OCTOBER 23 1967'
The Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz,
Lynch, McNeice and Robinson, City Manager McMicken and City Attorney Andrews present on
roll call. Councilman Lambert absent on roll call. It was MOVED by Robinson, seconded by
Lynch that Councilman Lambert be excused from this meeting: carried, Brown, Kurbitz, Larson,
Lynch, McNeice and Robinson voting aye by voice vote.
The Invocation was given by Councilman Lynch. .

The minutes of the regular meeting of October 16, 1967, having been duly certified accurate
by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor .
Larson declared said minutes approved as recorded.
Petition No. 560, having been filed with the City Clerk on October 13, 1967, by Wallace R.
and Dorothy :M. Klingele, requesting rezone of property located at 2906 West Nob Hill Blvd.,
and Petition No. 561, having been filed with the City Clerk on October 17, 1967, by Frigid
Fruit Co., Inc :, requesting rezone of property located at 1710 S. 16th Avenue, it was MOVED
by Robinson, seconded by Brown that said Petitions be referred to the City Manager and
Planning Commission for study and recommendation:_carried, Brown, Kurbitz, Larson, Lynch,
McNeice and Robinson voting aye by voice vote. Lambert absent, -
Petition No. 526, having been filed with the City Clerk on October 20, 1967, by Chester S.
and Lillian M. Meyer, requesting annexation of property located on both sides of S. 44th
Avenue from Nob Hill Blvd. to Storm Avenue extended, it was MOVED by Robinson, seconded by
Lynch that Petition No. 526 for Annexation filed by Chester S. and Lillian M. Meyer, be
approved as meeting the requirements of law; that said Petition be referred to the City
Manager and Planning Commission for study and recommendation; that the Mayor be authorized
to obtain waivers of a meeting by a Review Board; and that December 11, 1967, be set as
the date for a public hearing by the City Council on this Petition: carried, Brown, Kur-
bitz, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Lambert absent.
Petition No. 562, Notice of Intention to Commence Annexation Proceedings, having been
filed with the City Clerk on October 20 1967, by George M. Sears, Northwest Equipment Co.,
et al., requesting annexation of property located south of the present City Limits on S.
1st Street, it was MOVED by Lynch, seconded by McNeice that this date be set as the time
for a meeting with the initiating parties who signed the Notice of Intention to Commence
Annexation Proceedings dated October 20, 1067: carried, Brown, Kurbitz, Larson, Lynch,
McNeice and Robinson voting aye by voice vote. Lambert absent. Mr. George M. Sears and
Mr. J. G. Lindeman of Northwest Equipment Co., indicating that the area to be annexed is
willing to assume its share of the City's existing indebtedness, it was duly moved, secon-
ded and passed that the annexation proposed by petition No. 562 (Notice of Intention to
Commence Annexation Proceedings) be accepted by the City of Yakima and that the area sought
to be annexed be required to assume the City's existing indebtedness. The above Motion

and Robinson voting aye by voice vote. Lambert absent.
MOVED by Brown, seconded by Robinson that Ordinance No. 964 relating to licenses and
business regulations in connection with rules and regulations specifying hours during
which dancing is permitted at public dances and cabarets, and amending the Yakima Municipal
Code; be passed as read: carried, Brown, Kurbitz, Larson, Lynch, McNeice and Robinson
voting aye on roll call. Lambert absent. City Attorney Andrews explained that this Ordi-
nance permits dancing on New Year's Eve from 2:00 P.M. when December 31 falls on a Sunday,
and permits dancing until 3:00 A.M. on any New Year's Day. . .
ORDINANCE NO. 964, AN ORDINANCE relating to licenses and business regulations; regulating
dance halls and cabarets; adopting rules and regulations specifying hours during which
dancing is permitted at public dances and cabarets; amending Subsection 1. of Section
5.2$.140 of the City of Yakima Municipal Code.
A Damage Claim having been filed with the City Clerk on October 16, 1967, it was MOVED by
McNeice, seconded by Lynch that said Damage Claim filed. :byDonald and Inis Potter, be
referred to the City Manager and Staff for study and recommendation: carried, Brown, Kure.

The City Manager reported on two requests for Outside City Utility _Services, as filed by
Glascam Builders for sewer service to five acres of land located on 56th Avenue between
Chestnut and Summitview on which Glascam proposes to construct a 24 apartment condominium,
and by Patrick L. Marshall for property within the same block, on which is being construc-
ted a four -unit apartment: He further stated that he cannot recommend approval of these
applications partly due to the lack of time there has been to assimilate all City policies
and that he would recommend that the Council declare a moratorium on outside City utility
connections, until a thorough review of present policies can be made. Ronald F. Whitaker,
attorney representing Glascam Builders, Inc., explained the plans of Glascam Builders re-
garding the proposed 24 apartment condominium and stated that they are willing to pay for
building permits and comply with City Codes for new construction and to consent to annexa-
tion as soon as possible and feels that this will be a welcome addition to that part of
the country. Mr. Alex Maxwell, representing Yakima Federal Savings and Loan,spoke in .-
behalf of and in favor of the proposed project as submitted by Lee Campbell and his
attorney Ron Whitaker. Councilman Robinson stated that since there are definite plans laid
out for this condominium, and the Builders are willing to comply with all City requirements
that he feels that this sewer connection should be approved on the condition that the water
is also taken from the City supply. After due discussion by Council members, it was MOVED
by Robinson, seconded by McNeice that the outside utility connection that has been applied
for by Glascam Builders, Inc., be granted, on the usual conditions -- the signing of the
outside hookup agreement, and that City water also be used: carried, Brown, Kurbitz, Larson,
Lynch, McNeice and Robinson voting aye by voice vote. Lambert absent. City Manager
McMicken stated that in reference to the second application for service, filed by Patrick
L. Marshall, the applicant stated that he is not willing to pay for City building permits,
probably because the construction is already practically completed, but that the owner is
apparently willing to annex at some future date. Council members stated that they do not
feel that enough study has been made on this matter and would like to know more about the
financing of the project and the inspection, etc. After due discussion, it was MOVED by
Robinson, seconded by Lynch that the matter of the request for outside sewer hookup by
Patrick L. Marshall, be post -poned for one week, in order to study the matter further:
carried: Brown, Kurbitz, Larson, Lynch, McNeice and Robinson voting aye by voice vote.

OCTOBER 23, 1967
City Manager McMicken reported that R. S. Cameron, Architect fbr the new office building at
the Airport, has advised the need for primary and secondary power and telephone service to
the building'to be occupied by the Weather Bureau. He further stated that the service
would also be extended to the Fire.Station and the temporary overhead wires eliminated, as
the new service is proposed to be undergrounded. City Manager McMicken stated that the
cost of the new service is estimated at and that the funds are available within
the Airport Bond Issue. He further reported that the City Attorney advised that this work
can be let through the general contractor for•the Weather Bureau building on a change
order basis, through the Architect and recommends that unless the Council has'objections
to this procedure, that he will proceed with this course.of action. After due discussion,
it was MOVED by Robinson, seconded by Lynch-that the change order be authorized and that
the City Manager be authorized to proceed as outlined: carried, Brown, Kurbitz, Larson, •
Lynch, McNeice and Robinson voting_ay..e.by voice vote. Lambert absent.,•
City Manager McMicken reported that there - - -has been a request by the State Community Work
and Training Program for the City to provide on- the -job training to two men in the Sewage
Disposal Plant. He further stated that both Public Utilities Director! Frank Stein and
Paul Page, Supt. of the Sewage Department, recommend this program. After due discussion,
it was MOVED by Lynch, seconded by McNeice that this program be carried out: carried,
Brown, Kurbitz, Larson, Lynch, McNeice and Robinson voting aye by voice vote,. Lambert
absent.
There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Lynch. that we do now adjourn at'the hour of 4:05 P.M.: carried, Brown, Kurbitz,.
Larson, Lynch, McNeice and Robinson voting aye by voice vote. Lambert absent.
