The City Council met in regular session, Mayor Larson presiding, Councilman Brown, Lambert,
and McNeice, Acting City Manager Friedline and City Attorney Andrews present on roll call.
Councilmen Kurbitz, Lynch and Robinson absent on roll call. Councilmen Lynch and Robinson
having been excused from this meeting at the regular meeting on July 24, 1967, it was MOVED
by Brown, seconded by McNeice, that Councilman Kurbitz be excused from this meeting:
carried, Brown, Lambert, Larson and McNeice voting aye by voice vote.
The Invocation was given by Councilman Brown.

The minutes of the regular meetings of July 24 and July 31, 1967, having bee duly certified
accurate by two Councilmen, and no one present wishing to have said minutes read publicly,
Mayor Larson declared said minutes approved as recorded. .
This being the time fixed for the Hearing on Petition No. 527, filed by Fred M. Plath and
Others, requesting annexation of property located southeast of the intersection of Englewood
Avenue and N. 40th Avenue, it was MOVED by Lambert, seconded by Brown that Ordinance No. 941
providing for said annexation, be passed as read: carried, Brown, Lambert, Larson and
McNeice voting aye on roll call. Kurbitz, Lynch and Robinson absent.
ORDINANCE NO. 941, AN ORDINANCE annexing property to the City of Yakima, and zoning said
property. _ .
This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 916, West
• Nob Hill Boulevard Curb, Gutter and Paving District and there being protests in writing and
otherwise, it was MOVED by Brown, seconded by McNeice that Ordinance No. 942 confirming the
assessment roll and every part thereof, be passed as read. Mayor Larson opened the Hearing .
for discussion on said assessment roll. Property owners in this vicinity were present.
Some objected to this improvement for various reasons and others requested information.
Mrs. Maude Masters, 1020 Queen, stated she thought some of the charges were going to be taken
off her assessments for curbs and gutters that were already in. Public Works Director John
Mayo explained that when this question was brought up previously it had been stated that
this would be investigated and if the property was previously charged for this improvement,
this would be taken into con in figuring the assessments. He further stated that
their investigation showed that some of this property had been improved in the late thirties
by a W.P.A. project, and if any charges had been made against the property, it was figured
at about 35 per front foot, so they didn't feel there was really a credit due. Robert B.
Alton, 910.W. Lenox, stated that he did not feel that his property had been improved, as
there is now too much traffic on this street. John Mayo,stated that he could . not help but
feel that this property had been enhanced by this improvement, and that Mr. Alton was paid
a considerable amount of cash for right of way property, in excess of the improvement.
Mr. A. E. Stewart, 610 W. Lenox, stated he was forced to leave a 20 ft. piece of curb, and
that it -is not 20 ft., and is not striped as he thought it would be and cannot in any way
be marked as private parking, so anyone can park there. John Mayo explained that to make
- the curb cuts the proper size that this curb is about 17 ft. long, and that they will check
into the striping, which will not be a problem. Mrs. Glen Smith, . 1126 W. Nob Hill, stated
they have a drainage problem, which they thought was going to be solved by this improvement,
and it was not; that the water runs down the driveway when it rains. John Mayo stated that
he was not aware of this problem and that it would be checked into to see if a line is
plugged, as there should not be a drainage problem. Mrs. Smith and also Mr. Hugh Thomas,
who stated he is very satisfied with the street, asked if there are going to be any signal
lights on Nob Hill between 16th and 10th Avenues, stating that there is a great need for one
at 10th and /or 12th Avenues for the safety of children especially.' Mr. Mayo explained that
traffic counts are taken at various times of the year on these streets, and traffic signals
- are not scheduled this year or next, but if the traffic count should warrant one sooner, it
will be put in. Mr. Stan Easter, 1110 Nob Hill, asked how the assessments to the property
owners were figured, and John Mayo explained that they were assessed only about 25% of the
cost of the actual work done, and the rest is paid by gas tax money. The City Clerk read
three written protests by property owners who were not present, from Harrison J. and Viola
O. Day, 1018 Queen Avenue, Sophia Pratt, 1017 Queen Avenue, and Mrs. Clemmie Stump, 1015
Queen Avenue, who do not feel that this is an improvement to their property and that they
should not have to pay for any part of the improvement. All persons having been heard,
Mayor Larson called for the roll call vote on the Motion to pass Ordinance No. 942 confirm-
ing said Assessment Roll and it carried: Brown, Lambert, Larson and McNeice voting aye on
roll call. Kurbitz, Lynch and Robinson absent.
ORDINANCE NO. 942, AN ORDINANCE confirming the assessment roll covering Local Improvement
District No. 916 as created and established by Ordinance No. 503 of the Ordinances of the
City of Yakima.
Petition No. 546, having been filed with the City Clerk on July 31, 1967, by Mrs. Ruth
Anglin & Others, requesting the condemnation of the incinerator located on the premises of
the Super Giant Grocery Store at S. 6th Street, and prohibiting the owners from using it
for burning purposes as it is a nuisance and fire hazard to the property owners in this
vicinity, it was MOVED by Lambert, seconded by Brown that said Petition be referred to the
City Manager and Staff for study and recommendation:. carried, Brown, Lambert, Larson and
McNeice voting aye by voice vote. Kurbitz, Lynch and Robinson absent.
Petition No. 547, having been filed with the City Clerk on August 1, 1967, by the Southeast
Yakima Community at Work, with 265 signatures, requesting improvement of street lighting in
the southeast area, it was MOVED by Brown, seconded by McNeice that said Petition be referred
to the City Manager and Staff for study and recommendation: carried, Brown, Lambert, Larson
and McNeice voting aye by voice vote. Kurbitz, Lynch and Robinson absent.
II MOVED by Brown, seconded by Lambert that Ordinance No. 943 relating to the production,
processing and distribution of Grade A Pasteurized milk and milk products, and amending the
Yakima Municipal Code, be passed as read: carried, Brown, Lambert, Larson and McNeice
voting aye on roll call. Kurbitz, Lynch and Robinson absent.
ORDINANCE NO. 943, AN ORDINANCE relating to public health and sanitation;;defining terms;
providing for the appointment of a milk inspector; requiring and providing for the licens-
ing of milk producers and distributors; regulating the production, processing, grading,
labeling, sale and other distribution of milk and milk products; declaring the violation
hereof to constitute a misdemeanor and providing for penalties for such violation; amending
Sections 4.64.010, .020. .030 and .040, adding Sections 4.64.050, .060 and .070, and
repealing Section 4,64.035, all of the City of Yakima Municipal Code.

with Petition No. 538, filed by Lee Campbell, and fixing the time of Hearing for August
28, 1967, be passed as read: carried, Brown, Lambert, Larson and McNeice voting aye on

RESOLUTION NO. D -1105, A RESOLUTION of intention to create a. local improvement district.
MOVED by Lambert, seconded by McNeice that Resolution No. D -1106 authorizing the City's
participation in litigation entitled State of Washington, et al, vs. Pennsalt Chemical
Corp., et al., cause number 7201 in the U. S. District Court for the Western District of
Washington, be passed as read:. carried, Brown, Lambert, Larson and McNeice voting aye on
roll call. Kurbitz, Lynch and Robinson absent. City Attorney Andrews explained that a
suit has been commenced in the United States District Court for the Western District of
Washington by various cities in the State of Washington for the recovery of damages for
alleged collusive bidding on the part of suppliers of chlor- alkali products €o these
various cities, including the City of Yakima, that this Resolution authorizes the City's
participation as a plaintiff in this litigation and to pay its pro rata share of costs
and attorneys'. fees, which will mean $1,000 deposit at this time.
RESOLUTION NO. D -1106, A RESOLUTION authorizing the City's participation in litigation
entitled State of Washington, et al, vs. Pennsalt Chemical Corp., et al, cause number 7201
in the United States Court for the Western District of Washington..
MOVED by Lambert, seconded by Brown that a Resolution authorizing the hiring of Bouillon,
Christofferson and Schairer, Consulting Engineers, in connection with the heating and
cooling system of City Hall, be passed as read. Acting City Manager Friedline explained
that there have been problems with the air cooling and the heating system in City Hall and
that this Concern has done a preliminary study of the system and some work on it, and the
air conditioning is much better this summer, but that the whole system needs to be
balanced and this Resolution will provide for this service and other mechanical work,
needed to solve the problems of the system. Council members indicating that they felt
they would like to have more discussion and study on this matter, and that they would like
other Council members not present to be able to discuss and study this situation, it was
MOVED by Lambert, seconded by Brown that this matter be postponed one week or until the
next regular Council meeting on August 14, 1967: carried, Brown, Lambert, Larson and
McNeice voting aye by voice vote. Kurbitz, Lynch and Robinson absent.
MOVED by Brown, seconded by McNeice that. Resolution No. D-1107 authorizing the execution
of an agreement renewing a'Pipeline_ Crossing Agreement with Yakima Valley Transportation
Company, be passed as read: carried, Brown, Lambert, Larson and McNeice voting aye on
roll call. Kurbitz, Lynch and Robinson absent. Acting City Manager Friedline explained
that this Resolution authorized the renewal of a Pipeline Crossing Agreement executed on "-
October 11, 1962, which allowed the City to install a water pipeline across the Yakima.
Valley Transportation Company right of way in the vicinity of an extension of North 6th
Avenue, which agreement terminates on October 31, 1967.
RESOLUTION NO. D 1107, A RESOLUTION authorizing and directing the Acting City Manager and
City Clerk of the City of Yakima to execute an agreement renewing a Pipeline Crossing
Agreement with Yakima Valley Transportation Company.
MOVED by Lambert, seconded by McNeice that Resolution No. D -1108 authorizing the hiring of
work and labor and the purchase of materials without calling for bids to repair trusses
in the Central Aircraft Building at the Yakima Municipal Airport, be passed as read:
carried, Brown, Lambert, Larson and McNeice voting aye on roll call. Kurbitz, Lynch and
Robinson absent. Airport Manager Jim Eakin explained that during the progress of work
performed by Central Steel and Tank Company, who had been awarded the bid to repair trusses
in the Central Aircraft Building at the Yakima Municipal Airport, it was found that further
similar work of an emergency nature was necessary, making it necessary to do this work
without calling for further bids.
RESOLUTION NO. D -1108, A RESOLUTION authorizing the hiring of work and labor and the pur-
chase of materials without calling for bids.
The following bids were received and considered by a Bid Board on July 10, 1967, for the
1967 Sanitary Sealing Program: -

The City Engineer recommended that all bids be rejected, as the low bid is nearly double
the Engineer's estimate of $22,8 and is considerably in excess of the funds available
for the 1967 sealing program, it was MOVED by McNeice, seconded by Brown that the recommen-
dation of the City Engineer be accepted and all bids on the. 1967 Sewer Sealing Program be
rejected: carried, Brown, Lambert, Larson and McNeice voting aye by voice vote. Kurbitz,
Lynch and Robinson absent.
The Planning Commission reporting on Petition No. 543, filed by Floyd Wills, requesting
rezone of property southwest of the intersection of N. 16th Avenue and Fruitvale Boulevard,
it was MOVED by Lambert, seconded by Brown that August 21, 1967, be fixed as the time for
a hearing on said Petition and that the City Clerk give notice of such hearing as required
by law: carried, Brown, Lambert, Larson and McNeice voting aye by voice vote. Kurbit -z,
Lynch and Robinson absent.

It was MOVED by Brown, seconded by McNeice that the report of the City Engineer dated
August 3, 1967, with respect to the progress on the various construction projects of the
City of Yakima, be approved and that the progress estimates therein set forth be approved
and payment of the same authorized: carried, Brown, Lambert, Larson and McNeice voting
aye by voice vote. • Kurbitz, Lynch and Robinson absent. •
The thirty days legal time limit for protests to be filed having expired July 19, 1967,.
Public Works Director John Mayo submitted a report dated July 28, 1967, on the tabulation
of protests received on the proposed improvement of West Nob Hill Boulevard Arterial
Street - South 16th Avenue to South 24th Avenue, a portion of L.I.D. #965 as follows:
The total anticipated cost of the Nob Hill Boulevard Arterial Street Improvement
project is $54,590.65 of which $13,971.57 is being assessed against adjoining
property owners.
The percent of protest, based on the assessment portion only is 36.15/._
The computation does not exceed the sixty (60) percent legal limit for protests.
No further action was taken by the Council.
An appeal from the Planning Commission's decision having been filed with the City
Clerk on August 7, 1967, on Petition No. 542 by Leo Gefroh and Others, requesting rezone
of property located at 1411 - 1415 West Yakima Avenue, it was MOVED by Brown, seconded by
McNeice that August 21, 1967, be fixed as, the time for a hearing by the City Council on
said matter, and that. the City Clerk give notice of such hearing as required by law:
carried, Brown, Lambert, Larson and McNeice voting aye by voice vote. Kurbitz, Lynch and
Robinson absent.
A damage claim having been filed with the City Clerk on August 4, 1967, by Guy S. Wheeler
for damages to plumbing fixtures at premises owned by claimant at 909 and 911 East Maple
Street, by mud and sand surging through domestic water pipes, it was MOVED by McNeice,
seconded by Brown that said claim be referred to the City Manager and - Staff for study
and recommendation: carried, Brown, Lambert, Larson and McNeice voting aye by voice
vote. Kurbitz, Lynch and Robinson absent.
Acting City Manager Friedline reported on three requests for travel, and recommended that
these be allowed as follows:
Police Chief Campbell requested that Sgt. John Jenkins be allowed to attend the American
Polygraph Association Seminar at Las Vegas August 20 - 24, 1967, at an approximate cost
of $150, stating that this is an annual meeting where they learn up -to -date methods;
Building Inspector Charles McCoy requested that he be allowed to travel to Twin Falls,
Idaho, August 17 - 19, 1967, to attend a Community Development Workshop, at an approxi-
mate cost of $164;
Fire Chief Shockley requested that he and Nels Lindberg be allowed to attend the Inter-
national Western Fire Chiefs Conference in San Francisco September 9 -15, 1967, travel-
ing in Lindberg's car, at an approximate cost of $300 for Lindberg and $150 for Chief
Shockley.
It was MOVED by Brown, seconded by McNeice that the requested travel be allowed with.,
expenses paid: carried, Brown, Lambert, Larson and McNeice voting aye by voice vote.
Kurbitz, Lynch and Robinson absent.
Acting City Manager reported that James Sellers is seven months.in arrears in his payments
on his lease on property at the Yakima Municipal Airport, and requested that the Council
direct the City Attorney to start proceedings to terminate said lease. City Attorney
Andrews explained that Mr. Sellers has to be given 15 days in which to pay his back payments
and should he become in arrears again, it becomes automatic to terminate the lease. Council
members stated they think seven months in arrears is much too long to let such a matter go
without something being done. After due discussion, it was MOVED by Lambert, seconded by
McNeice that the Council authorize the City Attorney to take action in this matter:'

Robinson absent.
