HomeMy WebLinkAbout07/10/1972 Special Meeting / Regular Meeting ¶396 JULY 110, 1972.. . • MINUTES OF 'SPECIAL - MEETING > ' • YAKI'MA CITY COUNCIL = . . _. • ., JULY 10, 1972 ' The City Council met in special session pursuant to due notice, at 12 :00 Noon, July 10, 1972, in the Conference Room at Yakima City Hall. • Councilmen present at the._meeting were Mayor Ber•tBroad;''Wray Brown, Lenore Lambert, James Lust, Walter Robinson and Don '•Schussler. Also present City- Manager McMi'cken-, ' City - Attorney Andrews and Administrative Assistant Jim'Williams. City Manager McMicken reviewed his month spent at the Sloan School of- Management in Mas- sachusetts. The Council also discussed the upcoming neighborhood meeting involving those who reside in the typhoid area of Fairview- Sumac. The special meeting adjourned at 3 :00 P.M. REGULAR MEETING - JULY 10, 1972 - 3;00 O'CLOCK P.M. The City Council then met regular session at the hour of 3:00 P.M., at the Yakima Valley Regional Library, because the Council Chambers are being remodeled. 'Mayor Broad was presiding, Councilmen Brown, Lambert, Lust, Robinson and Schussler, City Manager Mc- Micken and City Attorney Andrews were present on roll call., Councilman Whitaker absent on roll call. It was MOVED by Robinson, seconded by Lust that Councilman Whitaker be excused from this meeting and the following meeting of July 17, 1972: carried, Broad, Brown, Lambert, Lust, Rob Schussler voting. aye by voice vote. The Invocation was given by City Manager McMicken. Since the minutes of the regular meeting of June 26, 1972, were not'certified accurate by two Councilmen, and could not be signed by_the Mayor, they were held over until the regular meeting of July 17, 1972. • Petition No. 749, having been filed' with the City Clerk on June 22, 1972, by Donald Picatti, and Others, requesting Vacation of Barge Street, between 41st and 42nd Avenues, and a re- . commendation having been received from the Planning Commission on -said Petition No. 749, it was MOVED by Robinson, seconded by Schussler that Resolution`No. D- 1889- fixing time • and place for a Hearing on said petition for vacation/ be passed - as read. Discussion in- dicating that the Planning Commiss'ion'might like to further review this matter, it was MOVED by Robinson, seconded by Schussler that Resolution No. D -1889 be amended to fix the time of hearing for one week later or August 7, 1972: carried, Broad, Brown, Lambert, Robinson and Schussler voting aye by voice vote. Lust not voting. Whitaker absent. Mayor Broad then called for the roll call vote on the MOTION made by Robinson and seconded by Schussler to .pass Resolution No., D-1889, and it carried, Broad, Brown, Lambert, Lust, Robinson and Schussler voting aye on roll call. • Wh'itaker absent. RESOLUTION NO. D -1889, A RESOLUTION fixing the time and place for hearing on a petition for vacation of a portion of Barge Street within the City of Yakima, Washington. Damage Claims having been filed with the City Clerk on June 29, by Mrs. Rose Hanson, 12032 West Yakima Avenue, in an undetermined amount, for injuries sustained by falling on a city sidewalk, and filed by'Jearleen Carol Hargett, Selah, Washington, in the amount of $97.73, for eyeglasses lost. during an arrest by a city policeman, it was MOVED by Schussler, seconded by Brown that said damage claims be referred to the City Manager and Staff for study and recommendation: carried, Broad, Brown, Lambert, Robinson and Schussler voting aye by voice vote. Lust requested that he be recorded as not voting. Whitaker absent. An Ordinance appropriating $41,800 within various funds tor:pay prior service charges to the Public Employees Retirement System, having been read in'its entirety at the previous meeting of June 26, 1972, and being read by Title only at this meeting, it was MOVED by Brown, seconded by Lambert that Ordinance No. 1420 appropriating said $41,800 to various - accounts-within various funds, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Schussler voting aye on roll call. Whitaker absent. ORDINANCE NO. 1420, AN ORDINANCE appropriating the amount'of $41,800 to various accounts within various funds to pay prior service charges to the Public Employees Retirement Sys- tem. - An Ordinance authorizing a -loan of $130,186 from Parks and Recreation Capital Fund and Fire Capital Fund to be made to the 1972 Various Purpose General Obligation Bond Redemp- tion Fund, and appropriating $71,509 from unappropriated money in the same Bond Redemption Fund, to pay for interest due, having been read in its entirety at this meeting, was laid on the table for one week or until July 17, 1972. City Manager McMicken explained that this loan and appropriation is necessary in order to provide funds for payment of interest to become due on Various Pur.pose General Obligation Bonds, 1972, previously issued by the City. - Mr. Bill Quist, 3801 Tieton Drive, being present, spoke to the matter of dog licensing in the city. Mr. Quist brought up. three questions: (1) Why does the City have dog licenses, and if necessary, why are not all animals licensed, (2) Why aren't people made aware that dog licenses are due in February, and (3) Why is there no enforcement of the dog ordinances in the city? Mr. Quist suggested to the Council that the City issue a numbered identifi- cation tag, when the animal is first introduced to the family, and charge the home owner 50 cents. He further suggested that the description could be recorded for identification purposes, and no further charge be made to the home owner. Mr. Quist proposed that a reminder be put\.on the .home owner's utility billing, telling them that dog licenses are due in February. City Attorney Andrews explained that licensing is a revenue raising measure rather than a regulatory measure. He further explained that the leash law is re- gulatory, and unrelated to whether the dog has'a license. City Clerk Marie Donelson in- . formed Mr. Quist. that his suggestion on licensing would not serve the purpose, because that would not raise the revenue necessary to help offset the costs of animal control. Council members agreed that Mr. Quist's suggestion to put a reminder on the utility bill was a good one, and that it would be looked into. 39V • • . JULY 10, 1972 Mr. E. A. Doran, 511 North Naches Avenue, brought up and - discussed with the Council the - matter of weed control;:namely, Canadian•Thist -le; • City Manager. McMicken reported that the City engineering. staff has developed a.construc- tion and maintenance agreement to be executed with Burlington Northern, Inc.,.'for impro- ving railroad crossings at Lincoln Avenue, "B "Street and -' "D" Street. •He further reported that this agreement has the recommendation' of the City Engineer and Burlington Northern, Inc., and is ready for Council After -.due discussion, it was MOVED by Robinson,. seconded by Lust that. Resolution No - -D -1890 authorizing execution of said construction and maintenance agreement with Burlington Northern, Inc., be passed as read: carried, • Broad, Brown, Lambert, Lust, Robinson'and.Schussler voting aye on roll call. Whitaker • absent. Public Works Dave Vargas explained that the railroad already pro- ceeded with the work. . - RESOLUTION NO. D-1890, A RESOLUTION authorizing.and directing the City Manager and City Clerk of the City of Yakima to execute a construction and maintenance agreement with Burlington Northern, Inc., for improving railroad crossings at. Lincoln Avenue, "B" Street and "D" Street. . City Manager McMicken reported that in. connection -with the Washington'Avenue and Mead Avenue Arterial Street Improvements across railroad right -of way and trackage, it is necessary. to execute easements.for public. roadway purposes' and roadway slopes as prepared by Burlington Northern, Inc. .It was then MOVED by Brown, seconded by Robinson that Re- solution No. D -1891 authorizing the execution of said easements for•public roadway pur poses, granted by- Burlington Northern, Inc., for'Washington and Mead Avenue Street and railroad crossing projects, be passed as read:•carried, Broad; Brown, Lambert, Lust, Robinson and Schussler voting aye on roll call. D -1891, A RESOLUTION accepting easement grants from Burlington Northern, Inc., to accommodate improvements to Mead Avenue and Washington.Avenue railroad crossings in the City of Yakima. . City Manager McMicken reported that in connection with improvements to be made to Randall Park at a total cost of $199,961, the State of Washington, Interagency.Cominittee for Outdoor Recreation, has agreed to pay 75 percent $149,970.75: He further reported .that a project agreement has already been.executed by the'State, and is ready for execu- tion by the City. After due discussion, it was MOVED by Brown, seconded by Robinson that Resolution No. D -1892. authorizing• the execution of said agreement with the State Inter- agency Committee for Outdoor Recreation andimprovements to Randall Park,.be passed as - • read: carried,' Broad,, .Brown, Lambent.,- -Lust, Robinson "and ' Schussler voting aye on roll call'.' Whitaker absent. . . RESOLUTION NO. D -1892, A RESOLUTION .authorizing :and'directing the City Manager and City Clerk. of the City of Yakima to execute a.Project Agreement with the State of Washington, Interagency Committee for Outdoor Recreation, for Randall Park Phase I Development. City Manager McMicken reported that in an effort to complete the street work adjacent to. the Southeast Community Center without further delay, the city obtained informal .quota- tions from each of the local paving companies, and the City Engineer recommended that the job be awarded to Superior Asphalt, who was the low bidder. It was then MOVED by seconded by Robinson that•Resolution No. D -1893 authorizing the City of Yakima to engage _Superior'Asphalt and Concrete Company to.pave an alley at Southeast Community Center without calling for formal be passed as read. ,Councilman Robinson inquired into this matter, questioning.the point of "emergency ". Discussion brought out that our-Charter states that purchases of $500 or more should receive formal bidding. Councilman Robinson indicated that'he preferred that construction, such -as this be .submitted for formal bids. II After considerable discussion, Public Works Director explained that the emer= gency was.caused due to the fact that in the beginning, it planned to do this work with City crews and rental of just the machine; but it was found that our crews were in- , volved in other work, and when weighed against factors of overtime and rental, it was • found to be cheaper as prescribed in the resolution being considered. Mayor Broad then called for the roll call vote on - the MOTION made by Lust, seconded by Robinson to pass Resolution No. D -1893, and it carried, Broad, Brown,- Lambert, Lust, Robinson and Schussler voting aye on roll call. Whitaker absent. City Manager McMicken defended the emergency, and explained' that department heads are trying to. be conscientious in bringing these matters before the Council for their consideration. RESOLUTION NO. D -1893, A RESOLUTION authorizing the City of Yakima to hire work and labor and purchase materials for the construction of asphaltic concrete paving at the Southeast Community Center without calling for bids. • A Resolution of Intention to improve property by the construction of curbs, gutters and surfacing of a portion of 18th Avenue, the widening of 16th Avenue and Nob Hill Boulevard, and the installation of domestic water mains, in accordance with Petitions No. 745 and 746, having been prepared by the City Engineer, it was MOVED by Robinson, seconded by Lam - bert that Resolution No. D -1894, a Resolution of Intention to create a local improvement district and fixing July 31, 1972, as a time for hearing on said matter, be passed as read: carried, Broad, Brown, Lambert, Lust, Robinson and Schussler voting aye on roll call. Whitaker absent. RESOLUTION NO. D- 1894,, A RESOLUTION of intention to, create a local improvement district. City Manager. McMicken reported that bids, were received and considered by a bid board on June 27, 1972, for West Mead Avenue Tree and Stump Removal Project, as follows: • Superior Asphalt & Concrete Co. $2890.00 H &.W Tree Service, 1843.92 Alfred Dolliver 1800.00 The City Engineer recommending that the contract be awarded to Alfred Dolliver, who sub- . mitted the lowest and best bid in the amount of $1800.00, it was.MOVED by Robinson, se- conded by :Brown that the recommendation of the City Engineer be accepted and that the con- tract be awarded to Alfred Dolliver, in the amount of $1800.00, and that the City Manager be authorized to enter into a contract with said contractor upon the filing of the proper bond and insurance: carried, Broad, Brown, Lambert, Lust, Robinson and Schussler voting aye by voice vote. Whitaker absent. ;98 . JULY 10, 1972 • The City Engineer, having reported on completion•of L.I.D. Nb. 983,.K -Mart Water and Sewer District, it was MOVED by Lambert, seconded by Robinson that August '7, 1972, be set as time for the Hearing on the Assessment roll for said district: carried, Broad, Brown, Lambert, Lust, Robinson and Schussler voting' aye by , voice' vote. Whitaker- absent. An off= the - Agenda item, pertaining to the approval of preliminary plans for "Eisenhower High School Tennis Courts, was brought on fbr•disc ''Parks - :and Recreation Director Bill Hutsinpiller, being present, reviewed the plans for tennis courts and the es- timated costs. He explained that the budget for this project is $48,000, and the estimated cost is $39,000. He further explained that the specifications have been completed, and that they are ready to call for bids. Councilman'Schussler questioned fencing between the courts, and lighting of the courts. Hutsinpiller explained that the plans include future lighting, and he would check into, the fencing, which had not been included. Mr. Hutsinpiller reported that an agreement hasn't been executed with the School as of yet, but will.be completed before any work is done. -After due discussion, it was MOVED by Schussler, seconded by Lust that the preliminary plans for Eisenhower High School Tennis Courts be approved: carried, Broad', Brown, Lambert, Lust, Robinson and Schussler voting aye by voice vote. Whitaker absent. City Manager McMicken requesting approval for out -of -State travel for Sandy Rogers, Traffic Engineers', Department, to attend the Institute of Traffic Eng'ineer's 25th Annual meeting in Portland, Oregon from July 10 through July 12, 1972, it wasMOVED by Robinson, seconded by Lust that said out -of -State travel be allowed with expenses- paid: carried, Broad, Brown, Lambert, Lust, Robinson and Schussler voting aye by voice vote. Whitaker absent. There being no further business to come before the Council, it was MOVED by Lust, seconded by Robinson that we do now adjourn at the hour of 4:30 P.M.': carried, Broad, Brown,' Lambert, Lust, Robinson and Schussler voting aye by voice vote.
