HomeMy WebLinkAboutR-1994-109 Gateway Center• RESOLUTION NO R-94- 109 A RESOLUTION concerning several aspects of the master application for the proposed Gateway Center in the northwest quadrant of the area divided by Interstate 82 and Yakima Avenue, submitted by First Western Development Services, Inc on behalf of Gary D Lukehart and Mary M. Lukehart; approving the preliminary long plat for 11 commercial lots, and releasing certain easements, subject to all of the conditions contained in the Hearing Examiner's Recommendation, and authorizing the Mayor to sign the preliminary long plat. WHERI+AS, on July 14, 1994, the Hearing Examiner duly held a public hearing to consider the master application for a project known as the Gateway Center submitted by First Western Development Services, Inc. on behalf of Gary D Lukehart and Mary M. Lukehart for, among other things. 1) Class 2 approval of the general site plan for compliance with the Floodplain Overlay District, (CL(2) #15-94), 2) a preliminary long plat for 11 commercial lots in the northwest quadrant of the area divided by Interstate 82 and Yakima Avenue, (Preliminary Long Plat #5-94), 3) release of certain easements, (Easement Release #2-94), all in aid of the proposed project; and WHEREAS, on August 8, 1994 the Hearing Examiner issued his Examiner's Recommendation, recommending approval of the master application subject to several conditions; and WHEREAS, the proposed Gateway Center lies adjacent to and is in many respects integrally related to the Yakima Gateway Interchange project being conducted by the City and the Washington Department of Transportation which will construct extensive improvements to Interstate 82 and will develop and extend Fair Avenue on a new alignment; and WHEREAS, the City has, in conjunction with the Washington State Department of Transportation, devoted substantial resources to planning and preparation for construction of the Gateway Interchange project for improvements to Interstate 82 in the immediate vicinity of the proposed Gateway Center, and the Gateway Center plans have been incorporated in and are integral to planning for the Gateway Interchange project; and WHEREAS, based on conditions stated in the Conclusions to his Recommendation, the Hearing Examiner approved the general site plan for Yakima for compliance with the Floodplain Overlay District; and lap\land use \lukehart/target\gateway plat appr res/final 8/23/94 Gateway Preliminary Plat Approval Resolution -- Page 1 • • WHEREAS, at its public meeting on August 23, 1994, each Council member declared that he or she had had no contact with either the applicant or opponents of this preliminary plat, and the City Council determined that the Recommendation of the Hearing Examiner should be adopted, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The Yakima City Council hereby adopts the Findings and Conclusions of the Hearing Examiner's Recommendation, Examiner No I94-7841-28, a true copy of which Examiner's Recommendation, including pages 1-13 of the City Planning Department Staff Report, is attached hereto as Exhibit "A" and is incorporated herein by reference. All approvals and findings of compliance expressed by this resolution are specifically conditioned on the pertinent provisions included among the Conclusions of the Hearing Examiner's Recommendation, subject to any specific modifications represented in the conditions stated below The master application for the Gateway Retail Center, including City Preliminary Long Plat #5-94, Easement Release #2-94, and Class 2 review CL(2) #15-94, is hereby generally approved. The preliminary long plat creating 11 new commercial lots zoned CBDS is approved subject to the following conditions. 1. The development shall substantially conform with the site plans and preliminary plat and design sheets dated March 18, 1994, as revised May 9, 1994, on file with the City Planning Department. 2. A final plat shall be submitted within one year of the date of City Council approval of the preliminary plat. The final plat shall be in substantial conformity with the preliminary plat, and shall meet all technical requirements of Yakima Municipal Code 14 25 200 Final plat approval shall be subject to the following conditions. A. The applicant shall provide bonding and surety for completion of required infrastructural improvements Applicant's provisions for such bonding and surety shall be subject to the approval of the City Engineer and the City Attorney The value of all on-site public improvements to be so bonded and ensured, including improvements to North 10th Street and North 11th Street and on-site public water and sewer extensions, shall be subject to the approval of the City Engineer B The following notes, subject to final approval by the City Planning Division and/or the City Attorney, shall appear on the face of the final plat and shall apply to all lots on the plat: lap\land use\lukehart/target\gateway plat appr res/final 8/23/94 Gateway Preliminary Plat Approval Resolution -- Page 2 • 1. All lots created by this plat are subject to reciprocal non-exclusive access and parking easements, as well as a maintenance agreement as to all shared facilities, including but not limited to parking, landscaping, and storm drainage. 2. All driveway approaches are subject to City of Yakima or Washington State Department of Transportation approval, and shall conform with the plans dated March 18, 1994, as revised on May 9, 1994, on file with the City of Yakima. 3. This plat replaces all previous recorded plats for this property 4. All buildings for which building permits are required shall require a Certificate of Occupancy, which, except for Lots 9, 10, and 11, shall not be granted by the City until substantial completion of the Fair Avenue extension, including water and sewer main relocation. G City Engineer approval of on-site storm water management plan, including exfiltration bed system in lieu of drywells. D. City Engineer approval of street improvement engineering plans and right-of-way dedications necessary for the following items: 1. North 11th Street Dedication of 25 feet from the centerline of the improved surface, together with installation of additional pavement, curb, and gutter, street lighting, and a 5 -foot sidewalk on the east side of the street. 2. North 10th Street Dedication of 25 feet from the centerline of the improved surface, and improvements including street lights, sidewalk, and curbing. 3. Drainage control measures shall be installed in the gutter line to accommodate storm water runoff, including City standard catch basins with through -the -curb frame and grates Catch basins shall outlet into drywells within the right-of-way, with measures taken during construction to ensure that silt laden runoff does not enter the structures. E. All lots shall be served with public water and sewer Water and sewer main extensions are required in North 11th Street and East "A" Street to North 10th Street, and shall be provided by the lap\land use\lukehart/target\gateway plat appr res/final 8/23/94 Gateway Preliminary Plat Approval Resolution -- Page 3 • developer All water and sewer plans and profiles shall be submitted by a licensed Civil Engineer and shall be subject to approval of the City Engineer prior to any construction or installation. F All utility easements, including water and sewer, shall be shown on the face of the final plat. Alternatively, a note shall be placed on the plat giving notice that all easements are pursuant to a document separately recorded containing "as built" drawings showing placement of easements. G. All public and private utilities shall be underground to the extent physically feasible. H. Fire hydrants and street lights shall be provided and installed by the developer at locations and specifications of the City of Yakima Code Administrator I The development shall conform with the mitigation measures identified in the MDNS dated May 17, 1994, file number UAZO EC #12-94 The easement releases will be dealt with specifically in a resolution which will come before Council when the final plat comes before Council for approval. Pursuant to Ch. 35 79 RCW, the street vacations shall be the subject of a separate ordinance. The Mayor is hereby authorized to sign the preliminary long plat dated March 18, 1994, as revised May 9, 1994 ADOPTED BY THE CITY COUNCIL this 23rdday of August , 1994 C;1"),C21..
