AN ORDINANCE amending the Yakima Municipal Code to provide that members of the
Parks and Recreation Commission shall all be residents of the City and
adding that requirement to Chapter 1.35, Park and Recreation
Commission, and specifically section 1.35.010.
Section 1. Section 1.35 of the City of Yakima Municipal Code is amended to read as
follows:

PARK AND RECREATION COMMISSION

1.35.010 Created — Members.
1.35.020 Terms of office.
1.35.030 Organization— Meetings.
1.35.040 Functions and duties.
1.35.010 Created — Members.
There is created a park and recreation commission to consist of seven members
who shall be appointed by the city council, who shall serve without compensation
and who shall all be residents of the City. The director of public works shall be an
ex officio member of and secretary of such commission, but shall not be entitled
to vote on any matter voted on by the commission.
1.35.020 Terms of office.
A. Appointments made to membership on the commission for terms of office
pursuant to YMC 1.35.020 prior to its amendment by this section shall be
adjusted as follows: the two terms set to expire December 31, 2006, shall be
extended to June 30, 2007; the two terms set to expire December 31, 2008, shall
expire June 30, 2008; and the three terms set to expire December 31, 2010, shall
expire June 30, 2009.
B. Upon the expiration of respective terms of office for respective members
referred to in subsection A of this section, successors shall be appointed for four -
year terms ending on June 30th of the applicable year. Upon the resignation of
any member, the city council shall appoint a new member to serve the unexpired
four -year term. Any member absent from three consecutive regular commission
meetings shall hereby be disqualified to continue as a member of the
commission. The commission shall recommend removal by the city council and
shall request appointment of a replacement to serve out the balance of the
disqualified member's term.
1.35.030 Organization— Meetings.
During January of each year, the commission shall elect from its membership, a
chairman, vice - chairman and such other officers as the commission members
deem necessary to organize and carry out the functions and duties of the
commission. The commission shall adopt a time for holding regular monthly
meetings, and regular monthly meetings shall be held unless cancelled by notice
from the secretary of the commission. Special meetings may be called by the

chairman to be held at any time pursuant to notice of such meeting given as
required by law.
1.35.040 Functions and duties.
A. The commission generally shall serve in an advisory capacity to the city
council, city manager and director of public works concerning formulation of
policy and plans for development, management and operation of the city parks
and recreation program.
B. In addition to the general duties specified in subsection A of this section, the
commission shall advise and assist the city council, city manager and director of
public works in specific areas including, but not limited to, the following:
1. Reviewing of parks and recreation budgets;
2. Promoting park and recreation programs to the community;
3. Setting standards for park maintenance;
4. Setting goals for short-term and Tong -term future of the city park system;
5. Serving as citizens' input concerning parks and recreation, generally;
6. Monitoring and evaluating the park system.
Such duties shall be coordinated to assist the city in carrying out a program of
recreation for the general welfare of the people of the city, and to assist the
division of parks and recreation in performing its duties as required by law or by
the city manager.
Section 2. This ordinance shall be in full force and effect 30 days after its passage, approval
and publication as provided by law and by the City Charter.

SUMMARY EXPLANATION:
On February 18, 2010 the City Council Rules and Procedures Committee reviewed the
residency requirements of all boards /committees/commissions to determine if changes should
be made to residency requirements. A recommendation was made to the full Council on
March 2, 2010, and City Council voted to direct staff to prepare the ordinances for
consideration.
Based on direction from the City Council, the staff respectfully requests consideration of an
® ordinance reflecting the city residency requirement for members of the Parks and Recreation
Commission.
This is basically a housekeeping measure; current members of the Parks and Recreation
Commission all live within the city of Yakima.

STAFF RECOMMENDATION: Staff respectfully requests the City Council to pass the
ordinance.
