Brown, Lambert, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on roll call. Councilmen Kurbitz and Lynch absent on roll call. It was MOVED by Robinson, seconded by McNeice that Councilmen Kurbitz and Lynch be excused from this meeting: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote. The Invocation was given by Councilman Lambert. The minutes of the regular meeting of October 30, 1967, having been duly certified accurate . by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. An Ordinance appropriating 822,000 within the 1967 Budget for Water -Sewer Fund, having been read in its entirety at the regular meeting on October 30, 1967, and being read by Title only at this meeting, it was MOVED'by Brown, seconded by Robinson that Ordinance No. 966 providing for said appropriation, be passed as read: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye on roll call. Kurbitz and Lynch absent. ORDINANCE NO. 966, AN ORDINANCE appropriating the amount of 522,000 from unappropriated money in Water -Sewer Fund to Account 520 -930, Other Structures and Improvements of the Capital Outlay General Classification, and to Account 520 -340, Stationary Equipment, Land, Building and Plant, of the Maintenance and Operation Classification, both within the 1967 appropriation for 520, Water - Sewer. This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 957, Coonse State Addition Sewer, and there being no protests in writing or otherwise, it was MOVED by Robinson, seconded by Lambert that Ordinance No. 967 confirming the assessment roll and every part thereof, be passed as read: carried, Brown, Lambert, Larson, McNeice and Robin- son voting aye on roll call. Kurbitz and Lynch absent. ORDINANCE NO. 967, AN ORDINANCE confirming the assessment roll covering Local Improvement District No. 957 as created and established by Ordinance No. 826 of the Ordinances of the City of Yakima. . . Petition No. 563, Notice of Intention to Commence Annexation. Proceedings, having been filed with the City Clerk on November 2, 1967, by M. H. Benjamin, President, Cabana Motor Hotel, Inc., requesting annexation of property from Tamarack, north to the Yakima River, the west boundary being Gordon Road and including the Cabana Motor Hotel at 1900 N. 1st. Street . it was MOVED by. Robinson, seconded by Lambert that this date be set as the time for a meet- ing with the initiating party who signed the Notice of Intention to Commence Annexation Proceedings dated November 2, 1967: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Kurbitz and Lynch absent. Mr. M. H. Benjamin, indicating that the area to be annexed is willing to assume its share of the City's existing indebtedness, it was duly moved, seconded and passed that the annexation proposed by petition no. 563 (Notice of Intention to Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought to be annexed be required to assume the City's existing indebtedness. The above Motion was made by Robinson, seconded by McNeice and carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Kurbitz and Lynch absent. . MOVED by Lambert, seconded by Brown that Ordinance No. 968 amending Ordinance No. 959 creating L.I.D. No. 967, Valley View Estates & Others Paving District, be passed as read: carried,. Brown, Lambert, Larson, McNeice and Robinson voting aye on roll call. Kurbitz and Lynch absent. John Mayo, Director of Public Works, reported that the 30 day legal limit for protests to be filed has expired and that no protests in writing or otherwise have been filed other than those made and filed at the regular meeting of the City Council on October 2, 1967. He further reported that the protests amounted to 64.85% on Garrett Street, from N. 16th to N. 18th Avenues, making it necessary to amend Ordinance No. 959 by deleting this portion from the District. ORDINANCE NO. 968, AN ORDINANCE amending. Section 1 of Ordinance No. 959 entitled "AN ORDINANCE providing for the improvement of certain property by grading, ballasting, sur- facing with asphaltic concrete, constructing concrete curbs and gutters, together with necessary drainage features; establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. ", passed by the Yakima City Coun- cil on October 2, 1967. . MOVED by Brown, seconded by Lambert that Ordinance No. 969 fixing the time of delinquency and providing for the issuance of bonds for the unpaid portion of L.I.D. No. 950., Fairbrook Addition and Other Sewers, be passed as read: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye on roll call. Kurbitz and Lynch absent. .. ORDINANCE NO. 969, AN ORDINANCE fixing the time of delinquency of installments of assess- ments levied for the payment of the cost of the improvement in Local Improvement District No. 950, and providing for the issuance of bonds with coupons attached for the payment of the unpaid portion thereof. A Resolution designating a taxicab stand for use by Yellow Cab Co., Inc., and repealing Resolution No. D -967 passed June 13, 1966, having been prepared for Council action, and City Attorney Andrews indicating that there is to be further study on the matter of taxi= cab stands, it was MOVED by Robinson, seconded by McNeice that action on this matter be post poned indefinitely: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Kurbitz and Lynch absent. Public Works Director John Mayo referred to the Sanitary Sewer System Sealing Project being done by the Penetryn Systems, Inc., stating that they are very pleased with the work, but will withhold judtment on the work done, for one season to be sure that the sealing material used does the job it is supposed to do. A letter having been received from Mrs. J. I. White, on October 30, 1967, regarding utilities billing procedures and suggesting that all utility customers be required to put up a deposit when they apply for water service, and a memo regarding this matter and current billing procedures having been received from Frank Stein, Public Utilities Direc- tor, it was MOVED by McNeice, seconded by Robinson that this matter be referred to the City Manager and Staff for further study and recommendation: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Kurbitz and Lynch absent. A damage claim having been filed with the City Clerk on October 30, 1967, by Helen R. Bivens, Grandview, in the amount of 525,000 for injury caused by a fall on a defective sidewalk in the City of Yakima, it was MOVED by Robinson, seconded by McNeice that said damage claim be referred to the City Manager and Staff for study and recommendation: carried,. Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Kurbitz and Lynch absent. The City Manager reporting that there is to be a joint public meeting of the City Council and the public on Wednesday, November $, 1967 at 7:30 P.M., on the presentation of a study outlining location of proposed overpasses, traffic data, etc., in connection with sub - mitting a Prospectus on Overpasses to the Urban Arterial Board and recommending that the Planning Commission . members be invited to this meeting, it was MOVED by Robinson, seconded by McNeice that the Planning Commission members be invited to attend this meeting: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote. Kurbitz and Lynch absent. There being no further business to come before the Council, it was MOVED by McNeice, seconded by Robinson that we do now adjourn at the hour of 3:30 P.M.: carried, Brown, Lambert, Larson, McNeice and Robinson voting aye by voice vote.
