SEPTEMBER 23,,1968 •
The City Council met in regular session, Mayor Larson presiding, Councilmen Keith, Kur-
bitz, Lambert, McNeice and. Robinson, City Manager McMicken and Assistant. City Attorney
McGlothlen present on roll call. Councilman Brown absent on roll call, having :been ex-
• cused at the previous meeting.

The minutes of the regular meeting of September 16, 1968, having been duly certified
accurate by two Councilmen, and no -one present wishing to have said.minutes read publicly,
• Mayor Larson declared said minutes approved as recorded.
A Damage Claim having been filed with the City Clerk on September 18,.1968, by Mrs. Warren
Bean, Jr., 6808 Englewood the amount of $160.00 for da.mages•caused to her car
by City garbage truck., it was MOVED by Robinson, seconded by Lambert that said Damage
Claim be referred to the City Manager and Staff for study and recommendation: carried,
Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting a.ye by voice vote. Brown
- absent.

City Manager McMicken reported that the damage claim filed by Mr. & Mrs. Al Sonnen, 709 S.
•
• 32nd Avenue, in the amount of $290.95, for damages resulting from a flooding of his base-
ment by sewage backing up from a plugged city sewer line, .has been investigated by the
Staff., and.after further communication with Mrs. Sonnen, the amount of the claim has been
reduced to $240.95, and the City Attorney's office recommends payment. It was then MOVED
by Lambert, seconded by McNeice that Resolution No. D -1258 authorizing the payment of.
$240.95 to Al Sonnen in full satisfaction of said Damage Claim, be passed as read: carried,
Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown
absent. .

RESOLUTION NO. D -1258, A RESOLUTION authorizing and directing the payment of a Claim for
Damages filed against the City of Yakima by Al Sonnen.
City Manager McMicken reported that it is necessary to execute a quit -claim deed to Esther
Graham, as part of an exchange of property in the vicinity of the Yakima Municipal Airport
as a part of the acquisition of certain right of way necessary in the construction of the
relocation of Washington Avenue. Public Works Director John Mayo explained that about ten
years ago some property was purchased from Mrs. Graham for this same purpose and it is now
found that this land is not needed, but the City is purchasing other land from her, and as
a. part of the terms of the sale of this property,.authorization is requested to execute a
quit- claim deed to Mrs. Graham for the property previously.purchased from her. After due
discussion, it was MOVED by Robinson, seconded by Lambert that Resolution No. D -1259
authorizing the execution of a quit -claim deed to Esther .Graham, be passed as read: carr-
ied, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Brown •
absent.
RESOLUTION NO. D -1259, A RESOLUTION authorizing the execution and delivery of a quit- claim
deed to Esther A. Graham.
City Manager McMicken referred to his report #31, regarding Outside City Sewer Service
Charges, in which he explains the present method of computing the sewer charge to the 190
accounts receiving sewer service outside the City limits, as it is found in the Yakima
Municipal Code. He explained that with processing for utility billing to be undertaken
this fall for.conversion by January, 1969, a change in the method of applying sewer ser-
vice charges outside the City is desirable and that the IBM Systems. Engineer advises that
the control panel wiring will be simplified by applying a charge equal to 50 percent of
the outside rate for domestic water instead of the 150 percent of the inside sewer rate as
presently provided. Mr. McMicken stated that the Director of Finance and the Director of •
Public Utilities have recommended this change and that he concurs with them. He recom-
mended'that the Council direct the preparation of an ordinance which would make the approp-
riate amendment to the Yakima Municipal Code, effective January 1, 1969. Finance Director
Leonard Crose explained the water billing process as it is now done and how the change
will affect the billing stating that in most cases the new rate will mean exactly
the same billing and in some instances there will be a lesser sewer charge, but the advan-
tage gain of the data processing setup will more than offset the monetary loss. After due
discussion, it was MOVED by Robinson,. seconded by Lambert that an Ordinance be prepared
• which - will make the appropriate amendment to the Yakima Municipal Code, to change the •
method of applying sewer service charges outside the City, effective January 1, 1969:

City Manager McMicken referring to a resolution of intention.to improve property by in-
stalling water and sewer lines for Englewood Crest Plat, Englewood and 48th Avenues, in •
accordance with Petitions No. 617 and 618, filed by Jack E. Nettleship, it was MOVED by
Keith, seconded by Lambert that Resolution No. D -1260, a resolution of intention to create
a local improvement district and fixing the time of hearing by the Council on said matter
for October 14, 1968, be passed as read: carried, Keith, Kurbitz, Lambert, Larson, McNeice
and Robinson voting aye on roll call. Brown absent. Mr. Joe Hogarth, representing the
builders of the Condominium, displayed a picture of the proposed development, showing the •
placement of driveways and garages, and the two access outlets on 48th Avenue only.

City Manager McMicken recommending.out -of -State travel be authorized for John Mayo, Frank
Stein, Francis Jaeger, Peggy Rabung, and Glen Perkins to travel to Portland, Oregon, as
they have been invited by the American Pipe Company to see how they manufacture the steel
and concrete pipe, and for Frank Stein to travel to Penticton, British Columbia, Canada,: to
attend the Pacific•Northwest Polution Control Association Convention, where he will speak
about the Sewer Sealing program that Yakima. had in.1967,'it was MOVED by Lambert, seconded
by Keith that said travel be allowed with. expenses paid: carried, Keith, Kurbitz, Lambert,
Larson, McNeice and Robinson voting aye by voice vote. Brown absent.
City Manager McMicken reported that Chief Inspector Charles McCoy, in the Inspection De-
partment, who has been employed by the City since 1959, has submitted his resignation.
Council. members expressed regret a.t losing his services, commending him for the high
quality of inspection over the years, which has increased the building standards of the-,
City.

There being no further business to come before the Council., it was MOVED by Kurbitz,
seconded by Robinson that we do now adjourn at the hour of 3:50 P.M.: carried, Keith, Kur-
bitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown absent.
