harrison's contract with the amendments and bring back to Council. The motion carried by unanimous vote; Herrera absent. Adjournment MOTION: Lund moved and Cousens seconded to adjourn to the next Council study session on September 12, 2023, at 5:00 p.m. in the Council Chambers at City Hall.
