MARCH 4, 1968
The Council met in regular session, Mayor Larson presiding, Councilme Brown, Keith,
Kurbitz, Lambert, McNeice, and Robinson, City Manager McMicken and Ci y Attorney Andrews
present on roll call. .
The Invocation was given by Councilman Brown
The minutes of the regular meeting of February 26, 1968, having been my certified
accurate by two Councilmen, and no one present wishing to have said minutes read publicly,
Mayor Larson declared said minutes approved as recorded.
Mayor Larson introduced Mrs. Margaret Campbell, who is visiting from ancouver, B.C.,
Canada, to promote tourism in Canada.
This being the time fixed for the Hearing on the Confirmation of the Irrigation Main-
tenance Assessment Roll for the year 1968, it was MOVED by Brown, sec•nded by Lambert,
that Ordinance No. 1010 confirming said Assessment roll, be passed as read. Public
Utilities Director Frank Stein read a part of his memo written to the City Manager,
explaining that the assessment rate for the majority of the irrigatio districts was
increased this year to provide funds for the future wareYouse faciliti -s in the Fruitvale
area. He further explained that a little over 6 of the total cost ill be charged to
the Irrigation Division, which amounts to approximately 22 per 100 s.uare feet of land
for the next four years. Mr. Stein also reported that planned improv -ments in some dis-
tricts account for part of the additional increases and stated that o1 the 64 districts
fifty -one show increases from 72% increase in one district, caused by the construction of
a new screening box and pump house, to 67% in three districts, 50% in rease in ten dis-
tricts, 48% increase in one district, 43% increase in four districts, 39% increase in
seven districts, and lesser amounts in other districts, and that rate- in eleven districts
were reduced in varying amounts from 52% to 5 %. Mr. Stein reported t at there have been
some protests filed in writing and that if the people are not present at this meeting
he will answer them by letter. He then answered questions and protes s of those present.
There were approximately 75 people present at this meeting, many of w om were from Dis-
trict 308, the General a trict, and were protesting the increase in rtes, stating that
they were not getting enough pressure. Mr. Stein explained that the ;rrigation system in
the general district is one of the oldest systems and is constructed •f wood pipe. He
further stated that several years ago it had been proposed that this .ystem be rebuilt,
and the people in this vicinity opposed this proposal, wishing to go :long making only
necessary repairs. Mr. Stein suggested that this system should eithe be rebuilt or
abandoned. After hearing all persons present who wished to speak to his matter, Council
members indicated that they feel that Mr. Stein has done an excellent job in handling
this matter, in explaining the reasons for increases and in answering all questions and
protests brought before the Council in writing or otherwise. They al -o indicated that
in comparing Yakima with other cities we are fortunate to have such a, irrigation system
with such reasonable rates. After due discussion, Mayor Larson callea for the roll call
vote on the Motion to pass Ordinance No. 1010 confirming the Irrigati.n Maintenance Assess-
ment Roll as read, and it carried: Brown, Keith, Kurbitz, Lambert, L.:rson, McNeice, and
Robinson voting aye on roll call. Public Utilities Director Frank St-in reported that
Lots 20 through 24, inclusive, Block 1, Broadway Park Addition #2, belonging to Gene
Shields and Nordan Co., Inc., have been assessed for irrigation, even though there is no
main line to the property and no irrigation water has ever been made available to them;
that he feels they should never have been included in this Irrigation District when it was
formed in 1938, and recommended that they be removed from the 1968 as- essment roll. Coun-
cilman McNeice, having voted on the prevailing side to pass Ordinance No. 1010 confirming
said assessment roll, MOVED, and it was seconded by Robinson, that said Ordinance No.
1010,be reconsidered: carried, Brown, Keith, , Kurbitz, Lambert, Larso , McNeice, and
Robinson voting aye by voice vote. It was then MOVED by McNeice, sec.nded by Brown, that
the ;.._irrigatizn - maintenance assessment roll., - as confirmed_ by Ordinance . No. 1 010, be amended to
delete Lots 20 through 24, inclusive, in Block 1, Broadway Park Addit on #2, from the 1968
assessment roll: carried, Brown, Keith, Kurbitz, Lambert, Larson, Mc eice, and Robinson
voting aye on roll call. .
ORDINANCE NO. 1010, AN ORDINANCE confirming the irrigation maintenanc- assessment roll of
the City of Yakima for the calendar year 1968, and levying irrigation maintenance assess-
ments according to such roll; and declaring an emergency.
Petition No. 595 having been filed with the City Clerk on February 28, 1968, by Frances M.
Ibach and Others, requesting improvement of property by constructing ater mains on
property fronting on St. Johns St. between S. 12th & Pleasant Avenues, except the west 140
ft. of the north side, and Petition No. 596, filed with the City Cler on February 29,
1968, by Frances M. Ibach and Others, requesting improvement of prope ty by constructing a
sewer on certain lots in King Street Addition and certain lots fronti g on St. Johns
Street, it was MOVED by Lambert, seconded by Robinson, that said Peti ions be referred to
the City Manager for study and recommendation: carried, Brown, Keith Kurbitz, Lambert,
Larson, McNeice, and Robinson voting aye by voice vote.
An Ordinance transferring money to the Urban Arterial Fund and approp iating said funds
for Arterial street construction, having been read in its entirety at the regular meeting
on February 26, 1968, and being read by Title only at this meeting, i was MOVED by
Robinson, seconded by McNeice, that Ordinance No. 1011 providing for -aid transfer and
appropriation be passed as read: carried, Brown, Keith, Kurbitz, Lam•ert, Larson,
McNeice, and Robinson voting aye on roll call.
ORDINANCE NO. 10.11, AN ORDINANCE transferring the amount of $30,000 f om 310- Street
to 380 -City of Yakima Urban Arterial Fund; authorizing the transfer t. 380 -City of Yakima
Urban Arterial Fund, and the deposit therein, of $10,000 from unappro•riated money in the
Current Expense Fund; and appropriating the amount of $2,110,736 within, and contemplated
to be deposited in, 380 -City of Yakima Urban Arterial Fund to Account No. 380-950, Con-
struction Expenditures, within said fund.
Mr. Bob Eschbach being present, stated that he is concerned about the traffic on Tieton
Drive when the children are going to and from school. He further sta ed that the sidewalk
is on the north side of the street only, and there are not enough mar ed cross walks, so
the children cross in many places instead of walking to a cross walk. Public Works Direc-
tor Mayo stated that there have been programs carried out on Tieton D ive and various
other streets, with the Police Safety Patrol system, and traffic and treets have been
observed where there seem to be more school children. He further sta ed that it would be

foolish to put cross walks at every intersection; that it is better to mark certain ones
and teach the children to walk to them in order to Cross, that it would, of course,
• be much better if there were sidewalks on both sides of all streets. No formal action was
taken on this matter. .
City Manager McMicken reported that Progress Report #3 on the Naches Water Treatment Plant
has been received from CH covering work accomplished through February 29, 1968, byTeeples
and Thatcher, In.c., recommending payment of same, it was MOVED by Robinson, seco`,nded-by •
McNeice, that the report of CH 1 M dated February 29, 1968, with to the progress on
said project be approved and - tat the progress estimate therein set forth be approved and •
payment in the amount of $86,174.56 be authorized: carried, Brown, Keith, Kurbitz, Lambert,
Larson, McNeice, and Robinson voting aye by voice vote..
City Manager McMicken reported that the City Engineer has submitted the following estimates
for. work performed during the month of February, 1968, for payment:

It was MOVED by Robinson, seconded by Brown, that the report of the City Engineer dated
February 29, 1968, with respect to the progress on the various construction projects of
the City of Yakima, be approved and that the progress estimates therein set forth be
approved and payment of the same authorized: carried, Brown, Keith, Kurbitz, Lambert,
Larson, McNeice, and Robinson voting aye by voice vote., -
A Notice-of Completion of L.I.D. No. 955, South Third Avenue Arterial Improvement, having
been submitted by the City . Engineer, it was MOVED by Robinson, seconded by Lambert, that .
April 1, 1968, be fixed as the time of Hearing on the Assessment Roll for this district
and that the City Clerk give due notice of publication and to each. property owner as pro -
vided by law: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson
noting aye by voice vote. •
• Petition No. 594 having been filed.with the City Clerk on February 23, 1968, by Norman F.
and Mary A. Richardson, requesting the of Utility Easement, and the City Engineer
recommending that said Easement be vacated, it was MOVED by Lambert, seconded by Keith,
that Resolution No. D -1183 vacating a public utility easement in Park Addition be passed as
read: carried, Brown, Keith, Kurbitz, Lambert, Larson,' McNeice, and Robinson voting aye on
roll call.

City Manager. McMicken submitted a request for out of State travel for Sgt. Bernard Kline,
to travel to Louisville, Kentucky, to attend the Southern Police Institute from March 1'6
to June 10, 1968, at a cost of $100 for registration fee and travel expense of $478. He
further reported that there is considerable honor -in being selected for this program; that
it is a twelve -week course for which he is getting his tuition paid, which amounts to
approximately $430,•and $110 for text books.; and recommended that this travel be allowed.
It was MOVED by Keith, seconded by Lambert, that said travel be allowed, with expenses paid:

City Manager McMicken requested that authorization be given to Sgt. Capon and Sgt. Brimmer
to attend a twd week Supervisory Training and Police Personnel School, with the idea that
they are getting training to advance rank. This school is to be held in Denver, at an
estimated cost of $424 per officer.: It was MOVED_by Kurbitz, seconded by Robinson, that
said travel be allowed with expenses paid: carried, Brown, Keith, Kurbitz, Lambert, Larson, .
McNeice, and Robinson voting aye by voice vote. •

There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Keith, that we'do now adjourn at the hour of 5:35 P.M.: carried, Brown, Keith,
