JULY 26, 1965
• The City Council met•in regular session, Assistant Mayor Brazier presiding, Councilmen
Brown, Lambert, Lynch and Robinson, City Attorney Andrews, present_on roll. call: ,City.
Manager George .Smith absent due to illness. It was MOVED by Lynch, seconded by Brown, that
Mayor•Larson and Councilman Kurbitz be excused from attendance at this meeting: .carried,.
Brazier, Brown, Lambert, Lynch and Robinson voting aye by voice vote.
The Invocation was given by Councilman Brown. •
The minutes of the regular meeting of July 6, 1965, having been duly certified accurate.by
• two Councilmen and no one present wishing to have said minutes read publicly, Mayor Brazier
declared said minutes approved as recorded.
An Ordinance appropriating $18,454 to the Street Fund having been read in its entirety at
the regular meeting on July 19, 1965, was read by title only at this meeting and it was
MOVED by Lambert, seconded by Lynch, that Ordinance No. 674 providing for said appropriatio
be'passed as read: carried, Brazier, Brown, Lambert,•Lynch and Robinson voting aye on roll
call vote. Larson and Kurbitz absent. .
NO. - 674
AN ORDINANCE /appropriating the.amount of $18,454 from unappropriated money in 310 - Street,
Fund, to Account 7930, Other Structures and Improvements, of the Capital Outlay Classifica-
tion, in the 1965 appropriation for 310 - Street Fund.

In accordance with action taken by the City Council at their regular meeting of July 19,
1965, it was MOVED by Robinson, seconded by Brown that Resolution D -843 supporting a
proposal by the Tri -City Nuclear Industrial Council, Inc., of the Hanford area as a site
• for a national accelerator laboratory by the United States Atomic Energy Commission be
passed as•read; carried: Brazier, Brown, Lambert, Lynch and Robinson voting aye on roll
call vote. Larson and Kurbitz absent.
No. D -843 •
A RESOLUTION /in support of a proposal by the Tri -City Nuclear Industrial Council, Inc., of
the Hanford area as a site for the installation of a national accelerator laboratory by
the United States Atomic Energy Commission.

This being the time for the Hearing on the Planning Commission's recommendation and rezon-
ing certain property located at 415 North 2nd Street, it was MOVED by Brown, seconded by

Lambert that Ordinance No. 675 providing for the rezone of said property from R -3, Multiple
Family zone, to B -1, Modified Business Zone, be passed as read; carried: Brazier, Brown, •
Lambert, Lynch and Robinson voting aye on roll call vote. Larson and Kurbitz absent.
NO. 675 •
AN ORDINANCE /accepting the recommendation of the Planning Commission and rezoning certain
property located at 415 North 2nd Street, in the City of Yakima, Washington, from R -3,
Multiple- Family Zone, to B -1, Modified Business Zone.

This being the time fixed for the hearing on Petition No. 365 as filed by M. D. Brown,
William Walker and Lincoln Center, Inc., requesting the rezoning of property located at
2009 to approximate) y 2109 Lincoln Avenue and North from B -2, Local Business Zone, to B -3,
General Business Zone, and the Planning Commission having recommended the rezone of said
• property, it was MOVED by Brown, seconded by Robinson, that Ordinance No. 676 providing for
said rezone be passed as read; carried Brown and Robinson voting aye, Lynch reluctantly
voting aye with the comment that he was afraid that the.precedent that the Council was
setting is a tremendous one, Brazier voting aye last, at his request, and Lambert voting
nay. In answer to Councilman Lambert's inquiry about the Planning Commission's intention t•
amend the zoning code concerning requirement of B -2 zoning, Director Gast advised that afte'
due consideration, a study committee reported that rather than amend the code this area
could be classified as B -3 without any detrimental effect on the property. Mr. Fred •
Velikanje speaking on behalf of property owners of the area explained that they raised no
objection to the rezone of B -3. Gene Cahoon, with interests at Lincoln Center, was present
but made no comment.

ORDINANCE NO. 676 - AN ORDINANCE accepting the recommendation of the Planning Commission
and rezoning certain property located. at 2009 to approximately 2109 Lincoln Avenue, in the
City of Yakima, Washington, from B -2, Local Business Zone, to B -3, General Business Zone. •
This being the time fixed for the hearing on Petition No. 385 as filed by Joe W. Hocker
requesting the rezoning of property located at West Lenox and Landon Avenues from R -2, two -
family, to M -2 heavy industrial, and the Planning Commission having recommended the rezone
of said property, it was MOVED by Lambert,. seconded by Brown, that Ordinance No. 677 pro-
viding for said rezone be passed as read; carried: Brazier, Brown, Lambert, Lynch and
Robinson voting aye•on roll call vote. Larson and Kurbitz absent.
ORDINANCE NO. 677 - AN ORDINANCE accepting the recommendation of the Planning Commission an
rezoning certain property consisting of property located on the northeast corner of West
Lenox and Landon, in the City of Yakima, Washington, from R -2, Two- Family Zone, to M -2,
Heavy Industrial Zone.
This being the time fixed for the hearing on Petition No. 378 as filed by John Mayo praying
for the annexation of property located along North 58th Avenue between Scenic Drive and the
Tieton Canal, it was MOVED by Robinson, seconded by Brown that Ordinance No. 678 providing
for said annexation be passed as read; carried: Brazier, Brown, Lambert, Lynch and Robin-
son voting aye on roll call vote. Larson and Kurbitz absent. Mrs. Don Foster, a property
owner, was present to inquire about the annexation and in particular its advantages, stating
also that neither she nor others in the area had received formal notice of the hearing, but
had learned of it through a posted notice. Council explained that due to circumstances
beyond the control of the City' Hall ommissions in such notifications do occur occasionally,

but affirmed Mrs. Foster that every .possible consideration would be given her in meeting
the problems that present themselves if she will discuss such matters with the Engineer's
Department.
AN ORDINANCE NO. 678 providing for the annexation by the City of Yakima of certain property •
contiguous to the City of Yakima and zoning the same as R -1, One- Family Zone.
This being the time fixed for the hearing on Petition No. 380 as filed by Buren Sheet )Metal
praying for the annexation of property located between Pierce and Washington Avenues and
South 7th and South 4th Avenues, it was MOVED by Brown, seconded'by Robinson, that

Ordinance No 679 providing for said annexation be passed as read; carried: Brazier

ORDINANCE NO. 679 - AN ORDINANCE providing for the annexation by the City of Yakima of
certain property'` to the City of Yakima and zoning said property.
Petition No. 395 having been filed with the City Clerk on July 19, 1965, by Boise Cascade
Corporation requesting formation of a Local Improvement District for the construction of
water mains at the Morrison- Merrill and Company property located at 1512 South 1st Street,
Yakima, Washington, it was MOVED by Lambert, seconded by Lynch, that said petition be
referred to the City Manager and staff for study and recommendation; carried: Brazier,
Brown, Lambert, Lynch and Robinson voting aye on voice vote. Larson and Kurbitz absent.
Petitions Nos. 396 and 397 having been filed with the City Clerk on July 19th and 20th,
1965, by Frank M. Bacon and Rhoda Bacon, husband and wife, and E. L. Clark, Paul Creamer
et al, respectively, for rezone of property located at 1018 S. 10th Avenue, in the first
instance, and 1902 -14 Nob Hill Blvd. and 1105 S. 20th Avenue, also 1102 -1104 S. 19th Avenue
in the second instance:, it was MOVED by Lynch, seconded by Lambert, that said petitions be
referred to the Planning Commission for study and recommendation.
MOVED by Lambert, seconded by Brown, that Ordinance No. 680 establishing meter rates and
meter charges for domestic water consumption and amending Yakima Municipal Code be passed
as read; carried: Brazier, Brown, Lambsrt, Lynch and Robinson voting aye on roll call
vote. Larson and Kurbitz absent.
ORDINANCE NO. 680 - AN ORDINANCE establishing meter rates and service charges for domestic
water consumption; and amending Section 7.68.250 of the City of Yakima Municipal Code.
MOVED by Robinson, seconded by Brown, that a Resolution authorizing the City Manager and
City Clerk to execute a lease modification agreement with the Federal Aviation Agency of
the United States of America providing for a reduction in janitorial service covering space
in the City Central Building at the Municipal Airport be passed as read; carried: Brazier,
Brown, Lambert, Lynch and Robinson voting aye on roll call vote.
RESOLUTION NO. D -844 - A -RESOLUTION authorizing and directing the City Manager and City
Clerk of the City of Yakima to execute a lease modification agreement with the Federal
Aviation Agency of the United States of America.
MOVED by Lambert, seconded by Lynch, that a Resolution authorizing the City Manager and City
Clerk to execute a contract with Book Publishing Company for printing and codification of
Yakima City ordinance for a three -year period at the cost of $2,000, be passed as read;
carried: Brazier, Brown, Lambert, Lynch and Robinson voting aye on roll call vote. Larson
and Kurbitz absent. .
RESOLUTION NO. D -845 - A RESOLUTION authorizing the City Manager and City Clerk to execute'
a contract with Book Publishing Company. .
MOVED by Lynch, seconded by Lambert, that Resolution No. D -846 transferring the sum of
335,000 within the 1965 appropriation for the Water -Sewer Fund, be passed as read; carried:
Brazier, Brown, Lambert, Lynch and Robinson voting aye on roll call vote. Larson and
Kurbitz absent. .
RESOLUTION NO. D -846 - A RESOLUTION transferring the sum of 535,000 within the 1965 appro-
priation for 520 - Water -Sewer Fund. .
Public Works Director John Mayo reported that Morrison- Merrill and C.o., a subsidy of Boise
Cascade Corp., has built a new building on South 1st Street and has signed on a petition for
annexation. (Petition No. 388 filed by C. E. McBeth) The occupants of the building are
ready to move in and they need water immediately and under the city's present policy, said
company is allowed to hook on to the water system by signing an agreement for the outside
hook -up permitting service prior to annexation. Arrangements for a cash settlement for the
cost of the main have been made by Morrison- Merrill and the cash payment is expected to
be made by Wednesday, July 28th. The matter requiringg a motion to authorize the execution
of this hookup agreement; it was MOVED by Robinson, seconded by Lynch, that the Council
authorize the execution of said outside hook -up agreement with Morrison - Merrill and Co.,
and that Morrison- Merrill be.allowed to immediately hook -up to the main upon payment to the
city of the required fee; carried: Brazier, Brown, Lambert, Lynch and Robinson voting aye
on voice vote. Larson and Kurbitz absent.
Mr. Charles Countryman petitioner protesting L.I.D. No. 943, heard by Council on July 19,
1965, was present to inquire about, the possibility of access to the area at the end of
Bel Air Drive instead of extending Walnut Ave., and also whether he would have to obtain
signatures of property owners on 46th Ave. if it was determined that by combining the
two items in the ordinance in this area the work might be done more economically. Council
indicated that they would treat these two units of the Ordinance separately and that it
would only be necessary to obtain signatures from owners on Walnut Avenue.
City Attorney Andrews acting in the absence of City Manager George;Smith informed the
Council that Mr. Smith was hospitalized, but tests indicated no cause for alarm and that
he intended to be at his desk .within the next day or so.
Mr. Andrews presented a request and recommendation by the Chief of Police Oscar Soderstrom
to send Sgt. John Jenkins to a Polygraph Seminar in Chicago, Illinois, at an estimated
expense to the City of 5526 for a period of two weeks, August 1 to August 13, 1965. It
was MOVED by Lynch, seconded by Lambert, that said request of the Chief of Police be granted
and expenses to cover Sgt. Jenkins' travel be allowed; carried: Brazier, Brown, Lambert,
Lynch and Robinson voting aye on voice vote. Larson and Kurbitz absent.

Mr. Andrews submitted to the Council a letter from Charles Lyon of the law office of Lyon,
Kohls, Beaulaurier and Aaron, Yakima, dated July 26, 1965, wherein Mr. Lyon gives notice
to the city that a survey of Preston Shepherd for the construction of MacDougall's &
Southwick Company building at Fourth Street and East Yakima Avenue discloses that there is
an encroachment of the building on to Lot 7 and upon the city's right of way, and asks
that the city acknowledge receipt of the notice and advise that the city does not intend to
take any action based upon Mr. Shepherd's survey, but will accept the location for the
improvement on the basis of Mr. Jaussaud's survey, Mr. Jaussaud being a licensed and regis-
tered surveyor, who prepared the original survey of the construction and upon which the
builder staked out the foundation. It was MOVED by Robinson seconded by Lynch that the Cit
Manager endorse the acknowledgment which was included with the letter and prepared by
Charles R. Lyon setting forth the confirmation that the City of Yakima does not intend to
take any action concerning the possible encroachments as shown by the survey made by Mr.
Preston Shepherd, and will rely upon the survey of Remie N. Jaussaud and his certificate
that the building is situate upon Lots 1, 2, 3, 4, 5 and 6 of said Block 90 without encroaci-
merit; carried, Brazier, Brown, Lambert, Lynch, Robinson voting aye on voice vote. Larson
and Kurbitz absent.
There being no further business to come before the Council, it was MOVED by Lynch seconded
- by Brown that we do now adjourn at the hour of 5:20 p.m.; carried: Brazier, Brown, Lambert.
