EXPLANATION: On October 28, 2008, Council held a study session to discuss and generate
ideas about how to improve the City's anti - graffiti program. A list of 43 suggestions and 14
general comments came out of the session (see attached minutes and list of ideas).
Subsequently, the list of suggestions was divided between those that addressed improving our
efforts to remove graffiti which were forwarded to the Council's Neighborhood Development
Committee; and those that focused on enforcement of anti- graffiti laws. This second group of -
23 suggestions is being reviewed by the Council's Public Safety Committee with
recommendations expected in the coming weeks. Today's discussion is focused on the
recommendations of the Council's Neighborhood Development Committee concerning the
• City's anti - graffiti removal program and includes proposals for the City's Office of Neighborhood
Development Services (ONDS) and Public Works.
ONDS: Since 1999, the City of Yakima Office of Neighborhood Development Services (ONDS)
" has used volunteers and donated paint to paint over graffiti on City right of way, alleys, and
private residential properties, in ever increasing amounts.

BOARD /COMMISSION /COMMITTEE RECOMMENDATION: The Neighborhood Development
Committee has discussed various solutions at meetings that have occurred since the October
study session. Although too few Committee members were present to achieve a quorum at
their June 10th meeting, Chairman Bill Lover was in favor of these proposals.

Challenges with the current ONDS program include:
1. A patch work result caused by using unmatched paint;
2. We have assumed responsibility for maintaining private' property and have created a
, certain sense of entitlement; -
3. , Our limited resources no longer allow us to keep' up; .
. 4. Our past response to graffiti on private property has . been "piece meal," without a
. coordinated plan. , . •
Proposed ONDS solutions:
1. Provide occupants of private residential property with a one -time limited supply of the
. latest graffiti removal agents together with instructions and resupply sources (to be
funded with current CDBG graffiti budget); , ,
2. Focus City volunteer crews in residential alleys to better utilize the single color donated
paint (supervision will continue to be funded with current CDBG graffiti budget);
• 3. Use a contractor to soda blast and /or paint over graffiti on public right of way, i.e. signs,
park property, and so on, and /or clean as necessary with the latest graffiti removal
agents (to be funded through Public Works from the general fund).
Public Works: Various, divisions within Public Works manage graffiti abatement on
infrastructure such as signs, electrical boxes, bus stops, park structures and refuse bins. This
new task requires Public Works to better understand the nature of the challenge, resources
. required and outcomes desired. With that in mind, Public Works proposes to put for bid a trial,
not to exceed $25,000, Project Call to soda blast down to bare concrete a finite number of
public concrete surfaces that ONDS has historically abated and establish an on -call system for
graffiti .abatement on those same structures:
Public Works is working with Purchasing to place this project call out to the public in' the very
near future. The information gathered from this experience will be used to evaluate program's
efficacy. An appropriate annual budget for the 2010 budget year for Council deliberation' could '
' , then be established: The source of funds for this limited project is not defined 'at this time.
Both the Streets and Parks Divisions have experienced a total of nearly $500,000 in cuts for
• 2009, and therefore, there are no appropriated amounts available. Other options would be for
Council to direct staff to not perform some tasks in the remaining 2009 budget year; or,
alternatively, use unobligated, unappropriated budget reserves to fund this $25,000 project. ' _
Staff recommends using Street Division reserves as those funds are at a healthier level than
Parks.
Staff requests Council authorization to begin using these proposed solutions to implement
graffiti removal.

2. Yakima graffiti program abatement and enforcement activities
Bill Cook, Director of Community and Economic Development, opened the
discussion by introducing various people and groups represented at the meeting. .
He noted there are two objectives of the study session:
1) Bring Council up to date on current anti - graffiti activities
2) Discuss what is being done or has been tried in other communities
Mr. Cook pointed out that although only one division within the City budget actually
has a line item for graffiti abatement, Office of Neighborhood Development
Services (ONDS), there are actually many departments and divisions involved. He
gave a PowerPoint presentation that depicted that fact. Some interesting data he
obtained from the City of San Antonio's web page that puts graffiti in perspective;

• Suburban males commit approximately 50% of graffiti vandalism (pre -teen
to early 20's)

Mr. Cook outlined the various divisions involved and to what level:
Code Enforcement is where we learn about a graffiti situation through citizen
complaints. We are not out looking for graffiti, but respond to complaints. The
Codes Department receives complaints over the hotline. Graffiti complaints are
referred to ONDS, and the complaints about substandard or boarded up vacant
buildings go to the Community Review Board (CRB). Only about .17 FTE of Codes
staffing goes into actual graffiti cases. Between 2003 -2007 there were 1,241
graffiti complaints; and only one citation was issued. How do we improve our
success? Going through the CRB is a slow process, if there was a way to

separate out the graffiti element and handling it with a citation, may speed up the
process.
Office of Neighborhood Development Services is where many of the complaints
end up. They paint over graffiti using donated paint. They provide permission
slips, maintenance equipment and vehicles for volunteers. They wprk primarily on
residential property in low and moderate - income neighborhoods. Currently have
1,080 permission slips on record, the result of someone calling and asking us to
paint out the graffiti on their property. Many of the sites get hit over and over
again. In 2008 ONDS spent about $2,000 on materials and supplies, and about
9,600 total hours (largely volunteer). There is only one FTE to supervise the
volunteer crews. The level of graffiti in the community is not decreasing, however,
ONDS appears to be able to respond more quickly than in the past. The patch
method is not an ideal solution but is economical. Property owners are getting
frustrated with repeat incidences and are less likely to take care of their own
property. To improve the success of the graffiti situation, we need to reinforce the
responsibility of the property owner to paint over the graffiti. We need to
concentrate our valuable volunteer labor on city alleys.
Public Works removes graffiti from parks, bus stops, street signs, signals, and
refuse bins using approximately 4,900 man hours and $22,000 annually. This is a
very responsive, proactive effort.
Police Department provides alternatives to gang involvement, handles graffiti
enforcement in cases of crimes in progress, investigates graffiti cases, and
oversees trustees that paint out graffiti utilizing a $10,000 grant (expires iri 2009).
Gang graffiti is on decline, but tagging is a rising percentage of all graffiti.
Improving success would require changing state law to allow�more aggressive
prosecution and tougher sentencing, reopening the County graffiti pod, continue to
use trustees to paint out graffiti and find a new funding source to replace the
$10,000 grant.
Leqal Department prosecutes all criminal and contested civil infraction graffiti
• related code violations. We are obtaining convictions but defendants are not
paying restitution or completing court ordered community service hours. To
improve success.would require amending the state law to establish parental
responsibility for juvenile offenders and a better tracking system.
The City's current total cost for managing graffiti:

1. Consider coating all surfaces that are included in capitol projects and include that cost
in the project budget (Michael Morales).
2. Focus ONDS on alleys and give the responsibility for private property back to the
property owner (Michael Morales).
3. Create a dedicated crew at Public Works for public facilities and ROW (Michael
Morales).
4. The Chamber is concerned about the prospect of control of paint sales. We don't think
it is a viable option and we feel strongly that it won't work (Mike Morrisette).
5. Launch an emphasis campaign_with businesses and maybe homeowners, with a' "you
can" approach. We tell them what they CAN do: 1. Paint it out yourself or hire
someone to do it; 2. City would provide paint and supplies to victim for them to paint it
themselves; 3. City is complaint driven due to lack of funding. Build partnerships where
City takes care of ROW and let everyone know what the options are for private property.
Try to get everyone to work together to build a "graffiti free zone." 4. Tell citizens that it
is okay to complain. We need to know where the graffiti is and we will work with you. 5.
Graffiti pod is a sound idea. Lets figure out how to make it work. Use emphasis patrols
® to increase the .number of referrals. 6. CSC will be happy to participate in whatever
way the city wants to go (Mike Morrisette).
6. Figure out how to respond in 24 -hours as often as possible (Carol Holden).
7. Educate property owners about the correct. way to remove graffiti (CDY). -
8. We need to get it reported instead of just covering it up (Tarin Miller).
9. Ideal solution for Graffiti Busters: Buy the paint..Pick a Yakima alley color. When you
get the permission slip paint the entire surface with that color. When you patch it will
blend right in. With the right color the graffiti is less noticeable even before it is covered.
ONDS will increase their coverage by 50% with just that change (Nathan Kwak).
10. Instead of hiring and training employees to handle graffiti, ask for bids from private
businesses.. If you don't like it, you don't have to use it (Nathan Kwak).
11. We either need to privatize or have a dedicated crew (Kathy Coffey).
12. Crews would need specialized training (Chris Waarvick).
13. The city needs to concentrate on public facilities and 'ROW (Rick Ensey).
14. If there are some people that can't do their own due to physical or financial issues, have
a few volunteers, have some paint and brushes (Rick Ensey).
15. We need to look at the Community Review Board and maybe revamp it a little bit. It is
taking way too long (Rick Ensey).
16. Regarding merchants. and spray paint: No paint police. We.can ask for their help but
often it is an adult buying the paint or it is stolen. We can't hold merchants responsible

17. Don't disregard the private sector idea. I like the idea of going out for bid probably more
than starting.another city crew (Bill Lover).
18. We have to get our own house in order. We had an instance recently where city
departments wouldn't work together to share equipment. We have to get paint out •
(ONDS) and law and justice together to address this problem (Micah Cawley).
19. We need to make this an ongoing thing. When we're out painting, I like the idea of
going to a certain color in our alleys. If we could get businesses to go along with that, it
would behoove us to go after that kind of backing. With the way we're doing it, are we
solving the problem or creating a new canvas for people to work on (Norm Johnson)?
20.About ten years ago, the Convention Center adopted the alley behind them and it was
their responsibility to paint it out within 24- hours. That is something we might want to
look into for businesses that abut an alley. Maybe that is something the Chamber of
Commerce could help with (Kathy Coffey).

6: Regarding holding parents responsible: The original draft of the omnibus gang •
legislation passed earlier this year would have allowed victims to get restitution from
juveniles. When juveniles are found to be responsible parents can also be held
responsible under a civil action. Some�states are doing this more and more. It comes
down to a policy decision; do we want to hold parents responsible or do we want to give
them other tools to help them deal with their children (Cynthia Martinez).
7. Regarding making graffiti a victimless crime: I don't support that because you lose the
judge's ability to order restitution upon conviction (Cynthia Martinez).
8. The biggest problem is�not being able to catch them. The crime is too quick (Cynthia

9. Youth should know there are options to being in trouble. Education is important (Carol
Holden).
10.Take the information to the schools to reach kids and parents (Carol Holden).
11. Reactivate the block watch program (Carol Holden).
12. Coordinated effort would include driving them to a graffiti site and supervising them
painting it out. They would rather just sit in jail. If there is someway we can meld the
two components, of punishment together it would be very effective (Judge Woodard).
13. I second Judge Woodard's assertion that offenders need to be out on the street painting
out graffiti. The embarrassment of having to paint out in their own areas is a deterrent
(Jared Boswell).
14. Regarding making parents responsible: I usually need their help in identifying the
signatures. We might not get that help if they know they can be held responsible (Tari�
Miller).

16. The most benefit would be to take the taggers off the street. They are fewer in number

21. Would like to see the people that are creating the graffiti clean it up. Make sure the
public realizes what is going on when they see the offender cleaning it up. Maybe some

22. Continue lobbying Olympia for tougher juvenile laws (Rick Ensey).
23. Regarding prosecution and enforcement: We lack prosecution. Investigate the citation
possibility. Juveniles can be ticketed. Codes and police can both issue citations (Bill
