Councilman Brown absent on roll call,,having been excused at a previous meet- . ing • The Invocation was given by Councilman Lambert.- . The minutes of the regular :,meeting of April 22, 1968, having been duly certified.accurate' • by two Councilmen,. and no•one present wishing to have.said minutes read publicly,*Mayor Larson declared said minutes apprpved as•recorded. - .. . This being the time fixed for. the continuation. of the hearing on the Application filed by Harold R. Sanford,, requesting.rezone of property situated southwest'of the intersection of Englewood'Avenue and N. 35th Avenue, Acting Planning Director Ed Loidhamer reported that . .a copy of the 'amendment to- the "amended -statement.of Protective and Restrictive Covenants" . has been filed with the City Clerk, as requested at the Council meeting an_.April 22',. 1968. City Attorney Andrews having checked this statement_ and`..stati_ng that it limits building, height to no more than allowed in an R -2 Zone, it was MOVED by Robinson, ,seconded by.. , • Lambert that Ordinance No..1029. accepting...the recommendation of the Planning Commission and rezoning . said property, be passed.as read: carried, Keith, Kurbitz, .Lambert, Larson., McNeice and Robinson voting ..aye on..roll call: Brown absent. ORDINANCE NO. 1029, AN ORDINANCE accepting the recommendation of the Planning Commission and rezoning certain property situated southwest of the intersection of Englewood Avenue and North 35th Avenue,.in the City of Yakima, Washin.gton,:from R -2, Two .Family•Zone, to • R -3, Multiple Family Zone.. . • This.being the time fixed for the- continuation of the matter of the request from Yellow Cab Co., and Yakima Cab Co., - increase Taxi rates, having been continued from April 15, • 1968, it was MOVED by Robinson, seconded by Keith that.Ordinance No. 1030 relating to licensing, specifying taxicab :rates and amending the Yakima Municipal•Code, be passed -as read. •City Attorney, Andrews' reported.. that in addition -to the change in taxi rates, other changes were made as suggested by the City Police Department and. the City Clerk.'s office, and 'explained some of these changes. He stated that previously..i-n the Ordinance;. refer -. ence was made to Airport limousine and since there is no Airport :limousine, this reference • has been deleted. He also explained the change in, rates that have "been made and the addi- tionof a new section -Zones and the.fare which:may,be charged in. addition. to'the regu l.ar charge shown •on -the •taximeter. He .further reported..that. the :existing Code does_not specifically set out.the type ;o felonies: and at,the request of the P.olice.,Department specifically names them He stated that there has been no. increase in.the amount of fee for the City Driver's License, the only difference being that the $5.00 fee is..not refund- ed if the applicant does _ not pass..: the requirements.. He . also - stated that the of allow- ing the applicant to •drive with•a temporary license has been extended from to thirty days.. Council members discussed the matter of. the Zones and indicated that .they .feel that • a copy of the Zone Map should'be. *visible to the.- p.ass.enger and- that, it _sYiould be so•stated in the Ordinance: .- Council members questioned the advisability ofgiving a temporary license before the investigation of the applicant is completed.' City:Clerk explained that the applicant is.thoroughly screened .by the'Police Department, before - application is' made. Officer .Fluegge, being' present, explained that ,an applicant. is. thoroughly screened before giving him a temporary license, to be•able to work while further., investigation is made. Mrs. Al Kauzlarich another .representatives of the.Taxi companies were present • and Mrs. Kauzlarich stated. that._ they approve of the suggested changes in the.Yakima.Muni- • cipal Code.regarding,•taxicabs and the change in rates, is the first change that has: . . been made in .eight years. Deardorff President, Good - Samaritan Nursing Home, Inc., requesting annexation of property situated at-N..17th and Jerome Avenues, it was MOVED by Robinson,, seconded by Kurbitz that this date be as the time for a meeting with the initiating party who signed the Notice of Intention to Com- . mence Annexation Proceedings dated April "25,1968: carried, Keith, Kurbitz, Lambert, Lar- son, McNeice and Robinson voting aye by voice vote. ORDINANCE NO 1031, AN ORDINANCE.fixing:the time of delinquency of installments of assess- ments- levied for the payment of the cost of the improvement in Local Improvement District • No. 961, and providing for the issuance•of- bonds'with coupons attached for the payment of • the unpaid portion thereof.' .. . 'City Manager McMicken referred to his Report -.#20, Outside City Utility Requests, in which he reported on four requests and stating that reports have been received from the Planning Commission, and giving his recommendation for the disposition of these requests, suggest- ing that each request be discussed and handled by the Council separately. • A request for sewer connection outside City, having been submitted by'United Builders for • property at 51st Avenue at Nob -Hill Boulevard, the Planning Commission recommended denial . of this request because they believe annexation is possible and feel if this is granted, other such requests will be made which will delay further action toward annexation pro -'. cedures. City Manager McMicken recommended that the outside sewer connection be authorized, subject'to the usual utility connection agreement with its standard provisions, plus .a report by the Planning Commission favorable to the proposed land use, and further, pro- vided that United'Builders.sign new outside utility agreements on all properties they own . within this area, and further recommended that the City, immediately initiate a program to annex the area -as shown - attached to the Planning Commission report. Mr. Fred Hammerst'ad, • and Mr. John were present representing United Builders and indicated that- they • are making every effort possible to annex. After due discussion, it was MOVED by-Robin- son, seconded by McNeice that the recommendation of City Manager McMicken be accepted and the outside sewer connection be authorized,.subject to the usual utility connection ag -ree- ment'with its standard provisions: carried, Keith; Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown absent. City Manager McMicken stated that another United Builders request for outside City sewer hookup has been filed; that . did not get put on the Agenda. He explained that this is a single residence built new and there is some-urgency on the part of United Builders to get sewer service to this property at 3901 McLean Drive, which is between 38th and 40th Ave- nues, south of Nob Hill Boulevard. After-due discussion; it was MOVED by McNeice, secon- ded by Kurbitz that this outside hookup be allowed subject to the usual conditions and the • • signing of an outside hookup agreement: carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Brown absent. Councilmen Keith and McNeice indi- 'cated that they are concerned about the helter - skelter growth on the outside of the City and feel that allowing many of the outside hookups help to cause this They also indica- ted they felt that in the future anything that can be done in the direction of annexation • should be done first. Councilman Kurbitz indicated that he believes there is no alterna- tive to allowing these outside hookups and that if they are turned down when requesting an outside hookup, it might make them reluctant to annex when. and if it becomes possible for them to do so. Mr. Fred Hammerstad.stated that United Builders tried to find land I/ contiguous to the City, but can't always do-this. and are working with Mr. Loidhamer and the Planning Department to conform to the Building Code and want to annex when it is possible. 0 City Manager McMicken referred to the Planning Reports on the Williams Equipment Company request for a utility connection, stating that One report pertains to the request and the other to a proposed annexation. He reported that the Planning Commission recommends denial of outside water service and that annexation of the area'be pursued. Mr. McMicken 'further reported that, another property owner in the vicinity will initiate annexation pro- ceedings and he recommends that this request for outside water service be denied. After due discussion, it was MOVED by McNeice, seconded' by .Keith that said request.for outside water service be denied: carried, Keith, Lambert, Larson, McNeice and voting'aye o by voice vote. , Kurbitz voting ,nay by voice vote. Brown absent. . 424 . • APRIL 29, 1968 ' Manager McMicken referred to the Planning Report which recommended denial of utility service to Marvin McCargar, 1321 South 24th Avenue, because this is a single` property' • request and'it was'felt that annexation is possible. Mr. McMicken recommended that this _ outside utility service be authorized, subject to the usual conditions, since this dwell ing has existed - for'some'years and the control of urban fringe development is..not at'issue, .and the. water main is immediately available. He_ further recommended that the City under= take to initiate annexation of this and adjoining properties in any. way that may be practicable. After due discussion, it was MOVED by Robinson, seconded by'Keith that said outside hookup be allowed in accordance with City Manager McMicken's recommendation: carried,. Keith, Kurbitz; Lambert, Larson,,McNeice and Robinson voting .aye by voice vote. - Brown absent. Mr. McCargar, being present, stated that he is willing to as soon as' . it becomes possible. . City Manager McMicken referred to the Planning Report on the request of. Don Smoot,•1108 West "I" Street, for outside .sewer service which. shows that annexation of this and adjoin ing properties may be feasible. He recommended that sewer service be extended to • this property', subject to the usual conditions, .(::111 the premise that this dwelling has no • effect upon urban fringe development and that the sewer line is immediately available. He further recommended that the City immediately initiate an annexation of this and adjoin • properties in any.way•that may be practicable'. After due. discussion, it was MOVED by Robinson, seconded'by Lambert that said outside. hookup'be allowed in accordance•with City . Manager McMicken.'s recommendation: carried,. Keith, Kurbitz, Lambert, Larson, McNeice and • • Robinson voting. aye by voice vote. .Brown absent. City.Manager McMicken reported that in March, 19.58, the.City of Yakima'installed a water main.on Jerome'Avenue west from the existing main on N. 16th Avenue, and .certain agree ments made with the County as'to the operation and maintenance. • He further reported . that both the County and City wish to terminate said agreements at this time so as to transfer the ownership and exclusive control of this water main to the City of Yakima. After due'discussion,'it was MOVED by Lambert, seconded by Robinson that Resolution No. . D -1199 authorizing _the ,execution of an•.Agreement with Yakima County to transfer ownership of said water main to the City of Yakima, be passed as read: carried,'Keith, Kurbitz, Lambert, Larson, McNeice and Robinson votin.g.aye on roll call. Brown absent. RESOLUTION NO. D -1199, A RESOLUTION authorizing and directing the City Manager and City Clerk of` the City of Yakima to execute a Water Main Agreement with Yakima County. . City Manager McMicken requesting authorization for out -of- State travel to Portland; Oregon, on April 30,•1968, by.him, Public Works Director JohnMayo andCity AttorneyFred • Andrews, to meet with Railroad officials regarding Grade 'Separation, it was MOVED by Keith seconded by Robinson that said travel be allowed.with expenses paid: carried, Keith, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote.
