HomeMy WebLinkAbout04/09/1973 Business Meeting 554 APRIL 9, 1973 The City Council met in regular session at 1:30 P.M. on this date in -the Conference Room at Yakima City Hall. Councilmen present at the meeting were Mayor Bert Broad, Wray Brown; Howard C. Cole, Betty L. Edmondson, Don Schussler and Bill Whitaker. Also present were City Manager, Craig McMicken; Administrative Assistant, Jim Flint;. and Jim Bowers, representing the press. The Council toured the Eisenhower pool and tennis facilities and the Lions Aquatics Center. At 3:00 P.M., the Council members moved into the Council Chambers for the balance of the meeting, Mayor Broad presiding, Councilmen Brown, Cole., Edmondson, Schussler and Whitaker, City Manager McMicken and City Attorney Andrews present on roll call. The Invocation was given by City Attorney Fred Andrews. The minutes of the adjourned regular meeting .of March 30, 1973, and the regular meeting of April 2, 1973, having been duly certified accurate•by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Broad declared said minutes approved as recorded. "- . This being time set for the Hearing on the Yakima Valley Transportation Company pro - posed Franchise Renewal, City Manager McMicken reported that this Hearing had been re- quested by the Council last week after his report to them on the status of the negotiations with the Yakima Valley Transportation Company. Mr. McMicken reviewed City Manager Report #160 dated November 24, 1972 concerning the proposed franchise renewal and the Council minutes of December 18, 1972, which meeting the Council had voted for a ten -year renew- al and extension of an existing permit to expire May 31,, 1973. He briefly rev,iewed the provisions in the proposed Ordinance for maintenance of tracks, hours of operation, obed- ience to traffic signals, speed limits, requirements for a flagman and appropriate light- ing. He referred to the conditions whereby the railroad would relocate tracks on Nob Hill if the cityshould undertake an improvement of Nob Hill from 24th to 40th Avenues, the transfer of six feet on. Nob Hill to the city and provisions for a ten -year extension to the franchise if the city should improve Hob Hill from 16th to 24th Avenues. He further reviewed the increase to a 5 percent franchise fee annually and the clauses in the Ordi- nance providing for the city and railroad to share the costs of beautification at 16th and Nob Hill and 16th and Tieton Avenues. Mr. James Bergmann, General Attorney with Union Pacific Railroad, being present, stated that the railroad is prepared to proceed on the basis of the proposed Ordinance and reported on the feelings of the railroad in regard to the earlier proposed location of the tracks on Ahtanum Road, the agreement for beautifica- tion and the number of trips made by the trains daily. Public Works Director, Dave Vargas, spoke to the matter of possibilities for future widening of the area on Nob Hill from 16th to 24th Avenues. Councilman Cole directed questions to Mr. Bergmann in connection with the railroad's interest in beautification. Those present in the audience and speaking to the'matters of a shorter franchise renewal, track relocation, beautification, and number of trips per day were H. G. Smith, Edward Lewis, Mr. McBarron; Jean Allard, and Ed Hanes. After due discussion, it was MOVED by Brown, seconded by Whitaker that Ordinance No. 1508, granting a ten -year franchise to the Yakima Valley Transportation Company, be passed: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1508, AN ORDINANCE granting to the YAKIMA VALLEY TRANSPORTATION COMPANY, .a corporation, a franchise to operate and maintain railway tracks and .a railway system thereon on certain public streets in the City of Yakima. This being the time set for the Hearing on Petition No. 714, filed by Dan Smith and Others, requesting annexation of property located at 57th and 58th Avenues, between Chestnut and Walnut, Principal Planner, Dick Hill, being present, reviewed the Planning Commission minutes concerning this petition dated April 3, 1973. He stated that this request is for 3.8 acres and reported that it has been before the County Boundary Review Board. Mr. Hill further stated that the Planning Commission is recommending the annexation of this area with a zoning of R -1, Single- Family Residential. After due discussion, it was MOVED by Whitaker, seconded by Cole that Ordinance No. 1509, annexing said property, be passed: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye on roll call. ORDINANCE NO. 1509, AN ORDINANCE annexing property to the City of Yakima, and zoning said property. This being the time set for the Hearing on Petition No. 780, filed by George T. Corbett, Agent, requesting vacation of an alley between North 4th Avenue and North 5th Avenue, from B Street to Lincoln Avenue, and it being noted that this matter is related to the Safeway Rezone Application to be considered at this meeting, it was MOVED by Schussler, seconded by Brown that this Hearing be continued to April 23, 1973, and that the Hearing on the application filed by Safeway, for the rezone of property located at 202 - 216 North 4th Avenue be fixed for that same date: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye by voice vote. An Ordinance appropriating $16,500 to the Fire Department, having been read by title only at the previous meeting of April 2, 1973, and having been read again by title at this meeting, it was MOVED by Whitaker, seconded by Cole that Ordinance No. 1510, providing for said appropriation, be passed: carried, Broad, Brown,, Cole, Edmondson, and Whitaker voting aye on roll call; Schussler abstaining. ORDINANCE NO. 1510, AN ORDINANCE appropriating the amount of $16,500 within 695- Contin- gency Fund and transferring and appropriating the amount of $16,500 within 000 - General Fund. An Ordinance appropriating $7,316 to the Police and Fire Pension Boards for eye care, having been read by title only at this meeting, was laid on the table for one week, or until April 16, 1973. Mayor Broad explained briefly the guidelines, to be .followed in connection with payment 'of claims for - glasses for firemen and policemen. Present in the audience and asking questions on this matter was.Mr. Garrett Anderson. It was MOVED by Whitaker, seconded by Schussler that Ordinance No. 1511, redefining eight existing precinct boundaries and creating four new precinct boundaries, be passed: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye on roll call. 555 • APRIL 9, • 19,73 . City Clerk, Jack Daniel, stated that these changes were necessary to reduce the size of the precincts due to the regulation,on the number .of registered voters allowable in a paper ballot precinct and machine precinct. He referred to those maps provided the Councilmen indicating the changes for the City of Yakima. ORDINANCE NO. - 1511, AN ORDINANCE redefining boundaries of certain existing City voting precincts; creating and defining the boundaries of certain ,new City voting precincts; .and declaring an emergency. It was MOVED by Whitaker, seconded by Brown that Ordinance No. 1512, fixing the time of delinquency and providing for the payment of the unpaid portion of L:I.D. No. 987, 16th Avenue and Nob Hill Boulevard Intersection Improvement, be.pas carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye on roll call. . ORDINANCE NO. 1512, AN ORDINANCE fixing the time of delinquency ofninstallments of assess- ments levied for the payment of the cost of the -improvement in Local Improvement District No. 987, and providing for the issuance of bonds with coupons attached for the payment .of the unpaid portion thereof. ' At this time, Mayor Broad referred to the need for a new Councilman to replace the position vacated by Mr. Jim' Lust. After due discussion, it was ' MOVED by .Brown, seconded, by Whitaker that Mr. Ralph Holbrook be nominated, for this position as. City Councilman: _ car- ried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye by voice vote. Councilman Cole referred to his contact with Mr.'Charles Lee in connection with . a position • on the City Council and expressed a des see_ provisions made for men to serve on the Council without extensive interference with their occupations. _He further stated his. - desire to see minority representation, particularly from the Black community, on the Council. Councilman Cole acknowledged the high qualifications of Mr. Holbrook for this position. A report having been received from the Planning Commission recommending approval of the final planned development plan for additional.tennis courts for-the Yakima Tennis Club, it was MOVED by Brown, seconded, by Cole that Monday, April 23, 1973, be the date set for a Hearing on this matter: carried; Broad, Brown, Cole, Schussler •and:Whitaker voting aye by voice .vote. • , - City Manager McMicken referred the matter of amending a revocable permit granted to the Yakima City Creamery, Inc., to Principal Planner, Dick Hill. Mr. Hill stated that altera- tions to the- canopy constructed pursuant to the permit of March-8, 1971-,._will conform to requirements by Department of Agriculture for an.enclosed' unloading and washing , facil- ity. With the use of'drawings, Mr. Hill explained plans for a wall along the west side of the canopy and doorsat both ends of the structure, which would be. required_ to_rema.in open,unless the facility is- in.-use for -unloading and washing : due.d.iscussion, was MOVED by Cole,.seconded-by Schussler that Resolution No. D-2037, authorizing altera- tions to the present canopy structure, be carr-ied,:Broad, Brown, Cole; Edmondson, Schussler and Whitaker voting aye on roll call. , RESOLUTION NO. D -2037, A RESOLUTION granting permission to alter:a structure within a public alley erected pursuant to a revocable permit granted Yakima •City Creamery, Inc. City Manager McMicken referred the matter of vacating an easement at Summitview Manor to Newell Pock, Chief Housing Inspector, who explained the desire of the Nursing Home to re- route the sewer line located underneath the building to a substitute easement granted the city by the-West.Valley Nursing Homes.,'Inc. - .Public Works Dave °:Vargas., reported' that.the work done by_the•Nursing,Homewould -be according to.�specifications provided. and that they have ,signed an agreement, with the_work•to .be started within the next few weeks. Cole that Resolution No: D- 2038,' authorizing the vacating of said:easement passed :., carried,, -Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting ayeton roll call: • , •- - RESOLUTION NO. D -2038, A RESOLUTION vacating a public utility easement in Crescent Hill Homes Addition to the City of Yakima. City Manager McMicken referred to the proposed agreement with Olson - Richert - Bignold, for professional services related to Franklin Park tennis court improvements and reviewed the costs associated with such improvements. He reported that the engagement of these services is recommended by the Parks and Recreation Commission. After due discussion, it was MOVED by Schussler, seconded by Edmondson that Resolution No. D -2039, authorizing'the execution of said agreement, be passed: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye.on roll call. RESOLUTION NO. D -2039, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute an agreement with Olson- Richert- Bignold,, Architects - Planners- Engineers for professional services related to Franklin Park tennis court improve- ments. . It was MOVED by Cole, seconded by Edmondson that - Resolution No. D -2040, authorizing an agreement with Olson - Richert - Bignold for professional services to prepare a Comprehensive Park Plan, be passed: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker vot- ing aye on roll call. RESOLUTION NO. D -2040, A RESOLUTION accepting a proposal by Olson - Richert- Bignold to • develop a Comprehensive Park and Recreation System Plan for the City of Yakima. - City Manager McMicken referred to the matter of the proposed acquisition of the Pacific Power and Light sub - station for a park site and recommended that.the Council hear a report on this subject from the Parks and Recreation Commission at the regular Council meet- ing to be held April 16, 1973, after which the Council - ,could ,dec=ide steps to take. Mrs. Robert'Blackmore, 207 Park Avenue, being present, submitted a Petition from residents and property owners located 'heat the -upper end of the proposed Powerhouse Park in opposition to access into this area by way of Park Avenue, North 21st Avenue and a portion of Browne. r • 356 APRIL 9,1973 City Manager McMicken referred to the'loan of $20,000 to the Park and Recreation Fund, stating that this loan is necessary until revenues from property taxes received. After due discussion, it was MOVED by Edmondson', by Schussler that Resolution No. D -2041 authorizing said loan, be passed: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye on roll call. RESOLUTION NO. D -2041, A RESOLUTION authorizing a temporary loan of $20,000 from 551 -City Garage Fund to 131 -Park and Recreation Fund, and providing for repayment. IlL City Manager McMicken referred the matter of the execution of a quit claim 'to" C.H.G. International, Inc., to Principal Planner, Dick' Hill, who 'explained that this deed is necessary to clear up the title of property owned by C.H.G. International and the City of Yakima. After due discussion, it was MOVED by Schussler, seconded by Cole that Resolution No. D -2042, authorizing the execution and delivery of said deed, be passed: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye on roll call." RESOLUTION NO. D -2042, A RESOLUTION authorizing and directing the City Manager and City Clerk of the City of Yakima to execute and deliver a quit claim deed to C.H.G. Internation- al, Inc. City Manager McMicken referred to the matter of the old' Police Station being sold as sur- plus city property and reported that Mr. Steve Spickard is interested in this property for reuse. Mr. McMicken referred to the previous City Manager Report #164 on this subject and recommended that bids be called for on this property. After "due discussion, it was MOVED by Whitaker, seconded by Cole that bids be called for on the old Police Station property and that these bids be brought back to the City Council: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye by voice vote. • City Manager McMicken referred to his Report #172 concerning the Proposed Hotel /Apartment Safety Ordinance, which he briefly reviewed. Chief Housing Inspector, Newell Pock, re- ported on a meeting held with persons affected'by this proposed Ordinance and stated "that the Ordinance takes' their response into con iderat"ion. After due discussion, it was MOVED by Schussler, seconded by Whitaker that Monday, April 30, 1973, be set as the date for a Hearing on this proposed Ordinance and that notices of Hearing and copies of the Ordinance be mailed to those same persons asked to participate in the earlier meeting attended by Mr. Pock: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye by voice vote. City Manager McMicken reviewed his Report 173 concerning a Passenger Service Fee at the Yakima Air Terminal. He stated that the Airport Development Act of 1973 now before Con- gress would raise the federal share of matching funds, but also prohibit a head tax of the type proposed for the Yakima Air Terminal. After due discussion, it was MOVED by Whitaker, seconded by Schussler that the matter of a passenger service fee at the Yakima Air Termi- nal be referred to'the Aviation Committee of the Chamber of Commerce for their advice and comment back to the Council: carried, Broad, Brown, Cole Edmondson, Schussler and Whitaker voting aye by voice vote. City Manager McMicken reviewed his Report #174 concerning Airport Security, stating that the city is now ready to make an approach to the County on helping with the financial costs of a security force. He also stated that an Ordinance is needed to establish pay rates for the Airport Security Officers and to " recruit two more trainees for this work. After due discussion, it was MOVED by Edmondson, seconded by Whitaker that the city approach the County Commissioners on the matter of financial assistance for airport secur- ity, that the necessary legislation be prepared to implement this pay scale for the officers and that authorization be given for the recruitment'of two additional trainees: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye by voice vote. It was then MOVED by Schussler, "seconded by Cole that the County also be approached on the matter of financial assistance for capital improvements at the Yakima Air Terminal: carried, Broad, Brown, Cole, Edmondson, Schussler and Whitaker voting aye by voice vote. The Yakima'City Council met.in joint session on this date with the Yakima County Commis- sioners and the Union Gap City Mayor at 7:30 P.M. at the Yakima County Courthouse,. Yakima City Council members present were Mayor Bert Broad, Wray Brown, Howard•C..Cole, Betty L. Edmondson, and Don Schussler. Others present were the three County Commissioners and Mayor Bob Masterman of Union Gap. Mayor. Bert Broad presented a plan for outlining the need for a representative committee of citizens on area -wide planning for the Yakima Urban Area and a proposal for the duties of that committee. He suggested appointment based on population with Union Gap having one member, Yakima County three members and the City of Yakima, five members. Discussion on this matter failed to produce agreement on the composition and duties of the proposed committee and it was decided to continue this meeting to April 24, 1973, at 7:30 P.M. The meeting adjourned at 8:50 P.M., with the'Yakima City Council to meet again on Friday, April 13, 1973, for a luncheon eeting at 12:00 Noon at the Coconut Surf Restaurant.
