The :minutes of. the ,regular meeting of May -8, 1972 having'been.'.duly certified accurate by
two-Councilmen and. no one present wishing to'have said minutes, read publicly, Mayor'Broad
. .declared said minutes approved as .
This being the , time fixed 'for' the Hearing on Resolution' .of Intention No. D-1848, improve
property by the•constructibh of a sewer in the vicinity'of South lst Street and Mead Avenue
having been continued from the previous meeting of May 8, 1972, in order for -the Staff to:
analyze,._the ;.policy of the City and what can be .anticipated in the future -in "the utilities
situation,•.Public_Works Director. Dave.Vargas._spoke to this matter. He stated that after '
the appearance of interested citizens last..week, that.the.objections.of the residential
property owners.along Russell Lane. have_. been. considered. and there are several alternatives.-
one would be to scrap..:the proposed L- ..I.-D.. and .come .back with a new proposal that would
benefit everyone; or in view' of the.•protests`onboth sides of Russell Lane, the residential
property on the northside of Russell-Lane could also-be deleted.and.those assessments .
. could .be picked up by the Water -Sewer Fund, or .the industries requesting the L...I.D., could
pick up the total.cost and then sign 15 -year reimbursement agreements with the City so that
. as others hooked'on they would .be reimbursed. He explained that this latter action.would
. require eight separate agreements and` that'..the. sitplest.way, .which the Staff recommends
._
would-be to.deletethe residential.properties.on -both sides of Russell_Lane, the Wate
Sewer Fund pick up the-balance;:.and.all.of these residential.properties would be deferred
assessments. in that when they do hook,.up;to the sewer system they would be charged an .
assessment equal to the industrial users.. _Councilman Robinson stated that he .is not dedi-
cated .to=the.proposition of postponing the collection and .having the Water -Sewer Fund pick
up the- cost,. and feels that.,.if this is. done, .that .it.- should .not. be considered a precedent ,
for future..actions.. : due..discussion, it.was. -MOVED by.Robinson, seconded by Brown that
an_Ord'i-nance be prepared.creating-an. L..I.D...which. would accomplish_the.result of omitting
the properties on both sides of Russell.Lane :.and have it available at the next meeting of
May 22, 1972: carried, Broad, Brown, Lambert, Lust, Robinson, Schussler and Whitaker voting
aye by voice vote.
This "being.the time fixed for the.Hearing -on the Improvement and Widening_of North 4
Avenue .between.. Lincoln ..and. _Englewood .Avenues , Mayor .Broad :stated . that•` everyone'. wishing to
speak to this matter will have the opportunity, after Staff members review the proposed
project for -the benefit-of .Council members and those present. City Manager McMicken
stated that there are two parts.to the discussion. -- 40th Avenue widening and the landscap-
ing.of the Reservoir. Director .of Planning, Jay Otto, explained that the Planning Commis-
sion had again reviewed and considered the_ entire proposed.plan..of the widening of North
40th Avenue and ,recommended that the City Council proceed with the project. Public Works
. Director Dave. Vargas referred to the- General.Plan of the. City which shows 40th Avenue from
Washington to Eruitvale Boulevard as.an- Arterial street,. which plan was adopted six years
ago by the City Council and the Planning Commission. He.reviewed the _proposed project in
detail.stating that. since the previous public hearing of the Planning Commission, the
Engineering Department has developed'some alternative plans -'.one is a boulevard landscap-
ing space in the middleof the roadway to allow -for a fifth lane in the future, but would
be presently constructed,.as a .median -strip for nearly one block..length which would preclude
traffic'. using Richey Road for by -pass. of the .signalization of Englewood and - Lincol
and 40th. He stated that' another. alternative considered,was to.eliminate..the middle fifth
lane altogether and narrow the,road to'48 feet'between the curbs .with. sidewalks and plant-
ing strips, and a more recent plan had been. .worked but to have four.traffic lanes, with a .
fifth turning lane, planter strips and...sidewalks on each side :. Mr.. Vargas also discussed
the Reservoir site plan which._is.to. have .shrubbery on all sides,..:with the height to be such
as to not cutoff the view but . screen -the slab. only• and the°` rest - would be in: grass • Persons

traffic lanes and no sidewalks. Mr. Jay.Otto, Planning Director, spoke again.in favor of

City Manager : McMicken referred. the .matter of. the..acquisition 'of.- property for park purposes
as addition to,_Miller Park..for ::.Senior Citizens.Center, Bill Hutsinpiller,.Director -of
Parksand Recreation, who reviewed - .this matter explaining that•there are -two parcels that
have been appraised by George Lemon.which the City desires to. purchase -and that -the owners
of one parcel,..602 N..._4th.Street, the.Sweeten Estate'.Representatives have offered to.sell
. to.:the. City- for...$12-,500.; together'.with- .incidental - costs, •andrecommends• the purchase of,—
said :,property._ He.further explained.that the,owners of other parcel, F. W.-& Laura
Riebe , have .been - offered... $13_, 500 -, ...but.: -they have: indicated that they will . not, sell. , that

the Washington State Department.of Highways for'the reconstruction.of water intake works.
.He•read a memo'from.Frank Stein.,.Utilities Director, which explained that at the time of
the. construction .of..the .headworks .for .the ..intake . system for the domestic water treatment
- _plant, work_.was done ._.in -the .Naches . River: by .the.. State - Highway Department' s • contractor . to •
. . provide a :rock.diversion..structure L to turn thestream'.s flow to.the auxiliary,intake,.and
that high water in the :spring of destroyed. this entire rock groin: The
• memo further explained - .that- in: the . late summer of .1971 the City contracted to make". channel
- .changes upstream from this..point.:to divert the river flow to the intake structure.and.to
.do a minimum amount ..of ..work on .the .rock groin diversion structure, and that in ,order not.. t.
• . have. to :do this. type -of annual maintenance on .the rock diversion structure, it -is r:equeste•
that approval -be given to.- entering. into a proposed to have the - State Highway.De-

City _Attorney Andrews referred-to Council...action.of January_10.,.1972,.in . accordance_ with .:
Resolution No. D -1792 authorizing the commencement of.a lawsuit by the City of Yakima as a
joint plaintiff with the Town.of Selah, against- Claude S..Willis,_d /b /a Slurry Seal of
Southwest Washington. He explained that he has not yet start suit and that Attorney Doug
Peters has now started such a .suit for the Town .of Selah..and .that the recommends that the
City of Yakima -farm this job out to Mr.. Peters to handle.with :.the suit for the Town of .
Selah. After due discussion, it was. MOVED by Robinson, seconded by Schussler that legisla-
tion be prepared authorizing the City.of Yakima to enter into an agreement to hire...Doug
Peters to handle.the lawsuit against Slurry Seal of Southwest..Washington for the City of
Yakima ..along with.the Town of Selah: carried Broad, Brown, .Lambert,...Lust, Robinson, Schuss-
ler and Whitaker voting aye..by..voice.vote.
Councilman Brown asking to be excused from the.Council meetings.of May_22 and.30, 1972, it
was MOVED by Lust, seconded by..Robinson that he be- -excused: carried.,. Broad, Lambert, Lust,
Robinson,.Schussler and Whitaker voting aye voice. vote.
