JUNE 16, 1969 • .
The City Council met in regular session, Mayor Larson presiding, Counciimen•Brown, Lambert,
McNeice and Robinson, City Manager McMicken City Attorney Andrews present on roll'call.
Councilmen'Keith. and Kurbitz- absent on roll call. It was MOVED by Brown, seconded by
. Lambert - that Councilmen Keith•and•Kurbitz be'excused from this meeting': carried, Brown,
• Lambert, Larson, McNeice and Robinson voting aye by voice vote.
The Invocation was given by City Manager McMicken.• .
The Minutes of the regular meeting of June 9, 1969, having been duly certified accurate by ,
two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson ,
declared said minutes approved as recorded.
Petition. No. 636, having been filed with.the City Clerk' on June 10, 1969, by Mr.' &
Charles Meeks & Others, requesting improvement of property by the construction of alley
pavement between S. 16th Avenue and S. 17th Avenue, from MacLaren Street to Lombard Lane,
it was MOVED by McNeice, seconded by Brown that said Petition be referred to the City •
Manager and Staff for study and recommendation: carried, - Brown, Lambert, Larson, 'McNeice
and Robinson voting aye by voice vote. Keith and Kurbitz absent.' .
Petition No. 637, Notice of Intention to Commence Annexation•Proceedings, having been filed
with the City Clerk on June 13, 1969, by Lawrence E. Deardorff,- President of Good Samaritan
Nursing. Home, Inc:, requesting annexation of property'in the vicinity of N. 16th and Jerome
Avenues; and Mr. Deardorff being present, it was MOVED by McNeice, seconded by Brown that
this date be set as'the time for a meeting .with the initiating party who .signed the Notice
of Intention to Commence Annexation Proceedings dated June 13, 1969: carried, Brown, Lam -
bert, Larson, McNeice and Robinson - voting aye'by voice.vote. Keith.and Kurbitz absent.
• Mr. Deardorff, stating that they are Willing to assume the City's existing indebtedness,
it was duly moved, seconded and passed that the annexation proposed by petition no. 637
(Notice of•Intention to Commence Annexation Proceedings) be•accepted by the City of Yakima
and that the •area sought to be annexed be required to assume the City's existing indebted
ness. The above Motion was made by McNeice, seconded by Brown and it carried: Brown,
Lambert, Larson, McNeice and Robinson voting aye by voice vote. •Keith and Kurbitz absent.
City Manager McMicken explained that this is a new Notice of Intention, deleting one parcel •
of_ property. -that was Listed •on the previous, Not:ice:of Intentiion. No, • 635.., .which was filed

. and Kurbitz absent.. City- Manager.McMicken explained that the owner of this property, Mr.
Spahn, had purchased.his home in 1964 with the sewer installed and had. no knowledge of the
• unpaid Mr. McMic.ken further• explained, that this matter had• been.brought befor
II the Councile about a year ago, and. it had been the Council's instruction to have the Staff•
contact. the State Auditor's Office to• find out'if there is some way a change can be made
in this assessment roll. He stated that the advice received was somewhat vague, because
it is:not: procedure. Mr•. McMicken indicated that the Staff :is.recommending de-
. leting: this: parcel-. from the Assessment because. the Council felt previously that Mr.
Spahn. had been the victim of . an uniisual. set of circumstances .and there seems. to-.be no • •
other way of doing' it.. He explained that .the deleted assessment. will be made up out of
the Water -Sewer Fund.
ORDINANCE - NO, 1139,' AN ORDINANCE deleting a parcel of property from the assessment roll
for Loca L ; Improvement District No: 915; providing for the refund of an assessment install-
ment payment and the payment•of -the entire. balance of such assessment; and amending-

City Manager McMicken referring to the matter of .the extension of terms of office for mem-
bers of the Board of Trustees of the Yakima Regional Library, it was MOVED by Robinson, .
. seconded by Brown that Resolution No.. D -1355' extending the terms' of office for-members of
the Board of Trustees of the Yakima Regional Library; be passed as read.:• carried, Brown,
Lambert, Larson, McNeice and•Robinson voting -.aye on roll call. Keith and Kurbitz absent.
City Attorney Andrews. explained that when. there was -a five -man Board, the terms were five
years and now there is a seven -man Board and the terms should.be seven years, and this
Resolution merely fixes the proper terms for the Board members. ,

City Manager McMicken referring to the City Engineer's. revised final`estimate on the com-
pletion of L.I :D. No. North:56th Avenue & Summitview Avenue Arterial Improvement,
. recommending that. the work be. accepted and final payment made,'it was MOVED Robinson;••
seconded' by Lambert, that the report of the City Engineer. dated •June •l.l, 1969, with respect
to the completion of the work on said project, be approved,•the work -be accepted and pay -,

City Manager explained that Mr Don Belding, operator the the Red Apple Motel-, has
requested permission to install a private direct -lin• telephone at.the Yakima Municipal
Airport and space is available' for such installation:• • Mr McMicken requesting•.authoriza-
tion to grant a permit as• requested for the convenience of airline passengers and•others,
and requesting further authorization' to grant permits•to others' similarly situated who may
apply, it was MOVED by Robinson, seconded by Brown that Resolution No. D -1356 authorizing
the granting of•permits motels and hotels for the•installation of private' direct -line
telephones at the Yakima Municipal Airport, be passed as read: carried, Brown, Lambert•,
Larson, McNeice and'Robinson voting aye by voice vote. Keith and Kurbitz absent. Discus-
sion•brought out that the permit states that the Grantee shall pay to the City the amount
of $15 each month and any such installations will •be treated•in the same manner as other
fixed base operators at the Yakima Municipal Airport with the monies going into the,Air-

City Manager McMicken referred to the request for authorization execute an extra work order
for installation of the Water Transmission Main and asked Public Works Director John Mayo
to report on this-matter. Mr. Mayo explained that Riverside Construction, Inc., & Lord
Bros. Contractors, Inc., is presently installing the main water transmission line from the
water treatment plant to the City in accordance with a contract, Schedule A, awarded upon
a call for bids. He further explained that at the time of awarding of this bid, the State
Highway Department was designing an interchange at 40th Avenue and Fruitvale Boulevard,
and there were some details regarding the balance of the construction of this transmission
main that,,made it impossible to have a final design at the time of the first call for bids.
Mr. Mayo stated that at that time it was contemplated that when the final design, Schedule
B, was ready, a separate contract would be awarded and there would be a second call for
bids. He further stated that the State Department has now finished their design, that
there isn't time to go out for another call for bids, that HUD has agreed that the present
contractor can be given an extra order, and the contractor has agreed to do the work at a
reasonable- cost. Mr. Mayo indicated that a state of emergency exists which justifies the
awarding of an extra work order to the present contractor, without calling for further
bids, and recommended that authorization be given to execute an extra work order as re-
quested. Councilman Robinson stated that there are certain bid requirements to be follow-
ed and indicated that he feels the regular order of calling for bids should be followed on
a project costing - $175,000. After due discussion, it was MOVED by Brown, • seconded by
McNeice that Resolution No. D -1357 authorizing the execution of an extra work order for
the installation of the water transmission main, be passed as read: carried, Brown, Lam-
bert, Larson and McNeice voting aye on roll call.. Robinson voting nay on roll call.

RESOLUTION NO. D -1357, A RESOLUTION authorizing the hiring of additional work and labor
and the purchase of additional materials from Riverside Construction, Inc., & Lord Bros.
Contractors, Inc., a joint venture, without calling for further bids, in connection with
an existing public improvement project consisting of the installation of the main water
transmission line for the City.
City Manager McMicken referred to the matter of authorization to give notice of termina-
tion of lease with Alex Berkes, a fixed base operator at the Yakima Municipal Airport,
stating that he had received a copy of a letter from the Airport Manager to Alex Berkes,
and a few days later the same type of letter from the Airport Manager to James Sellers,
notifying them that they are overdue in their rent on their operations at the Airport.
Mr. McMicken reported that Alex Berkes owes past due rent of $100 per month from September,
1968 through June, 1969, which makes a total of $1,000, and Jim Sellers owes $24.85 per
month, or a total of $124.25 for the months of February, 1969, through June,.1969, and is
requesting_ authorization to notify them of the time of termination of lease if the back
rental is not paid. Council members question the matter of letting this matter go this
long. .: •Ci Manager McMicken explained that in the case of Alex Berkes, in past years he
had always gone several months through the winter without paying the monthly rental and
then when -the spraying business progressed in the spring, he always paid up in full the
back rental, but this year has not done so. After due discussion, it was MOVED by Robin-
son, seconded by Lambert that authorization be given to give notice of termination of
lease with Alex Berkes and James Sellers, fixed base operators at the Yakima Municipal
Airport: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote.

City Manager McMicken referred to his Report #58, Snow and Ice Removal Costs -- 1968 -69,
stating that the report is self - explanatory and one asked for by Council members previous-
ly. Public Works Director John Mayo, reported that although there have been other winters
with as much snow fall, prices have gone up, and this past winter the snowfall seemed to
land heavier on weekends, which made the removal costs more because overtime had to be
paid.
City Manager McMicken referred to the following street improvement projects and recommend-
ed that they be referred to the Planning Commission for a report, and that a Public Hearing
by the City Council be called for June 23, 1969: •

(a) Washington Avenue, 16th to 28th Avenues,
(b) "B" Street, Lincoln Avenue, & Couplet, 6th Avenue to 6th Street,
(c) Six -Year Arterial Street Plan.
Mr. McMicken explained the reasons for requesting a public hearing on the above projects
as follows: on the first two street projects, prospecti have been filed to put us in line
for the funding, but there are over 90 property owners who will be affected by these im-
provements and it seems appropriate that they have a chance to speak on the matter, and on
the Six -year Arterial Street Plan, it is required by law that there be a Hearing held and
Council action taken. Drawings were displayed showing in detail the two street projects
and Public Works Director John Mayo and Traffic Engineer Al Ray explained the projects as
to traffic patterns and signalization, and answered questions. After due discussion, it
was MOVED by Robinson, seconded by McNeice that the above listed street improvement:pro-
jects be referred to the Planning Commission for study and recommendation, and that June
23, 19.69,,. by fixed as the time for a hearing by the City Council on said matter, and that
the property owners affected be notified of said hearing: carried, Brown, Lambert, Larson,
McNeice and Robinson voting aye by voice vote. Keith and Kurbitz absent.
City Manager McMicken referring to the matter of authorization to grant permits for the
retail sale of fireworks within the City for 1969, and explaining that this is done each
year, it was MOVED by Robinson, seconded. by Brown that Resolution No. D -1358 authorizing
the granting of said permits, be passed as read: carried, Brown, Lambert, Larson, McNeice
and Robinson voting aye on roll call. Keith and Kurbitz absent.
RESOLUTION NO. D -1358, A RESOLUTION granting permits for the retail sale of fireworks
within the City of Yakima for 1969.
City Manager McMicken explained that relative to the construction of grade crossing sepa-
rations on "B" Street and on Lincoln Avenue, Resolution No. D -1194 authorizing the execu-
tion of an agreement with ABAM Engineers, Inc., engaging its professional engineering
services, was adopted on April 8, 1968, and it is now necessary to make certain revisions
to, that agreement and an additional agreement is necessary to engage their professional,
engineering services in connection with the construction of a railroad grade crossing

separation on Yakima Avenue. After due discussion, it was MOVED by Brown, seconded by
Robinson that Resolution No. D -1359 authorizing the execution of an agreement with ABAM
Engineers, Inc., for professional engineering services relative to the construction of
grade crossing separations on "B" Street, Lincoln Avenue and Yakima Avenue, be passed as
read: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye on roll call.

RESOLUTION NO. D -1359, A RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to enter into an agreement with ABAM Engineers, Inc., for
professional engineering services relative to the construction of grade crossing separa-
tions on "B" Street , Lincoln Avenue and Yakima Avenue in Yakima, Washngton.
,r The matter of Safety Measures for Summitview Avenue, including a previously requested
report on the construction of a fence was discussed. Public Works Director John Mayo
indicated that this matter is being studied and a report will be made.
There being no further business to come before the Council, it was MOVED by McNeice, secon-
ded by Robinson that we do now adjourn at the hour of 9:50 P.M.: carried, Brown, Lambert,
