HomeMy WebLinkAbout07/08/1968 Business Meeting 447 JULY 8, 1968 ./J i The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kur- bitz, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Keith absent on roll call. It was MOVED by Robinson, seconded by Brown that Councilman Keith be excused from this meeting: carriedi, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. I II The Invocation was given by Councilman Brown. The minutes of the regular meeting of July 1, 1968, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor II Larson declared said minutes approved as recorded. This being the time fixed for the continuation of the Hearing on the Grade Separation Project on "B" Street and Lincoln Avenue, City Manager McMicken reported that there are several questions to be resolved; that the Planning Commission has made no recommendation as yet and wishes to give the matter further consideration; and recommended that the pro- I ject hearing be set over for an indefinite period. He reported that conferences with the property owners and the railroads are to be and, plans worked out in further detail, at which time a report will be made to the Planning Commission; that the Planning Com- mission will then give further consideration to the project and report back to the Council. After further discussion and there being no need for Council action at this t the matter was set over for future consideration. I i This being the time fixed for the hearing on Petition No. 597, filed by John Decoto, re- questing annexation of property situated on the north side of West Washington Avenue, City Manager McMicken reported that the City Attorney has advised that after consultation with the County Assessor, he finds the petition does not fully reflect the fuh1 75% assessed valuation of the property involved in this annexation, as required by law to be valid; and that therefore, all proceedings become moot; and no further action is re- quired on said petition. This being the time fixed for the Hearing on Petition No. 608, filed by Traders Realty Co., requesting vacation of the alley located north of Elm Street and west of North First Avenue, it was MOVED by Brown, seconded by McNeice that Ordinance No. 1046 providing for said Vacation be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. Acting Planning Director Loidhamer re- ported that the alley in question is. not accessible for through traffic to First Avenue . crossing to the west; that there are no utilities located in the right of way; that pro- perty owners on both the north and south have signed the vacation petition; that all utility companies have been notified of-this proposed vacation and no adverse comment has been received; and that the Staff and Planning Commission have both recommended the vacation. 1 ! ORDINANCE NO. 1046, AN ORDINANCE providing for the vacation of a public alley, in the City. of Yakima, Washington. It was MOVED by. Brown, seconded by Robinson that Ordinance No. 1047 amending Chapter 4.16 II of the Yakima Municipal Code relating to storage, collection and disposal of garbage,.be passed as read: carried, Brown, Kurbitz,.Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith Absent. City Manager McMicken stated that this ordinance is for the purpose of providing that the requirements of state law be satisfied before al city license is issued. I . ORDINANCE NO. 1047, AN ORDINANCE relating to health and sanitation; regulating the issu- ance of a City license to collect garbage, refuse or debris in. the business classifica- tion of the City of Yakima; and adding Section 4.16.185 as a new section of the City of Yakima Municipal Code. The Planning Commission reporting on Rezone Applications filed by Retirement Income Corp. requesting rezone of property located on the east side of South 38th Avenue, 'north of Webster Avenue, and by Harry G. and Muriel Valen requesting rezone of property located at the northwest corner of Nob Hill Boulevard and South 20th Avenue, it was MOVED by Robinson, seconded by Brown that July 22, 1968, be set as the time for hearings by the City Council on the matter of the rezone of certain real property as requested in said rezone applications, and that the City Clerk give notice of such Hearings as !required by law: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Keith Absent A report having been received from the Planning Commission on parking requirements for rent supplement housing projects, Acting Planning Director Loidhamer reviewed' the back- ground of the Rent Supplement Housing projects being sponsored by private developers and stated that he had researched . this matter to determine what is being done in various areas of the state. He reported that the general indication was that the City of Se',attle has moved to adopt an ordinance which provided that when over 90% of the tenants were over the age of 62 years the parking requirements could be reduced to one parking !space per four units; that the City of Spokane reductions had been made in projects for' the elderly in the central business district, and similar requirements had been made in the Portland, Oregon area. He stated the Planning Commission had d- iscussed the matter at some length, and it was decided that it would be very difficult to administer a code when it was neces- sary to determine the tenancy requirements and if it was later found that the ratio had been .dropped below the required percentage that it might be difficult to find the land for additional parking. Mr. Loidhamer further stated that the Planning Commission and staff believed this type of project could be administered under the provisions of the Planned Development Zone, whereby each project could be considered separately and each project handled as a separate item, and that the Planning Commission recommended that the zoning ordinance remain in its present form and that Rent Supplement Projects be con- sidered under the Planned Development Zone in the future. He reported the entire site would have to be approved and a site landscaped for open area could be included:°until the need for additional offstreet parking arose, at which time the landscaped areia could: be converted to parking. He further stated that the developers of the current rent supple- ment projects have complied with the present zoning requirements for offstreet parking and that no action of the Council is required at this time. City Manager McMicken reported that the City should have at least two Council members present at Board of Equalization meetings; that the present designated members are Council- men Brown, Kurbitz and Keith; and suggested that an alternate be appointed in case two of the members could not attend. Keith absent. City Manager McMicken reported that there is need for a culvert pipe at the garbage,dis- posal site and that monies are available within the 1968 Budget for Municipal Garbage Fund. He requested that authorization be given to transfer said funds in the amount of $550.00. After due discussion, it was MOVED by Robinson, seconded by McNeice, that Resolution No. D -1227 authorizing said transfer of funds within the. Municipal' Garbage Fund from Salaries and Wages to Maintenance and Operation, to purchase culvert for the sanitary landfill, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. RESOLUTION NO. D1227, A RESOLUTION transferring the amount of $550.00 within!the 1968 appropriation for 320 - Municipal Garbage. City Manager McMicken reported that the Airport Terminal Building had been modified for the occupancy of Air West and that a lease agreement is required covering the use of this space, it was MOVED by Brown, seconded by Lambert, that Resolution No. D -1228 authorizing the execution of a Lease Agreement with Air West for space. in Airport Terminal Building, be passed as read: carried, Brown, Kurbitz, Lambert, Larson,, McNeice and Robinson voting aye on roll call. Keith absent. RESOLUTION NO. D -1228, A RESOLUTION authorizing and directing the City' Manager and City Clerk of the City of Yakima to execute a Lease Modification Agreement with Air West,Inc. Director of Public Works, John Mayo, reported that the provisions of the grant from HUD require that an agreement be made with Pacific Power & Light Company regarding diversion facilities in the Naches River, providing for the City to pay a penalty in case of a rise in water caused by the intake. He further stated that only a small amount of money is involved and there is little likelihood of a problem arising under normalloper.ation, except in the case of very high water. After due discussion, it was MOVED by Robinson, seconded by Lambert, that Resolution No. D -1229 authorizing the execution of an agree- ment with Pacific Power & Light Co. regarding diversion facilities in the Naches River, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. RESOLUTION NO. D -1229, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an Agreement with Pacific Power & Light Company. City Manager McMicken reported that some time ago an agreement was executed with the State Highway Department regarding improvements and property in the vicinity of the. Naches River diversion project, and that the Highway Department has now returned the agreement requesting certain revisions. Director of Public Works, John Mayo; stated that the revisions provide that payment will be on the basis of actual cost, plus.,over- head, instead of on the basis of estimated costs. He further stated that the engineering is being done by the City consultants and the construction will be done .by the State. After due discussion, it was MOVED by Robinson, seconded by Brown, that Resolution No. D -1230 authorizing the revision of the agreement with the State of Washington re domestic water improvements at new intake on the Naches River, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye on roll call. Keith absent. _ Director of Public W John Mayo, r that the legislation set.ting'up the. arterial II • program stipulated, that by July 1, 1968, all cities in the state adopt a classification plan for their arterials;. that the State. had employed a consulting engineering firm to work the program out and the consultant furnished maps for aterial street systems for all urban areas,in - the state. He further reported that the City staff had met with the State Aid Engineer and had come to an understanding regarding the City's arterial'system and the classifications of the various streets. Mr. Mayo presented a map showing the three . classifications: major, secondary and collector; and stated that this classification plan . had been approved by the Urban Arterial Board. He further stated that the criteria for classification is based on the type of traffic generated, rather than the .amount of traf- fic carried.
