Councilmen Brown, Kurbitz, Lambert, Larson, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilman Lynch absent on roll call. It was MOVED by Brown, seconded by McNeice, that Councilman Lynch be excused from this meeting: Carried, Brown, Kurbitz, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Lynch absent. The Invocation was given by Councilman Kurbitz. . The minutes of the regular meeting of November 6, 1967, having been duly . certified accurate by two Councilmen, and no one present wishing to have said minutes, read publicly, Mayor Larson declared said minutes approved as recorded. This being the time fixed for the Hearing on Petition No. 554, filed by Emery Blakely, requesting annexation of property located at 1110 St. Johns, it was MOVED by Brown, seconded by Robinson, that Ordinance No. 970 providing for said annexation be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. Lynch absent. ORDINANCE NO. 970, AN ORDINANCE annexing property to the City of Yakima, and zoning said property. This being the time fixed for the Hearing on Petition No. 559, filed by Jack Redfield and Cecil Schmoe, requesting annexation of property located at 723 and 725 Fair Avenue, it was MOVED by Brown, seconded by. Lambert, that Ordinance No. 971 providing for said annexa- tion, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. Lynch absent. . . I ORDINANCE NO. 971, AN ORDINANCE annexing property to the City of Yakima, and zoning said • property. r Petition No. 564, having been filed with the City Clerk on November 3, 1967, by Lloyd H. Hammerstad and H. Eugene Patterson, requesting improvement of property by the construc- tion of a sewer to serve Lots 11 through 20, Carolyn Addition, located south of Lincoln Avenue between 57th and 58th Avenues, it was MOVED by Robinson, seconded by McNeice, that said petition for the creation of a local Improvement District be referred to the City Manager and Staff for study and recommendation: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Lynch absent. An Ordinance appropriating $3,000 within the 1967 Budget for Water -Sewer Fund, having been ' read in its entirety, was ordered laid on the table for one week or until the next regular meeting of the City Council on November 20, 1967. City Manager McMicken explained that this additional appropriation is needed because the City has been required to operate II domestic water wells and pumps at the treatment plant more this year than previously. It was further indicated that the demand this year was up two million gallons per day over last :year. It was MOVED by McNeice, seconded by Brown, that Ordinance No. 972, amending the Ordinance adopting the comprehensive plan for the City and providing for the procedure to amend said Plan, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye on roll call. Lynch absent. City Attorney Andrews explained that this ordinance changes one word, "Ordinance," to "Resolution," so that the Comprehensive Plan• may be changed by resolution instead of by ordinance. City Manager McMicken explained that. the State Law has been amended to permit this method. The technique for approval is the same, but the Council action is a statement by resolution, which makes it a statement of policy, rather than,law. The concept is that the Comprehensive Plan is a long range general statement, with maps and text, of what we expect and hope the community to be in the next twenty years or so. It is not a law. It is not binding in the sense that ordinances are binding, but is a statement, and as such, is flexible and may be amended. City Attorney Andrews explained that the State Law talks about a "Com- prehensive Plan." The City plan was called a "General Plan," but is referred to as a comprehensive plan. There are three terms: long range, comprehensive, and general, and they all refer to the same thing. ORDINANCE NO. 972, AN ORDINANCE relating to planning; specifying a procedure for amending the comprehensive plan of the City of Yakima; and amending Section 2 of Ordinance No. 779, passed March 7, 1966, and entitled "AN ORDINANCE relating to planning; adopting a com- prehensive plan for the City of Yakima; providing a procedure for amending such plan; and repealing Section 1.42.070 of the City of Yakima Municipal Code." An appeal from the Planning Commission's decision on Petition No. 560, having been filed with the City Clerk on October 13, 1967, by Wallace R. and Dorothy Klingele, requesting rezone of property located at 2609 West Nob Hill Blvd., it was MOVED by Robinson, seconded by McNeice, that November 27, 1967, be fixed as the time for the hearing by the City Council on said matter, and that the City Clerk give notice of such hearing as required by law: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. The Planning Commission reporting on Petition No. 561, filed with the City Clerk on October 17, 1967, by Frigid Fruit Company, requesting rezone of property located between Pierce and Perry Streets, west of South 16th Avenue, it was MOVED by Robinson, seconded III by Brown, that November 27, 1967, be fixed as the time for a hearing by the City Council on said Petition and that the City Clerk give notice of such hearing as required by law: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Lynch absent. A letter having been addressed to the City Council by George H. Mullins, Municipal Court Judge, regarding Driver Education in traffic violators school, Judge Mullins, being present, explained that this school has been held in the Court House since December of last year. He stated that an ordinance is needed in order to provide penalties for failure to attend the school, when directed to do so by the Court, and also in order to make it possible to accept donations from insurance companies, clubs, etc., for the school. The County Commissioners have been asked to pass a similar ordinance. There will be no cost to the °City. After due discussion, it was MOVED by Robinson, seconded by Lambert, 351 NOVEMBER 13, 1967 that Mr. Andrews be requested to prepare an ordinance that would implement.Judge Mullins' request: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Lynch absent. • . Mrs. Alan Grant was present and stated she wanted to call the attention of the Council to • an "injustice" to new property owners in Yakima. She_has on two different occasions received second notices of assessments on property without having ever received' a first notice, and on both occasions a .penalty has been charged. In one case, she had only ten days to pay the amount and penalty to avoid being charged an additional penalty. She sug- gested that'title companies be required to provide the City Treasurer with a list of new property owners. She believes that the penalty. should be waived in the case where a property owner does not receive the first notice. Director of Public Utilities Frank Stein explained that State Law requires that in the case of irrigation maintenance assessments the Citysh:all not change the rolls in any way from County Treasurer's records. Mr. Friedline, Assistant City Manager, stated that these rolls are updated every month_ by checking the County Treasurer's records. It was MOVED by Kurbitz that the penalty be . waived. Motion died for want of a second. Council members questioned whether the City Council has the Authority to waive the penalty. The Council members requested that City Manager McMicken give the Council a report on the method of handling notices and suggested that the title companies .be asked to notify new owners of outstanding assessments. City Manager McMicken presented the. request of five tow truck operators to amend Section 9.36.340 of the,Yakima Municipal Code, REDEMPTION OF IMPOUNDED VEHICLES, to raise impound fees from $7.50 to $10.00. He stated that the request was referred to Acting Chief Madden and a conference was held, with the tow truck operators and Police officers in. attendance. Mr. McMicken recommended approval of this increase. After due discussion, it. was MOVED by •Lambert, seconded by Robinson; that an ordinance be drawn'providing for the increase in impound fees from $7.50 to $10.00: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Lynch absent. • City Manager McMicken reported on the application of Yakima Pallet & Bin, Inc., for Utility P 6 Connection Outside Yakima City Limits, and recommended the'application be sent to the . Planning Commission for a report. Director of Public Utilities Frank Stein reported•that the connection was desired for fire protection and t o reduce insurance costs. The cost • ould be about $4,500 for the installation of the. meter connection for the service, this amount to be paid by Yakima Pallet & Bin, Inc. An eight inch line is contemplated, which will provide water for both fire prevention and domestic purposes, and it is planned to tap into the transmission line for this purpose. Cameron, Architect for this project, it was MOVED by McNeice, seconded by Brown, that said report dated November 13, 1967, with respect to the progress on this project, be approved and that the estimate of $20,162.44 be approved and payment of the same authorized: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye -by voice vote. City Manager McMicken reported two requests for travel and recommended they be allowed as follows: Alice Bachison, Ernie Amos, and Bernard Kline of the Police Department to attend Police Community Relations Institute in Portland, Oregon, at an approximate cost of $265; and James Beaushaw of Police Department to use City car for trip to Crescent: City, Cali- fornia, on an extradition matter, accompanied by the Prosecuting Attorney, no other expense incurred. It was MOVED by Kurbitz, seconded by McNeice, that the requested travel be allowed with expenses paid: carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote. Lynch absent. Mayor Larson reported that the Mayor's Committee on Human Rights has suggested that Rev. Jesse Boyd be appointed to fill the vacancy on the Executive Board left by the resignation of Rev. Warren Campbell. The other Council representatives on the Executive Board are: Ralph Holbrook, Roy Tufts and Stuart Semon. It was MOVED by Robinson, seconded by Lambert, that Rev. Jesse Boyd be appointed to serve on the Executive Board of the Mayor's Committee on Human Rights: Carried, Brown, Kurbitz, Lambert, Larson, McNeice, and Robinson voting aye by voice vote.
