Councilman Keith absent on roll call, having been excused at the previous meeting. Coun- cilman Kurbitz absent on roll call and present after 8:45 P.M. • The Invocation was given by Councilman Lambert. . This being the time fixed the Hearing on Petition No. 625, filed by the Metropolitan Park • • District of Yakima, requesting Vacation of Sumac Lane (S. 15th Street), located north of East Maple Street, it was MOVED by by Robinson, that.Ordinance No. 1084 • providing for said Vacation, be passed as read: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith and Kurbitz absent. ORDINANCE NO. 1084, AN ORDINANCE providing for the vacation of a public street in the City of Yakima. This being. the time fixed for the Hearing on the appeal from the Planning Commission's decision to deny Rezone. Application of Humble Oil & Refining Company, requesting rezone of . property situated at 504 N. 1st Street, and Mr..Charles'Turpin, representing Humble Oil & Refining'Company on this matter, as he is lessee and.owner of present business at this address, asked if the matter may be continued as his attorney needs more time to prepare • for the Hearing. Morris, 1118 S. 9th Avenue, on December 10, 1968, in the amount of $110.48 for damages caused by a sewer backup, and by Henry J. Slavin, Route 1, Box 426, on December 12, 1968, for damages in the amount of $22.33, for damages caused by a sewer backup, it was.MOVED by Brown, seconded by McNeice that said damage claims be referred•to the City Manager and Staff for study and recommendation: carried, Brown, Lambert, Larson, McNeice and Robinson, voting aye by voice vote. Keith and Kurbitz absent. • An Ordinance appropriating $3,000 Police Relief and Pension Fund, having been read in its entirety at the regular meeting on December 9, 1968, and being read by Title only at this meeting, it was MOVED by Brown, seconded by Robinson, that Ordinance No. 1085 pro - viding for said appropriation, be passed as read: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye on roll•call. Keith and Kurbitz absent. • ORDINANCE NO. 1085, AN ORDINANCE appropriating the amount of $3,000 from unappropriated money in Fund No. 620 -- Police Relief and Pension Fund, to Account 150, Refunds of Pension. Contributions and Benefits, in the Maintenance and Operation classification in the 1968 appropriation for Fund No. 620 -- Police Relief and Pension Fund. • An Ordinance appropriating $4,000 for the Firemen's Relief and Pension Fund,.having been read in its entirety at the regular meeting on December 9, 1968, and being read by Title only at this meeting, it was MOVED by Robinson, secpnded by Lambert that Ordinance No. .,1086 providing for said appropriation, be passed as read: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye on roll call. ORDINANCE NO.'1086, AN ORDINANCE appropriating the amount.of $4,000 from .unappropriated • money in Fund No. 610 -- Firemen's Relief and Pension Fund to Account 160, Pensions, in the Maintenance.and Operation classification in the 1968 appropriation, for Fund No. 610- - Firemen's Relief•and Pension Fund. . • An Ordinance appropriating $2,800,000 for the Domestic Water Improvement Fund, having been read in its entirety at the. regular meeting on December 9', 1968, .and being read by Title only at this meeting, it was MOVED by Brown, seconded by McNeice.,that Ordinance No. 1087 providing for said appropriation, be passed as read: carried, Brown, Lambert, Larson, • McNeice and Robinson voting aye on roll call. Keith and - Kurbitz absent. • • ORDINANCE NO. 1087, AN ORDINANCE appropriating the amount of $2,800,000 from unappropriated money in Fund No. 590 -- Domestic Water Improvement Fund, to Account 7 -950 Construction Expenditures,. of the Capital Outlay classification of the 1968 appropriation for Fund No. 590 -- Domestic Water Improvement Fund. McMicken City Manager /introduced an Ordinance authorizing the execution an agreement with Yakima County for relocation and construction of Washington Avenue, stating that this matter had III been brought on too late to get on the Agenda. City Attorney Andrews reviewed the status of the rights of way in the matter of the Relocation of Washington Avenue, and the funds to be received from the County on this project. .He stated that most of the rights of way . • • have been acquired, but there are four owned by three property owners, on which the City has been unable to come an agreement, and referred to the Ordinance authoriz- ing the City to commence legal proceedings for condemnation and acquisition of real prop- . . . erty, for the relocation of Washington Avenue. He further stated that these people are aware of this Ordinance and that the City is still negotiating with them, but he contem- plates that the City will have to resort to legal proceedings on some of these parcels. Mr. Andrews stated that a new appraisal will be required which will be.brought before the City Council in the future. After due discussion, it was MOVED by Robinson, seconded by Brown that Ordinance No. 1088 authorizing the execution of an agreement with Yakima County • for relocation and construction of Washington Avenue, be passed as read: carried, Brown, • Lambert, Larson, McNeice and Robinson voting aye on roll call. AA • 511 • DECEMBER 16, 1968 ORDINANCE NO. 1088,,AN ORDINANCE authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an agreement with Yakima County for the construction of Washington Avenue, as relocated, in the vicinity of the Yakima Municipal Airport;. and de -. • claring an emergency. • • It was MOVED by Robinson, seconded by Lambert that Ordinance No. 1089 authorizing the City to commence legal proceedings for condemnation and acquisition of real property for the re- location of Washington Avenue, be passed as read: carried,.Brown, Lambert, Larson, McNeice and Robinson voting aye on roll call. ORDINANCE NO. 1089, AN ORDINANCE authorizing and directing the City Attorney of the City of Yakima to commence legal proceedings for the condemnation and acquisition 'of real prop- erty as right -of -way for the relocation and construction of a portion of Washington Avenue and the installation of curbs, gutters and drainage facilities related. thereto; and for the relocation, widening and improving of a portion of 24th Avenue and the installation of curbs, gutters and drainage facilities related thereto; providing for the condemnation and taking of such real property and declaring the condemnation and taking thereof to be neces- sary for a public use required by the public interests; and directing that compensation for such taking be paid from the Arterial Street Fund of the City of Yakima; and declaring an • emergency. • • It was MOVED by Lambert, seconded by Brown that Ordinance.No,. 1090 fixing the time of de- linquency and providing for the issuance of bonds for the payment of the unpaid portion of .L.I.D. ORDINANCE NO. 1090, AN ORDINANCE fixing the time of delinquency of installments of assess- • ments levied for the payment of the cost of the improvement in Local Improvement District No. 962, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. Councilman Kurbitz present after 8:45 P.M. for the balance of the meeting. City Manager McMicken reported that letters have been received from the Yakima Ambulance. Service giving notification that they have replaced a 1961 Cadillac ambulance with a 1968 Cadillac ambulance, and that there will be a rate change effective December 15, 1968, whereby the base rate will change from the present $30.00 to $32.00 and the mileage will change from the present 75 to 804 per mile. Councilman Lambert inquired these rate • changes are comparative to other .cities and City Manager McMicken stated that he will in- vestigate this matter and report back to the City Council. City Clerk'Donelson explained that the ambulance service in Yakima has been upgraded in the past few years, and that Sgt. Chute was instrumental in starting the program of hiring of better drivers, who must pass rigid driving and health tests and the Police Department is continuing this program. City Manager McMicken referred to the Damage Claim filed by Kenneth Garner•for damages • caused by flooding of residential property, and the City Attorney's Memo which explained that Mr. Carner has agreed to accept $140.00 in settlement his claim for damages, plus • the City changing the grade around his house. Public Works Director John Mayo explained that this work has been done to Mr. Carner's property, which has.removed his fear of future flooding, at a cost of about $400.00. After due discussion, it was MOVED by Robinson, seconded by McNeice that Resolution No. D -1284 authorizing payment of $140.00 to Kenneth Carrier in settlement of a claim for damages, be passed as read: carried, Brown,. Kurbitz, . Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. RESOLUTION NO. D -1284, A RESOLUTION authorizing payment of a Claim for Damages filed against the City of Yakima by Kenneth Carver. City Manager McMicken reported that bids were received and considered by a bid board on December 12, 1968, on L.I.D. No. 972, North and South First Street Water District, as follows: Bills Septic Service $ 37,478.93 DeBlasio Construction Co., Inc. 37,805.49 The City Engineer recommending that Bills Septic Service, having submitted the low bid, be awarded the contract, it was MOVED by Robinson, seconded by Kurbitz that the recommendation of 'the City Engineer be accepted and that the bid be awarded to Bills Septic Service in the amount of $37,478.93, and that the City Manager be and is hereby authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith absent. Discussion brought out the fact that althoughthere was only about $325 differ- ence in the two bids, the bid of Bills Septic Service was a very unbalanced bid in that some items were bid at very low prices in comparison with the other bid and the City En- gineer's estimates and other items were at very high prices in comparison. Council members inquired as to whether this matter should be continued a week in order that the bids be further studied. Public Works Director John Mayo stated that although the Engineering Department would prefer to have a balanced bid, the.total..amount of the bid is reasonable. . City Manager McMicken reported on another item that did not get on the Agenda, stating that a temporary loan of $30,000 from the Water -Sewer Fund to the Airport Improvement Fund, is . necessary in order to pay outstanding bills for airport improvements. He further explained that funds are due from the FAA before September 16, 1969, which when received will be used to repay this loan of $30,000, plus the loan of $60,000 authorized by Resolution No. D -1255 plus a: ccrued,�.interest on both loans. After due discussion, it was MOVED by Robinson, sec- onded by Brown that Resolution No. D -1285 authorizing a temporary loan from the Water - Sewer Fund to the Airport Improvement Fund, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. 512 DECEMBER 16, 1968 RESOLUTION NO. D-1285, A RESOLUTION authorizing a temporary loan of $30,000.00 from 520 - Water -Sewer Fund to 912-Airport Improvement Fund, and providing'for repayment. City Manager McMicken stated that he will be taking a week's vacation next week, and that there will be a short City Council meeting, but no study session. He further stated that it is not •planned to have a Council meeting on the 30th of December, 1968. There being no further business to come before the Council, it was MOVED by Kurbitz, secon- ded by McNeice that we do now adjourn at the hour of 9:25 P.M.: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote.
