A RESOLUTION authorizing the continuation of the agreement with
Yakima School District #7 for an After School Program.
WHEREAS, the Parks and Recreation Division of the Department of
Public Works has provided after school recreation programs for youth; and
WHEREAS, the City Council deems such activities to be healthy and
beneficial for the youth of the City; and
WHEREAS, the Yakima School District #7 has funding to extend the
program through January, 1992; and
WHEREAS, the City Council deems it to be in the best interest of the
• City to to continue the contract with Yakima School District #7 for these
services, now, therefore
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager and the City Clerk of the City of Yakima is hereby
authorized and directed to execute the attached and incorporated
addendum agreement between the City of Yakima and the Yakima School
District for the period from January 1, 1992 to January 31, 1992.

1991 AGREEMENT
BETWEEN THE CITY OF YAKIMA AND THE
YAK:IMA SCHOOL DISTRICT #7
This Agreement, made and entered into the ZS-� day of JUui
1991, by and between the City of Yakima, Department of Public
Works. Parks and Recreation Division, herein referred to as the
'City' and the Yakima School District #7, a non-profit school
district herein referred to as 'YSD'.
WHEREAS. the YSD finds it necessary to contract with the City to
provide supervised after school activities at the locations
specified.

sex, religion, national origin, creed, or the presence
of any sensory, mental or physical handicap.

4. It is expressly agreed upon by both parties that the
program staff are not employees of the YSD. The City
is solely responsible for compensating their employees
and complying with all applicable laws related to such
employment, including but not limited to payment of
Federal Witholding Tax, FICA, Social Security Tax,
Assessment for Unemployment and Industrial Injury.
5. It is understood that the YSD does not maintain
liability insurance on the City and/or it employees.
6. The City shall defend, indemnify and hold harmless the
YSD, its agents, officers, and employees from any and
all liability resulting out of the performance of this
Agreement.
7. As consideration for the services specified in this
Agreement, the YSD agrees to compensate the City
according to the payment schedule, Attachment 'B' which
is attached and incorporated into this Agreement.
8. This Agreement, or any interest therein,'can not be
assigned in whole or in part by YSD to any other
party unless mutually agreed upon by both the City and
the YSD.
9. If YSD fails to perform this Agreement in such a manner
that the Parks and Recreation Manager in his sole
discretion deems that the continuation of this
Agreement is no longer in the best interest of the
City, the City may terminate this Agreement by setting
forth cause in a written notice and giving the YSD
thirty (3C0) days notice of termination.'
10. If the City fails to comply with the terms and
conditions of this Agreement, the YSD may terminate
this Agreement by written notice, giving the City
thirty (3C0) days notice of termination.
All notices required by this Agreement shall be deemed
properly served when deposited in the United States
Mail three (3) days prior to any deadline listed
herein, postage prepaid, and addressed to the
appropriate party at the addresses listed below.
12. This Agreement constitutes the entire Agreement between
the parties. There is no other oral or written
Agreements between the parties as to the subjects
covered herein.
13. If any portion of this Agreement is changed per mutual
agreement the Agreement shall be amended in writing to
reflect the change.

ADDENDUM
1991 Agreement between the City of Yakima and Yakima School District #7.
This Addendum extends the 1991 Agreement between the City of Yakima
and Yakima School District #7 for an additional term expiring January 31, 1992.
This extension is made possible by a surplus of funds after operation of the
program through December 31, 1991, sufficient for an additional month of the
program.
By this Addendum, the City of Yakima agrees to operate the program for
the above given term, and the School District remains obligated to compensate
the City for these services up to the original contract amount of $41,591.00, as
billed by the City. All other provisions of the original contract remain in effect
for the above given term.

ATTACHMENT 'A'
AREAS OF RESPONSIBILITIES:
1. The City of Yakima Parks and Recreation Division shall:
A. Prepare a written proposal to be submitted to the YDS
Athletic Director by June 3rd, 1991. This written
proposal must contain: a program breakdown per location
which identifies staffing required, dates and hours of
operation, program ages and activities provided. Also
to be included in this written report are staff job
descriptions, position hours and rate of pay.
B. Prepare an action plan' which outlines specific goals
and objectives to be attempted or,achieved during the
duration of this Agreement.
C. Submit monthly attendance figures per location which
specifically identifies: preventions, interventions,
interdictions, projected substance abuse rate, age of
participants and ethnic mix.
D. Work with other resource agencies and organizations to
meet the required goals and objectives of the YSD
Gang Intervention/Prevention Grant.
E. Abide by all terms and conditions as outlined in the
Yakima School District gang prevention/intervention
grant.
F. Hold a minimum of three (3) review meetings with the
YSD Athletic Director to discuss the programs underway
and to discuss possible modifications to the proposed
program as initially submitted.
G. Prepare a final written financal report for the YSD by
March 1st, 1992 which specifically itemizes the
amount of moneys spent per location.
H. Prepare a final written program report for the YSD by
March 1st, 1992 which outlines what goals and
objectives were accomplished, which were not, evaluate
the programs offered per location and make suggestions
as to how the program could be improved on.
2. The Yakima School District #7 shall:
A. Provide a copy of the Yakima School District gang
prevention/intervention grant to the City's
Administrative Specialist by June 13th, 1991.

B. Provide School Facilites at: Barge Lincoln School,
Garfield School and Washington Middle School to
facilitate the after school at risk program.
C. Provide custodial staff to maintain the school
facilities in a safe and clean condition.
D. Provide non -program supplies such as tables, chairs,
open space, gym space and classrooms so that, the
program can be facilitated at the school locations.
E. Adhere to the written facility and program schedule as
proposed and accepted.
F. Fay the City of Yakima within thirty (30) days upon .
receiving an itemized program bill. Each program is
to be.itemi:ed seperately.
ATTACHMENT 'B'
PAYMENT SCHEDULE:
1. The City of Yakima Parks and Recreation Division shall:
A. Submit to the YSD Athletic Director an itemized program
invoice/billing for each program location.
B. Provide a final written financal report outlining all
moneys spent per location to the YSD Athletic Director.
by March 1st, 1992.
The Yakima School District #7 shall:
A. Pay the City of Yakima for the after school at risk
program as outlined in the accepted proposal. This
proposal specifically identifies the following amounts
to be paid:
1. Barge Lincoln School; $ 9,427
2. Garfield School; $ 9,427
3. Southeast Community Center; $ 9,427
4. Washington Middle School; $13,310
Total: $41,591
B. Pay the City of Yakima within thirty (30) days upon
recieving the itemized invoice/billing. Check is to,
be made payable to: 'The City of Yakima'.
