BUSINESS MEETING
1. ROLL CALL
•
•
The City Council met in session on this date at 2:00 P.M: in Council
Chambers of City Hall, Yakima, Washington. Mayor Henry Beauchamp,
presiding, Council members Clarence Barnett, Pat Berndt, Lynn Buchanan,
Lynn Carmichael, and Bernard Sims present on roll`call. Council. member
Jerry Foy absent and excused. City Manager Zais, City Attorney'Vanek, City
Clerk Roberts and Deputy City Clerk Toney also present.
2. INVOCATION -
The Invocation was, given by Mayor Beauchamp.
3. OPEN DISCUSSION FOR THE GOOD OF THE ORDER
A proclamation was read and presented to Juanda Krebs, President of
the Better Business Bureau. The week of October 12 -16, 1987 was designated
"Better Business Bureau Week."
Last week Mayor Beauchamp that the employees responsible for the
production of the City's Annual Budget be recognized today for their
efforts. Director of Finance and Budget John Hanson introduced those •
individuals, explaining their role in the preparation of the budget each
• year.. Mr. Hanson stated Marsha Graf, Jean Groth, Clara Sanders, Chuck
Greenough' and Bob Wheeler have earned the designation of Professional
Finance Officer. Mr.• Hanson`explained to earn this designation, they must
accumulate 50 points in the educational field of financial matters, and 50
points for actual experience. Once they have attained. the title, to
maintain it they must earn 25 points each year in continued education,
training, teaching or serving as a board member, along with the annual
certification for the annual report and budget. Council'member Carmichael
noted John Hanson was recently re- elected to a two year term on the Board
of Directors for the Washington Officers Association. Mr. Hanson stated he
is the Legislative Chairman for the Finance Officers Board next year and
asked that Council notify him if there are any items they wish to see WFOA
support next year. Accounting Manager Bob Wheeler also acknowledged
Theresa Farren of Word Processing for typing the budget and, Heidi Frenzel
of the Copy Center for printing the budget. City Manager Zais praised
for his leadership in the development of the budget format currently used
by the City.
Mayor Beauchamp read a proclamation designating the week of October 12 -16,
1987 as "Alpha Delta Kappa Week" in the City of Yakima. The proclamation
was accepted by Adelaide Harris on behalf of the Alpha Delta Kappa
organization. Mrs. Harris stated this week is set aside each year to honor
teachers and to make the public aware that this is an international, state
and local honorary sorority.
4. CONSENT AGENDA
Mayor Beauchamp referred to the items placed on the Consent Agenda,
questioning whether there were any additions or deletions from either
Council members -or citizens present. It was the general consensus to
remove Item No. 11, as requested by Council member Barnett. The City Clerk
then read the Consent Agenda items, including resolutions and ordinances by
- title. - It was MOVED by Buchanan, seconded by Sims,• that the Consent
Agenda, as read, be passed. Unanimously carried by roll call vote. Foy
absent. (Subsequent paragraphs preceded by an asterisk ( *) indicate items
-on the Consent Agenda handled under one motion without further
discussion.)
*5. APPROVAL OF MINUTES OF THE COUNCIL OF SEPTEMBER 22, 1987
The Council minutes of September 22, 1987 were approved, having been duly
certified accurate by two Council members and. no one present wishing to
have said minutes read publicly.

6. AUDIENCE PARTICIPATION
Lloyd Mullanix, 623 North 6th Avenue, addressed: Council about the need to
clean up the,_ City, stating he believes an ordinance should.be passed
requiring ,citizens to. keep their. property free of litter and debris. Mr.
_ Mullanix stated many of the houses in his neighborhood are owned by
absentee landlords who are ,interested only in the.income derived from
. those properties, and, do nothing to improve the dwellings, Following
. further discussion, Mayor Beauchamp assured Mr. Mullanix that staff will •
investigate the complaint and attempt to find . a solution. . .
Vern Shaw, 202 South 4th Street, Walnut Manor, addressed Council regarding
the drug problem at the,Eastwood'Apartments on Spruce Street. He stated
he has observed as as 53 people in one hour purchasing drugs at that
location. Mr. Shaw stated he is going to contact Nancy Reagan and 60
Minutes in an attempt to get something done about the : drug, problem in his
neighborhood. He stated he has contacted the Police Department on a number

of occasions, and not feel any action is being taken'to stop 1 the sale
of drugs. Council member Carmichael stated Council is 'aware of the
situation in his area and encouraged Mr. Shaw and his neighbors to
continue working with the Police. Department' and City Council to resolve
this problem..
Dan Snyder, 116. North 6th Street,, stated he owns,proper across the street
from. where the drugs are being sold. He stated he has had a gun drawn on
• him, he has been assaulted, and threats have been made against his life on
a number of occasions. Mr. Snyder stated the situation is so .bad that he
has applied fora concealed weapons permit. He appealed to Council for any
assistance they might be able to give in finding a solution to this
problem. Council member Berndt stated some legislative changes must take
place before a solution to the drug problem can be found.
• . Mayor Beauchamp stated he recently had conversation with a judge who
commented once a person has been arrested for selling ,drugs, it is •
difficult to keep them incarcerated due to .the structure of the legal
system and :the individual's constitutional rights. He reiterated Council
members are very concerned about. finding..a. solution to the drug problems
that exist in our City. ,
Mrs. Elberth Trotter, 209 South 4th Street, echoed the concerns of Mr.
Shaw, Mr. Snyder and Mr. Mullanix. She stated now that, school is in .
session, she is especially concerned for the children who are confronted
daily by the drug dealers and pushers. Mrs. Trotter also ,spoke of the
excessive amount of ,garbage accumulating in. the alleyways.. in the
southeast part of Yakima. She stated the large black' receptacles are
overflowing with garbage and this is attracting, mice and rats into the
neighborhoods, thus creating a health problem. Mrs. Trotter stated she
felt this could be remedied if the refuse containers were emptied
more. She asked which department, or employee, she should contact to have
this done.. Mrs. Trotter was informed that additional refuse service must
. be requested by the property owner, or the person responsible for the
billing. She was advised to contact the Health District and the City Code
Inspection Department with these concerns if there is an obvious health

hazard. Mrs. Trotter also asked if there is an ordinance against growing

a vegetable garden on City right -of -way. She stated there' is such a garden
on 7th Street. City Attorney Vanek indicated the parking strip, or the
property between the sidewalk and the curb, is City right- of- way, may
be used by the homeowner until such time the: City should .need that
property for a specific use. He indicated' as long as that use is not
causing a public nuisance or'a health hazard, the City will not intervene.
However, should such usage become a public nuisance or health hazard, the
Code Enforcement Department should be notified. Mrs. Trotter
stated she has contacted city staff with a number of concerns in the past,
however, been informed.they (city staff) cannot help her; she will have
to take her concerns to the City Council. Following further comments, City
, ,Manager Zais advised Mrs. Trotter to bring her concerns .to,.,him_for,review
and he will direct her to the appropriate staff.for resolution: _,
Dennis Hawkins, 407 W. 3rd Street, Wapato, and David J. Hawkins, Post
Office Box 1384, Yakima, 98907,_ spoke about the., the
"Chippendales" scheduled for October 27th at the,YakimaCeriter:, Both men
opposed this•type of entertainment due to their`Christian'beliefs. They

appealed to Council to take steps in the future to' p rohibit this PPe p prohibit type of
entertainment within the City of Yakima. Mayor Beauchamp commented, if
possible, he would like to see Council take a position on this matter, and
indicated he would speak with the City Attorney about this. City Attorney
Vanek referred to the Municipal Code, explaining `fu ther 'that .a person
must be in violation of the Municipal Code before any action be taken
to prohibit these type of performances. He stated he ,would discuss the
issue in more detail with Mayor Beauchamp following the meeting.
7. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF A CONTRACT WITH LITTLE
LEAGUE ASSOCIATION FOR CONCESSION SERVICES
Finance and Budget Director Hanson and Public Works Director Copeland
responded to Council's inquiries regarding this agreement. A brief
discussion ensued regarding the effective date of the agreement, followed
by the reading of the title of Resolution No. ..D -5396. It was MOVED by
Berndt, seconded by Carmichael, that . the resolution' be adopted.
Unanimously carried by voice vote. Foy absent.
RESOLUTION NO. D -5396, A RESOLUTION authorizing and directing' the City
Manager and City Clerk of the City of Yakima to execute a concession
agreement with Yakima National Little League Association.

IN VICINITY OF NORTH 47TH AVENUE AND MODESTO
RESOLUTION NO. D -5397, A RESOLUTION authorizing the amendment,of Short Plat
80 -9 upon the petition of Chrysta Belle Swanson.

Department Reorganization Effects Bargaining Agreement.
*10. CONSIDERATION OF RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT WITH PEOPLES
BANK FOR PARTICIPATION IN THE RENTAL REHABILITATION PROGRAM
RESOLUTION NO. D -5399, A RESOLUTION authorizing the Director of Community &
Economic Development to enter into an agreement with Peoples National Bank
of Washington for the implementation of a multi - family loan program.

Council member Barnett stated he requested this item be removed from the
Consent Agenda as he believes the staff recommendation.,is beyond the scope
of its purpose. It was MOVED by Barnett, seconded by Berndt, to set the
date of the public meeting for October 27th, 1987. Unanimously carried by
voice vote. Foy absent.

*14. CONSIDERATION OF AN ORDINANCE AMENDING THE YAKIMA MUNICIPAL CODE RELATING
TO THE STANDARDS OF CONSTRUCTION WITHIN FLOODWAYS
ORDINANCE NO. 3058, AN ORDINANCE relating to building regulations;
providing standards for construction within floodways and amending Section
11.58.160 of the City of Yakima Municipal Code.

Mayor Beauchamp asked if any of the Council members are•aware of a sister
city group coming to Yakima next month. He stated he received a phone call
from Representative Margaret Rayburn's office informing him that a group
of Japanese visitors are caning to our area. Council members Carmichael
. and • Barnett ,commented normally a wire is received notifying the City of
Yakima 'of such a visit, then a followup letter is sent. Mayor Beauchamp
,stated the:visit,is..planned for some time in November and, he.will obtain
additional information.fran Representative Rayburn's,office.
