The minutes of the regular meeting of June. 15,.1970, having been duly certified accurate by two Councilmen, and no one present wishing to have said minutes read publicly, Mayor Larson declared said minutes approved as recorded. Mayor Larson indicating that persons are presentregarding one' item on the agenda later in the meeting and one item not on the agenda, and sinceTthey'do not take much time to act -upon, asked that these. matters be brought on for action at this time. Petition No 662, Notice -of •Intention to Commence Annexation Proceedings, having been file. with the City Clerk on June 5,.1970, by E.W.• Poulin :& Other; requesting annexation of property situated on South 1st Street,. contiguous to the. South Yakima City .limits, and Mr. Poulin being present, it was MOVED by R seconded by.McNe.ice that,: this date be set as the title for ameeting with the initiating .parties who'_signed. the Notice of Intentio to Commence Annexation Proceedings dated June 5, 1970, those initiating parties being E.W. • .Poulin & Others: carried, Keith, Lambert, Larson, Lust,. Brown absent. . • Petition No. 664,:Notice of Intention to Commence Annexation Proceedings, having been file. with-the City Clerk on June 22, 1970, by Alfred Stelzer &:Others, requesting annexation property bounded.on'the north -by Washington Avenue, on the west by Voelker Avenue and on '-the east by Longfibre Avenue, My. Jay Otto, Director'of Planning•andCommunity Develop- ment, reported that this is an•area of 'about 24 acres,:which'will create two islands, but that an investigation. had been made, and the people withiin. the two islands do not wish to annex at this time or in the near future. He further reported.that.•it is plann,ed.to build a Mobile Home Park on this property and that the Planning Commission has_ recommended that it be annexed as a Planned Development -Zone. Brown absent. • • This being the time fixed for the hearing on Petition No 654, fil:edby Csp Josephine Hammond and Kenneth R.`and Wilma Hull, requesting vacation.of a portion of Willow Street right -of- way, Mr. Jay Otto; Director of Planning and Community Development explained that the Planning`Staff had recommended denial of..this•petition for the reason that it is only • a partial vacation of . a street,.._but -.that the Planning,_Commission, after discussing the matter and hearing Mr. Hull's presentation and reasons for wishing this strip of land vacated, recommended that the requested vacation of a portion of Willow Street be granted subject to easements. Mr.. Otto stated that the Planning Commission,at. its meeting of May .21, 1970, passed a Resolution•:of Intention to vacate the reamining right -of -way, if,any, of Willow Street between .North 15th - and 16th Avenues. Mr.Hull,.be'ingpre'sent, spoke in behalf of-the petition.and expressed-dissatisfaction with the City of Yakima with the ' handling of the petition, and stated that to his knowledge the City -had no right -of -way on this strip of land as it has always been included as yard for this parcel of land: He further stated - that „he had just received a statement for•an L.I.D. assessment which in- cluded this strip of 'land as a part of his land being assessed. Mr. Bull explained that for many years he has taken care of this piece of'land along with his own, but that cars, kids and dogs make it very difficult,;and if this vacation granted he will fence the property to keep a grandchild =in.and the dogs out. Discussion brought out the fact that this strip is only 20 feet wide, and that Willow Street is shown on the•C-,iera1 Plan as a neighborhood street with no opening between 15th and 16th Avenues. City Attorney Andrews explained that in researching this matter, it was found that the area was first platted in 1892, with Willow Street being"'platted through, but it was never :opened. He stated than in 1909 there was no public right of way shown, then in 1911 this area was re- platted, showing only this 20 ft. strip of right -of -way for which the vacation'is being requested and that the:.ba'lance of Willow is not_shown as being included in the re -plat of 1911. Mr. Andrews, stated that in this case, as in many early plats and re- plats, the title records • • JUNE .22,E 19.70 • are not very clear.. Brown absent. • • ' RESOLUTION NO. D -1502, A RESOLUTION'approving - and providing for the execution of a Con - - tract for Grant to Acquire and /or Develop Land for Open -Space Purposes No. WASH- OSC -94(G) by and between the City of Yakimaand the United States of America. • City Manager McMicken referred to his'Report #89, Traffic Engineering Division.- Personnel Changes and Reclassifications and explained that this report is to advise the City Council of certain personnel changes and reclassifications requested for'the Traffic Engineering Division and the impact on the budget and requires no action by the City Council.' He .further explained that the requests involve. -three per'manent'positions, involving upgrading of one position, the filling of -one position.at a lower. level than previously classified • and the creating . of apermanent position now being performed on a part -time basis, which changes - result in.an net annual decrease to salaries and.wages of $144. • • City Manager McMicken referred the matter of the Solid Waste Collection, Disposal and Rates Study, as prepared by'the Public Works Director, to -Mr. John Mayo, who reviewed the report briefly, stating that the last report on.the operations•and financial problems of the Yakima Municipal Garbage Service was made in January, 1961, at 'which time as a result of the study and its recommendations, the City Council adopted by Ordinance a new rate schedule in June of 1961. He reported that in addition to the new: 'r-ate,.Schedule at that time, as soon as possible, modern•larger packer trucks were purchased which allowed the City to reduce the number of the number of :employees in the division, which combination of reduced expenditure and increased revenue has 'allowed the City to operate on a fiscally sound basis through the calendar year 1969. Mr Mayo further reported that revenues•in 1969•were.not adequate to cover expens.es,nor•are the predicted revenues for 1970adequate unless . a rate change, a reduction in expenditure, or combination. of both is before mid year.. There was discussion regarding raising rates in several different ways. such .as - a per -can amount, on the carry out fee. and chargin for brush: and leaf haul. Since.there.would be extra bookkeeping required with some of the suggested, methods•, .both the - Finance Department and' possibly by truck drivers, the matter was informally continued for None week to allow _for further study on the various methods -of raising 'fees and some investigation into the bookkeeping methods that would be required. City Manager McMicken. referred to his Report #90, Yakima Avenue Underpass, which reviewed the chronological sequence of events necessary. for proceeding with the Yakima, Avenue Underpass, and stated that the City now should proceed with the review of the Preliminary . Study, Phase II, holding hearings as necessary,.and involving the adjacent property owners and general public in the decision making process. He further stated that pro - ceeding with Phase II of the underpass project does not mean that it is proposed that the underpass be built:ahead of the two overpasses on "B" Street and Lincoln Avenue, but that the order of priority should remain as.orginally recommended by the Planning. Commission. Mr. McMicken stating that in accordance with thB chronological sequence of events, the next thing to be done is to refer Phse II,' Preliminary. Study, to the Planning Commission for their review and recommendation after public hearing, and recommending said action, it was MOVED by Robinson, seconded by Keith that the Preliminary Study of Yakima Avenue Undercrossing, Phase II, be referred.to the Plann-ing'Commission as recommended by City Manager Report #90: carried,. Brown absent. . • City Manager McMicken reviewed the Yakima County Water - Sewer Plan and suggested that the City - might make a statement similar to what is in this Plan. He•referred to the suggested draft of a letter to the Sewer Water Review Committee and stated that the water -sewer plan in general fits the City of Yakima, but there,might be additional ideas. There being no further discussion on this matter, no Council •action was taken, or is necessary: City Manager'McMicken explaining that in the widening and improving of portions of Mead Avenue and Nob Hill Boulevard, it is necessary-to acquire some right-of-way recommend- ing that George M. SRA, be engaged to perform the work of .appraising property to be acquired and negotiating for its acquisition, in accordance with a letter from • Mr. Lemon, . it was MOVED by Keith, seconded.by Robinson that Resolution No. D -1503 authorizing the engaging of Mr. Lemon, be passed as read: carried, Keith, Lambert, Larson, Lust, McNeice and Robinson voting aye on roll call.
