The City Council met in regular session, Mayor Larson presiding, Councilmen Brown, Kurbitz,
Lambert, Lynch and McNeice, City Manager Smith and City Attorney Andrews present on roll
call. Councilman Robinson absent and excused at the last meeting on May 15, 1967.
The Invocation was given by Councilman Lynch.
The minutes of the regular meeting of May 15, 1967, having been duly certified accurate by
two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson
declared said minutes approved as recorded.
This being the time fixed for the Hearing on Resolution No. D -1070, being a Resolution of
Intention to improve certain property by the construction of water mains, in accordance
with Petition Nos. 509, 512 and 515, and there being no protests in writing or otherwise,
it was MOVED by Lynch, seconded by Lambert that Ordinance No. 913 creating L.I.D. No. 964,
Dillon Addition & Others Domestic Water District, be passed as read: carried, Brown, Kur-
bitz, Lambert, Larson, Lynch and McNeice voting aye on roll call. Robinson absent.
ORDINANCE NO. 913, AN ORDINANCE providing for the improvement of certain property by con-
structing the necessary mains, fire hydrants, valves and other appurtenances for the pur-
pose of supplying water for domestic use and fire protection; establishing a Local Improve-
ment District, providing for the method of payment thereof, and creating a special fund.
This being the time fixed for the Hearing on Petition No. 51$, filed by Cook -Lewis Co. &
First Baptist Church, requesting rezone of property located at 7, 9 & 11 North 6th Street,
it was MOVED by Brown, seconded by Lambert that Ordinance No. 914 accepting the recommenda-
tion of the Planning Commission and rezoning said property, be passed as read: carried,
Brown, Kurbitz, Lambert, Larson, Lynch and McNeice voting aye on roll call. Robinson
absent.
ORDINANCE NO. 914, AN ORDINANCE accepting the recommendation of the Planning Commission and
rezoning property situated at 7, 9 and 11 North Sixth Street in the City of Yakima, Wash-
ington, from R -3, Multiple Family Zone, to B -3, General Business Zone and B -2, Local Busi-
ness Zone.
This being the time fixed for the Hearing on the Assessment Roll for L.I.D. No. 915, Sumac
Sewer District, and there being two protests in writing filed with the City Clerk, it was
MOVED by Lynch, seconded by. Brown that the Ordinance confirming said assessment roll and
every part thereof, be passed as read. Mr. John Noel, property owner, filed with Mayor
Larson, a written protest signed by his wife, Olivia Noel, which objected to being assess-
ed for this improvement. He explained that about 1935, he had paid cash for a sewer hookup,
and feels that he should not be assessed at this time for the Sumac Sewer improvement when
it does not benefit his property. John Mayo, Public Works Director, explained that the
reason Mr. Noel's property was included in the Assessment Roll at this time is because the
Engineering Department could find no records of this property ever having paid any assess-
ments on any of the City sewer system, even though they are hooked up to the sewer, and
asked Mr. Noel to bring in any receipt or record showing that he had paid hookup charges,
and stating that we will check further also. Mr. Clifford Wells, property owner in this
area, filed a letter with the City Clerk on this date, stating that since the time that
the assessment roll had been figured on this improvement, he has purchased more property
in this vicinity and merely wished to bring to the Council's attention that there might be
a difference in assessment rates on his property. John Mayo explained that the assessment
rate is figured on a flat rate of $200.00 per parcel, then the extra cost is assessed on a
per square foot basis. One person owning two or more lots will have to pay only one $200
rate. He further explained that this Local Improvement District is one of the oldest,
since it had taken a long time to get some of the necessary rights of way. After due dis-
cussion, it was MOVED by Lynch, seconded by Lambert that the Hearing on the Assessment Roll
for L.I.D. No. 915, Sumac Sewer District, be continued for one week or until May 29, 1967,
so that the Staff may further study the matter of protests and other matters brought out
at this time, and make any necessary changes in the Assessment Roll: carried, Brown, Kur-
bitz, Lambert, Larson, Lynch and McNeice voting aye by voice vote. Robinson absent.
Petition No. 52$, filed by H. E. Patterson & Keith J. Spanton, requesting rezone of proper-
ty located at 57th to 58th Avenues, abutting Lincoln Avenue on the south side, and Petition
No. 529, filed by Dwight E. Drumright, requesting rezone of property located at 1006 S. 3$t
Avenue, between West Nob Hill Blvd. and Bonnie Doone, both Petitions having been filed with
the City Clerk on May 17, 1967, it was MOVED by Lynch, seconded by McNeice that said Peti-
tions be referred to the City Manager and Planning Commission for study and recommendation:
carried, Brown, Kurbitz, Lambert, Larson, Lynch and McNeice voting aye by voice vote.
Robinson absent.
MOVED by Lambert, seconded by Brown that Ordinance No. 915 amending Ordinance No. 907,
creating L.I.D. No. 963, Englewood Heights and Others Sewer District, be passed as read:
carried, Brown, Kurbitz, Lambert, Larson, Lynch and McNeice voting aye on roll call.
Robinson absent. Public Works Director, John Mayo; explained that two letters were filed
with the City Clerk on May 16 and May 1$, 1967, respectively, by Lee Campbell of Glascam
Builders, requesting that Paddack Garden Lots, Lot 10, be left out of any improvements,
which made it necessary to amend Ordinance No. 907 and omit this property from L.I.D. No.
963. .
ORDINANCE NO. 915, AN ORDINANCE amending Section 1 of Ordinance No. 907, passed May 8,
1967, and entitled "AN ORDINANCE providing for the improvement of certain property by con -
structing a pipe sewer with the necessary wye branches and manholes; establishing a Local
Improvement District, providing for the method of payment thereof, and creating a special
fund ".
MOVED by Lambert, seconded by McNeice that Resolution No D -1076 authorizing the purchase
of materials and hiring of labor for repair of the main electric panel at Yakima City Hall,
without calling for bids, be passed as read: carried, Brown, Kurbitz, Lambert, Larson,
Lynch and McNeice voting aye on roll call. Robinson absent. City Manager Smith and Pur-
chasing Agent Kermit:Smith explained that due to the age of the equipment, there has been
some heating problems on the panel and the lights have gone out several times in City Hall
and this electric panel needs to be fixed.

and the hiring of labor without calling for bids.

MOVED by Lambert, seconded by Brown that Resolution No. D -1077 authorizing the purchase of
a flowmeter to replace one used in connection with disposal of industrial waste, without
calling for bids, be passed as read: carried, Brown, Kurbitz, Lambert, Larson, Lynch and
McNeice voting aye on roll call. Robinson absent. City Manager Smith explained that this
II flowmeter is available from. one source only.
RESOLUTION NO. D -1077, A RESOLUTION authorizing the purchase of materials without•calling
for bids.
Councilman Kurbitz excused at 4:00 P.M.
-Mr. 0. F. Gilbert, being present, asked the Council why the City has discontinued the
practice of collecting water deposits, and stating that he protests this action because •
tenants in his.rental property move out without paying their water bills. Council members
explained that at the time this practice was eliminated, Yakima was the only City of its
size that had a water deposit, and that basically we found that it was making it difficult
to give immediate service to the customer, thus creating poor public relations. Council
members further suggested that property owners should make their own arrangements with
tenants, either requiring a deposit to take care of any unpaid utility bills,. or charge a
. little more rent and pay the utility services themselves.
An Application for Outside Utility Connection, having been filed with the City Clerk on
• May 18, 1967, by the Northern Pacific Railway Company, City Manager Smith recommended
that the Council approve said connection, and explained that this area is involved in a
Notice of Intention to Commence Annexation Proceedings that will soon be filed with the
• City. Discussion brought out that. some of the easements have not been obtained as yet.
City Manager Smith explained that Mr. Forney of Forney Fruit Company, is obtaining this
property from the Northern Pacific Railway Company and Council members suggested that a
letter should be received from Mr. Forney regarding said easements. After due discussion,
it was MOVED by Lynch, seconded by Lambert that said Outside Utility Connection be allowed
• subject to the obtaining of the necessary easements and letter from. Mr. Forney, as well as
the signing of the Outside Hookup Agreement: carried, Brown, Lambert, Larson, Lynch and
,McNeice voting aye by voice vote. Kurbitz and Robinson absent.
City Manager Smith recommending that Mayor Larson be authorized to attend the Annual Con -
ference of National League of Cities at Boston, Massachusetts, from July 29 to August 2,
1967, and stating that a City of our size should be represented at this National meeting,
it was MOVED by Lambert, seconded by Brown that Mayor Larson be authorized to attend said
Conference with expenses paid: carried, Brown, Lambert, Lynch and McNeice voting aye by
voice. vote: Kurbitz and Robinson absent.
' There being no further business to come before the Council, it was MOVED by.Lynch, seconded
by McNeice that we do now adjourn at the hour of 4:20.P.M.: carried, Brown, Lambert,'Lar:
