SEPTEMBER 11, 1967
The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz,
Lambert, Larson, Lynch, McNeice and Robinson,°Cityl'�.Manager McMicken and City Attorney
Andrews present on roll call. .
The Invocation was given by Councilman Lynch.
The minutes of the regular meeting of September 5, 1967, having been duly certified accurat:•
by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as recorded.
Before proceeding with the meeting further, the new City Manager, Craig W. McMicken, was
sworn in by the City Clerk, and welcomed by Mayor Larson and the Councilmen. .
Ordinance No. 954, relating to the distribution of handbills, having been continued from
the Council meeting of August 28, 1967, and at that meeting it was MOVED by Robinson,
seconded by Lynch to pass said Ordinance as read, Mayor Larson asked for further discussion
on this matter. Mr. Tony Arntson, attorney, representing Mr. Baer who had requested that
the Yakima Municipal Code be amended so that handbills may be attached to . the doorknob of
residences, unless . the occupant specifies that he does not wish to receive such material,
stated that he and his client will be glad to answer any questions regarding this matter.
After due discussion, Mayor Larson called for the roll call vote on the Motion to pass
Ordinance No. 954 as read, and it carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice
and Robinson voting aye on roll call.
ORDINANCE NO. 954, AN ORDINANCE relating to public safety and morals; prohibiting bill
posting; regulating the distribution of handbills; amending Section 6.04.465 of the City
of Yakima Municipal Code; and adding Section 6.04.466 as a new section to the City of
Yakima Municipal Code.
Petition No. 553., having been filed with the City Clerk on September 6, 1967, by Wilsen M.
Wierman & Others, requesting the improvement of property by the covering of an open irriga-
tion canal between Summitview Avenue and the intersection of S. 18th and Park Avenues, it
was MOVED by Robinson, seconded by Lynch that said Petition for the creation of a Local
Improvement District, be referred to the City Manager and staff for study and recommenda-
tion, and that the people involved in this request, be so informed: carried, Brown, Kur-
bitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote. -
MOVED by Lynch, seconded by Brown that Resolution No. D - 1115 adopting the 1968 Preliminary
Budget for the City of Yakima, fixing October 2, 1967, as the date for hearing on the
adoption of the Final 1968 Budget, and directing the City Clerk to give notices of Budget
proceedings, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice
and Robinson voting aye on roll call. City Manager McMicken explained that there will be
meetings of the Council members and various departments to discuss and study the Budget
before the Hearing on the adoption of the Final Budget.
RESOLUTION NO. D - 1115, A RESOLUTION adopting the 1968 Preliminary Budget for the City of
Yakima, setting a date for hearing on the adoption of the Final 1968 Budget, and directing
the City Clerk to give notices of Budget proceedings.
MOVED by_Lambert, seconded by Brown that Resolution No. D - 1116, a Resolution of intention
to improve property by the construction of curbs, gutters and surfacing of various streets
and alleys in accordance with Petitions No. 511, 517, 519, 520, 539, 540, 541 and 552, and
the alley, Block 2,. Grandview Addition, and cul de sac south end of Bel Air Drive, and
fixing the time for Hearing on said matter for October 2, 1967, be passed as read: carried,
Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call.
RESOLUTION NO. D -1116, A RESOLUTION of intention to create a local improvement district.
MOVED by Lynch, seconded by McNeice that Resolution No. D -1117 authorizing the purchase of
property from Congdon Orchards, Inc., for airport clear zone and street right -of -way pur-
poses, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and
Robinson voting aye on roll call. City Attorney Andrews explained that negotiations have
been in progress for some time to acquire this property and all legal aspects have been
satisfactorily settled.
RESOLUTION NO. D - 1117, A RESOLUTION authorizing the purchase by the City of real property
from Congdon Orchards, Inc., for airport clear zone and street right - of - way purposes.
MOVED by Lambert, seconded by Robinson that Resolution No. D -1118 authorizing the hiring
of work and purchase of materials without calling for bids, to pay for electrical repair
and installation.work at the Yakima Municipal Airport, be passed as read: carried, Brown,
Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye on roll call. City
Attorney Andrews explained that this was for emergency work that was done in March, 1967,
by Pacific Power and Light Co. for S1,339.75 and Knobel Electric for $888.97, due to a
power failure in an underground line.
RESOLUTION NO. D -1118, A RESOLUTION authorizing and ratifying the hiring of work and the
purchase of materials without calling for bids.
The City Engineer reporting on the completion of L.I.D. No. 952, Fairbrook Addition and
Other Streets, it was MOVED by Robinson, seconded by Brown that October 9, 1967, be fixed
as the time of Hearing on the Assessment Roll for this district, and that the City Clerk
give due notice of publication and to each property owner as provided by law: carried,
Brown, Kurbitz, Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote.

The Planning Commission reporting on Petition No. 533, filed by Phillip J. Robillard &
Others, requesting vacation of a portion of Bell Avenue, it was MOVED by Robinson, seconded
by Brown that a resolution be prepared setting October 9, 1967 as the time for a hearing
by the City Council on. said Petition: carried, Brown, Kurbitz, Lambert, Larson, Lynch,
McNeice and Robinson voting aye by voice vote.
City Manager McMicken indicated that he feels that a special study session should be held
on the Budget and it was decided by'Council members that they would meet in the Council
chambers on September 19, 1967, at 7:30 P.M.
There being no further business to come before the Council, it was MOVED by Kurbitz,
seconded by Lynch that we do now adjourn at the hour of 3:45 P.M.:_ Brown, Kurbitz,
Lambert, Larson, Lynch, McNeice and Robinson voting aye by voice vote.
