Roll Call Present: Mayor Janice Deccio, presiding;Assistant Mayor Soneya Lund (attending via Zoom) and Councilmembers Matt Brown, Patricia Byers, Holly Cousens (attending via Zoom), Danny Herrera and Eliana Macias (attending via Zoom and present at 5:35 p.m.) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Rosalinda Ibarra 2. Pledge of Allegiance Mayor Deccio led the Pledge of Allegiance. 3. Interpreter Services Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in Spanish. 4. Open Discussion for the Good of the Order A. Proclamations Draft National Health Center Week proclamation MOTION: Brown moved and Herrera seconded to approve the proclamation. The motion carried by unanimous vote, Macias absent. 5. Council Reports A. Downtown parking plan proposal endorsement letter from Downtown Association of Yakima (DAY) City Manager Bob Harrison described the parking plan proposal endorsed by the Downtown Association of Yakima and requested Council direction.After discussion, MOTION: Lund moved and Byers seconded to direct staff to prepare changes to the ordinance and policy as presented to City Council by DAY. The motion carried by a 6-0 vote; Cousens not voting due to technical issues at the time of the roll call vote. Later in the meeting, Councilmember Cousens stated she would have voted yes. 6. Consent Agenda Page 1 of 4 3 Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Byers moved and Brown seconded to approve the consent agenda. Resolution accepting Change Order No. 1 to City Contract 2023-065 with Prospect Construction, Inc. for Project WP2631 Primary Clarifier Rehabilitation RESOLUTION NO. Resolution to accept a Washington State Department of Natural Resources Grant for the development of an Urban Forestry Management Plan RESOLUTION NO. R-2023-100,A RESOLUTION accepting and authorizing an Agreement with the Washington State Department of Natural Resources for a grant through the Community Forestry Assistance program. J. Ordinance amending the 2023 Budget for the City of Yakima and making appropriations from unappropriated fund balances within various funds for expenditure during 2023 for various purposes (Second Reading) ORDINANCE NO. 2023-031,AN ORDINANCE amending the 2023 Budget for the City of Yakima; and making appropriations from Unappropriated Fund Balances within various funds for expenditure during 2023 for various purposes. 7. Public Comment Walt Ranta, City resident, spoke regarding changes to Yakima Avenue to make downtown more pedestrian and bicycle friendly, increase free parking spaces using diagonal parking, and to allow for wider outdoor seating for downtown restaurants. Kathy Kramer, City resident, CEO of State Fair Park, thanked Council for their support of the fireworks display at State Fair Park's 4th of July celebration and asked for continued financial support for this event. Joe Lewis Daniels, Jr., City resident, expressed concern about the relationships between local law enforcement agencies and the local black community and encouraged improving those relations. Curt Wilson, Downtown Association of Yakima (DAY), thanked Council for their support of the proposed changes to downtown parking and asked that Council include language to ensure funds are earmarked for downtown parking to maintenance needs. Joe Mann, City resident and downtown business owner, thanked Council for their support and cooperation in working to improve downtown parking. Mr. Mann also encouraged use of the funds generated by parking permits be directed towards maintenance of the parking lots. Patty Hoendermis, thankee Cou ciR I for their support of downtown parking plan. Andrew Reyes, City resi , sp§k regarding courts of limited jurisdiction and civil rights regarding small claims. DEPARTMENT ITEMS 8. Ordinance amending City of Yakima Municipal Code Chapter 1.92 relating to the Yakima Air Terminal for the purpose of allowing parking fees to be assessed in public parking areas and controlled parking areas, addressing failure to respond to parking citations, addressing vehicle impoundment as it relates to parking, and addressing enforcement personnel City Attorney Sara Watkins briefed the Council on the ordinance amending Chapter 1.92 relating to parking provisions at the Yakima Air Terminal. The City Clerk read the ordinance by title only. MOTION: Byers moved and Brown seconded to pass the ordinance. The motion carried by unanimous vote. Roll Call Present: Mayor Janice Deccio, presiding;Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Danny Herrera and Eliana Macias Absent and Excused: Councilmember Holly Cousens Staff: City Manager Robert Harrison, City Attorney Sara Watkins, and City Clerk Rosalinda I barra 2. Public comment (allow 15 minutes) None. 3. Executive Session pursuant to RCW 42.30.140 regarding collective bargaining Present for Executive Session: Mayor Janice Deccio, presiding;Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Danny Herrera, and Eliana Macias Absent and Excused: Councilmember Holly Cousens MOTION: Lund moved and Byers seconded to adjourn to Executive Session for 15 minutes to discuss collective bargaining per RCW 42.30.140. The motion carried by unanimous vote; Cousens absent. Executive Session was held and adjourned at 4:20 p.m. at which time the regular meeting reconvened. 4. Resolution amending the Memorandum of Understanding and Engagement between the City of Yakima and Mid-Columbia Fisheries Enhancement Group City Engineer Bill Preston briefed the Council on the proposed resolution amending an agreement with Mid-Columbia Fisheries Enhancement Group and noted that no additional funding is associated with this amendment. The City Clerk read the resolution by title only. MOTION: Lund moved and Byers seconded to adopt the resolution. The motion Page 1 of 3 7 carried by unanimous vote; Cousens absent. RESOLUTION NO. R-2023-102,A RESOLUTION authorizing acceptance of an Amendment and Memorandum of Understanding and Engagement between the City of Yakima and Mid-Columbia Fisheries Enhancement Group (MCFEG). 5. Human Resources Budget Presentation Director of Human Resources Connie Mendoza presented potential budget reductions and impacts to services from the Human Resources Department. 6. Finance Department Budget Presentation Director of Finance and Budget Jennifer Ferrer-Santa Ines, Financial Services Manager Kimberly Domine, and Purchasing Manager Kristine White presented potential budget reductions and impacts to services provided by the Finance Department. 7. Legal Department Budget Presentation City Attorney Sara Watkins presented potential budget reductions and impacts to services within the Legal Department. • 8. Strategies regarding use of opioid pharmacy and rri iufacturer settlement funds Finance Director Jennifer Ferrer-Santa Ines reportedCity of Yakima is expected to receive $1,302,988 over a period of 17 years from the Opioid Pharmacy and Manufacturer Settlement. City Attorney Sara Watkins described the allowed uses under the settlement agreement which include treatment, prevention, and other strategies. City Prosecutor/Senior Assistant City Attorney Cynthia Martinez presented a proposed strategy of utilizing some or all of the funding to enhance the Community Diversion Program (CDP)to better meet the needs of participants. The proposal consists of the following strategies: • Strategy D2 -Address the needs of criminal justice involved persons by expanding the CDP current part-time case manager to a full-time case manager position. • Strategy Al -Treat opioid use disorder by establishing a grant program for participants to access funds for mental health treatment implicated by substance abuse issues. Megan Tweedy (Yakima resident) and Alicia Stromme Tobin (Executive Director of Safe Yakima Valley) encouraged Council to utilize the funds on prevention efforts to help others from becoming addicted and lessen the stigma of substance use disorders. Tony Courcy spoke on unrelated matters. After discussion, it was Council consensus to explore additional options. Council requested that staff research what other local communities are doing with their settlement funds and conduct a future roundtable discussion to include treatment providers and non profits, as well as additional information about the Yakima Health District Harm Reduction Program. 9.
