The City Council met in session-at. 1 :30 P -.M. on . this date in the Conference Room at ,Yakima
City Hall.,' -
Councilmen present at the meeting were Mayor -Bert, Broad,. Howard C. Cole, Betty L. Edmondson
Don Schussler,, and Bill Whitaker: •,Also present, were City Manager,_ : Craig McMicken; Public.

City Manager McMicken referred to the notice regarding the proposed dinner meeting with the
Chamberof Commerce. Board of : Directors. There - was.discussion about taking a tour of the.
shop and airport facilities before -the dinner. ,

At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the
meeting, Broad presiding, Councilmen Cole, Edmondson and Whitaker present on roll
call. Councilmen Brown and Holbrook absent on roll call, having been excused at a previous
meeting. Councilman Schussler absent on roll call and present after 3:10 P.M.
The Invocation was given by City-Attorney Fred Andrews.
The minutes of the previous adjourned regular meeting of July 20, 1973, and the regular
meeting of July 23, 1973, having been duly certified accurate by two Councilmen, and no
one present wishing to have said minutes read publicly, Mayor declared .said minutes
approved as recorded.
An Ordinance appropriating $17,000 in the Parks and Recreation Fund to pay for the profes-
sional :services of. Olson- Richert - Bignold for the development of a Comprehensive Park and
Recreation Plan, having been read by title only at the previous meeting, and being read
again by title at this meeting, it was MOVED by Whitaker, seconded by Cole that
No. 1547, providing for said appropriation, be passed: carried, Broad, Cole, Edmondson
and Whi:t•aker voting aye on roll call. Brown, Holbrook and Schussler absent.
ORDINANCE NO. 1547, AN ORDINANCE appropriating the amount of $17,000 from unappropriated
money in 131- Parks and Recreation Fund to Account 533.10.31 within the 1973 appropriation
for 131 - Parks and Recreation Fund.
Mr. Phil. Pleasant,. Chairman of the Black Coalition, being present, requested information .
regarding the city's plans for implementing an Affirmative Action Program presented in an
earlier proposal distributed to Councilmen at the meeting of June 25, 1973. Mayor Broad
indicated that this matter had been referred to the Staff at that time. City Manager
McMicken reported that recent Police and Fire negotiations have delayed this matter, but
that in few months the Staff would be taking a closer look at the earlier request.
City Manager McMicken reported on the matter of the disputed,water.billing for the resident.:
of water system and reviewed his report, on this subject dated July 26, 1973. He
stated that Mr: Abbott has not abided by the terms of the agreement for outside utility
service of February 6, 1973 and reported that the water consumption has been above average,
Which could be due to There was•discussion as to whether an adjustment should be
made in .the chargesto Mr. Abbott. Councilman Whitaker indicated a desire to see Mr.•Abbotu
treated as other outside users of city water and that itishould first be determined what
the actual loss of water is before an adjustment is made in the billings. After due discus
sion, it was informally agreed by Councilmen that it be determined if there is a large leak
and how large the los -s of water •is•before adjustments are made in Mr. Abbott's billings.
City Manager McMicken referred the matter of irrigation water service to Administrative
Assistant, Dick Zais, who referred to Petition No. 788, filed by Mr. Cecil Warrinerat last
week's Council meeting, and signed by residents of L.I.D. No. 661, requesting adequate
irrigation water service to this area. Mr. Zais reported that in investigating causes for
water shortage, he finds causes to be the low Naches River level, a moss and weed problem
and the Schanno Ditch which takes water to South Yakima, Yakima County and Union Gap. He
reviewed steps which have been taken to remove the moss and weeds from the Fruitvale Canal.
Director of Public Works, Dave Vargas, being present, used a map to indicate sources of
water for the various irrigation districts throughout the city and stated that the river
level was higher because of the Board of Reclamation releasing water from the
Tieton Reservoir. Mr. Vargas recommended that the entire city be asked to participate in
a rotationsystem of irrigating for the rest of the summer, with the even numbered homes
irrigating on-the even numbered days and the odd numbered homes irrigating on odd numbered
days to include those using domestic water. Mr. Eric•Wightman, President of the New
Schanno Ditch Company, being present, stated that he did not wish to participate in sharing
with the city the water going into the Schanno Ditch and reviewed the means whereby the
ditch company maintains perpetual water rights. Mr. Cecil Warriner, being present, stated
that he.believed residents of the Fruitvale District should not have to pay an additional
amount if they are forced to use city water and reported that this district was not in
opposition to the rotation system. After due discussion, it was MOVED by Cole, seconded by
Schussler that the recommendation of the Director of Public Works be accepted and that the
city be asked immediately to participate in a rotation system of irrigation: carried,
Broad, Cole, Edmondson, Schussler and Whitaker voting aye by voice vote. Brown and
Holbrook absent. Councilman Schussler indicated that enforcement may become necessary if
this request is not followed.
City Manager McMicken referred the matter of the Gilbert Park lawn care to Parks.Director,
Bill Hutsinpiller, who reviewed the problems in watering the park with the Yak-- ima- Tieton
Irrigation System and the advantages of conversion to city water as contained in the report
on this matter dated July 30, 1973. After due discussion, it was MOVED by.Whitaker,
seconded by Cole that Gilbert Park be put on domestic water for irrigation purposes:
carried, Broad, Cole, Edmondson, Schussler and Whitaker voting aye by voice vote. Brown
and Holbrook absent. •

City Manager McMicken referred to the matter of engaging the firm of N. G. Jacobson and
Associates, Inc., to make an airport parking analysis, stating that an addition,to their
letter of proposal requests that the work be completed in thirty days, with the total cost
not to exceed $3,500. After due discussion, it was MOVED by Edmondson, seconded-
Whitaker that Resolution No. D -2087, engaging this firm for this parking analysis, be
passed: carried, Broad, Cole, Edmondson, Schussler and Whitaker voting aye on roll call. •
Brown and Holbrook absent. •
RESOLUTION NO. D -2087, A RESOLUTION engaging professional services of N. G. Jacobson &
Associates, Inc., Consulting Engineers, for the purpose of conducting an airport••parking
analysis at the Yakima Air Terminal. •

City Manager McMicken referred to an off - the - agenda item concerning recent negotiations
with Henry Beauchamp for a new lease on the Flight Deck . Restaurant expansion. He stated
• that Mr. Beauchamp has agreed to pay the city seven percent of his gross receipts on food
and liquor the city paying utilities. Mr. McMicken recommended the hiring of Marble-
Dawley and Associates, to perform the architectural services in connection with 'the'pro -
posed expansion and that a cost estimate be received from them before the city negotiates
for new lease terms. After due discussion, it was MOVED by Whitaker, seconded Cole
that Resolution No. D -2088, engaging the firm of Marble - Dawley and Associates for services .
in connection with the Flight Deck Restaurant expansion,_ be passed: carried, Broad, Cole,
Edmondson, Schussler and Whitaker voting'aye on roll call. Brown and Holbr.00k absent.
RESOLUTION NO. D- 2088., A RESOLUTION authorizing the City of Yakima to engage Marble- Dawley
and Associates, A.I.A., for architectur.al services in connection with expansion.of the
airport restaurant.
Mayor Broad reported on the appointment of Mrs. J. C.-Morrison to the Housing Authority to
fill the position vacated by Howard Cole for a term.of five years to end January 31 1978,
and Mr. Oliver Nelson to the Housing,Authority to fill the,position vacated by Edward
Melfort which term ends January 31, 1974. It was MOVED by Cole, seconded by Schussler that
those persons so named be appointed to the positions so stated: carried, Broad, Cole,
Edmondson, Schussler and Whitaker voting aye by voice vote. Brown and Holbrook absent.
Councilmen Cole and Schussler requesting permission to be excused from the regular-Council
meeting of August 6, 1973, and the adjourned regular meeting of Friday, August 10;.1973, it
was MOVED by Edmondson, seconded by Broad that Councilmen Cole and Schussler be 'exused
from these meetings: carried, Broad, Edmondson and Whitaker voting aye by 'voice vote. •

There being no further'business to come before the Council, it was MOVED by Cole, seconded
by Whitaker that this meeting be adjourned at 5:05 P.M.-,'to Friday, August 3, 197'3; at the
hour of 12:00 Noon, to then meet at the Flight Deck Restaurant in the Yakima Air Terminal:
carried, :Broad.;, Cole, Edmondson, Schussler and aye by voice vote. Brown
and Holbrook absent.
