APRIL 3, 1967
The City Council met in regular session, Mayor Larson presiding, Councilmen Lynch, McNeice
and Robinson, City Manager Smith and City Attorney Andrews present on roll call. Council-
men Brown, Kurbitz and Lambert absent on roll call. It was MOVED by Robinson, seconded by
McNeice that Councilmen Brown, Kurbitz and Lambert be excused from this meeting: carried,
Larson, Lynch, McNeice and Robinson voting aye by voice vote.
The Invocation was given by Councilman Lynch. .
The minutes of the regular meeting of March 27, 1967, having been duly certified accurate
by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor
Larson declared said minutes approved as recorded.
Mayor Larson welcomed three girls from West Valley High School, who are delegates to Girl'E
State at Ellensburg, Washington, and are present to observe the Council meeting.
Petition No. 510, having been filed with the City Clerk on March 27, 1967, by Thomas A.
Dillon & Others, requesting annexation of property located between S. 10th & Pleasant
Avenues, adjacent to Spokane Street, it was MOVED by Robinson, seconded by Lynch that the
Petition for Annexation filed by Thomas A. Dillon & Others, being Petition No. 510, be
approved as meeting the requirements of law; that said Petition be referred to the City
Manager and Planning Commission for study and recommendation; that the Mayor be authorized
to obtain waivers of a meeting by a Review Board; and that April 17, 1967, be set as the
date for a public hearing by the City Council on this Petition: carried, Larson, Lynch,
McNeice and Robinson voting aye by voice vote. Brown, Kurbitz and Lambert absent.
Petition No. 515, filed by Thomas A. Dillon & J. J. Zerr, requesting improvement of prop-
erty by the construction of water mains serving property located between S. 10th & Pleas-
ant Avenues adjacent to Spokane Street, and Petition No. 516, filed by Thomas A. Dillon &
J. J. Zerr, requesting improvement of property by the construction of a sewer between
S. 10th & Pleasant Avenues adjacent to Spokane Street, having been filed with the'City
Clerk on March 30, 1967, it was MOVED by Lynch, seconded by McNeice that said petitions be
referred to the City Manager and Staff for study and recommendation: carried, Larson,
Lynch, McNeice and Robinson voting aye by . voice vote. Brown, Kurbitz and Lambert absent.
MOVED by Robinson, seconded by Lynch that Ordinance No. $99 pertaining to public safety
and morals regarding wandering or prowling and amending the Yakima Municipal Code, be
passed as read: carried, Larson, Lynch, McNeice and Robinson voting aye on roll call.
Brown, Kurbitz and Lambert absent. City Attorney Andrews explained that the Ordinance now
on the books was passed in 1917, and Ordinance No. $99 will amend this Ordinance and bring
the Code up to date with State Statue, and will more thoroughly cover some of the situa-
tions that the present Ordinance does not now cover.
ORDINANCE NO. 899, AN ORDINANCE pertaining to public safety and morals; prohibiting the
wandering or prowling by persons, uncer certain circumstances, and declaring such conduct
as constituting vagrancy; amending Section 6.04.155 of the City of Yakima Municipal Code;
and declaring an emergency.
MOVED by Robinson, seconded by McNeice that Resolution No. D -1063 authorizing the payment

of $76$.37 for automobile repairs without calling for bids, be passed as read: carried,
Larson, Lynch, McNeice and Robinson voting aye on roll call. Brown, Kurbitz and Lambert
absent. City Attorney Andrews explained that the Insurance Company had paid the money
directly to the City for the repair of a City owned automobile and this Resolution author-
izes the payment to the Lee Van Cleave Body Shop for the repairs. Discussion-indicated
that since this was an Insurance Claim, the usual three bids had been submitted and that
of Van Cleave was the lowest bid.
RESOLUTION NO. D -1063, A RESOLUTION authorizing the payment of $76$.37 for automobile
repairs without calling for bids.
Bids having been received and considered by a bid board on this date, for the East Spruce
Street Storm Drain, and the following bids having been received: .
N. L. Kimball, Yakima $9,366.00
Bill's Septic, Yakima 9,5$2.50
DeBlasio Bros., Parker 10,329.00
E. M. Gostovich, Sunnyside . 10,964.00
and the City Engineer recommending the bid of N. L. Kimball as being the low bid, it was
MOVED by Robinson, seconded by Lynch that the Engineer's recommendation be accepted and
the bid be awarded to N. L. Kimball in the amount of $9,366.00 and that the City Manager
be -and is hereby authorized to enter into a contract with said contractor upon the filing
of the proper bond and insurance: carried, Larson, Lynch, McNeice and Robinson voting aye
by voice vote. Brown, Kurbitz and Lambert absent.
City Manager Smith requesting and recommending that Fire Chief. Shockley, Mechanic Virgil
Wilson and three firemen, Ron Roberts, Roger Allen and Fred McIntosh be allowed to go to
Cornelius, Oregon on April 30, 1967 to observe the pump test on a new pumper similar to
one we are going to acquiresaid trip expenses to be approximately S30.00 for meals, it
was MOVED by Lynch, seconded by McNeice that said travel be allowed with expenses paid:
carried, Larson, Lynch, McNeice and Robinson voting aye by voice vote. Brown, Kurbitz and
Lambert absent.
There being no further business to come before the Council, it was MOVED by Lynch, seconded
by McNeice that we do now adjourn at the hour of 3:40 P.M.: carried, Larson, Lynch, McNeice
and Robinson voting aye by voice. vote Brown, Kurbitz and Lambert absent.
