YAKIMA CITY COUNCIL
June 20, 2023

5:30 p.m. Regular meeting conducted in person and virtually via Zoom
1. Roll Call
Present: Mayor Janice Deccio, presiding, and Councilmembers Matt Brown, Patricia Byers,
Danny Herrera and Eliana Macias (attending via Zoom)

2. Pledge of Allegiance
Mayor Deccio led the Pledge of Allegiance.
3. Interpreter Services
Mayor Deccio introduced Jorge Villasenor who announced interpreter services are available in
Spanish.
4. Open Discussion for the Good of the Order
A. Presentations/ Recognitions/ Introductions
i. Recognition of retiring City Clerk Sonya Claar Tee
City Manager Bob Harrison recognized City Clerk Sonya Claar Tee on her retirement and 30+
years of service to the City. Sonya thanked Council, senior staff and former staff for the
opportunities she's had during her career. Council presented Sonya with a retirement clock for
her service.
ii. Recognition of Eisenhower athletic trainers Joel Buffum and Josh
Holliday
Acting City Manager Rosylen Oglesby recognized Eisenhower athletic trainers Joel Buffum
and Josh Holliday for performing life-saving measures on a Napavine runner who collapsed at
the finish line during a state track and field championship. Mayor Deccio presented Mr. Buffum
and Mr. Holliday with a City Apple Award.

6. Consent Agenda

Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there
were any additions or deletions from Council members present. There were no changes. The
City Clerk read the Consent Agenda items, including resolutions and ordinances, by title.
(Items on the Consent Agenda are handled under one motion without further discussion—see
motion directly below.)
MOTION: Byers moved and Brown seconded to approve the consent agenda. The
motion carried by unanimous vote, Lund and Cousens absent.
A. Approval of minutes from the June 6, 2023 City Council regular meeting and June
13, 2023 City Council study session
B. Approve payment of disbursements for the period May 1-31, 2023
C. May 2023 Investment Transaction Report
D. Project Completion and Contract Acceptance with Total Site Services LLC for the

E. Resolution authorizing an amendment to contract with the United States of America

RESOLUTION NO. R-2023-084,A RESOLUTION amending the contract with the United

F. Resolution authorizing application for and, if awarded, to accept grants from the

RESOLUTION NO. R-2023-087,A RESOLUTION amending the Interlocal Agreement with
Yakima County to adopt the 2023 Yakima County Solid and Hazardous Waste Management
Plan.
I. Resolution amending a contract with Opportunities Industrialization Center of
Washington to provide transportation between the Henry Beauchamp Jr.

RESOLUTION NO. R-2023-088, A RESOLUTION authorizing an amendment to City
Contract 2019-033 to provide for direct transportation between the Henry Beauchamp Jr.
Community Center(HBCC)and Franklin Pool.
J. Resolution authorizing an amendment to grant contract 22-56104-035 with the
Department of Commerce to provide additional funding to private and public utilities
to help address residential customer arrearages as a result of the COVID pandemic
RESOLUTION NO. R-2023-089,A RESOLUTION authorizing a Grant Agreement
Amendment with the Washington State Department of Commerce for the Federally funded
Residential Utility Arrearages assistance program.
K. Resolution authorizing an agreement with Preferred Industrial Electric LLC for the
Yakima Rotary- City Park Light Projects 2751, 2752 and 2753
RESOLUTION NO. R-2023-090,A RESOLUTION authorizing an agreement with Preferred
Industrial Electric LLC for the Yakima Rotary- City Park Light Projects 2751, 2752 and 2753.
L. Resolution authorizing an agreement with Cortez Fencing for the construction of
fencing along Naches Parkway
RESOLUTION NO. R-2023-091,A RESOLUTION authorizing an agreement with Cortez
Fencing, LLC for the Naches Avenue Parkway Fencing Project 2764.
M. Ordinance updating Classification and Compensation Plan for City Employees
Section 2.20.100
ORDINANCE NO. 2023-024,AN ORDINANCE relating to City personnel; adopting a
classification and compensation plan for City employees to be effective July 23, 2023; and
repealing all preceding pay ordinances in the City of Yakima Municipal Code.
7. Public Comment
Jeanna Hernandez, resident, asked Council to review who is setting policy for the City of
Yakima and provided comments regarding downtown parking and perception of late additions
to Council agendas.
Tony Courcy, resident, spoke regarding several subjects.
Andrew Reyes, resident, spoke regarding property rights of businesses to file claims in small
claims court and civil rights violations.
PUBLIC HEARINGS
8. Public meeting to receive comments on the 2022 Consolidated Annual Performance Evaluation
Report(CAPER) regarding HUD funded housing and supportive services
Community Development Director Joan Davenport briefed Council on the public meeting
regarding the 2022 Consolidated Annual Performance and Evaluation Report (CAPER).
Mayor Deccio opened the public hearing and, with no one coming forward or calling in to
speak, closed the hearing.
9. Public hearing to consider: A) Resolution adopting the Six-Year Transportation Improvement
Program for the period of 2024 through 2029, and to amend the Transportation Systems Plan
2040; and B) Resolution amending the Yakima Urban Area Comprehensive Plan Capital

Facilities Element
City Engineer Bill Preston briefed Council on the public hearing.
Mayor Deccio opened the public hearing and, with no one coming forward or calling in to
speak, closed the hearing.
The City Clerk read both resolutions by title only.
MOTION: Byers moved and Herrera seconded to adopt both resolutions. The motion
carried by unanimous vote, Lund and Cousens absent.
RESOLUTION NO. R-2023-092,A RESOLUTION adopting the Six-Year Transportation
Improvement Program(TIP)for the period of 2024 through 2029 for transportation
improvements to arterial streets in the City of Yakima and amending the Transportation
Systems Plan 2040.
RESOLUTION NO. R-2023-093,A RESOLUTION to amend the Yakima Urban Area
Comprehensive Plan Capital Facilities Element to incorporate the Six-year Transportation
Improvement Program(TIP)for the period of 2024 through 2029.
10. Public hearing and Ordinances to consider the Yakima Planning Commission's
recommendation regarding 2023 proposed text amendments to Titles 14, 15 and 16
Planning Manager Joseph Calhoun briefed Council on the text amendments to Titles 14, 15
and 16.
Mayor Deccio opened the public hearing and, with no one coming forward or calling in to
speak, closed the hearing.
The City Clerk read the ordinances by title only.
MOTION: Byers moved and Brown seconded to pass all three ordinances. The motion
carried by unanimous vote, Lund and Cousens absent.
ORDINANCE NO. 2023-025,AN ORDINANCE amending Yakima Municipal Code Title 14—
Subdivisions to incorporate text amendments recommended by the City of Yakima Planning
Commission.
ORDINANCE NO. 2023-026,AN ORDINANCE amending Yakima Municipal Code Title 15—
Yakima Urban Area Zoning Ordinance to incorporate text amendments recommended by the
City of Yakima Planning Commission.
ORDINANCE NO. 2023-027,AN ORDINANCE amending Yakima Municipal Code Title 16—
Administration of Development Permit Regulations to incorporate text amendments
recommended by the City of Yakima Planning Commission.
DEPARTMENT ITEMS
11. Update on condition of structures on W Nob Hill Blvd in the Vicinity of S 30th Ave
Supervising Code Inspector Tony Doan reported on the condition of some vacant structures on
W. Nob Hill Blvd in the vicinity of S. 30th Ave. He stated that many violations have been
abated and permits have been applied for to correct remaining issues. Doan also provided

information on how vacant property issues may be addressed.
12. Ordinance amending City of Yakima Municipal Code Chapter 6.08 Drug Related Offenses to
adopt provisions of SB 5536 ("Blake Fix")which regulates possession of counterfeit,
controlled, and legend drugs, drug paraphernalia, and drug use in public, repealing YMC
6.08.060 and RCW 69.50.425, RCW 69.41.070, YMC 6.08.030, YMC 6.08.210, and YMC
6.08.300 as housekeeping measures.
Senior Assistant City Attorney Cynthia Martinez and Police Chief Matthew Murray reported on
the "Blake Fix," which passed the Washington State Legislature and was signed by Governor
Jay Inslee on May 16, 2023, with the provisions relating to use and possession of drugs taking
effect on July 1, 2023.
The City Clerk read the ordinance by title only.
MOTION: Brown moved and Byers seconded to pass the ordinance. The motion carried
by unanimous vote, Lund and Cousens absent.
ORDINANCE NO. 2023-028,AN ORDINANCE concerning Title 6, Public Safety and
Morals; amending the City of Yakima Municipal Code Chapter 6.08 Drug Related Offenses to
adopt provisions of SB 5536 ("Blake Fix")which regulates possession of counterfeit,
controlled, and legend drugs, drug paraphernalia, and drug use in public, repealing YMC
6.08.060 (Loitering for purposes for drug activity), and RCW 69.50.425, RCW 69.41.070,
YMC 6.08.030, YMC 6.08.210, and YMC 6.08.300 as housekeeping measures.

MOTION: Byers moved and Brown seconded to adjourn to a Council study session on
June 27, 2023, at 4:00 p.m. at the Henry Beauchamp Jr. Community Center. The
motion carried by unanimous vote, Lund and Cousens absent. The meeting adjourned at 6:38
p.m.
