The Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz,
• McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call.
Councilmen Keith and Lambert absent on roll call. It- was' MOVED by Robinson, seconded by •
• McNeice that Councilmen Keith and Lambert be excused from this meeting: carried, Brown,
Kurbitz, Larson, McNeice and Robinson voting .aye by voice vote.
II The Invocation was given by City Manager McMicken. . •
The minutes of the regular meeting of March 11,_1968, having been duly certified accurate
by two Councilmen, and'no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as recorded.
Petition No. 597, Notice of Intention to Commence Annexation Proceedings, having been
filed'with'the'City "Clerk on March 6, 1968, by John Decoto, President, Decoto Aircraft,
Inc., requesting annexation of property situated west of S. 24th'Avenue, and north of W.
Washington Avenue and the Yakima Municipal Airport, it was MOVED by Robinson, seconded by
• .Brown that this date be set as the time for a meeting with the initiating party who signed
the Notice of Intentionto Commence Annexation Proceedings dated March 6, 1968: carried,
Brown,. Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Keith-and Lambert
absent. Mr. Howard Hettinger, Attorney, having been appointed by Decoto Aircraft, Inc.,
to meet with the City Council in these matters and indicating that the area to be annexed
is willing to assume its share of the City's existing indebtedness, it was duly moved, .
seconded and passed that annexation proposed by petition no. 597 (Notice of Intention •
,to Commence Annexation Proceedings) be accepted' by the City of Yakima and that the area
sought to be annexed be required to assume the City's existing'indebtedness. The above
Motion was made by Robinson, seconded by McNeice and carried,, Brown, Kurbitz, Larson, .
McNeice and Robinson voting aye by : voice vote. ,Keith and Lambert absent.
This being the time fixed for a meeting with Matt and Adeline Hatzenbihler, who filed ,
Petition''No. 598, Notice= of Intention to Commence Annexation" Proceedings, requesting
annexation situated 200• 'ft. northwest of .the. inter of N. 16th and
Lincoln•Avenues, and said initiating parties indicating that the area'•to be annexed is•
willing to= •assume its share bf the City's existing indebtedness,• it was duly moved;. .• •
seconded and passedrthat the annexation proposed by petition:no. 598 (Notice of Intention
to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area
soughtyto annexed be required to assume the City's existing indebtedness. The above
Motion was made by Robinson, seconded by Brown and carried, Brown, Kurbitz, Larson;

• Petition No. 599, having been filed with the City Clerk on March 15, 1968, by Chester S.
Meyer & Others, requesting improvement of property by the construction of curbs, gutters
and surfacing of streets on S. 44th Avenue from West Nob Hill•Blvd. to Storm'Avenue
extended, it was MOVED by Robinson,• seconded- by Brown -that said Petition -No'. 599, for the
creation of a Local Improvement District, be referred to the City Manager and Staff for

study and. recommendation: carried Brown-, Kurbitz, Larson, McNeice and Robinson voting aye.

Mr. Herb Schoff •filed with the Council and City'.Clerk at this meeting, a Petition signed
by 20 property owners, which protested being included inany annexation.irnto the City of
Yakima. He " stated that all of these property owners' do not. wish to be included in ,the •
proposed Decoto annexation-proceedings and have taken this method to register protest.
Mr. Glenn•Hardman,'property owner in this vicinity asked a list of the assessed valua-
tion of the properties to be included in the proposed- annexation will'be'availab}le. -
Mayo', Public Works Director, stated that as soon as. such a•list is prepared, it. will be
available. ..•
A report having been received from the Traffic.Advisory Board recommending the_ removing •
of parking on the following streets:
. a. 7th Avenue, between Chestnut Avenue and'Tieton Drive
b. Tieton Drive - from 16th Avenue to 40th'Avenue
• c. Lincoln Avenue - from 24th Avenue to 40th Avenue,
Public Works Director John Mayo reviewed said matter. He explained that a` survey had
been made among the persons living on S. 7th Avenue and the majority favored removing the
parking on..the East side of the street. He further explained that at the time Tieton
Drive and Lincoln Avenue were widened and improved to four lanes, provisions had been •
made for part -time parking because at that time there seemed to be a need for it. Mr.
Mayo stated that the situation has now developed that very "few people utilize the parking
privileges and the Traffic Board feel's that the occasional parking creates a traffic
hazard and has recommended that the City Council make' the parking restriction
and remove all parking on thes two streets. After due discussion, it was MOVED by
Robinson, by Brown that an Ordinance be prepared authorizing the removal of park-
ing on the side of S. 7th Avenue between Chestnut Avenue and Tieton Drive, and that
April. 1, 1968, be fixed as the time for a hearing on the matter of removing the parking on
Tieton Drive, from 16th Avenue to 40th Avenue and on Lincoln Avenue, from 24th Avenue to
40th Avenue, and notice be given to the property owners in these vicinities: carried,
Brown, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote. Keith and Lambert
absent.

- City`Manager'McMicken stated that an Application for Utility Connection outside the City
Limits has been filed with the City Clerk on March 14,.1968, by Leo V. and Bernice R.
Scott,, 1523 S. 10th Avenue, and the .matter has been studied by the Staff. He stated that
this request is prompted by an F.H.A. requirement for the sale of said property. Mr.
McMicken reported that the staff feels that the annexation route is the one to take and

that if this owner and the others in the neighborhood find that they n-ed water, they
ought to proceed to annex to the City. He further reported that the S aff is recommending
against granting this outside hookup, which is contrary to what they u.ually recommend, but
they don't think there is anything about this application which should single them out for
the outside water service. Mr. Glen Anderson, agent for the owners, s ated that the owner
is very much in favor of annexation, but can't get the rest of the neighborhood interested.
Councilmen discussed the matter of the outside hookup agreement which ias been prepared _
for such requests and which must be signed by the applicant requesting an outside hookup,
and states that the property owner is willing to annex to the City and will do so when the II
opportunity arises. Councilmen Brown, Kurbitz and Robinson concurred hat when the
service is in the area and it is practical to hook up, that the most p actical approach
is to grant these services when an outside hookup agreement is signed. Mayor Larson
stated that he hoped the laws will be soon changed and that although h- doesn't like to
see services denied those who want to be in the City, he doesn't like o see services .
given to people that are not in the City either. Richard Buck, Yakima Herald - Republic
newspaper reporter, asked questions about the validity of the outside ookup agreement -
if the people signing it can be held to this agreement when the opport nity to annex
arises and what happens when the property is sold. City Attorney Andr-ws stated that the
Outside Hookup Agreement is filed in the County Auditor's Office and t e signing of this
agreement is an obligation that runs with the land. He further stated that as far as
being legal, these agreements have been upheld by the courts. Mr. And ews stated that he
is satisfied with the legality of the agreement and would be willing te argue the validity.
After due discussion, it was MOVED by Robinson, seconded by Kurbitz that the Utility
Connection outside the City Limits requested by Leo V. and Bernice R. .cott be granted
when the outside hookup agreement is signed by said applicants: carries, Brown, Kurbitz,
McNeice and Robinson voting aye by voice vote. Larson voting nay by vice vote. •Keith
and Lambert absent.
City Manager McMicken reported that the Director of Utilities, Frank S ein, went to
Pullman last week, and finds that further equipment and analysis Of th- flow, distribution
and pressure of the Yakima water system is needed. Mr. McMicken reco ended that the
Council authorize the hiring of professional services for this analysi_ and technical
information and stated that the money is available through the sale of bonds and will
come from the water improvement fund. Mr. Stein stated that this stud, is needed now in
order to determine the elevation needed and the sizing of the main nee•s to be done to be
sure that it is large enough. After due discussion, it was MOVED by R.binson, seconded by
McNeice that Resolution No. D -1187 authorizing the hiring of professio al services of
Washington State University College of Engineering to conduct a McIlro, Analysis of the
Yakima water system, be passed as read: carried, Brown, Kurbitz, Larso , McNeice and
Robinson voting aye on roll call. Keith and Lambert absent. .
RESOLUTION NO. D -1187, A RESOLUTION authorizing and directing the City Manager to hire

professional services for an analysis of the Yakima water system.
City Manager McMicken referred to his Report #14 regarding Access Report - Sign Route 410
and stated that there will be a meeting of the State Highway Commissio to consider this
report and that a letter should be submitted approving the report or partially approving
=it. He further suggested that the Planning Commission have a chance t. review it and
probably there can be a Council consideration next week. Mr. McMicken reported that
generally speaking, this'plan is in accordance with our own General Plan on 1st Street
and 16th Avenue, and that the State Engineers have been reviewing the -uggestion that 40th
Avenue needs access to the freeway also, and have been trying to work .ut additional
designs and study on where it would tie into the Interstate. After du- discussion, it was
MOVED by Robinson, seconded by McNeice that the Council follow the rec.mmendation of the
City Manager and refer the subject to the Planning Commission for thei' advice and have
them report back to the Council: carried, Brown, Kurbitz, Lars n, McNeice and Robinson
voting aye by voice vote. Keith and Lambert absent.
City Manager McMicken reported that Villesvik & Smith, Architects on t e Yakima Airport
Terminal Building improvements, have submitted a progress report of co struction work
performed by W. M. Yeaman, contractor, during the month of February, 1 :68, and have
recommended payment of Estimate #5 in the amount of $38,995.96. It wa MOVED by McNeice,
seconded by Brown that the Report of Villesvik & Smith, with respect t. the progress on
work performed by W. M. Yeaman, be approved and that progress estimate- therein set forth
be approved and payment of same authorized: carried, Brown, Kurbitz, L.rson, McNeice and
Robinson voting aye by voice vote. Keith and Lambert absent.
City Manager McMicken requesting authorization to travel to Oregon to .ttend the Northwest
City Manager's Meeting with expenses paid, it was MOVED by Robinson, seconded by McNeice
that said travel- be authorized with expenses paid: carried, Brown, KurI.itz, Larson, .
McNeice and Robinson voting aye by voice vote. Keith and Lambert absent.

Bids were received and considered by a Bid Board on March 18, 1968, on the Sow h 16th
Avenue Paving project - Washington Avenue to Mead Avenue, as follows:

The City Engineer reporting that Yakima Cement and Asphalt Co. on Schedule I, and DeBlasio
Construction Co., on Schedule II, having submitted the low bids on these schedules and
recommending that they be awarded the contracts, it was MOVED by Robi son, seconded by
McNeice that the bid on Schedule I be awarded to Yakima Cement and As alt Paving Co., in

the amount of $52, 310.25, and the bid on Schedule II be awarded to DeBlasio Construction
Co., in the amount of $14,935.25, and that the City Manager be and is hereby authorized to
enter into contracts with said contractors upon the filing of the proper bond and insur-
ance: carried, Brown, Kurbitz, Larson, McNeice and Robinson voting aye by voice vote.
