The Council met in regular session, Mayor Larson presiding, Councilmen Brown, Keith,
qU' Lambert, McNeice, and Robinson, City Manager McMicken, and-City Attorney Andrews present
• D-1' on roll call. Councilman Kurbitz absent on roll call. (Councilman Kurbitz present after
a 3:10 P.M.)

The Invocation was given by Councilman Brown.
The minutes of the regular meeting of January 22, 1968, having been duly certified •
accurate by two Councilmen, and no one present wishing to'have said minutes read publicly,.
Mayor-Larson declared said minutes approved as recorded.
This being the time fixed for the Hearing on Petition No. 568, filed by Va -Alta, Inc., .
requesting rezone of property situated southeast of the intersection of 9th and East "A"
Streets, Mayor Larson requested a report on this matter. Acting Planning Director Ed
Loidhamer reported that the applicant is requesting rezone of said property.from"R -3,
Multiple Family Zone, to B -3, General Business Zone, to, construct a 120 unit Motel and
other business facilities. He further stated that the'Planning Department staff and the
Planning Commission recommended that the application be•approved and said property be
rezoned as requested. Mr. Leonard Cockrill, Attorney, and Secretary of Va -Alta, Inc.,
being present and speaking in favor of the rezone, stated that this is an-application to
rezone the north half of a block, the south half of which is already zoned for general •
business, in order to construct a 120 unit Motel -Hotel convention facility. After due
discussion, it was MOVED by Keith, seconded by McNeice, that Ordinance No. 995 rezoning
said property be read: carried, Brown, Keith, Lambert, Larson, McNeice, and Robinson. .
voting aye by voice vote. Kurbitz absent. It was then MOVED by Brown, seconded by
Lambert, that Ordinance No. 995 accepting the recommendation of the Planning Commission
and rezoning said property, be passed as read: carried, Brown, Keith, Lambert, Larson,
McNeice,.and Robinson voting aye on roll call. Kurbitz absent.
ORDINANCE.NO. 995_, AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property situated on the east side of North 9th Street between "A"
Street and East Yakima Avenue, in the City of Yakima, Washington, from R-3, Multiple
Family Zone, to'B -3, General Business Zone.
This being the time fixed for the Hearing, on Petition No. 578, filed by Va -Alta, Inc.,
requesting Vacation of the entire alley in Block 190, Huson's Addition, Acting Planning

Director Ed Loidhamer reported that in addition to the rezone request, Va- Alta, Inc., has
filed an alley vacation request, and that the Planning Department Staff.and the Planning
'Commission recommended approval of said alley vacation. An Ordinance providing for
vacation of the entire alley in Block 190, Huson's Addition, having been read, it was
MOVED by Lambert, seconded by Brown, that said Ordinance be passed as read. Councilman
Robinson asked if the'strip of property owned by the City is accessible in any other way
than by the alley. Acting Planning Director Ed Loidhamer stated that access to this
property can be gained on the other side of the fence on East Yakima Avenue. Public Works
Director John Mayo explained that Va -Alta wants to purchase all or part. of this triangular
piece of property owned by the City and that Mr. Noel, property owner in this vicinity,
has also indicated an interest in purchasing some of this property, which is a part
the alley. (Kurbitz present after 3:10 P.M.) Mr. Leonard Cockrill stated that Va -Alta
would like to acquire all or part of this strip of property owned by the City and, although
there hasn't been any formal agreement with the Noel families regarding the purchase of

this property, he is certain such an agreement can be reached, as the Noel families had
no objection to the vacation of the alley. Councilman Robinson stated that he feels that
the City's interest is to get a fair price for this tract. He further stated that he •
feels that we should have the sale of the property.settled.first before approving the
vacation. City' Manager McMicken stated that the Staff had discussed the matter and
thought that the rezone and vacation matters . should come first; and, if approved, then
the matter of the sale of the property settled : and that he feels the prospective
purchasers are going to pay a reasonable sum. After due discussion, it was MOVED by
Robinson, seconded by Lambert, that action on the Ordinance providing for the Vacation •
• of said property be continued for one week, or until the matter of the sale of the property
is settled. Councilman Keith stated that he feels that the staff has worked out the
processing of these matters satisfactorily and that we would be complicating the whole
matter by delaying it a week. Councilman Robinson stated that he feels that the matter
should be delayed so that the sale and vacation can be considered at the same time. After
due discussion, Mayor Larson called for the vote on the Motion to continue the action on
the Ordinance providing for said Vacation, and it carried: Brown, Kurbitz, Lambert,
• Larson, McNeice, and Robinson voting aye by voice'vote. Keith voting nay by voice vote.
• It was then MOVED by Robinson, seconded by Keith, that an Ordinance be drawn authorizing
the sale of this piece of property owned by the City: carried, Brown, Keith, Kurbitz,
Lambert, Larson, McNeice, and Robinson voting aye by voice vote. City Manager McMicken
. asked what kind of Ordinance or Resolution the Council would like drawn up. Council
members indicated that it depends on whatever agreement is made between Va -Alta, Inc.,
and the Noel families. Mr. Noel, Sr., being present, stated that he doesn't believe that
the Noels are interested in that piece of property at this time. •

Petition No. 591, having been filed with the City Clerk on January 23, 1968, by Walter
• Bohen, requesting the vacation of a public utility easement located at the corner of
Cornell and 7th Avenue fronting on Mead, it was MOVED by Robinson, seconded by Lambert,
that said Petition be referred to the City Manager and Staff for study and recommendation:
carried, Brown, Kurbitz, Keith,. Lambert,' Larson, and,Robinson voting aye by voice
vote. -
MOVED by Brown, seconded by Robinson, that Ordinance No. 996 creating the City of Yakima
Urban Arterial Fund, be passed as read: carried, Brown, Keith, Kurbitz, Lambert, Larson,
McNeice, and Robinson voting aye on roll call.

ORDINANCE NO. 996, AN ORDINANCE creating the City of Yakima Urban Arterial Fund as a
special fund of the City of Yakima; designating the purpose of said fund, the source of
money to be.depbsited in said fund, and limiting expenditures therefrom; and creating
Chapter 3.74, consisting of Sections 3.74.010, .020, and .030 as a new Chapter and as new
Sections of the Ci_ty•of Yakima Municipal.Code. •

Mrs. Linda Osborn and Mrs. Beverly Wart, being present at this meeting, Mrs. Osborn
presented information regarding a Petition with 889 signatures of parents who are con-
cerned about the admission of minors to movies of questionable morality, and read a
prepared statement referring to this matter. She also read letters received by Mrs. Wart

in answer to ones she had written from Fred M. Vinson, Jr., Assistant Attorney General,
Department of Justice, Washington, answering one written to the President of the United
States; and letters from Senator Warren G. Magnuson and Congresswoman Catherine May.
Mrs. Osborn further read in her statement that they were "filing this material and peti-
tions with the City Council and County Commissioners requesting that an ordinance be
passed and enforced by legal authorities that admittance be refused to any minor under 18

years of age, unless accompanied by a parent or adult to any immoral or adult movie'with
Yakima City and /or County including Drive-in Theaters, and no more thah two features be
shown .. per evening." (While reference was made to filing a Petition with the City of
Yakima, it was not done at this time - there was an indication in discussion that the
current petition would be filed with the County. Copies of the statement read by Mrs.
Osborn and the letters referred to were filed with the City Clerk on this date, January
29, 1968.) Mrs. Wart asked if there is any way that an ordinance could be passed requir-
ing theater owners to post notice in the theaters when adult or movies of questionable
morality are to be shown and should prohibit minors under 18 attending She also mentioned
foreign films being shown that they felt were not proper for children.1 Council members
asked City ,Attorney Andrews if an Ordinance can be written that would restrict . attendance
as requested. City Attorney Andrews stated that there are two cases now pending before
the United States Supreme Court regarding censorship, and it will probably be better to
await the outcome of these before attempting any local legislation ... on this matter, as the
States and Cities will then have some guidelines to follow. Mr. Mike M ercy., owner of the
two Yakima theaters in the City Limits, stated that they do make a policy of not showing
such films as mentioned by Mrs. Osborn and Mrs. Wart, and suggested that one positive way
to end the showing of these films is by non - participation. He also stated that there is a
certain obligation on the parents' part regarding allowing children to attend certain
movies. Mr. Mercy stated that with respect to the foreign films, the ones in this series
are good films, according to the Legion of Decency. He further stated that he will be
glad to work with anybody in any way concerning the theaters he operates. Mr. Herb
Blisard, representing Yakima Valley College, spoke regarding the foreign film series;,
stating that it is being sponsored by the College and shown at a downtown theater because
the College does not have the facilities, and stated that these films are selected with
the idea of art value. He further stated that these foreign films have been well received
and that they did cut two films from the series. Council members indicated they feel that
our Supreme Court has gone a long way in trying to protect minors, and they are hopeful
that the two cases now before the Supreme Court will protect the children. They further .
indicated that the City Council has an obligation to our citizens not to spend their funds
for unnecessary litigation and do look to the parents to protect their children. Don Tait,
a county resident, indicated that he does not feel that the City Council should leave the
matter to the Federal Government. After due discussion, Mayor Larson stated that the City
Manager, Staff and City Council will take this matter under consideration, and. asked
Mrs. Osborn if she wished to file her petition with the Council. Mrs. Osborn stated that
she is going to file it with the County Commissioners. y-
With reference to a letter written to the President of West Coast Airlines by the Yakima
Chamber of Commerce, Mr. Howard Hettinger, Attorney, and Mr. Jim Fletcher, Assistant Mana-
ger of the Yakima Chamber of Commerce, were present to ask the City to join with the
Chamber of Commerce in participating in an investigation of the complaints received, and
suggesting that West Coast Airlines be invited to participate in this investigation.
Mr. Hettinger stated that the City of Yakima depends upon a good air service,, and the
Chamber of Commerce's interest is not one of attack, but one of finding out if there is
some substance to the complaints received. City Manager McMicken suggested that as a part
of this investigation of these complaints a survey at the airport be included, which would
give people a chance to make comments. He further suggested that the Airport Manager could
construct a box at the airport, with a sign on it asking for comments regarding the Air-
port, air service, personnel, etc., and asking them to sign it and place it in the box.
Mr. McMicken also suggested that in addition to the information they might gather from
these comments, they might use what resources are available to actuall inquire of the
travellers what their comments would be. After due discussion, it was MOVED by Keith,
seconded by McNeice, that the City Council and City Staff work with the Chamber of Commerce
as negotiations are made with West Coast Airlines for improved service carried, Brown,
Keith, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote.

It was MOVED by Robinson, seconded by Brown, that the report of the City Treasurer dated
December 31, 1967, regarding the investments of the City of Yakima, belaccepted and
approved: carried. Brown, Keith, Kurbitz, Lambert Larson, McNeice, arid Robinson voting
aye by voice vote. Councilman Robinson referred to the amount of $954,000.00 cash on hand
after investments and stated that he would hope that there can be an allalysis to find
out if some of this can be invested, as it seems that at the end of each month there is a
very large cash balance on hand. Mayor Larson stated that the Investment Committee is
trying to get as much cash invested as possible. City Manager McMicken stated that he and

the former Finance Director, Ray McGraw, have talked about this matter and he has also
talked with the new Finance Director, Leonard Crose, and he informed Council members that
within the next couple of weeks an analysis will be made and a report given to the Council.
The matter of prohibiting on- street parking on 16th Avenue between Nob Hill Blvd. and.
Lincoln Ave., having been continued from January 22, 1968, City Manager McMicken stated
that Public Works Director Join Mayo is prepared to give us . more detail, or if the Council
wishes this may be an item that would follow the reconstruction of the street. It was
MOVED by Robinson, seconded by Kurbitz, that this matter be postponed indefinitely, with
the hope that the people who live on that street will recognize that there will not be
parking on the street during the construction and after it: carried, Brown; Keith, Kurbitz
Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Robirisod stated that he
hopes that the people will be informed so that it can be a matter of general interest to
them and that he feels we shouldn't inconvenience them until the time comes that we have
to do it.
A Notice of Completion of North 56th Avenue Arterial Improvement, L.I.D. No. 960 -1, having
been submitted by the City Engineer, it was MOVED by Robinson, seconded by Lambert, that
February 26, 1968, be fixed as the time of Hearing on the Assessment Roll for this district
and that the City Clerk give due notice of publication to each property owner as provided
by law: carried, Brown, Keith, Kurbitz, Lambert, Larson, McNeice. and Robinson voting aye
by voice vote.
There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Keith, that we do now adjourn at the hour of 4:30 P.M.: c9rri'e'd, Brown, Keith,
