' rili) cii, MINUTES YAKIMA CITY COUNCIL August 1, 2022 City Hall —Council Chambers 5:30 p.m. Regular meeting; 6:00 p.m. public hearings —conducted in person and virtually via Zoom 1. Roll Call Present: Assistant Mayor Soneya Lund, presiding, and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Sonya Claar Tee Absent: Mayor Janice Deccio (excused) 2. Pledge of Allegiance Assistant Mayor Lund led the Pledge of Allegiance. 3. Interpreter Services Assistant Mayor Lund introduced Marivy Vazquez who announced interpreter services are available in Spanish. 4. Open Discussion for the Good of the Order A. Proclamations i. National Health Center Week proclamation Councilmember Byers proclaimed the week of August 7-13, 2022 as"National Health Center Week"and Rhonda Hauff, CEO of Yakima Neighborhood Health, Christy Bracewell Trotter, interim CEO of Yakima Valley Farm Workers Clinic and Angela Gonzalez, CEO of Community Health of Central Washington accepted the proclamation. ii. National Night Out proclamation Assistant Mayor Lund proclaimed Tuesday,August 2, 2022 as "Yakima's Night Out Against Crime & Drugs"and James Park, Community Services Director of OIC of Washington, accepted the proclamation. 5. Council Reports None. 6. Consent Agenda Page 1 of 5 24 Assistant Mayor Lund referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Byers moved and Cousens seconded to approve the consent agenda. The motion carried by unanimous vote, Deccio absent. A. Set date of September 6, 2022 for a closed record public hearing to consider the Hearing Examiner's recommendation regarding the preliminary plat of"Apple Tree Phase 1 C"submitted by Kinloch Borton Enterprises located in the vicinity of Occidental Rd & S 96th Ave D. Resolution accepting and approving 2nd Quarter 2022 Claim Report RESOLUTION NO. R-2022-089,A RESOLUTION accepting and approving the 2nd Quarter 2022 Claim Report for the City of Yakima. E. Resolution authorizing a Commercial Lease with McCurley Fruitvale Property, LLC to lease the property located at 506 Fruitvale Boulevard, Yakima, Washington RESOLUTION NO. Resolution of Interest directing staff and the Yakima Arts Commission to study and prepare the background information on the formation of a "Creative District" in the City of Yakima RESOLUTION NO. R-2022-097,A RESOLUTION declaring that the City of Yakima is interested in forming a creative district within the City of Yakima, directing staff to move forward with any necessary activities to evaluate formation of such a district, and bringing a report back to City Council with findings from staff and the City of Yakima Arts Commission. M. Resolution authorizing 911 Support Service Agreement with Yakima County RESOLUTION NO. R-2022-098,A RESOLUTION authorizing execution of the"911 Support Services Agreement"with Yakima County for the provision of 911 services. N. Resolution authorizing application for funding assistance for a Washington Wildlife and Recreation Program(WWRP) project to the Recreation and Conservation Office (RCO)for West Valley Community Park pedestrian bridge RESOLUTION NO. R-2022-099,A RESOLUTION authorizing application for funding assistance for a Washington Wildlife and Recreation Program(WWRP) project to the Recreation and Conservation Office (RCO) as provided in Chapter 79A.15 RCW,Acquisition of Habitat Conservation and Outdoor Recreation Lands, and WAC 286 for a Pedestrian Bridge at West Valley Community Park. O. Q. Ordinance amending YMC 13.16.078 to add a knowledge element; amending YMC 13.16.150 to clarify violations of Title 13, unless otherwise specified, are a misdemeanor ORDINANCE NO. 2022-023,AN ORDINANCE relating to Public Safety and Parks; amending YMC 13.16.078 to add a knowledge element; amending YMC 13.16.150 to clarify that violations of Title 13, unless otherwise specified, are a misdemeanor. 7. Public Comment None. PUBLIC HEARINGS 8. Final public input meeting and Resolution to consider citizen comments on the proposed 2022 Annual Action Plan (DRAFT)for Community Development Block Grant (CDBG) & HOME Investment funds Archie Mathews, ONDS Manager, briefed Council on the proposed Annual Action Plan. Assistant Mayor Lund opened the public hearing and,with no one coming forward to speak, closed the hearing. The City Clerk read the resolution by title only. MOTION: Byers moved and Cousens seconded to adopt the resolution. The motion carried by unanimous vote, Deccio absent. RESOLUTION NO. R-2022-101,A RESOLUTION adopting the proposed 2022 Annual Action Plan for Community Development Block Grant(CDBG)and HOME Fund Programs as mandated by the Department of Housing and Urban Development (HUD). 9. Closed record public hearing and Resolution to consider the Yakima Planning Commission's recommendation regarding the preliminary plat of Spring Creek Heights submitted by PLSA Surveying & Engineering located at 7509 Occidental Rd Joseph Calhoun, Planning Manager, briefed Council on the hearing. Assistant Mayor Lund opened the public hearing. Tom Durant, Planning Manager for PLSA and representing the owners and developer, spoke in support of the project. With no one else coming in or calling to speak, the Assistant Mayor closed the hearing. The City Clerk read the resolution by title only. MOTION: Cousens moved and Byers seconded to adopt the resolution. The motion carried by unanimous vote, Deccio absent. RESOLUTION NO. R-2022-102,A RESOLUTION approving the Preliminary Long Plat of Spring Creek Heights, a 19-lot subdivision, located at 7509 Occidental Road. 10. Other Business Page 4 of 5 27 MOTION: Lund moved and Brown seconded to request an updated report on the plans for restoration of the City-owned Millennium Plaza. The motion carried by unanimous vote, Deccio absent. MOTION: Byers moved and Brown seconded to recess until 6:00 p.m.The motion carried by unanimous vote, Deccio absent. Council reconvened at 6 p.m. Councilmember Cousens shared some history on listening session or town hall type meetings and noted it is helpful to have topics in advance in order to have the appropriate staff attend the meetings. Councilmembers Brown and Herrera expressed interest in holding such meetings. 11. Adjournment MOTION: Byers moved and Cousens seconded to adjourn to the next City Council regular meeting on August 16, 2022, at 5:30 p.m. in the Council Chambers.
