ROLL CALL The City Council met in session on-this date ,at . 2:00 : P_.M. in the - Council Chambers of City Hall,.Yakima,• Washington. Mayor Henry Beauchamp, presiding, Council, members Pat,Berndt,_-Lynn Buchanan, :Lynn Carmichael, Jerry-Foy -and Jack Sparling present on call. Council member Clarence Barnett absent and excused. City Manager Zais, City Attorney Andrews, City Clerk Roberts and Deputy City Clerk Toney also present. 2: INVOCATION • The Invocation was given by City Manager Zais. • 3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER Council member Carmichael reiterated her concern that Council complete the study of the storm drainage system. • Mayor Beauchamp indicated he attended a seatbelt conference earlier today and asked for a show of hands of those who use seatbelts when they drive. He spoke about some of the efforts being' made to educate the public in seatbelt usage and encouraged everyone to use seatbelts regularly. 4. CONSENT AGENDA • Mayor Beauchamp referred to the items placed on the Consent Agenda, questioning whether there were any additions for= deletions from either Council members or citizens present. Mayor Beauchamp indicated Item No. 12 should be removed to allow for citizen comment and it has been requested that Item No. 19 be moved up on the agenda , and addressed immediately following the public hearing. The City Clerk then -read the Consent Agenda items, including resolutions and ordinances by title. It was MOVED by Carmichael, seconded by Berndt, that the Consent Agenda, as read, be passed. Unanimously carried by roll call vote. Barnett absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items on the Consent Agenda handled under one motion without further discussion.) *5. APPROVAL OF MINUTES OF THE COUNCIL MEETING OF SEPTEMBER 2, 1986 The'Council minutes of'September 2, 1986•were approved, having been duly certified accurate by two Council members and no one present wishing to have said minutes read publicly. 6. AUDIENCE PARTICIPATION • Mark Bontrager, 924 South 26th Avenue,—addressed Council regarding concerns related to the storm drainage system in the city and county. Mr. Bontrager stated everytime it rains his house floods and his neighbor also has the same problem. He urged Council to reconsider the joint City /County storm drainage study and resolve this problem for the citizens of Yakima. 7. HEARING ON RESOLUTION OF INTENTION TO CREATE ENGLEWOOD SCENIC HOMESITES SEWER LOCAL IMPROVEMENT DISTRICT (SEE ORDINANCE CREATING L.I.D. NO. 1043) This being the time set for the hearing on the resolution of intention to create the Englewood Homesites Sewer Local Improvement District, Office Engineer Rita Germunson read the agenda statement and responded to Council's inquiries. Mayor Beauchamp opened the hearing for public testimony at this time. Ron Broom, 624 N. 50th • Ave, stated he owns two adjoining lots on the far end of the proposed sewer line and he does not want a sewer connection on the second lot. He indicated he would work with Mrs. Germunson to 393 SEPTEMBER 23, 1986 resolve the matter. Mr. Broom stated there are'also two lots that are being sold and he has spoken with the individuals who are purchasing those lots and both have indicated they are in agreement with the installation of the sewer line. He indicated he has lived in the area for , forty years' and has' been waiting for the sewer line to be installed for quite awhile. Ash Miller, 5011 Madera Way, stated his neighbor has been having some problems with his septic system and he •(Mr. Miller) is also concerned about his own septic system. He stated they believe the sewer line is a much better alternative, particularly since it runs within several feet , •1 of their property.`.'There being no' other citizens'• present wishing to speak for or against the Local Improvement' District, Mayor Beauchamp closed the hearing. Ordinance No. 2984 having been read II/ by title it was MOVED by Foy, seconded by Carmichael,• that the ordinance be adopted. Unanimously carried by roll call vote. Barnett absent. di ORDINANCE NO. -2984, AN ORDINANCE providing for the improvement of '•certain by constructing a sewer pipe with the'necessary wyel branches and manholes;1• establishing a Local Improvement District, providing for the method of payment thereof, and creating a special fund. -- 19. CONSIDERATION OF LEGISLATION RELATING TO CBD PLANNING PROGRAM: A. A'RESOLUTION AUTHORIZING EXECUTION OF CONTRACTS: r 1. BUCHER; WILLIS AND RATLIFF (PROPOSED CITY CONTRACT 86 -44) 2. KASPIRSIN DESIGN GROUP (PROPOSED CITY CONTRACT 86 -45) ' 3.' TRANSPO GROUP (PROPOSED CITY CONTRACT 86 -46) 4. DEPT. OF URBAN & REGIONAL PLANNING, EASTERN WASHINGTON UNIVERSITY (PROPOSED CITY CONTRACT'86 -47)' Director of Economic & Community Development Glenn Rice addressed' Council briefly regarding this item. He stated this report represents a great deal of work on behalf of many people and requested authorization to continue with the project by authorizing the.rsigning of the'' contracts as presented in today's Council packet. Walter Philipp, 11 North 40th Avenue, related that his son -in- law indicated the City of Everett has begun rebuilding their downtown area just as some of the • citizens of Yakima are attempting to do with the 'downtown `are'a:'r He: ,distributed a commentary from The Herald entitled - "Downtown: Insight,: action -- can give life to Everett" and stated, "if Everett' 'can do it, Yakima can do it too." Lenore Lambert, North Front Street Association, speaking on behalf of the downtown merchants stated several of the downtown businesses have made donations for this project and are eager to have the downtown,- area• revitalized.' Mrs. Lambert presented City Manager Zais with the funds collected thus far to be applied to the cost of the study and added she will be contacting other downtown merchants for additional contributions. She stated the merchants have ' been very cooperative and willing to make contributions toward the redevelopment study for the downtown area. Council member Foy stated the attitude of the downtown merchants is encouraging and complimented them for their participation in the project and encouraged' their continued ' support. REPORT FROM DEPARTMENT OF COMMUNITY DEVELOPMENT ADVISORY - COMMITTEE REGARDING REALLOCATION OF-1986 CDBG FUNDS • -Dixie Kracht, Housing Supervisor, stated the report is a recommendation from the Community Development Advisory Committee and responded to Council's inquiries. Council member Foy asked if the $77,950 could be awarded pending the irrigation and sewer study that will be available October-14th. Mrs. Kracht stated this would be possible as long as the funds would be used for rehabilitation of the irrigation . system. Committee Chairman Peggy Noel - stated the committee's• recommendation -to allocate $10, to Allied Arts for continuation of the art program was with the intent the art program would be administered during the school year. Mrs. • Noel indicated Allied Arts' intent was to utilize the funds for art programs during school vacation periods. Following further discussion, it was MOVED by-Foy, seconded by Sparling,.to accept the Advisory Committee's recommendation with the following two changes: 1) - the allocation $10,000 for Allied. Arts and 2) - setting aside $77,950 pending the irrigation report and application. Unanimously carried by voice vote. Barnett absent. • *9. CONSIDERATION OF REQUEST FROM RANDY BROWN ENTERPRISES FOR WAIVER OF PERMIT FEE FOR FIREWORKS DISPLAY AT IKE /DAVIS HOMECOMING GAMES The staff recommendation -to grant the request from Randy Brown • Enterprises for a waiver of.permit fees.for fireworks displays at -the Eisenhower and Davis homecoming games and to shoot four salutes -to •start the Sunfair parade, was *10 CONSIDERATION OF REQUEST FROM WASHINGTON STATE DEPARTMENT OF • TRANSPORTATION REGARDING RELEASE OF UNUSED UMTA TRANSIT ALLOCATION FUNDING • . • The staff recommendation to approve the Washington State Department of Transportation request•that the City release unused UMTA Transit allocation funding for use by Pacific Transit, was accepted. *11. STATUS REPORT FROM TRAFFIC ENGINEERING DIVISION REGARDING PARKING ENFORCEMENT AT 40TH AVE. AND ARLINGTON • The status report from Traffic Engineering Division and the Police Department regarding the parking enforcement at 40th Avenue and Arlington, was accepted. - 12. - PRESENTATION OF '1986 COMMUNITY DEVELOPMENT BLOCK , GRANT HOUSING ASSISTANCE PLAN - - Dixie Kracht, Housing Supervisor, indicated this item was removed from the Consent Agenda to allow for citizen comments regarding the Housing Assistance Plan (HAP). She - stated the HAP is a three year plan with each individual .annual - -community goal.- This is the second-year of the plan and consists of • a one- page community goal. Mrs. Kracht--stated last year.'s goal • was exceeded. by 16units, bringing, the total of• rehabilitated or newly constructed units to 160 units. Council , ,member Carmichael asked if staff plans to review structures rehabilitated three to five years ago to observe their current condition. She indicated the City has spent a • tremendous amount of money rehabilitating houses in the community and- it-would be•interesting to know if the money has been well spent. Mrs. Kracht indicated she could have such a report back • to Council by mid- November. 395 SEPTEMBER23, 1986 On'a different matter, Council member Foy mentioned the audit report from the U.S. ' Department of Housing andiUrban Development regarding the'maintenance and'upkeep of the various public housing projects which are administered by the Yakima Housing Authority. He since the City of Yakima dispenses funds to that .''agericy City'Council makes appointments to: the YakimaiHousing Authority Board, he would like be advised of how the Housing .Authority intends to resolve the • situation and prevent it from reoccurring. He stated he would like the City Managerlto submit a letter to the Yakima Housing Authority asking that a report be sent to the City 'of Yakima with an explanation of how they intend to resolve the - issues listed in the letter from HUD dated'September 9, 1986. • Council member - Sparling interjected that in regard td` the request made by Council member Carmichael for a review of the rehabilitation program, it would be helpful to know the amount of funds expended for the individual projects. Mayor Beauchamp asked if there were citizens present desiring to speak to the Housing Assistance Plan, and there being none, it was MOVED by Foy, seconded by Berndt, to accept the., Citizens Advisory report, and show that no negative comments during the fact and findings period of the public meeting were voiced. Unanimously carried by voice vote. Barnett absent. *13: CONSIDERATION 'OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT FOR PUBLIC DEFENDER SERVICES FOR 1987 • RESOLUTION NO. D -5298, A RESOLUTION appointing Glen P. Warren as City of Yakima public defender for the calendar year 1987. *14. CONSIDERATIONOF RESOLUTION-GRANTING A CLASS 3°USE REQUESTED BY KEN OLSON FOR AT 3707 W. NOB BLVD. • ' RESOLUTION 'NO'. D -5299, - 'A RESOLUTION adopting and amending the decision of the Hearing' Examiner to grant Ken Olson a Class 3 use *15. CONSIDERATION OF AN ORDINANCE' FIXING LEVYING THE 'AMOUNT OF AD VALOREM TAXES FOR 1987 • ORDINANCE 2985, AN ORDINANCE fixing and levying the amount of 'ad valorem taxes necessary to balance estimated revenue with estimated expenditures for the 1986 Budget for the City of.Yakima. *16. CONSIDERATION OF AN ORDINANCE REZONING PROPERTY LOCATED AT 624 NO. 3RD AVENUE, AS REQUESTED BY ELMER VANDERWOOD '• ORDINANCE NO. 2986, AN ORDINANCE affirming the Hearing Examiner's recommendation to rezone property at 624 North 3rd Avenue, and amending the zoning map of the' City of Yakima. *17. CONSIDERATION OF AN ORDINANCE PROHIBITING PARKING ON NORTH FIRST STREET, LINCOLN TO "I "' ORDINANCE• NO. 2987, AN ORDINANCE _relating to traffic control; prohibiting parking on certain streets; and amending Section 9.50.050 of the City of Yakima Municipal Code. *18. CONSIDERATION OF AN ORDINANCE AMENDING THE 1986 BUDGET AND APPROPRIATING FUNDS. FOR FIRE APPARATUS EQUIPMENT (FIRST READING) An ordinance appropriating funds for fire apparatus equipment having been read by title only at this meeting was laid on the table until October 14, 1986. 20. OTHER BUSINESS Council member Foy recommended Council give consideration to a Council position, referring to the Wenatchee Forest Plan, which needs to be in by October 30th. There are several alternatives and he stated he is concerned about one of the alternatives, relating 396 SEPTEMBER 23, 1986 to jobs. He stated an independent consultant,: Bryon Long, conducted a study which indicates there is a- discrepancy in the number of-job losses, which could have a drastic effect on Yakima. City Manager Zais reminded Council of the study-session /workshop planned for the October 7th meeting from 12:00 noon through the dinner hour if necessary. He reviewed some of the topics to be discussed during the workshop and-added that the preliminary 1987 budget forecast will also be presented at that time. - City Manager Zais complimented staff for their preparation and presentation of the Central Business District Plan and Program. He stated Fred Andrews, Fred Stouder, Glenn Rice and John Vanek have spend a lot of extra time and effort working with the consultants and the committee of businessmen to bring this issue before Council.. Mr. Zais stated he will 'be at ICMA next week and Assistant City Manager Stouder will be administering to city business in his absence. • - - , -- ,Information Items Items of information supplied to Council were: Letter from Office of Washington State.
