A RESOLUTION authorizing the execution of a Fire
Communications Contract with the Cities of
Selah and Union Gap and Yakima County Fire
Protection Districts 1, 2, 3, 4, 6, 9, 10, 11
and 12.
WHEREAS, the City operates a fire dispatch center
for the purpose of receiving fire emergency calls and
diapatchrng appropriate personnel and equipment; and
WHEREAS, the City currently has excess service
capacity in its fire dispatch center; and
WHEREAS, the City Council deems it to be in the best
interests of the City of Yakima to contract with the
Cities of Selah and Union Gap and Yakima County Fire
Protection Districts 1, 2, 3, 4, 6, 9, 10, 11 and 12
(later referred to as Districts) for the purpose of
providing alarm and dispatch service to such cities and
districts, now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
YAKIMA:
The City Manager and the City Clerk of the City of
Yakima are hereby authorized and directed to execute the
attached Fire Communications Services Contract with the
Cities of Selah and Union Gap and the aforementioned
Districts. A true copy of the Fire Communications
Services Contract is attached to this resolution and
incorporated into it as if it were fully set forth.

FIRE COMMUNICATIONS SERVICES CONTRACT
PARTIES: CITY OF YAKIMA, hereinafter called "City," and THE CITY
OF UNION GAP, THE CITY OF SELAH, hereinafter called
"Cities," and YAKIMA COUNTY FIRE PROTECTION DISTRICTS NO.
1, 2, 3, 4, 6, 9, 10, 11, 12, hereinafter called
"Districts."
RECITALS:
The City has heretofore provided alarm services to the Dis-
tricts and Cities for the handling and processing of fire, alarm,
and emergency calls. The parties desire to enter into a contract
for the continuation of such services, now, therefore, for and in
consideration of the covenants and conditions hereinafter con-
tained,
THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1. FIRE DISPATCH CENTER. The City shall continue to operate
a central facility to be known as the Fire Dispatch Center within
the City of Yakima and shall use the same for the purpose of re-
ceiving fire and emergency service calls from the respective areas
served by all of the parties hereto, and shall dispatch fire appa-
ratus of the appropriate party in answer to any such fire or emer-
gency calls and for the purpose of receiving and transmitting
mutual aid calls among the various parties hereto and for other
related business.
2. AUTHORITY OF DISPATCH CENTER. It is agreed that the duty
of operating the Fire Dispatch Center and the complete management
thereof is vested in the City and that the City shall have the
full, complete, and exclusive authority to operate and manage such
Fire Dispatch Center, including, but not limited to, the authority
to hire and fire employees and operators for such office.

3. EXPENSE OF MAINTENANCE AND OPERATION. The expense of
continued maintenance and operation of the Fire Dispatch Center,
including the expense of operating all telephone lines terminating
at the Fire Dispatch Center, and including the maintenance of
equipment located within the Fire Dispatch Center belonging to the
Districts and/or Cities shall be borne by the City.
4. TERM. This contract is for a term of three (3) calendar
years commencing January 1, 1991. It shall terminate on December
31, 1993.
5. COST OF SERVICE. The City shall maintain a record of all
the Districts' and Cities' alarm calls, and each District and each
of the Cities of Union Gap and Selah shall be charged by the City
for each call as stated herein. During the calendar year 1991, the
cost per alarm call shall be SEVENTEEN DOLLARS AND EIGHTY-FIVE
CENTS ($17.85). The cost per alarm call for 1992 and 1993 shall be
increased each year by a percentage equal to the percentage in-
crease in the Consumer Price Index for the Seattle Metropolitan
Statistical Area as published by the Bureau of Labor Statistics.
If there is no increase or there is a decrease, there will be no
change in cost per alarm call for that year.
Each District and each of the Cities of Union Gap and Selah
shall be billed in January of each year for alarm service during
that calendar year based on the number of alarm calls handled by
the City for each District and the Cities of Union Gap and Selah
during the previous calendar year times the cost per alarm call
rate applicable for the respective year.
6. PAYMENT FOR ALARM CALLS. Each District and each of the
Cities of Union Gap and Selah shall pay for each year's billing for
alarm services within ninety (90) days after billing by the City.
Payment shall be made to the City Director of Finance and Budget,
City Hall, Yakima, Washington.
7. DEFINITION OF ALARM CALLS. A call to be charged for
under the terms of this agreement is defined as follows:
A. An alarm call is defined as a call requiring the
dispatch of equipment from Districts or the Cities. Any number of
vehicles from the responsible Districts or Cities may answer any

such alarm call. All communications dealing with such alarm call
shall be deemed one (1) alarm call.
B. Mutual Aid. In the event an individual District or
Union Gap or Selah requests mutual aid it shall pay for each addi-
tional alarm call it requests.
8. EARLY TERMINATION OF CONTRACT. The parties to this
Contract agree this Contract will be terminated if a combined
communications center is placed into operation as a result of
implementing a 911 system, which replaces the existing Fire Dis-
patch Center. A combined communication center is defined as a
central receiving point and dispatching center for all police,
fire, emergency medical services, and related emergencies. If the
combined communications center is placed into operation at a time
other than the end of the calendar year, the Cities and Districts
will be responsible for payments for that calendar year only
through the time the services provided by the City of Yakima are
terminated. If payment for the entire calendar year has been paid,
a pro -rata refund through the date of service provided will be
made.
9. HOLD HARMLESS. The Districts and the Cities shall de-
fend, indemnify, and hold harmless the City, its agents, officers,
and employees from any and all liability arising out of the per-
formance of this contract.
10. SIGNATURE. It is agreed that this contract may be signed
by each District separately and the signatures of all Districts
need not be placed on a single document.
IN WITNESS WHEREOF, the parties have set their hands and seals

3. EXPENSE OF MAINTENANCE AND OPERATION. The expense of
continued maintenance and operation of the Fire Dispatch Center,

Districts and/or Cities shall be borne by the City.

"Cities," and YAKIMA COUNTY FIRE PROTECTION DISTRICTS NO.
1, 2, 3, 4, 6, 9, 10, 11, 12, hereinafter called
"Districts."
RECITALS:
The City has heretofore provided alarm services to the Dis-
tricts and Cities for the handling and processing of fire, alarm,
and emergency calls. The parties desire to enter into a contract
for the continuation of such services, now, therefore, for and in
consideration of the covenants and conditions hereinafter con-
tained,
THE PARTIES MUTUALLY AGREE AS FOLLOWS:
1. FIRE DISPATCH CENTER. The City shall continue to operate
a central facility to be known as the Fire Dispatch Center within
the City of Yakima and shall use the same for the purpose of re-
ceiving fire and emergency service calls from the respective areas
served by all of the parties hereto, and shall dispatch fire appa-
ratus of the appropriate party in answer to any such fire or emer-
gency calls and for the purpose of receiving and transmitting
mutual aid calls among the various parties hereto and for other
related business.
2. AUTHORITY OF DISPATCH CENTER. It is agreed that the duty
of operating the Fire Dispatch Center and the complete management
thereof is vested in the City and that the City shall have the
full, complete, and exclusive authority to operate and manage such
Fire Dispatch Center, including, but not limited to, the authority
to hire and fire employees and operators for such office.

3. EXPENSE OF MAINTENANCE AND OPERATION. The expense of
continued maintenance and operation of the Fire Dispatch Center,
including the expense of operating all telephone lines terminating
at the Fire Dispatch Center, and including the maintenance of
equipment located within the Fire Dispatch Center belonging to the
Districts and/or Cities shall be borne by the City.
4. TERM. This contract is for a term of three (3) calendar
years commencing January 1, 1991. It shall terminate

under the terms of this agreement is defined as follows:
A. An alarm call is defined as a call requiring the
dispatch of equipment from Districts or the Cities. Any number of
vehicles from the responsible Districts or Cities may answer any

such alarm call. All communications dealing with such alarm call
shall be deemed one (1) alarm call.
B. Mutual Aid. In the event an individual District or
Union Gap or Selah requests mutual aid it shall pay for each addi-
tional alarm call it requests.
8. EARLY TERMINATION OF CONTRACT. The parties to this

communications center is placed into operation as a result of
implementing a 911 system, which replaces the existing Fire Dis-
patch Center. A combined communication center is defined as a
central receiving point and dispatching center for all police,
fire, emergency medical services, and related emergencies. If the
