For Meeting of: July 5, 2022 ITEM TITLE: Resolution authorizing the City of Yakima to participate in a S I E D application on behalf of the Yakima First Partners, LLC for a project at South 1st Street and Russell Lane SUBMITTED BY: Joan Davenport, Community Development Director Bill Preston, City Engineer SUMMARY EXPLANATION: The City of Yakima has been requested to authorize an application with the Supporting Infrastructure for Economic Development (S I ED) program to fund an improvement to the existing street intersection of South 1st Street and Russell Lane. There is an existing traffic signal at this intersection. Russell Lane will be re-aligned to utilize this existing signal. This project will open up about 5 acres of commercial property and make more efficient use of our street network. The private party will pay the local match and is responsible for the loan repayments. The project is requesting $416,000 in grant, $416,000 in loan and $168,000 in local match. R-2022- A RESOLUTION authorizing the City of Yakima to support the grant and loan application of up to $1,000,000 from Yakima County Supporting Investments in Economic Development (SIED) fund to install street and traffic signal improvements in the vicinity of South 1 n Street and Russell Lane for Yakima First Partners, LLC, in the City of Yakima. WHEREAS, The City of Yakima has established that public safety, especially on public streets, is a Strategic Priority for the City Council; and WHEREAS, The City Council is committed to assisting existing businesses, supporting new development as feasible and the preservation of the community employment base.; and WHEREAS, Yakima First Partners, LLC proposes to make more efficient use of the existing traffic signal and street network on South First Street by re-aligning and improving Russell Lane, and WHEREAS, South 1st Street is a classified Principal Arterial that carries approximately 18,500 Average Trips a Day (ADD and is a designated truck route. Additional traffic signals are not necessarily advantageous, and this project proposes to make more efficient use of the existing infrastructure; and WHEREAS, the improvement of city streets to improve public safety is a priority. In this case, Yakima First Partners, LLC proposes a significant improvement of the existing street and will create additional jobs in Yakima, enhance the commercial node on South First Street and reduce potential traffic safety concerns; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YAKIMA: The City Manager is hereby authorized to support the grant application with the Yakima County "Supporting Investments in Economic Development" program in the amount not to exceed one million dollars including $416,000 in grant, $416,000 in loan and $168,000 in local match, with all repayment and local match to be paid by the private developer (Yakima First Partners, LLC).. A resolution or ordinance of the local governmental jurisdiction authorizing the SIED application is required. riP- roject Costs. Engineer cost projections for public project costs are required. SIED will not entertain requests for project cost overruns. For the success of your project, ensure project cost estimations are realistic. 1 Local Match. A local match of twenty(20) percent of the SIED request is required. Local match may be demonstrated as cash or in-kind contribution. Other Funding Sources. No more than $1,000,000 total award from SIED when loan and grant combined.) Interest rates on loans are established when the County formally approves the project contract by using the County Interfund Loan Rate, as authorized by law. Loans are given for a term of 10 years and annual payments are made in equal amounts on June 15t of each year. An interlocal agreement will be established between the County and the applicant specifying repayment dates and a loan amortization schedule. Loan payment installments are based on an ordinary annuity, compounded annually. If an applicant needs additional flexibility on loan repayment schedules they can request a deferral. Interest on loans will continue to accrue from the date the contract is approved by the County, even if the applicant is granted a deferral on their first loan payment. If an applicant requests a deferral of the first loan payment,the applicant must justify the request. A SIED loan is a general obligation of the jurisdiction receiving the loan. With acceptance of a SIED loan,the jurisdiction agrees to the terms of the interlocal agreement regardless of the project which prompted the application for SIED funding. Russell Lane Improvement Project Project Title: Project Summary: Describe the public infrastructure project and the private development that will occur. Explain why the private development requires the public infrastructure project: Private Development: The Yakima First Partners, LLC (YFP) proposal is to develop a 24 seat, 2,600 square foot Popeye's quick service restaurant with a eating patio, drive-thru, and 37 parking spaces. The property currently encompasses one 1.11-acre parcel that was previously used as a used car lot. The development will bring new retail restaurant establishments to the City of Yakima. The property is served by South 1st Street, a principal arterial to the East, and Russell Lane, a local access road, to the South. The project is proposed to be served with public water and sewer. The project has an estimated build out cost of$4,084,000 and the developer anticipates construction to be completed in 2023. Public improvements will be constructed at the beginning of construction. Public Development Currently there is a three legged signalized intersection servicing the Home Depot entrance off South First Street that prevents direct access to the proposed development. Adding a forth leg to the signal, creating a signalized entrance into the restaurant was investigated. However the south edge of the signal is also only 50 feet from the north edge of Russell Lane, which creates a traffic safety concern with the overlapping turn pockets. Therefore the northern portion of Russell Lane will need to be relocated to align the public road with the existing traffic signal. The realignment will require revisions to the traffic signal for an additional leg, and constructing Russell Lane to City of Yakima Standards. The site is well suited for the proposed commercial development, the City of Yakima and YFP have reviewed alternatives and found the proposed Russell Road realignment shown on attachment to be optimal. The road realignment also rectifies the existing concerns. Without road revision to the development area, the required utility improvements will far exceed the costs a developer could reasonable pay. The City of Yakima and YFP has reviewed alternatives and found the proposed Russell Road realignment shown on attachment to be optimal and the most cost-effective solution. The proposed signal and Russell Lane improvements will rectify the existing traffic safety concerns, provide the ability to redevelop an existing vacant commercial lot and allow much needed economic development opportunity in this undeveloped area. The project will also promote future growth and utilization of undeveloped land further west along Russell Lane. Adjacent property owners have had strong interest from a number of businesses interested in constructing facilities in this area, but have been reluctant due to existing access concerns. While there are no additional plans for construction at this time, this infrastructure project is expected to generate additional development within the area. Russell Lane Improvement Project improves approximately 380 lineal feet of Russell Lane. The road improvements will include new asphalt roadway with associated curb, gutter, and sidewalk. The project will also add a signal pole, and striping revisions to the existing traffic signal allowing for Russell Lane to be realigned to this location. A3. Specifically, for what element(s) of the public project are SIED funds requested? SIED funds will be used in conjunction with private funds (SIED Match)for the 380 lineal feet public roadway expansion and signal improvements. Describe how the public facility project will enhance or encourage other development in the immediate area in addition to the direct development described in this application section C. Russell Lane Improvement Project will increase the access to 4.19 acres of undeveloped General Commercial zoned property and 4.51 acres of undeveloped Light Industrial zoned property. The improved access will encourage further economic development in this corridor, and provide potential for much needed commercial infill. Full build-out of the area anticipates an economic benefit of$20 million annually. The project will inject immediate economic stimulus dollars into the City of Yakima's economy through the creation of construction jobs. In the long-term, opening access to additional commercial and light industrial property along Russell Lane will invigorate development. A5. The public benefit from this project will have long term and broad economic impacts for the entire City of Yakima, not just limited to the immediate area. B2. In the context of the local government's overall annual budget, explain the need for SIED assistance. If the applicant has budget reserves, please explain why these funds are not available for the project. The City of Yakima does not have funds available to directly fund a project of this magnitude. The City's existing budget for transportation improvements is very limited and primarily focuses on maintaining existing roads, with no reserves available. The City of Yakima will utilize revenue generated by the development and developer agreement to finance the project. B3. Identify funds (General Fund, Utility Fund, Property taxes, etc.) that are eligible to repay a SIED loan: The City will utilize a combination of reserves, property taxes, construction sales tax, retail sales tax, and developer reimbursement for repayment of the SIED loan funding of the Russell Lane Improvement Project. Will a revenue stream be generated that could repay a SIED loan outside of the system's normal operations and maintenance costs? If yes, please explain: The improvements will generate construction sales tax, and retail sales tax due tot he improvements in the developed area. There are no anticipated additional revenue sources to pay back the SIED loan. B4. If the local jurisdiction is not financially contributing to the project, please explain why. The City is committed to the SIED loan repayment, although they will primarily use revenue generated by the development and developer agreement to finance the project. The only remaining private authorization for the Popeye's quick service restaurant will be the result of the SIED board application. Once approval is provided, the project can proceed. Popeye's has approved the site and terms have been agreed to and signed by both companies on the Letter of Intent. The Land Lease will formalize the agreement and no obstacles are anticipated. C6. Explain how the private sector is financing their capital investment in this project. Yakima First Partners, LLC, will be seeking financing for the construction of the Popeye's development, but the lender will not be chosen for the project until around September 2022. Yakima First Partners, LLC have spoken to several institutions and are just determining the most favorable terms. How were job projections developed? Explain how the projections are realistic. Job predictions are from their experience of opening and operating 2 local Popeye' locations. Will this project move existing jobs from another part of the county? If yes, please describe why the project cannot happen where the jobs are currently located. No jobs are anticipated being relocated from other parts of the County. Mangers from other restaurants will assist in start-up operations and staffing, but are anticipated to return to their current facility, or another employee would be promoted to replace them at that facility. C10. Will the private sector project offer expanded employment opportunities to disadvantaged or unemployed workers? How will the firm work to hire people from Yakima County? The proximity to low income areas offers close job opportunities to disadvantaged and currently unemployed workers. Local employees will be specifically engaged and provided opportunities at locations such as job fairs, local job posting sites, etc. Attachments 1. The agreement serves as the first level of convincing evidence that the private sector development will occur. 6. Business plan or year-end financial statements of the Private Sector Business: Attach supporting information such as a business plan or year-end financial statements (financial statements may be unaudited). The entire SIED application is considered a public record; however, financial and commercial information provided by the private business is exempt from disclosure to the extent permitted by RCW 42.56.270 paragraph (4). 7. Letters of support: If applicable, please include any letters of support for this project from partners or others entities in the community. Application for Funding,2018 Page 14 Yakima County SIED Program 17 SAMPLE CONTINGENCY AGREEMENT 1. PARTIES. The parties to this Agreement are THE APPLICANT and THE PRIVATE BUSINESS. ATTENTION: If a developer is involved in the project, the tenant must also be a party to this agreement or there must be an additional agreement between the developer and the tenant. 2. PURPOSE. The purpose of this Agreement is to clarify the intentions of the parties regarding the completion of THE PUBLIC FACILITIES PROJECT. This section should also contain an explanation of the need for the public improvements. 3. BACKGROUND. The purpose of this section is to provide a description of the public improvements, which can be referenced, thereafter, as"required public improvements." 4. AGREEMENT. This section must contain the following: a) A statement that the applicant agrees to construct the required public improvements providing that SIED financing is approved. b) A statement by the business of the projected number of permanent, full-time jobs created and/or retained as a result of the public facilities project. (Attention: Job estimates identified here must equal those in Question C5.) c) A statement by the business of the estimated private capital investment. d) An agreement by the business to contact the local One-Stop Career Center, Job Service Center, or appropriate Community Based Organization for assistance in filling new positions. e) An agreement by the business to provide the applicant with employment and investment data as requested by SIED. f) If applicable, this section must also contain a list of any public and/or private contributions to the public facilities project, such as cash contribution or donated land. 5. CONTINGENCY. This Agreement is contingent upon receipt of SIED funds by THE APPLICANT and is intended to meet the first level of convincing evidence of private development as required by SIED. All parties must sign the Agreement. PARTIES The parties to this Agreement are City of Yakima, whose address is 129 N. 2nd Street, Yakima, WA 98901 and Yakima First Partners, LLC, whose address is P.O. BOX 53696, Irvine, CA 92619. PURPOSE In order to allow development to occur near the intersection of Russel Lane and S. 1st Street, Russell Lane will need to be relocated to align the public road with the existing traffic signal at S. 1St Street. The realignment will require revisions to the traffic signal, adding an additional leg, and constructing Russell Lane to City of Yakima Standards. The proposed project will result in new commercial development and significant jobs for the City and region. BACKGROUND Required public improvements to be completed for this project include: A. Russel Lane Improvement Project Relocate the northern end of Russell Lane to align the public road with the existing traffic signal at S. 1St Street. The realignment will require revisions to the traffic signal in the form of an additional leg and constructing Russell Lane to City of Yakima Standards. The project will also include the necessary re-striping of S. VI Street. AGREEMENT The PARTIES do hereby agree as follows: A. The City of Yakima agrees to construct the required public improvements provided SIED financing is approved, and Developer loan re-payment agreement(s)are executed. B. Yakima First Partners, LLC projects approximately 22 jobs may be created in the 1st year, and 30 jobs may be created by the 3rd year. C. Yakima First Partners, LLC anticipates the total private investment in the development project to be$2,084,000. D. Yakima First Partners, LLC agrees to contact the local One-Stop Career Center, Job Service Center or other Community based Organizations for assistance in filling new job positions. E. Yakima First Partners, LLC agrees to provide the City of Yakima with employment and investment data as requested by SIED. F. The funding for this project anticipates a$416,000 SIED Grant, a$416,000 SIED Loan, and a 20% matching requirement of $168,000. The $168,000 match will be provided by the developer, Yakima First Partners, LLC, in the form of cash, and right-of-way.
