Roll Call Present: Mayor Janice Deccio, presiding,Assistant Mayor Soneya Lund and Councilmembers Matt Brown, Patricia Byers, Holly Cousens, Danny Herrera and Eliana Macias (attending remotely via Zoom) Staff: City Manager Robert Harrison, City Attorney Sara Watkins and City Clerk Sonya Claar Tee 2. Pledge of Allegiance Mayor Dec ' led the Pleipliance. 3. Interprete ervices Mayor Dec introduced Jorge Villasen nounced interprete ervices are available in Spanish. 4. Open Discussion for the Good of the Order MOTION: Lund moved and Cousens seconded to add a Cinco de Mayo proclamation to the agenda. The motion carried by unanimous vote. A. Proclamations National Day of Prayer proclamation Councilmember Byers proclaimed May 5, 2022 as "National Day of Prayer" and Linda lasella accepted the proclamation. ii. Missing and Unidentified Persons Awareness Month proclamation Assistant Mayor Lund proclaimed May 2022 as "Missing and Unidentified Persons Awareness Month" and Michelle Joe accepted the proclamation. iii. Mental Health Month proclamation Mayor Deccio proclaimed May 2022 as "Mental Health Month"and Benine McDonnell accepted the proclamation. iv. Cinco de Mayo proclamation Councilmember Herrera proclaimed May 2-7, 2022 as Cinco de Mayo Cultural Awareness Page 1 of 5 3 week and Luz Bazan Gutierrez accepted it. B. Presentations/ Recognitions/ Introductions Introduction of Assistant City Manager Rosylen Oglesby City Manager Harrison introduced newly appointed Assistant City Manager Rosylen Oglesby. 5. Council Reports A. Discussion about having the City apply for County ARPAfunds for internet in city parks I.T. Services Manager John Carney briefed Council on a prior report regarding internet in the parks. MOTION: Cousens moved and Lund seconded to apply for County ARPA funds for internet in City parks. The motion carried by unanimous vote. B. Discussion on amending the Council Rules of Procedure relating to limiting public comment to Yakima County residents only Councilmember Brown shared his concern about protecting City and County residents time to speak under public comment.After discussion, MOTION: Byers moved and Lund seconded to establish a procedure for public participati' . e fi to re nts o residents of Yakima C• ty an, he =nyon: •Ise d th district. Consent A •nda Mayor Deccio referred to the items placed on the Consent Agenda, questioning whether there were any additions or deletions from Council members present. There were no changes. The City Clerk read the Consent Agenda items, including resolutions and ordinances, by title. (Items on the Consent Agenda are handled under one motion without further discussion—see motion directly below.) MOTION: Lund moved and Byers seconded to approve the consent agenda. The motion carried by unanimous vote. A. Approval of minutes from the April 19, 2022 City Council regular meeting and April 26, 2022 study session B. 2022 1st Quarter Financial Report C. Set date of June 7, 2022 for an open record public hearing to consider the Hearing Examiner's recommendation regarding a right-of-way petition to vacate a portion of right of way in the southwest corner of"Tract B"where S 18th St becomes Pacific Ave. D. Project Completion and Contract Acceptance with Halme Construction Inc for Bravo Company Municipal Solid Waste &Wood Debris Removal Project 2529 Page 2 of 5 4 E. Resolution accepting and approving 1st Quarter 2022 Claim Report RESOLUTION NO. R-2022-052,A RESOLUTION accepting and approving the 1st Quarter 2022 Claim Report for the City of Yakima. F. Resolution authorizing a Contract with Merrell Bros., Inc.for Project 2561 Biosolids Removal and Reuse RESOLUTION NO. R-2022-053,A RESOLUTION authorizing a contract with Merrell Bros., Inc. for Project 2561 Biosolids Removal and Reuse 7. Public Comment Tony Courcy, City resident, asked about his previous question. PUBLIC HEARINGS 8. First public input meeting on the 2021 Consolidated Annual Performance Evaluation Report (CAPER) ONDS Manager Archie Matthews briefed Council on the 2021 Consolidated Annual Performance Evaluation Report (CAPER) and noted this will be brought back for another public hearing and approval. Mayor Deccio opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. Dulce Gutierrez, City resident, shared her concerns about the ethnic disparity and asked that this process be referred to the Community Integration Committee for review. MOTION: Macias moved and Lund seconded to have the process reviewed by the Community Integration Committee. The motion carried by unanimous vote. 9. Public hearing and Ordinances to consider the Yakima Planning Commission's recommendation regarding 2022 proposed text amendments to Title 15 and Title 14 Planning Manager Joseph Calhoun briefed Council on the proposed text amendments. Mayor Deccio opened the public hearing and, with no one coming forward or calling in to speak, closed the hearing. The City Clerk read both ordinances by title only. MOTION: Byers moved and Lund seconded to pass both ordinances. The motion carried by unanimous vote. ORDINANCE NO. 2022-010,AN ORDINANCE amending Yakima Municipal Code Title 14— Subdivisions to incorporate text amendments recommended by the City of Yakima Planning Commission Page 3 of 5 5 ORDINANCE NO. 2022-011,AN ORDINANCE amending Yakima Municipal Code Title 15— Yakima Urban Area Zoning Ordinance to incorporate text amendments recommended by the City of Yakima Planning Commission DEPARTMENT ITEMS 10. 2022 Vacant Building Safety Project- 1st Quarter Report Glenn Denman, Code Administration Manager, reported on implementation efforts of the Vacant Building Safety Project and next steps. Council members expressed their appreciation to Codes for their hard work. 11. Review of Request for Proposals for development of the property on the East side of South 3rd Street between East Walnut and East Spruce (across from the Law and Justice Building) City Attorney Sara Watkins reviewed a Request for Proposals for development of the property on the East side of South 3rd Street between East Walnut and East Spruce (across from the Law and Justice Building). MOTION: Cousens moved and Brown seconded to approve the RFP and direct staff to move forward with the RFP process for the property. The motion carried by unanimous vote. 12. After Council discussion,Assistant Mayor Lund stated she objected to the motion. 13. Other Business MOTION: Byers moved and Brown seconded to add to the agenda for the May 10 study session a reevaluation of Ordinance 2020-019 related to the flag policy. The motion carried by unanimous vote. 14. Adjournment MOTION: Lund moved and Cousens seconded to adjourn to a City Council study session on May 10, 2022, at 5:30 p.m. in the Council Chambers at City Hall. The motion carried by unanimous vote. Asian America ative awaiian, NcAfic Island r Writage Mont roclamation Assistant Mayor Lund proclaimed the month of May 2022 as "Asian American, Native Hawaiian, and Pacific Islander Heritage Month," and Dori Peralta Baker accepted the proclamation. 4. Yakima County EMS Levy Renewal Chief Markham reported on the Emergency Medical Services (EMS) Levy that expires on December 31, 2023 and the benefit of the levy to the City. He noted the Yakima County EMS Administration Board has asked the Board of County Commissioners to place this measure on the ballot for renewal at the next general election this November. 5. Utility Account Management James Dean, Utility Customer Services Manager, reviewed the current municipal code relating to how utility accounts are billed, collected and managed and issues of landlord vs. tenant held accounts. 6. Discussion regarding flag policy Councilmember Byers stated with a recent Supreme Court ruling against the City of Boston for violating the First Amendment regarding its flag policy, she believes the City's flag policy should be rescinded. MOTION: Byers moved and Brown seconded to rescind Ordinance No. 2020-019. Page 1 of 2 8 The motion carried by unanimous vote. 7. Adjournment MOTION: Lund moved and Cousens seconded to adjourn to the next City Council regular meeting on May 17, 2022, at 5:30 p.m. in the Council Chambers. The motion carried by unanimous vote.
