Council member Carmichael referred to the - Residential Building
Activity and Housing Conditions '1980= 1987 report. submitted by
Community & Economic'. Development - Director Rice:. and Manager
Kracht, stating she-appreciates " receiving this report:, and thanked
staff for a job well done. • r.
Mayor. -read la proclamation designating. February 15 -21, 1988,
, as - , "National Patriotism Week in the: City of Yakima. The
proclamation.- Was accepted by 'Del- Trimble,- representative of the
Grand Exalted Ruler - of the Protected .Order-:,of' Elks. :Mr. Trimble
encouraged citizens : to - I celebrate - r the ,' privilege Y of (American
citizenship by flyiJng American - flags'during this particular week.
4. CONSENT AGENDA- - ,; r r
Mayor .Berndt 'referred -to the , items placed "' on the- Consent- Agenda,
questioning whether there were any additions rror deletions from
either - Council = members - or , citizens present.' There being no
changes;. the.; City Clerk ,. then' read 'the ;Consent ;Agenda items,
including resolutions - and - .ordinances. -by • title. It - -was- - MOVED by
Carmichael, seconded by - Buchanan, that the .Consent- Agenda, as
read;' be passed.. - Unanimously carried by roll call vote.

*5. APPROVAL OF THE MINUTES OF THE COUNCIL MEETINGS OF JANUARY 12 & 26,
1988
The Council minutes & 1 26, -1988 :were approved, (having

present' wishing to :have: said minutes read , publicly.
6. AUDIENCE PARTICIPATION" • = ;=' . • -
A. APPEARANCE BY ROBERT :MAY'. REGARDING AIRPORT /AIRCRAFT NOISE
Robert' May, ' 1411:. South•, 5th Avenue, Yakima, - stated he ,appeared
before' Council previously regarding aircraft - traffic-- over the
residential area in which he resides, primarily helicopters flying
from the Yakima. Firing Center to , the Yakima 9 Airport and military
aircraft using the primary runway for training flights. Mr. May
stated he received a letter from the Yakima Airport Advisory Board
•regarding the petition submitted by him; stating there has been
some misunderstanding rof his intentions,' and submitted a memorandum
to clarify the issues The: .memorandum states : "the complaints )of the
people that signed- - the petition- - -were for the » - following type
'flights: - 1) Military - helicopters - flying -directly over the city
enroute to the airport from the - Yakima Firing , .Center. We are
requesting that - .a , different 'approach be assigned..' ( 2) \ Military
training flights , • i.e. touch- and =go - ;(landings - and , missed- approach

flights. We would like to .see these flights discontinued. All
military flights that use runway 9/27 and come to a full stop are
not a problem." Mr. May requested this memorandum be submitted to
the Yakima Air Terminal Board for further consideration. He
stressed that the citizens are not opposed or insensitive to the
"Fire Watch ", "Fire Bucket" and "MAST" programs as has been
indicated. He reiterated the flights he is concerned with are the
flights mentioned in his memorandum. He stated other citizens have
.expressed concerns with the flights of the C141 doing the touch-
.
and-go and the missed approaches, however, he is not
bothered by those exercises. Council member .Carmichael stated
Council' had referred his petition - to the Airport Board for
consideration • however, he (Mr. May) had not appeared to address
the issue before the Board -. Mr. May indicated' he had a prior
commitment that could not be rescheduled and was unable to attend
that meeting. Council member Carmichael asked if Mr.l'May is asking
Council to resubmit this to the Airport Board at this time, and he
indicated that is his desire.' Council member'Carmichael stated she
has no objection to referring this to the Airport Board again if
Mr. May does not feel they have addressed the issues of concern. to
him. Mayor Berndt stated she had no objection, however, after
reading the material provided to Council by the Airport Board, she
felt Mr. May's concerns had already been. addressed by the Board.
Council member - Buchanan stated he believes Mr. May should present
this to the Airport Board, .and-they in turn will submit it to the
Council. Mr. May stated he had spoken with Council member Barnett
and was advised to submit a memorandum to the City Council. Mr.
May indicated he is not familiar with the City's procedures on
- handling such. matters so he contacted Council.member Barnett and
was •advised_to submit a memorandum to the City Council. Council
• member Barnett commented he suggested the memorandum be submitted
• to the Yakima Air Terminal Board, the County Commissioners and the
• City - Council. Mr.. May - indicated he will see that the County
Commissioners and the Airport Board receives a copy of the memo.
Council member Buchanan pointed out that Mr'. May is a former
aircrew member and is requesting that airplanes make a-full stop
rather than the "tough- and -go" or "missed approaches, "• and yet a
-full stop landing will generate far more noise because it takes a
lot more energy from the engines to get the aircraft going from a
full-stop than it does to keep the airplane going, or increase the
speed to .,flying speed again. He stated'one of the things the
airport needs to do,•'if the citizens of Yakima want keep an
airport tower at the Yakima City Airport, is to make sure there is
a maximum number of flights using the instrument approach system
and making instrument approaches to Yakima. Mr. Buchanan stated if
the number of instrument approaches and.landings drop'at the Yakima
Airport, the City will end up without an airport control tower. He
stated if that happens Yakima will lose a fair' number of the
scheduled flights in and out of Yakima. Mr. Buchanan stated
instrument approaches and landings are a major factor in the number
• of landings and take offs that make up the requirement for
. Yakima to havera control tower. Council member Carmichael stated
there is no other action for the Council to take'at this time other
than awaiting additional information from the Airport Board. Mayor
Berndt encouraged Mr. May to arrange his • schedule so he is
a available to discuss his concerns with the Yakima Air Terminal
Board and thanked him for this information.
7. REPORT 'FROM DEPARTMENT OF COMMUNITY' ECONOMIC DEVELOPMENT AND
LEGISLATION RELATING TO CABLE TV FRANCHISES AND YCTV LEASE:
A. CONSIDERATION OF AN ORDINANCE REPEALING ORDINANCE NO. 2443
WHICH GRANTED A CABLE TV FRANCHISE TO MC'CAW CABLEVISION
Director of Community & Economic Development Rice briefly reviewed • •
the agenda statement - and introduced Dave ' Eyles, Cable
Communication Coordinator, Craig Ackerson and Gary Bailey of Cooke
Cable. •Mr. .; Rice stated Cooke Cablevision is seeking the
elimination of one of the two cable television franchises the
City of Yakima. The franchise that Cooke Cablevision would like to
have eliminated was originally created for McCaw Cablevision in
1980 in order to operate in the newly annexed Valley area.

- Since Cooke Cablevision.now operates •ini areas cf' Yakima the
second franchise_,,is unnecessary. Mr. Rice recommended- - - Council
accept the report and subsidization for the• YCTV Facility. Council
member Sims questioned how they arrived at the 30% figure for
subsidization for the balance of the franchise term: Craig
'Ackerson, 3208 West Yakima Avenue, stated they are basically
subsidising -the YCTV's operation -over and -above the 15%-cifigure of .
- the -gross revenues currentlIv paid to the-City, in -that they have
moved from the :Skill- Center to. 24th - .Avenue. - He - stated :way they
were,-able, to arrive , -at the :300 -is that initially when Cox held the

City franchises, rMcCaw and Cox- were both required-to state
of the art studio and facilities. He stated the access committee
came before the City Council and indicated it would be;.their desire
to enter into municipal access within the City limit. He stated
. basically what they. •are.. doing with the: 30% A.sqrsubsidization the
program over above that - equipment. which were to have
provided to the City. There being no •fur.ther discussion, and
..Ordinance No. 308E having been read byc'title, ' it was by
..Carmichael,' seconded :by Buchanan, that the.. ordinance - °be_ passed.
Unanimously carried by roll call vote, Beauchamprand..=Foy absent.
ORDINANCE NO. 3081, AN ORDINANCE repealing an existing ordinance
regulating the provision , of cable television in•:the -•City of
Yakima.
CONSIDERATION OF A ..RESOLUTION' AUTHORIZING :EXECUTION OF A

Resolution D-5436 having been read by title, it was. MOVED by
Carmichael, seconded by Buchanan, to adopt .the :resolution.

*9. CONSIDERATION OF RESOLUTION AUTHORIZING•EXECUTION OF ADDENDUM TO
THE.LEASE'AGREEMENT FOR POINT COMMUNICATION:SITE• '
RESOLUTION NO. D -5437, A'RESOLUTION authorizing the City Manager to
execute an addendum to the Lease Agreement for Communication Site.

The report from the Director of Finance and Budget dated
February 9, 1988, regarding the investments of the City of Yakima,
was accepted and approved.
B. FOURTH QUARTER 1987 INSURANCE CLAIMS REPORT
The Fourth Quarter 1987 Insurance Claims report from the Director
of Finance and Budget was accepted.
C. FOURTH QUARTER 1987 ACCOUNTS RECEIVABLE REPORT
The Fourth Quarter 1987 Accounts Receivable report from the
Director of Finance and Budget was accepted.
• *11. CONSIDERATION OF AN ORDINANCE AMENDING THE 1988 BUDGET AND
APPROPRIATING FUNDS FOR 1987 YEAR -END ENCUMBRANCES (FIRST
READING)

An Ordinance appropriating funds for the 1987 year -end
encumbrances having been read by title only at this meeting, was
• laid -.the table for one'week or until February 16, 1988.
12. OTHER BUSINESS
•
Council member Carmichael referred to a memo in the Council packets
' from Racial Fields, regarding.a request that members be appointed
to the Community Program Advisory Committee. Mrs. Carmichael
stated the Council Committee will be reviewing applications and
making recommendations for appointment in the near future.

13. EXECUTIVE SESSION REGARDING PROSPECTIVE'LITIGATION
It was MOVED by Buchanan, seconded by Sims, to move into Executive
Session for the purpose of discussing prospective litigation for
approximately 15 minutes and immediately adjourn the meeting.
Unanimously carried by voice vote. Beauchamp and Foy absent.
14. ADJOURNMENT
Following the completion of the Executive Session, the meeting was
adjourned at the hour of 3:00 p.m.
